Abstract

The case of official positional auction under Indonesia legal system is not yet determined hence on this case, the civil servant regulation is adopted as a reference on goverment organization. Therefore, the government body or state officials may consider any policy in order to fullfil the public demand. Indonesian officials have right to act based on Fress Ermessen’s principle which can provides the freedom for authorized party to make decision as long as it is still on the track and does not overreach legal procedure. Consequently, the official positional auction is considered as a policy that belong to all state officials as long as it does not againts the law.

Abstract

General Election is a means of implementing people's sovereignty which is carried out directly, freely, secretly, honestly and fairly based on the Pancasila and the 1945 Constitution of the Republic of Indonesia. Implementation of Elections is the implementation of the stages of elections which are carried out freely, fairly, and honestly.   The purpose of this study is to analyze the principle of justice in the requirements to become a legislative member for the Village Head based on Law Number 7 of 2017 and Election Commission Regulation Number 20 of 2018. The results of the study showed that the first election held in 2019 did not implement the principles of justice in terms of the legislative candidate for the Village Head. The public can provide legal certainty for the implementation of the 2019 Election law. It is recommended to the General Election Commission to revise the Election Commission Regulation regarding the nomination of members of the DPR, Provincial DPRD, and Regency / City DPRD specifically in the requirements for candidates for the Village Head in Article 8 paragraph 1 letter b number 6 point b, to guarantee the rights of citizens and fulfill the principles of justice.

Abstract

The holding of elections simultaneously raises implications for the mechanism of general elections the President and Vice-President, especially in terms of the implementation of the presidential threshold. After the decision of the Constitutional Court (MK) number 14/PUUXI/2013, which mandates the simultaneous elections raises the pros and cons about setting the presidential threshold. In the perspective of the Constitution, using or not using the presidential threshold indeed does not conflict with the Constitution, because the presidential threshold is the policy of the law that are open from forming laws. The purpose of this paper is to study the presidential threshold in conjunction with a Simultaneous Election in 2019. The method of approach in this research is normative juridical with examines the problems that arise in terms of the law. The presidential threshold has been twice used in the election, the results show evidence that the presidential threshold is very positive become a tool of initial selection of candidates for President and Vice-President. The use of the presidential threshold in the elections in Indonesia was initially set in the 1945 Constitution (UUD 1945) stated in article 6A, and then further regulated in Legislation Number 23/2003 about General Election of President and Vice-President, then amended by Lagislation Number 42/2008 on General Election of President and Vice-President are next rearranged in Lagislation Number 7/2017 about General Elections. In the implementation of the presidential threshold is not necessarily only a positive impact, but there are also negative impacts such as the presence of new parties that have passed verification and are expressed as participants of the election by the Election Commission (KPU) in 2019 it does not have political rights in candidates for President and Vice-President, and the presence of Indonesian citizens who feel maimed political rights for which he choose in the 2014 election not necessarily be the choice in the elections 2019 or the candidate would they choose is canceled forward because the rules of the presidentila threshold. With keep the enactment of the rule threshold in the 2019 elections expected legislators to rethink about the terms of the presidential threshold, especially in conjunction with simultaneous elections, taking into account the advantages and disadvantages in the application or removal of the presidential threshold, for the purpose to strengthen the presidential system in Indonesia. Abstract

Abstract

Kabupaten Aceh Utara memiliki lahan perkebunan kelapa sawit mencapai 33,781.64 hektar yang diberikan kepada 11 perusahaan perkebunan. dengan jumlah lahan tersebut memunculkan banyak persoalan di bidang sosial-ekologi. Oleh karena itu pemerintah kabupaten Aceh Utara membangun konsep pembangunan perkebunan yang berorientasi sustainability dan berpedoman pada Peraturan Menteri Pertanian Nomor 11/Permentan/Ot.140/3/2015 tentang Sistem Sertifikasi Kelapa Sawit Berkelanjutan Indonesia (Indonesian Sustainable Palm Oil Certification System /ISPO). Penelitian ini bertujuan untuk mengetahui dan menganalisis apa yang menjadi hambatan, serta bagaimana peran dan upaya  pemerintah Kabupaten Aceh Utara dalam mengimplementasi prinsip-prinsip perkebunan berkelanjutan melalui ISPO. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis empiris. Dalam penelitian ini menggunakan tiga pendekatan yaitu pendekatan dengan mengidentifikasi objek penelitian, pendekatan perundang-undangan (Statute Approach), dan pendekatan terhadap taraf sinkronisasi vertikal dan horizontal ialah untuk mengungkap kenyataan. Berdasarkan hasil penelitian ini, Pemerintah kabupaten Aceh Utara telah mendorong 3 perusahaan di sektor perkebunan kelapa sawit berkomitmen menjalankan sertifkasi ISPO. Dalam pelaksanaannya mengalami hambatan di karenakan kurangnya kesadaran perusahaan perkebunan sawit dalam menjalankan sertifikasi ISPO. Pemerintah Aceh Utara mengalokasikan anggaran untuk mengatasi hambatan tersebut, serta membentuk tim percepatan implementasi ISPO. Penulis menilai perlu adanya sinergitas antara pemerintah daerah dengan pelaku usaha di bidang perkebunan kelapa sawit dalam membangun terwujudnya perkebunan sawit berkelanjutan dengan konsep sertifikasi ISPO.

Abstract

Kepastian hukum diperlukan strategi dalam upaya membangun hukum yang dikehendaki masyarakat dan hukum yang berpihak pada masyarakat, hukum yang demikian adalah hukum yang berkarakter esponsive. Namun, persoalan tentang kualitas dan kuantitas regulasi di Indonesia sudah seringkali menjadi sorotan dari berbagai pihak baik nasional maupun internasional. Penelitian ini bertujuan untuk mengetahui penerapan hukum esponsive dalam pembentukan undang-undang di Indonesia, serta untuk mengetahui banyak undang-undang yang diajukan Konstitusional Review ke Mahkamah Konstitusi. Penelitian ini menggunakan jenis penelitian yuridis esponsiv, dengan menggunakan pendekatan penelitian kualitatif. Berdasarkan hasil penelitian diketahui bahwa, penerapan hukum responsif dalam pembentukan undang-undang di Indonesia merupakan perkembangan pemikiran konsep-konsep hukum dari pakar-pakar hukum, untuk membawa Indonesia keluar dari keterpurukannya, dengan sistem hukumnya yang  karakter khas. Terkait banyaknya undang-undang di Indonesia yang diajukan Konstitusional Review, dalam hal ini penulis mengambil salah satu contoh Undang-Undang di Indonesia yang tidak esponsive. Dijadikannya UU KPK sebagai salah satu contoh Undang-Undang yang tidak esponsive, karena pembahasan perubahan kedua UU KPK tidak dilakukan secara partisipatif. Disarankan kepada pemerintah Indonesia untuk beralih kepada konsep hukum responsif.

Abstract

The impact of using social media is knowledge that must be possessed by students because this young generation uses social media a lot in their daily activities. The most basic impact for children during the corona virus pandemic is the widespread use of devices, both according to conventional views, for school purposes, as well as in the family and local environment. The use of these devices adversely affects children. Children in the use of online media must be limited to things that have a positive impact and deviations from the use of web-based media can be denied by protecting them from abusing criminal demonstrations recorded in the ITE law. For this reason, community service activities were carried out to socialize the impact of using social media on high school students. The socialization was carried out in 2 schools, namely SMA Negeri 1 Bireuen and SMA Negeri 2 Bireuen. The material for socialization is Law no. 11 of 2008 concerning Information and Electronic Transactions. This activity is expected to provide positive knowledge about the use of social media among students.

Abstract

The panel of judges rejected the demands for a wife and children's financial support in the decision Number 251/Pdt.G/2021/MS.Mbo. Whereas a living that is not given during the marriage becomes a debt for the husband who has the right to be demanded back by the wife. This study aims to analyze the reasons for the judge's refusal to support his wife and children and the legal consequences of the refusal. The author uses a normative juridical research method. The legal materials used are primary legal materials, secondary legal materials and tertiary legal materials. Data analysis was carried out qualitatively. The results showed that the judge's consideration of rejecting the demand for a living was because only one witness from the two people who were presented to the trial was able to state that the defendant had never provided a living for his wife or children. The principle regulated in the procedural law is unus testis nullus testis which means one witness is not a witness. Juridically, the refusal of a living was appropriate because the panel of judges had taken into account the provisions of Article 172 of the HIR which stipulates that witness statements must match each other.

Abstract

Penelitian ini bertujuan untuk mengetahui kedudukan Komisi Pemberantasan Korupsi dalam sistem ketatanegaraan Republik Indonesia sebelum dan setelah Putusan Mahkamah Konstitusi No 70/PUU-XVII/2019dan untuk mengetahui mengetahui kewenangan Komisi Pemberantasan Korupsi setelah lahirnya Putusan Mahkamah Konstitusi No 70/PUU-XVII/2019). Metode penelitian yang digunakan untuk menjawab permasalahan tersebut yaitu menggunakan jenis penelitian kualitatif dengan pendekatan penelitian yuridis normatif berdasarkan Putusan Mahkamah Konstitusi No 70/PUU-XVII/2019, Undang-Undang No 19 Tahun 2019 tentang Perubahan Kedua Atas Undang-Undang Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsidengan menggunakan pendekatan perundang-undangan, norma-norma hukum atau kaidah-kaidah. Tata caraaglutinasi data dan analisis data yang digunakan dalam penelitian yang lewatriset kepustakaan (library research) dan diolah secara kualitatif sehingga hasilnya akan disajikan secara deskriptif analisis dan dapat dipahami pembaca dengan mudah. Hasil penelitian menunjukkan bahwa (1) Pada revisi kedua Undang-Undang KPK menyatakan bahwa kedudukan KPK itu sendiri berada di bawah ranah kekuasaan eksekutif. Namun setelah Putusan Mahkamah Konstitusi Nomor 70/PUU/XVII/2019 menyebutkan bahwa kedudukan KPK berada di dalam rumpun eksekutif dalam melaksanakan tugas bersifat independen dan bebas dari pengaruh kekuasaan manapun. (2) Dalam melaksanakan tugas dan fungsi penyadapan yang telah selesai dilaksanakan harus diberitahukan kepada Dewan Penggawas serta dalam hal penyidikan, penyidik yang melakukan penggeledahan dan penyitaan dapat memberitahukan kepada Dewan Penggawas. Hal ini sesuai dengan tugas dan kewenangan yang dimiliki oleh Dewan Penggawas sesuai dengan Pasal 37B Undang-Undang No 19 Tahun 2019 yakni memberikan izin atau tidak memberikan izin penyadapan, penggeledahan, dan/atau penyitaan.
