Abstract

Political development in Indonesia with Pancasila democracy has experienced many challenges and obstacles. Indonesian culture which is strongly influenced by ethnic and religious interests must continue to adapt to the Pancasila democracy which is a nationalism nationalism. This condition since independence until now has experienced many positive changes, starting from the issue of central and regional conflicts and building the strength of national unity. The founders of the Indonesian people put them together in the form of Unity in Diversity as the ideological power of the nation. With a very large population, a big national problem, it requires political development in Indonesia that is directed, fair and wise.

Abstract

Pancasila sudah lama menjadi ideologi bangsa Indonesia. Meskipun demikian, masih banyak subyek bangsa ini yang tidak menempatkannya sebagai ideologi. Mereka menunjukkan sikap dan perilaku yang berlawanan dengan ideologi. Salah satu sila dalam Pancasila yang dilanggar atau dilecehkannya adalah sila kedua (kemanusiaan yang adil dan beradab). Bentuk perbuatan yang ditunjukkan dengan melecehkan sila kedua dari Pancasila ini adalah radikalisme baik secara individual maupun kelompok. Pancasila sebagai penjaga multikulturalisme hanya disikapi sebagai kumpulan teks yang tidak bermakna.Kata kunci: Pancasila, ideologi, radikalisme, multikulturalisme, Islam         Pancasila has long been the ideology of the Indonesian. Even so, there are still many subjects of this nation that do not place it as an ideology. They show attitudes and behaviors that are contrary to the ideology. One of the principle in Pancasila that was violated or abused was the second principle (fair and civilized humanity). The form of deeds shown by insulting the second principle of the Pancasila is radicalism both individually or in groups. Pancasila as the guardian of multiculturalism is only addressed as a collection of meaningless texts.Keywords: Pancasila, ideology, radicalism, multiculturalism, Islamic

Abstract

Law of Teachers and Lecturers (UUGD) as a form of recognition and appreciation to teachers and lecturers' profession. In the implementation of UUGD, teacher governance is often very complex and faced with various problems. The question in this study is why teacher governance has not been good. This study uses the qualitative approach chosen because of its open and flexible nature. Through open interviews (individuals and groups) as well as several focus group discussions (FGD) FGD found that teacher governance problems in the implementation of UUGD are related to many issues, for example: the lack of clear definitions of teachers and their implications on additional tasks (structural) and functional supervisors, curriculum changes, quantity-distribution-mutation of teachers, quality-specialization-workshops of civil servants and non-civil servants teachers, teacher protection, teacher awards, and teacher professional organizations.

Abstract

Permasalahan lingkungan dapat menimbulkan dampak terhadap kondisi ekosistem dunia. Rumusan masalah kajian ini adalah bagaimanakah pengaturan perizinan di bidang lingkungan dan bagaimanakah penegakan hukum di bidang perizinan dapat mencegah dan menanggulangi pencemaran lingkungan hidup. Metode penelitian adalah penelitian hukum normatif. Hasil penelitian menunjukkan bahwa perizinan lingkungan di Indonesia yang berkaitan dengan permasalahan lingkungan telah diatur di berbagai macam perundang-undangan yang meliputi bidang pengairan, bidang pertambangan, bidang kehutanan, bidang perindustrian, bidang penataan ruang, bidang pertanahan, bidang pengolahan limbah B3, bidang pengendalian pencemaran dan atau kerusakan laut, bidang perikanan, bidang konservasi sumber daya alam hayati dan ekosistemnya serta izin ditingkat daerah yakni izin gangguan (HO). Dalam penegakannya dapat dilakukan melalui sarana hukum admintrasi dan hukum pidana.

Abstract

The number of political parties continues to increase from time to time. Ironically, the establishment of a political party is not based on the desire to carry out the functions of political education, political recruitment, and political regeneration. It is only to fulfill the desire for the power of a group of political elites. This research aims to analyze the need to simplify the number of political parties and determine the ideal simplification design of political parties This research used normative juridical research with statutory, historical, and conceptual approaches. The results indicated that political party simplification is needed for creating effectiveness and efficiency, minimizing segmentation or the emergence of friction among Indonesian citizens, preventing voter confusion, and maintaining political stability. Meanwhile, the ideal design to simplify political parties that can be executed is through submitting the dissolution of political parties to the Constitutional Court (Indonesian: Mahkamah Konstitusi (MK)) by expanding the criteria for those who can propose for dissolution (legal standing), imposing strict sanctions, implementing a moratorium on permits for the establishment of new parties, and extending the authority of the government to unilaterally dissolve political parties, such as the power to dissolve banned community organizations.

Abstract

Abstrak Ketika banyak produk norma yuridis dipermasalahkan atau diuji oleh banyak, maka salah satu pihak yang seharusnya merasa digugat keseriusan dalam membentuk atau memproduksinya adalah badan legislatif. Banyaknya norma yuridis yang dieksminasi ini juga mengindikasikan terjadi kelemahan konstruksi sistem hukum nasional. Pembatalan sejumlah produk Peraturan Daerah dan banyaknya Mahkamah Konstitusi (MK) dalam menerima permohonan judicial review, juga mengindikasikan kebenaran kalau produk peraturan perundang-undangan mengandung kelemahan serius. Oleh sejumlah ahli, kelemahan ini tidak leps dari kurangnya mempertimbangkan Pancasila sebagai sumber rujukan utama dalam pembentukannya.Kata kunci: sistem hukum, badan legislatif, pembatalan Abstract When many juridical norm products are questioned or tested by many, one of the parties who should feel sued for their seriousness in forming or producing them is the legislature. The large number of juridical norms that have been exploited also indicates a weakness in the construction of the national legal system. The cancellation of a number of products in the Regional Regulations and the number of Constitutional Courts (MK) in accepting applications for judicial review also indicated the truth that the product of legislation contained serious weaknesses. By a number of experts, this weakness does not leps from the lack of considering Pancasila as the main source of reference in its formation.Keywords: legal system, legislative body, cancellation

Abstract

Livestock waste as a negative factor on the farm is a phenomenon that can not be removed easily. On land, livestock waste can weaken the carrying capacity of the soil, causing soil pollution. While on the water, microorganisms pathogenic (disease causing) derived from livestock waste will pollute the marine environment. In addition, pollution of water, air and soil are also cases of pollution and environmental destruction that stand out as a result of rapid activity less maintain the aspect preservation of the environment. The issue of environmental pollution can be solved through medical aspects, planalogis, technological, environmental engineering, economics and law. In the perspective of environmental law, the completion of cases of environmental pollution environment includes three (3) fields at once, namely legal administrative environment, legal environment of civil and environmental law penal law as a logical consequence of the position of environmental law as the law is functional, thus, in terms of substance, job descriptions environmental law consists of: environmental law administrative, civil environmental law, environmental law penal law. Law No. 32 of 2009 on the Protection and Environmental Management delegate authority from central to local government which is to optimize the role of local governments in a bureaucratic environment ministry.

Abstract

Local and global economic activities which are increasingly supported by the development of increasingly advanced information technology will certainly have a good impact on the development of a local economy that is with the livelihood and development of micro and small business activities in a region or country. Such conditions must be well anticipated by all small businesses to take advantage of these technological advancements for future business development. There are many critical factors for the success of a business actor in carrying out his business mission, but with technological advancements, the gap to utilize technology properly is the key to success in itself, bearing in mind that the world is now in an all-digital communication order. Increasingly being able to adopt advanced technology, will certainly bring its own success for business people. This research was conducted on a group of small businesses in Indonesia who began to pioneer their businesses by utilizing information technology in cooperating with business partners and customers in order to enter the global market.

Abstract

During the Covid-19 epidemic pandemic, the government has done a lot of policies, in order to overcome the widespread corona virus outbreak and reduce the number of victims. In dealing with the Covid-19 outbreak, the government issued several policies, one of which was the Circular of the Minister of Manpower Number M / 3 / HK.04 / III / 2020 regarding guidelines for Labor Protection and Business Continuity in Prevention and Subscription Coordination. However, this Circular Letter is deemed insufficient to solve labor problems during the Covid-19 pandemic.The Minister of Manpower circular is deemed inappropriate if the government regulates the labor sector in dealing with Covid-19 only through the Minister of Manpower's Circular Letter. The government should issue better policies such as Ministerial Regulations or higher so that they have the authority and binding force. Government policies on employment must be able to provide guidance and clarity for industrial relations actors in facing the current Covid-19 pandemic.
