Abstract

 AbstrakSejak 2009 hingga saat ini terdapat 30 kasus yang diadili oleh Pengadilan Negeri di Indonesia dengan menggunakan Pasal 27 ayat (3) Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Berbagai kasus tersebut memunculkan opini dari sebagian masyarakat yang menganggap pasal-pasal delik pencemaran nama baik bertentangan dengan semangat reformasi yang menjunjung kebebasan berpendapat dan berekspresi. Jenis penelitian ini adalah penelitian hukum normatif. Tulisan ini berkesimpulan bahwa tindak pidana reputasi pasca Putusan Mahkamah Konstitusi Nomor 50/PUU-VI/2008, Putusan Mahkamah Konstitusi Nomor 2/PUU-VII/2009, Putusan Mahkamah Konstitusi Nomor 5/PUU-VIII/2010,  Putusan Mahkamah Konstitusi Nomor 31/PUU-XIII/2015 dan Putusan Mahkamah Konstitusi Nomor 76/PUU-XV/2017 tentang Pengujian Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 diatur secara terperinci dengan salah satu pointnya yaitu melakukan perubahan dalam Pasal 27 ayat (3) UU ITE dan menurunkan ancaman pidana pada 2 (dua) ketentuan.Kata Kunci: Delik Reputasi, Kepastian Hukum dan Mahkamah Konstitusi.Abstract  Since 2009 until now there have been 30 cases tried by the District Courts in Indonesia using Article 27 paragraph (3) of Law Number 19 Year 2016 concerning Amendments to Law Number 11 Year 2008 concerning Information and Electronic Transactions. This study concluded that the crime of reputation after the decision of the Constitutional Court Number 50 / PUU-VI / 2008, Decision of the Constitutional Court Number 2 / PUU-VII / 2009, Decision of the Constitutional Court Number 5 / PUU-VIII / 2010, Decision of the Constitutional Court Number 31 / PUU-XIII / 2015 and Constitutional Court Decision Number 76 / PUU-XV / 2017 concerning Testing of Law Number 19 Year 2016 concerning Amendment to Law Number 11 Year 2008 concerning Information and Electronic Transactions of the Constitution of the Republic of Indonesia Year 1945 is regulated in detail with one of the points, namely making changes in Article 27 paragraph (3) of the ITE Law and reducing criminal threats in 2 (two) provisions.Keywords: Reputation Delik, Legal Certainty and the Constitutional Court.

Abstract

Abstract In 2020, Indonesia's corruption Perception Index (CPI) ranked 102 out of 180 countries with a score of 37. This decline is the first since Indonesia's previous CPI improved in 2019. Corruption eradication was conducted in various ways and by government efforts to improve technical regulations through derivative regulations and the Supreme Court's regulations. At the end of 2020, a Supreme Court Regulation was issued regarding the regulation of Articles 2 and 3 of Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crimes. This research is normative. The material is obtained through works of the literature analyzed and described in a descriptive qualitative manner. The results depicted that Perma 1/2020 is not yet relevant to eradicate corruption in Indonesia. Issuance of Perma 1/2020 is still sectoral because it only regulates Article 2 and Article 3 of the Corruption Act. Abstrak Pada tahun 2020, Indeks Persepsi korupsi Indonesia berada pada peringkat 102 dari 180 negara dengan skor 37. Penurunan ini adalah yang pertama sejak IPK Indonesia sebelumnya sempat membaik pada 2019. Pemberantasan korupsi dilakukan dengan berbagai cara, juga dengan usaha pemerintah untuk memperbaiki regulasi secara teknis melalui peraturan turunan seperti halnya peraturan mahkamah agung. Pada akhir tahun 2020, terbit Peraturan mahkamah Agung terkait pengaturan Pasal 2 dan 3 Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan atas Undang-undang Nomor 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi. Penelitian ini merupakan penelitian normatif, bahan diperoleh melalui studi Pustaka yang kemudian dianalisis dan diuraikan secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa Perma 1/2020 belum relevan terhadap upaya pemberantasan korupsi di Indonesia. Penerbitan Perma 1/2020 yang masih bersifat sektoral karena hanya mengatur substansi Pasal 2 dan Pasal 3 UU Tipikor.

Abstract

Abstract

The purpose of this research is to know the vague of crime perpetrator identity by journalist from law number 40/1990 on Pers and Penal Code Perspective and to know the rule of police in enforcing the law related to vague of crime perpetrator identity in observuing journalist investigation result. The type of this research field is filed research in which data collection done by interviewing several parties related to research. Besides, writer also make literature research through related data and books. Then, data taken is analysed qualitatively and explained descriptively.Based on analysis, writer conclude that: very side interpretation on rejection right is legal weakness that can be used by journalist to do action which vague identity if crime perpetrator. The action of vague crime perpetrator identity fey on Artivle 165 Indonesia Penal Code which oblige every citizen to report known to police officer. The usage of rejection right by journalist not suit to article 165 Indonesia Penal Code that can be used to vague informan identity who is witness, child crime perpetrator and rape victim as journalist ethic code. Keywords: The Vague of Perpetrator Identity, Journalist, Law Number 40/1999 on Pers, Indonesian Penal Code.

Abstract

Berbagai kasus tindak pidana pencemaran nama baik melalui media elektronik memunculkan kontroversi. Penerapan pasal delik pencemaran nama baik dianggap bertentangan dengan UUD NRI Tahun 1945, yaitu hak asasi manusia dalam menyampaikan pendapat dan berekspresi. Fokus permasalahan dalam penelitian adalah bagaimana tindak pidana pencemaran nama baik pasca Putusan Mahkamah Konstitusi. Jenis penelitian ini adalah penelitian hukum normatif. Abstract

Narcotics crimes include crimes outside the Criminal Code which are regulated in the Narcotics Law Number 35 of 2009 and therein regulates special minimum sentence provisions. The approach used is a doctrinal approach with the aim of knowing two main points of discussion: First, the author wants to know and understand the punishment for narcotics crimes that are criminalized under a special minimum sentence. Second, the author wants to know the implementation of the binding persuasive principle of precedent in the judge's consideration in deciding narcotics crime cases under a special minimum sentence. Based on the results of the study, it can be concluded that the punishment of narcotics crimes that are sentenced under the special minimum provisions are not in accordance with the special minimum sentence provisions in the Narcotics Law, causing legal uncertainty. Then legal certainty and the principle of the binding persuasive of precedent cannot be applied because the judge uses his freedom in imposing a sentence by imposing a sentence under a special minimum provision. Abstract

The civil servants is the actor with the most corruption cases in the first semester of 2021. With its status as a state civil apparatus, including the law enforcement profession, it should receive more severe criminal sanctions. The criminal case in decision number 10/PID.TPK/2021/PT DKI. precisely without weighting. In addition, the judge's consideration of gender status where the perpetrator is a woman leads to considerations that relieve the perpetrator. This writing uses a normative research method with a case approach and a statutory approach. The analysis was carried out on library materials or secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials The results of the analysis were then described in a qualitative descriptive manner. The results of the study indicate that the accountability for criminal acts of corruption committed by state civil servants should be given weight by referring to the provisions of Article 52 of the Criminal Code (KUHP) so that the punishment in case number 10/PID.TPK/2021/PT DKI is not in line with the spirit of eradicating corruption, which should be aimed at providing a deterrent effect, both specifically and in general. Abstract

Cassation Law is the right of the defendant or public prosecutor not to accept the court's decision. Cases categorized as minor crimes are cases where the threat of a criminal verdict is a maximum of 3 months of confinement/imprisonment and a fine, one of which is a criminal act of using land without permission. The purpose of this study is to review and analyze, first, the legal arrangements for filing appeals according to SEMA No. 8 of 2011 against cases of minor criminal acts of using land without permission Decision Number 164 / Pid / 2019 / PT Smr and legal considerations of the Bailiff of the Samarinda District Court in issuing a notice of appeal decision No. 164 / Pid / 2019 / PT Smr which explains that the defendant can apply for cassation. The results showed that the legal arrangement for filing an appeal according to SEMA No. 8 of 2011 against cases of minor criminal acts of using land without permission Decision Number 164 / Pid / 2019 / PT Smr is a case that is not eligible to be appealed because the criminal verdict falls on qualifications that are threatened with imprisonment under 1 (one) year. Legal considerations for the issuance of a notice of appeal decision No. 164/Pid/2019/PT Smr, which explains that the defendant can apply for an appeal based on the Bailiff being obliged to convey the Right of a Defendant because the defendant has the right to file an appeal and in Article 205 of the Criminal Procedure Code regarding the examination of minor crimes there is no specific mention of the prohibition of filing appeals.

Abstract

The wrongful arrest by investigators simultaneously occurs during the arrest process, resulting in a violation of someone's human rights. The responsibility of investigators for wrongful arrests has been regulated in the Criminal Procedure Code and the police professional code of Ethics. The research approach used is a socio-legal approach that aims to find out two main points of discussion. First, the author wants to know and analyze the legal responsibility of investigators who commit wrongful arrests from the perspective of criminal law and human rights. Second, the writer wants to know and analyze the enforcement of criminal responsibility laws against investigators who commit wrongful acts of arrest in the Kutai Kartaneagara Police area. Based on the results of the research, it can be concluded that the responsibility of the investigator is towards the occurrence of wrongful arrests from a criminal law perspective, namely by imposing sanctions on the professional code of ethics of police and disciplinary law or further regulated in Article 13 PP No. 1 of 2003 concerning the Intentions of Members of the National Police of the Republic of Indonesia. Apart from that, from a human rights perspective on wrongful arrests, investigators must be processed following Perkap No. 8 of 2009 concerning the Implementation of Human Rights Principles and Standards in implementing the Duties of the Republic of Indonesia Police. Then the obstacles in enforcing the criminal law against wrongful arrests are caused by the lack of strict application of the police code of ethics sanctions against investigators, specifically regarding sanctions against investigators who violate the police code of ethics.
