Abstract

Islam is a perfect religion and there is no Samawi religion after Islam. All laws are derived from alShari (AllahSwt) and this has covered all forms of human behavior. All these provisions are revealed to the Prophet Muhammad PBUH. So this makes Rasulullah PBUH as the main source in teaching syari `at. However, after Rasulullah PBUH past away there is no more revelations that come down to humans. This is the problem among Muslims. On that basis, Imam al-Syathiby gave birth to the concept of sukut al-Syari ' as one method of ijtihad in answering the absence of legal proof in Islam.

Abstract

Pilgrimage tradition in Indonesia is a phenomenon that has not been eradicated by the times. The more modern and sophisticated technology, the more pilgrims come. In each city and region there are many people who cult certain graves to the point that the tomb can solve their problems. The tradition of the grave pilgrimage or the term in Mukomuko Regency is "pegi tepat."  It is a traditional practice carried out every year. Many practices that come from outside the teachings of Islam even there are deviations from the teachings of Islam itself such as: prostration on the grave, asking for healing, enliven the grave and combining between tradition and religion.

Abstract

This study aims to reveal about the pillars of education in the perspective of Imam al-Syathiby. This research is library research where the authors explore the opinion of Imam al-Syathiby in the book al-Muwafaqat fi Ushul al-Syari’ah that related with education. After the data is collected, it is processed by qualitative approach method. The instrument in this study is the author himself. From this study it can be concluded that the concept of education according to Imam al-Syathiby has four pillars; first, materials (science), second, teacher, third, method and forth, student. Every pillar in education must be paid attention proportionally. If not, education will not work properly. The further impact is that the goodness of human life both in the world and in the hereafter will not be realized. In this world human will be miserable, in the hereafter they will be misfortune.Penelitian ini bertujuan untuk mengungkap tentang pilar pendidikan dalam perspektif Imam al-Syathiby. Penelitan ini berbentuk library research dimana penulis mengeksplorasi pendapat Imam al-Syathiby dalam kitab al-Muwafaqat fi Ushuli al-Syari`ah yang berkaitan dengan pendidikan.Setelah data terkumpul, diolah dengan metode pendekatan kualitatif. Adapun instrument dalam penelitian ini adalah penulis sendiri. Dari penelitian ini dapat disimpulkan bahwa konsep pendidikan menurut Imam al-Syathiby memiliki empat pilar, yaitu, materi (ilmu), guru, metode dan murid. Setiap pilar dalam pendidikan tersebut harus mendapatkan perhatian sesuai dengan porsinya. Jika tidak, maka pendidikan tidak akan berjalan dengan baik. Dampak lebih jauhnya adalah tidak akan terwujudnya kemashlahatan pada kehidupan manusia di dunia dan akhirat. Di dunia manusia akan sengsara di akhirat nanti manusia akan celaka.

Abstract

The pressures of life that continue to increase during the Covid-19 pandemic have made people stressed in living their lives. Therefore, to ease the burden of life so as not to be stressed, advice is needed to deal with a lot of problems properly and to run life normally. For a Muslim, the source of advice in life is the Qur'an. As the word of Allah SWT which was revealed to the Prophet Muhammad to be used as a life guide for humans, it contains various values that can be used as lessons in life. To understand the values, the author researched the words mau'izhah in the Qur'an and its relation to counseling science. This study aims to find out the explanation of the Qur'an about Mau'izah and its relation to advice in counseling science. The method used in this study is library research. The results of this research showed that the word mau`izhah in the Al-Qur'an has several meanings, namely: religious law, warning, and advice. The last meaning is closely related to counseling science.

Abstract

This study aims to analyze how the practice of pagang gadai is carried out by the community according to the perspective of Islamic law. This study uses a qualitative method with a phenomenological approach, data sources are taken through interviews with ten people in Kenagarian Ganggo Mudiak, Pasaman Regency, West Sumatra Province. To strengthen the interview data, the researcher also made direct observations on the process and procedures for the practice pagang gadai is carried out by the community at the research location. All research data were then analyzed using the Miles Huberman technique. The research findings found two community mistakes in the practice of pagang gadai, namely i) pagang gadai is carried out by the community in Kanagarian Ganggo Mudiak is not in accordance with gadai in the perspective of Islamic sharia law, ii) the practice of pagang gadai is carried out by the community contains elements of usury which is legally contrary to sharia. Islam. Whereas in the Islamic context the application of gadai is not for profit but aims to help others. The recommendation from the research findings is that it is necessary to provide education to the public about how to pagang gadai procedures that are in accordance with Islamic sharia guidelines so that the error in practices is pagang gadai is not sustainable in the community

Abstract

Madrasah Aliyah (MA) Plus Keterampilan merupakan salah satu bentuk pelaksanaan kebijakan pemerintah dalam meningkatkan kemajuan social ekonomi bangsa. Melalui program keterampilan yang diikuti siswa saat sekolah, dapat mengantisipasi lulusan MA yang tidak dapat melanjutkan ke Perguruan Tinggi, mereka dapat mendirikan usaha sendiri atau bekerja  ke dunia usaha/industry sesuai dengan program keterampilan yang diikutinya saat menempuh pendidikan MA. Namun, dalam proses pelaksanaannya, fasilitas praktek mata pelajaran keterampilan beberapa MA di Sumatera Barat belum memadai sehingga tujuan pembelajran mata pelajaran praktek belum tercapai maksimal.  Sebagai upaya dalam meningkatkan kualitas pembelajaran praktek keterampilan di jenjang pendidikan MAN, maka tim pengabdi merasa tertarik  memberikan pelatihan kepada guru tentang berbagai keterampilan olahan produk yang sedang digemari dikalangan masyarakat, khususnya keterampilan dibidang Pastry dan Bakery menggunakan bahan dan alat yang sederhana. Melalui kegiatan pelatihan yang dilaksanakan tim pengabdi ini, pengetahuan guru tentang berbagai macam olahan Pastry dan Bakery yang mudah dalam pengolahannya semakin luas, sehingga saat akan memberikan materi tentang olahan pastry dan Bakery di kelas, kratifitas guru tidak dibatasi oleh kurang lengkapnya fasilistas praktek di sekolah.

Abstract

As written in al-Muwafaqat fi Ushuli al-Syari'ah, Imam al-Shatibi explained that every divine law (the command of Allah) must be prescribed on purposes. The intended purposes or objective of the law is to fulfill for the benefit of humankind. Imam al-Shatibi divided the higher objectives of law into two categories: (1) the objectives of the Lawgiver (Allah), and (2) the human objectives (the benefits that refer to humankind as the doer of law). The human objectives are defined in three scales: from the ‘essential’ (dharûriyat), to the ‘necessary’ (hajiyât), and to the ‘complementary’ (tahsiniyât). Furthermore, Imam Al-Shatibi explained that there are four steps in understanding the human objectives. The first is understanding maqasid (objectives) through the purity of the command and prohibitions. The second is understanding maqasid through the existence of ‘illah (basis) contained in commands and prohibitions. And the third, understanding the maqasid through the law that related to 'adah (customs) and 'ibadah (worship) which have the main and additional objectives. Fourth, understanding the maqasid through silence on the part of Allah due to the absence of any occasions or circumstances for further declaration related to certain matter. In other word, there is no evidence from the Holy book on certain issue which provides the reasons of the law implementation despite the existence of the meaning (ma’na) behind the revelation.

Abstract

The formation of national law which is the basis for realizing justice in Indonesia has gone through a long process. Starting from the entry of Islam into Indonesia and is still ongoing now. In the formation of the national law, there are at least four theories that explain how the struggle for legal sources that have been integrated with Indonesian society has crystallized into the main guideline in regulating the lives of Indonesian people. The sources of law are Religious Law, Customary Law, and Dutch Law. Combining these three sources of law to become national law is not simple. So that clashes often occur which results in the birth of various conflicts in the community. In particular, when the Dutch Colonial tried to apply their laws in Indonesia, they set rules according to their interests in order to strengthen their grip on the colonized country. So to explain how the process of forming national law, there are several theories that can explain it, namely: Receptie in Complex, Receptie, Receptie a Contrario, and Eclecticism. This research is in the form of qualitative which tends to be analytical and descriptive. Data were collected from various relevant literature and then analyzed using interactive methods. Thus, the findings of this study are that the theory of Receptie in Complex, Receptie, Receptie a Contrario, and Eclecticism explains that national law and religious law have a strong relationship. So national law and religious law will always be united in their principles because the majority of Indonesian people are Muslims.
