Abstract

PT Lafarge Cement Indonesia merupakan salah satu perusahaan produsen semen yang berasal dari Perancis yang mulai beroperasi pada 1983 yang mengalokasikan dan melaksanakan program CSR. Prinsip 5 Deklarasi Rio 1992 dan Undang-Undang No. 40 Tahun 2007 Tentang Perseroan Terbatas serta Undang-Undang Nomor 11 Tahun 2006 Tentang Pemerintahan Aceh yang mewajibkan perusahaaan untuk menjalankan Corporate Social Responsibility (CSR). Untuk memenuhi ketentuan tersebut, PT Lafarge Cement Indonesia telah dan sedang melaksanakan CSR di Kecamatan Leupung dan Lhoknga, Kabupaten Aceh Besar. Akan tetapi pelaksanaannya belum sesuai peraturan perundang-undangan dan keinginan masyarakat yang berdomisili di sekitar perusahaan tersebut. Namun demikian, pelaksanaan CSR telah berdampak signifikan terhadap pertumbuhan ekonomi bagi masyarakat sekitar. Negara-negara peserta Deklarasi Rio 1992 termasuk Indonesia, dan Pemerintah Aceh seharusnya segera mengatur secara khusus mengenai sanksi dan mengawasi secara berkala serta berkelanjutan terhadap pelaksanaan CSR Lafarge Cement Indonesia yang beroperasi di wilayah Aceh

Abstract

Indonesia adalah negara yang setiap tahunnya mengalami kebakaran hutan yang disebabkan oleh perubahan iklim maupun aktivitas korporasi dan menimbulkan dampak yang turut dirasakan oleh Negara Malaysia dan Singapura. Maka dari itu, dibutuhkan tindakan pencegahan dan pemantauan agar kebakaran  tersebut tidak terjadi secara meluas dan menimbulkan dampak yang lebih besar. Demi mengatasi hal tersebut, Perhimpunan Bangsa Bangsa Asia Tenggara atau Association of Southeast Asean Nations (ASEAN) telah menandatangani sebuah perjanjian regional yaitu ASEAN Agreement on Transboundary Haze Pollution pada bulan Juni tahun 2002 dan diratifikasi oleh Indonesia pada tahun 2014. Penulisan artikel ini bertujuan untuk mengetahui bagaimana tanggung jawab negara dan korporasi dalam mengatasi polusi asap lintas batas berdasarkan ASEAN Agreement on Transboundary Haze Pollution. Disamping itu, untuk mengetahui bagaimana penerapan sanksi terkait pelanggaran prinsip hukum lingkungan internasional berdasarkan Draft Articles on Responsibility of  States for Internationally Wrongful Acts, Rio Declaration, Deklarasi Stockholm dan juga peraturan nasional Indonesia. Untuk memperoleh data dalam penulisan artikel ini dilakukan penelitian kepustakaan yaitu dengan cara mempelajari sejumlah peraturan perundang-undangan, buku teks, tulisan ilmiah, surat kabar, dan literatur-literatur yang ada relevansinya dengan masalah yang dibahas dalam penulisan ini. Berdasarkan hasil penelitian dari penulisan artikel ini menunjukkan bahwa secara umum, penerapan ASEAN Agreement on Transboundary Haze Pollution (AATHP) belum dimanfaatkan secara maksimal untuk mengatasi pencemaran lintas batas di regional ASEAN. Hasil penelitian menunjukkan bahwa Indonesia belum membentuk sebuah badan untuk memitigasi terkait pencemaran udara yang diakibatkan oleh kebakaran hutan untuk selanjutnya berkoordinasi dengan badan serupa yang berada dibawah naungan sekretariat ASEAN. Disarankan jika Indonesia bersungguh-sungguh untuk menyelesaikan masalah pencemaran yang terjadi tiap tahunnya, agar secara sigap dan lugas menjalankan kewajiban yang tercantum didalam AATHP, terutama terkait pembentukan badan mitigasi sebagai bentuk keseriusan dari Indonesia untuk menangani permasalahan pencemaran.

Abstract

penelitian ini bertujuan untuk menjelaskan permasalahan yang terjadi dalam peraturan dan pelaksanaan Corporate Social Responsibilty dalam pengolaan panas bumi oleh penanaman modal asing berdasarkan ketentuan hukum internasional dan nasional Indonesia tentang bagaimana selayaknya aturan tersebut berlaku. Namun fakta yang ditemukan di lapangan perusahaan belum melaksanakan kewajibannya dibidang CSR dan tidak memberikan dampak positif bagi masyarakat tidak sesuai dengan aturan yang tertera dalam UU No. 25 Tahun 2007 Tentang Penanaman Modal, UU No. 40 Tahun 2007 Tentang Perseroan Terbatas, aturan pelaksanaan PP No. 47 tahun 2012 Tentang Tanggung Jawab Sosial dan juga ISO 26000. Abstract

Polluter Pay’s Principle, which ones of principle of compensation in international environmental law, exploitation oil and gas activities on offshore areas would be damage not only the jurisdiction of the sea areas belong to coastal states but also spread to jurisdiction of other coastal states. So that, the states which exposed damage are involving compensation to remedy the environment of the sea that tainted. The wrote Thesis has aimed to know and to explain concerning regulations and mechanism toward compensation of transboundary oil and gas pollution caused by offshore activity based on International Convention on Oil Pollution Preparedness, Response and Cooperation 1990. Convention on Civil Compensation for Oil Pollution Damage Resulting from Exploration and Exploitation of Seabed Mineral Resources 1977. Convention on Environmental Impact Assessment in a Transboundary Context 2001 and regulations in Indonesia. In order to obtain data in this wrote Thesis has been doing library research. That is to learn and to analyze the Conventions, the Regulations, text books, news paper, journal and any literate have related to this Thesis. The resulted of this Thesis explaining the regulations toward compensation of transboundary oil and gas pollution caused by offshore activities have not been be regulated definitely, because the regulations have not yet entry into force. But, The parties that wanted compensation are operator from offshore installation, whereas the claim could be propose when the activity to repair of marine environment tried to be done and together with party of origin to do study about Environmental Impact Assessment. Mechanism for giving compensation could be done with two ways, through insurance of environment and special body in this case is OPOL Association Limited. Based on the explanation, recommended to any states are studying exhaustive and doing the convention related transboundary oil and gas pollution caused by offshore Activities. Furthermore, recommended to Indonesian government is doing regional cooperation with ASEAN Countries, Asia Pacific and Australia and also ratify Espoo Convention.

Abstract

This paper explores the management of the Pase Upstream Working Area of  oil and gas (MIGAS) by Triangle Pase Inc as a Foreign Direct Investment, which is not according to the Revenue Sharing Agreement signed by the parties and regulations Indonesia. The main obstacle in the implementation of Foreign Direct Investment in the Upstream MIGAS sector in Pase Working Area is the failure to establish the APGE as a Joint Venture Company that operated as a subsidiary company required by the Investment Law and Regulation of the Minister of Trade 08/2017. It has a severe impact on the Aceh government's income from the cooperation management of the Upstream MIGAS sector in the Pase Working Area. The Arbitration Award that BANI has granted, which rejected The PDPA lawsuit, has reduced and even eliminated the privilege of the Aceh Government in managing the Upstream MIGAS sector in the Pase Working Area as stipulated by Law Number 11 of 2006 and Aceh's MIGAS Government Regulation.  As a solution, the BPMA has ordered Triangle Pase Inc. to revise the legality of APGE to comply with the prevailing laws and regulations in Indonesia. Therefore, the BPMA, as the regulator, and The PDPA as the parties in the Upstream MIGAS management in the Pase Working Area and Commission III of the Aceh's House of Representative to immediately summon Triangle Pase Inc. to resolve the dispute between The PDPA and Triangle Pase Inc. Abstract

This research aims to explain how the regulation of CSR and what factors support and hinder the implementation of CSR in foreign direct investment in the upstream oil and gas sector in the Pase Block, East Aceh. The writing of this thesis uses a normative juridicial  method. The result of the study shows that the implementation of CSR in the Pase Block was not in accordance with UU No. 11 Tahun 2006 tentang Pemerintahan Aceh, Qanun Aceh No. 5 Tahun 2018 tentang Penanaman Modal, Qanun Kabupaten Aceh Timur No. 12 Tahun 2016 tentang TJSLP, Peraturan Gubernur No. 65 tahun 2016 tentang Pedoman Pelaksanaan TJSLP and  ISO 26000, as well as Production Sharing Contract between parties.the company has not implement CSR in accordance with the laws and regualtions due to lack of commitment of TPI to implement CSR. As a result, the CSR  has not had a positive impact on the economic growth of community and the environment around the company.

Abstract

This article explains the regulation of CSR and what factors support and hinder the implementation of CSR in foreign direct investment in the upstream oil and gas sector in the Pase Block, East Aceh. The  result shows that the implementation of CSR in the Pase Block was not in accordance with Law on Governing Aceh number. 11/ 2006, Qanun Aceh No. 5/2018 on investment, Qanun Aceh Timur Number 12/ 2016 on CSR, Government Regulaiton number 65/ 2016 on the guideline for CSR and ISO 26000, as well as Production Sharing Contract between parties. The company has not implemented CSR in accordance with the laws and regulations due to the lack of commitment of TPI to implement CSR. As a result, the CSR has not positively impacted the economic growth of the community and the environment around the company.

Abstract

Acne vulgaris or acne is a chronic inflammatory skin disease in adolescents and adults affecting one self-confidence. The result of the research shows the ethanol extract, subfraction, pure isolate, and gel extract of Artocarpus camansi are active in inhibiting the growth of Propionibacterium acnes. The ethanol extract with the highest inhibition zone was at the concentration of 0.5 and 2% with 9.1±0.62 mm and 8.5±0.7 mm with the activity of 47.07% and 43% respectively (in comparison with the chloramphenicol 30 μg 19.33±0.47mm). The gel extract had the highest activity at 2%, with an inhibition zone of 8±0.50 mm and the activity of 43.97%. Anti-acne activity for all subfractions had an activity of 32.5-33.3% while the pure isolate was at 42.10 - 45.63%. Physical properties of the gel extract were evaluated for four weeks by examining the pH test obtained with a range of 5.8-6.7, viscosity in the range of 18460-19668 cP, spreadability in the range of 5.45-7.20 cm, adhesion observation above 4 seconds, and homogeneity in a concentration of 0.5-7.5%. The pure isolate has a melting point of 147 ℃, presumed to be γ-sitosterol and appropriate with the screening phytochemicals results with the presence of steroid.

Abstract

ABSTRACT: Customary law of Aceh has a number of legal principles such as acceptable, accountability, non-discrimination/equality before the law; accessible to the public, win-win solution, consensus, transparency, competent, and presumption of innocence. The principles are not only found in Adat Law of Aceh but also in other civilized legal systems in the world. In practice, the principles are applied strictly (see the case of Sultan Iskandar Muda). Adat guidelines or legal procedure of Adat is badly needed by informal justice providers in order to have legal certainty. There are some reasons why the guide line is necessary; (1) during new order (35 years) central government denied the existence of adat law, (2) during the conflict era (30 years) Acehnese did not have enough opportunity to practice their customary law, and (3) most of you people today are head of village  and they do not have enough knowledge and experience on guide line of adat. The Application Guideline of Informal Justice in Aceh

Abstract

The control and exploitation of aging oil and gas wells in North Aceh Regency present intricate challenges and conflicts. This article sheds light on the various conflicts arising from this issue and propose potential solutions for their resolution. This article adopts a normative legal research approach, complemented by in-depth interviews, to examine the legal dimensions of control and exploitation by local communities. The findings highlight the necessity of clear regulations in the management of old oil wells to prevent illegal drilling or unauthorized tapping. Specifically, the government should establish robust regulations concerning the mechanism for transferring old oil wells left by companies. In this context, corporations can involve local residents who engage in activities to rejuvenate the wells. While local communities rely on customary law for control and exploitation of old oil wells, the government's approach is based on statutory regulations. By addressing these legal aspects and promoting collaboration between stakeholders, a more effective and harmonious management of aging oil and gas wells can be achieved in North Aceh Regency.
