Abstract

This writing tells about the endeavor of FKUB, or the Religious Harmony Forum in the city of Jayapura in estabilishing harmony between religions in Jayapura-Papua The Land of Peace in Maqasid Syari’ah perpective. This is an analytical descriptive research aimed to explain explicitly about the existence of FKUB in estabilishing the religious harmony according to the Maqasid Syari’ah point of view. The result shows that the effort of FKUB in Jayapura led to five points of priority measurement applied to maintain the harmony between religions. Those are as follows: a) preserving religions in Dharuriyyat (basic needs) level in the effort of estabilishing harmony of religious groups through dialogue in one’s group to be persuasive; b) preserving spirit (Hifz) is a basic need (dharuriyyat). Otherwise, people would fail to present seminars, dialogue, and contain people aspirations; c) preserving intelligence (Hifz al-‘Aql) is obviously fundamental to create harmony; d) preserving successors in daruriyyat level. It is also fundamental for better upcominng future; e) educating relgious figure how to maximally maintin prosperity.

Abstract

This article comes with a new perspective to understand the community transactions dynamics at the Saga Abepura Mall, Papua (MSA). The Covid-19 period challenges MSA managers in carrying out contract transformation. This article takes a close look at the changes in the muamalah fiqh agreement from offline to online, significantly transforming contract transactions at MSA during the Covid-19 pandemic. Two points are studied. First, muamalah fiqh transactions concerning contract transformation. Second, an analysis of contract changes. The focus of this article is on changing the old contract to the new contract. This article considers that a new contract is allowed in muamalah jurisprudence as long as there is no opposition with the Al-Qur'an and Al-Hadith. This article seeks answers to questions using observational data and interviews. The interview involved seven informants. They are four MSA employees and three customers. Transactions in a new contract do not mean replacing the old contract law. Creating a muamalah contract transformation does not have to eliminate other covenants. The existence of transforming an online buying and selling contract gave birth to a new form of contract at MSA, namely the order contract. First, the salam contract is the contract when the goods are paid for in advance, while the isthisnah contract was the contract when the order is paid when the good is in hand. Thus, all agents, MSA managers, customers, and employees should pay attention to contract transformation.تأتي هذه المقالة مع منظور جديد لفهم ديناميكيات المجتمع في الصفقة في مولSaga Abepura-Papua (MSA) ، تمثل فترة كوفيد-19 تحديات لمديري المول في تنفيذ تغيير العقد. تنظر هذه المقالة نظرة فاحصة على التغيير في عقد فقه المعاملة من العقد المباشر وغير المباشر عبر الإنترنيت في المول فترة كوفيد-19. هناك شيئان مهمان يتم دراستهما الأول صفقة فقه المعاملة المتعلقة بتغيير العقد والثاني تحليل تغيير العقد. التركيز في هذه المقالة هو تغيير العقد القديم إلى العقد الجديد. تعتبر هذه المقالة أن العقد الجديد مسموح به في فقه المعاملة بشرط عدم وجود دليل في القرآن الكريم والسنة النبوية على تحريمه. تسعى هذه المقالة للحصول على إجابات للأسئلة باستخدام بيانات المراقبة والمقابلات. تشمل المقابلة سبعة مخبرين، أربعة موظفي المول وثلاثة عملاء، الصفقة في العقد الجديد لا تعني محو حكم العقد القديم، التغيير في فقه المعاملة لا يلزم إلغاء العقود الأخرى، وقوع التغيير في عقد المعاملة عبر الإنترنيت يؤدي إلى ظهور شكل جديد من العقود في المول وهو عقد الطلب. الأول عقد السلم هو دفع قيمة البضائع المطلوبة مقدمًا، وأما عقد الاستصناع هو دفع ثمن البضائع المطلوبة في النهاية عند استلام الطلب. وهكذا كل الأطراف من مديري المول والعملاء والموظفون يهتمون بتغيير العقد.Artikel ini hadir dengan perspektif baru untuk memahami dinamika masyarakat dalam bertransaksi di Mall Saga Abepura-Papua (MSA). Masa Covid-19 memberikan tantangan terhadap pengelola MSA dalam melakukan transfomasi akad.Artikel ini melihat dari dekat kaitan perubahan akad fikih muamalah dari offline ke online khususnya bagaimana transformasi akad bertransaksi di MSA pada masa pandemi covid-19. Ada dua hal penting yang dikaji. Pertama, transaksi fikih muamalah tentang transformasi akad. Kedua, analisis perubahan akad. Fokus dalam artikel ini adalah perubahan akad lama kepada akad baru. Artikel ini memandang bahwa akad baru dibolehkan dalam fikih muamalah asalkan tidak ada dalil Alqur’an dan Alhadis yang melarangnya. Artikel ini mencari jawaban atas pertanyaan-pertanyaan dengan menggunakan data observasi dan wawancara. Wawancara melibatkan tujuh informan. Empat orang karyawan MSA dan tiga orang konsumen. Transaksi dalam akad baru bukan berarti manghapus hukum akad yang telah lama. Menciptakan transformasi akad muamalah tidak harus menghilangkan akad-akad yang lainnya. Adanya transformasi akad jual beli online melahirkan bentuk akad baru di MSA, yakni akad pesanan. Pertama akad salam adalah pembayaran barang pesanan yang di bayar diawal, sedangkan akad isthisnah adalah pembayaran barang pesanan yang dilakukan diakhir yakni ketika pesanan sudah di tangan. Dengan demikian semua pihak, pengelola MSA, pelanggan dan karyawan memperhatikan transformasi akad.

Abstract

Konflik antar umat beragama yang pernah terjadi berkepanjangan di Jayapura telah padam dan menjelma menjadi kehidupan yang damai. Salah satu perangkat yang berkontibusi besar dalam perubahan progresif tersebut, yakni Forum Kerukunan Umat Beragama (FKUB) kota Jayapura. Penelitian ini bermaksud untuk mengidentifikasi nilai-nilai Pancasila dalam strategi pembinaan kerukuanan umat bergama oleh FKUB Kota Jayapura. Penelitian kualitatif berupa studi kasus ini menggunakan pendekatan analisis normatif-empiris-filosofis. Data primer diambil dari informasi lapangan melalui observasi, wawancara. Sementara data sekunder diambil dari berbagai literatur ilmiah yang relevan dengan objek pokok pembahasan. Sifat pendekatan penelitian ini deskriptif-analitik. Sementara itu, teknik analisa data meliputi reduksi data, penyajian data, serta verifikasi data. Hasil penelitian menunjukan manifestasi nilai-nilai pancasila dalam peran FKUB Kota jayapura dapat dipetakan menjadi tiga strategi besar. Pertama, nilai ketuhanan, kemanusiaan, dan persatuan dalam dialog tokoh agama dengan tokoh masyarakat. Kedua, nilai demokrasi permusayawaratan dalam menampung dan merekomendasikan aspirasi keagamaan dan kemasyarakat sebagai kebijakan pemerintah. Ketiga, nilai keadilan universal dalam sosialisasi kebijakan pemerintah tentang kerukunan umat beragama. Implikasi teoritik dari penelitian ini menunjukan bahwa pelbagai nilai sosial dan keberagamaan yang termuat dalam Pancasila berkontribusi besar dalam membina kerukunan hidup antar umat beragama.

Abstract

This study aims to determine the model of zakat distribution which is carried out by the community and to find out the lack of understanding of the groups who are entitled to receive zakat. This study also aims to find out the institutions that applied in society as well as how the perspective of Islamic law regarding the distribution of zakat in Skouw Sae Village, Muara Tami District, Jayapura City. It is qualitative research, using the paradigm of social phenomenology. Research results: There are quite a lot of Muzaqih included in the category of poor and converts. The formation of Amil by the administrators of the Al-Aqsa Skouw Sae mosque is carried out every year before the holy month of Ramadan. In addition, not all Muslims who are appointed to be Amil knows the terms and duties of it, so that the lack of public knowledge about Islam causes an inability to understand the assets that must be zakated which results in public ignorance about the 8 Asnabs that are obliged to receive zakat. The lack of religious guidance carried out in the community causes knowledge of the obligation to pay zakat to be known to the public, but not in detail about what assets are required to be tithe, the nisab, and who is obliged to receive zakat. This knowledge is only owned by the Imam of the Mosque. The point of view of Islamic law regarding zakat in Skouw Sae that paying zakat is a must that should be done by every Muslim which is not included in the 8 asnabs, its implementation is regulated in the Qur'an and Hadith. Social institutions: Lack of Dai/Mubaliq who can provide continuous religious guidance. Economic Institutions: Economic factors support a person to make the habit of issuing zakat. Cultural Institutions: Habits carried out by people who have the ability not to pay zakat on their wealth to others lead to imitations that are carried out to the next generation, thus creating a new culture in the community.

Abstract

This thesis aims to analyze Ngudi Tentrem's savings practices from the perspective of fiqh muamalah in 4th Neighborhood, 2nd Hamlet, Ongan Jaya Village, Yapsi District, Jayapura Regency. This research also discusses the management's efforts to resolve the bad credit problems experienced by Ngudi Tentrem's savings practice. This study is qualitative research using primary and secondary data. The data analysis technique used is the phenomenological paradigm approach. The results of this study indicate that Ngudi Tentrem's savings practices in Ongan Jaya Village are carried out under the pillars and conditions of al-wadi'ah yad adh-dhamanah which involve the contract of two people who have faith, the existence of goods entrusted, and also ijab and qabul. The effort is restructuring which the management will provide interest relief and extension of time to creditors to save trouble to fulfill his obligations. The other way to resolve the bad credit problem is to settle with deliberation peacefully. The phenomenon of the survival of Ongan Jaya village savings is the culture of mutual aid which is still very thick in rural areas. Sense of solidarity and trust make this savings can be borne from its inception in 1997 until now, even though it does not have an official legal entity. The absence of collateral in these savings also adds to the value of its uniqueness, so, the people of Ongan Jaya village, especially, 4th Neighborhood, 2nd Hamlet prefer to choose Ngudi Tenrem savings practice.

Abstract

This study intends to identify the values of religious moderation in the paradigm of inter-religious conflict reconciliation by FKUB Jayapura City. This qualitative research uses a normative-empirical-philosophical analysis approach. Primary data was taken through observation and interviews. The nature of this research approach is descriptive-analytic. The theory of analysis in this study is an indicator of religious moderation formulated by the Ministry of Religion of the Republic of Indonesia. Data analysis techniques include data reduction, data presentation, and data verification. The results showed that there were dimensions of religious moderation values in the conflict reconciliation paradigm implemented by the Religious Harmony Forum (FKUB) of Jayapura City. First, the values of anti-radicalism and tolerance in the socio-religious-based conflict reconciliation paradigm. This can be seen from the paradigm of inclusiveness of religious social values in the dialogue room which was attended by various interfaith leaders and community leaders. Second, the accommodative value of local wisdom and national commitment in the paradigm of conflict reconciliation based on culture and nationalism. This can be seen from the existence of space for religious and social aspirations in socio-cultural pluralism and the spirit of nationalism. The theoretical implication of this study shows that indicators of religious moderation in Indonesia can be a paradigm for fostering inter-religious harmony. The limitation of this research is that it has not examined what factors are the obstacles and supports the Jayapura City FKUB in efforts to reconcile conflicts between religious communities.

Abstract

This study aims to explore and identify the role of the four pillars in building harmonious relations between religious groups in Jayapura-Papua City. The four pillars referred to here are traditional leaders, community leaders, religious leaders, and the government. This qualitative research is in the form of a case study. Data collection techniques through observation, interviews, and documentation. The results showed the synergy of the role of the four pillars in building harmonious relations between religious groups in Jayapura City through two fundamental processes. First, as a communicator through mediation communication strategies and media tools. The second is as a coordinator to overcome conflict tensions and continuity in coordination and coordination that is dynamic. The theoretical implications of this study show that synergy is needed for the role of traditional leaders, community leaders, religious leaders, and the government in realizing harmony between religious people. The limitations of this study have not examined the constraints, obstacles, or challenges of the synergy of the role of the four pillars in realizing harmonious relations between religious people in Jayapura City-Papua.

Abstract

Efforts to overcome the phenomenon of social conflict between religious communities can actually refer to the universal social values contained in each religion itself. This study intends to identify the paradigm of social-community fiqh in the paradigm of reconciliation of inter-religious conflicts by Religious Harmony Forum, Jayapura City. The value of Islamic universalism and Islamic indigenization in the social-community fiqh paradigm (fiqh muamalah ijtimaiyah) formulated by Abdurrahaman Wahid became the theory of analysis in the discussion of this research. The results showed that there were dimensions of social-community fiqh (fiqh muamalah ijtimaiyah) in the paradigm of inter-religious conflict reconciliation by Religious Harmony Forum Jayapura City. First, the value of Islamic universalism in the socio-religious-based conflict reconciliation paradigm. This can be seen from inclusive religious social values such as tolerance, openness and social care in the dialogue space between interfaith leaders and community leaders regarding inter-religious harmony. Second, the value of Islamic indigenization in the cultural-based conflict reconciliation paradigm. This can be seen from the value of local wisdom that are in line with Islamic teachings in the space of religious and social aspirations. The theoretical implication of this research shows that Islamic religious social valuescan be the basis of the social-community fiqh paradigm in realizing a harmonious social life between religious communities. The limitation of the research is that it has not studied what factors are the obstacles and support for the Jayapura City Religious Harmony Forum in efforts to reconcile conflicts between religious communities.
