Abstract

Financial service activities provided by Islamic banking in Indonesia are applied with various service contracts such as wakalah, hawalah and kafalah. In its current operation, the service contract is still an issue that is discussed, especially regarding the conformity of the contract to sharia provisions. The purpose of this study is to analyze the service contracts of Islamic banks in the review of fiqh muamalah maliyah. The type of qualitative research used in this study describes descriptively to provide a clear picture of the implementation of the contract used in the service products provided by Islamic banking. The literature study in this study was carried out by collecting data in the form of journals, books, Fatwa DSN, KHES in order to strengthen the conclusions that were built. The results of this study describe the operational concepts of service contracts: wakalah, hawalah and kafalah in Islamic banking. Furthermore, the findings in this study reveal that service contracts in wakalah, hawalah and kafalah contracts that are applied to various products in Islamic banking are appropriate in the review of fiqh muamalah maliyah.

Abstract

Akad merupakan suatu perjanjian yang sangat penting bagi orang yang membuat atau yang mengucapkannya, baik itu janji kepada Allah SWT., orang lain, lingkungan atau institusi, maupun janji kepada dirinya sendiri. Sekecil apapun janji itu akan tetap menjadi hutang jika tidak dipenuhi. Celakanya, sebagian besar masyarakat belum mengerti arti dari pada konsepperjanjian yang sebenarnya, masih banyak orang yang lebih memperhatikan janji tertulis dan menyepelekan janji-janji kecil yang hanya terucap dengan lisannya. Oleh karena itu, tulisan ini sangat penting agar masyarakat dapat mengetahui arti dari konsep perjanjian yang sebenarnya, tidak hanya dalam hukum positif saja, namun juga dalam hukum Islam, sehingga penyepelean janji sekecil apapun dapat dihilangkan

Abstract

This study about how the implementation of Murabahah financing with the Bai' Bistaman 'Ajil contract at BTPN Syariah Cab. Teluk Nibung, Tanjung Balai City. The DSN-MUI Fatwa has regulated the financing in the MUI Fatwa No. 04/DSN-MUI/IV/2000 Regarding Murabaha. This research is using qualitative research or field research (Field Research) with a legal and conceptual approach. The data sources are primary and secondary data, data collection techniques are observation, interviews and documentation and analyze data using triangulation of sources, techniques and time. The results of the study are basically the law of murabahah financing and the bai' bistaman ajil contract is permissible. Islam has also regulated murabahah and bai' bistaman 'ajil in detail where in its application there are provisions and terms and pillars which have also been regulated in the MUI Fatwa. However, when one of the conditions and pillars is not fulfilled, it can damage the contract and change the law. Murabahah financing with BBA contract provided by BTPN Syariah Cab. Teluk Nibung in its application does not meet the financing provisions that have been regulated in the MUI Fatwa No. 04/DSN-MUI/IV/2000.

Abstract

One of the conditions for performing Umrah is being able. Able in the sense of being able to body and provision (cost). While credit is the same as debt. Imam Shafi'I in his book says no when doing worship to the Baitullah with debt. And some of these travel in Medan provide Umrah trips by way of credit or the so-called Umrah bailout in collaboration with the bank. This is where the problem arises in the opinion of Imam Shafi'i. First, what about the conditions for being able to perform Umrah and what is the reason for prohibiting Umrah by credit, so that you think so. Then how is the systematics in performing Umrah by way of credit. And finally, what are the opinions of people who have performed Umrah by credit regarding this matter. The method used is qualitative with a socio legal approach. Results of the author's findings are that many people perform Umrah with this credit method because of a lack of understanding of the meaning of istithaah from the conditions for Umrah even though the majority of Muslims in Medan follow Imam  Syafi’i. Meanwhile, Imam Shafi'i forbade Umrah with debt. Because credit is like debt. And also the desire to perform worship to Umrah which is like a lifestyle trend today. Therefore, many people want to perform Umrah by credit. There are even those who use the guarantee of the house they live in as collateral to perform Umrah by means of this credit. It will be a big problem if there are problems in paying the installments every month.

Abstract

The growing public awareness of Islamic investment has encouraged the development of the Islamic capital market in Indonesia. Young people in most parts of the world have low levels of financial literacy. This is due to various factors such as socioeconomic and demographic. The low level of Islamic financial literacy is reflected in the low level of public understanding of the Islamic capital market. This study aims to measure the level of understanding of Muslim generation Z on the Islamic capital market. This research is a quantitative research using primary data. The sample of this research is Muslim generation Z, totaling 245 people with purposive sampling technique. Data analysis used in this research is univariate test. The results show that generation Z Muslims are related to the Islamic capital market at a good level of understanding as much as 39 percent, enough as much as 50 percent and less as much as 11 percent. Thus, generation Z Muslims in North Sumatra have a sufficient level of understanding related to the Islamic capital market. Various efforts can be made to increase understanding of Generation Z Muslims through education, outreach, seminars and promotions through social media.

Abstract

This study aims to determine the results of the analysis of the promotion mix on the marketing of goods and services as well as the forms of construction services that exist at PT. Khafi Multi Mighty. The type of method in this research is a qualitative type with a descriptive approach that is directed to be explained in greater detail about the actual situation that occurs in the field. This study also conducted direct interviews addressed to the Director of the company PT. Khafi Multi Mighty. This study shows the results that the promotion mix has not been implemented by employees so that it does not have a significant effect on service marketing, this is evidenced by their marketing method which only uses three components contained in the promotion mix. So that the services offered have not yet reached the desired point of satisfaction because the marketing system that is being implemented is not perfect. Keywords: service quality, promotion mix

Abstract

Penelitian ini bertujuan untuk menganalisis faktor-faktor yang mempengaruhi impulsif buying pada konsumen minimarket ditengah pandemi covid-19. Adapun metode penelitian yang digunakan dalam penelitian ini yaitu metode kuantitatif. Penelitian ini menggunakan Sampling Aksidential. Sampel yang digunakan dalam penelitian ini berjumlah 80 responden. Metode analisis data yang digunakan dalam penelitian ini yaitu regresi linier berganda. Berdasarkan hasil uji SPSS menunjukkan secara parsial variabel price discount (X1) tidak berpengaruh secara signifikan terhadap impulsif buying hal ini dibuktikan dengan nilai t hitung lebih kecil dari t tabel (0,101 < 1,6651). variabel bonus pack (X2) berpengaruh secara signifikan terhadap impulsif buying hal ini dibuktikan dengan nilai t hitung lebih besar dari t tabel (2,561 > 1,6651). variabel pendapatan (X3) berpengaruh secara signifikan terhadap impulsif buying hal ini dibuktikan dengan nilai t hitung lebih besar dari t tabel (7,656 > 1,6651). Dan uji secara simultan dapat disimpulkan bahwa variabel price discount, bonus pack dan pendapatan secara simultan memiliki pengaruh signifikan terhadap nilai impulsif buying. Yang mana hasil diperoleh F hitung sebesar 38,691 sedangkan F tabel sebesar 3,12. Berdasarkan uji Determinasi (R2) sebesar 58,9% yang menunjukkan bahwa model yang dibuat untuk memprediksi pengaruh variabel price diacount, bonus pack dan pendapatan mampu menerangkan realisasi variabel impulsif buying sebesar 58,9% sedangkan sisanya sebesar 41,1% dipengaruhi variabel lain.

Abstract

Maqashid syariah menganut prinsip syariah untuk mencapai kemaslahatan umat dengan berpartisipasi dalam banyak kegiatan manusia yang berkaitan dengan menjaga agama, jiwa, pikiran, harta benda dan generasi mendatang. Bertujuan menganalisis implementasi maqashid syariah yang terdapat dalam mekanisme asuransi syariah pada PT. Asuransi Takaful Keluarga Cabang Setia Budi Medan menggunakan parameter Al-Syatibi. Metode yang digunakan kualitatif, menunjukan bahwa perlindungan terhadap agama diimplementasikan dalam produk takafulink salam ziarah baitullah sebagai upaya perlindungan dalam menjalankan rukun Islam kelima yaitu haji. Perlindungan terhadap jiwa diimplementasikan dalam semua produk takaful keluarga sebagai upaya pencegahan terhadap terancamnya jiwa dan mengkover biaya kesehatan. Perlindungan terhadap akal diimplementasikan dalam produk takaful dana pendidikan dan takafulink salam cendekia sebagai penyandang dana pendidikan. Perlindungan terhadap keturunan diimplementasikan dalam semua produk takaful keluarga sebagai adanya perlindungan ahli waris dan keluarga yang ditinggalkan ketika peserta meninggal dunia. Perlindungan terhadap harta diimplementasikan dalam semua produk takaful keluarga sebab terdapat investasi sebagai harta yang sewaktu-waktu dapat dijadikan proteksi. Maka dapat disimpulkan bahwa maqashid syariah telah diimplementasikan didukung oleh terwujudnya kemaslahatan dalam produk dan mekanismenya.

Abstract

This study aims to determine the application of the mudharabah contract on Jasindo Syariah KP Insurance. Medan, knowing the percentage ratio of each product contained in PT. Asuransi Jasindo Syariah KP. Medan, and find out about the illustration of profit sharing calculations from sharia insurance products at PT. Asuransi Jasindo Syariah KP. Medan. The type of research used is descriptive research, with a qualitative approach. The conclusions of this study in brief are: First, the Implementation of the Mudharabah Agreement on Jasindo Syariah KP Insurance. Medan is implemented by establishing cooperation between the customer as the owner of the capital and the Jasindo Syariah Insurance as the capital manager. In tabarru' accounts, sharia insurance companies are allowed to provide profit sharing but are not required. The benefits will be obtained after deducting insurance expenses, will be shared between participants and companies with a mudharabah system. Second, the percentage ratio for Asuransi Jasindo Syariah Medan Marketing Office products is determined by the company. The percentage ratio for each Jasindo Syariah Insurance product is different because it is seen from how big the risks that occur in the future are. The illustration of the profit sharing calculation that is exemplified is the KBM (Motorized Vehicle) product at Asuransi Jasindo Syariah KP.
