Abstract

It is unfortunate that there is a bad stigma by some Muslims who view the mainstreaming of religious moderation in Indonesia as liberalization and secularization of religion in state life. This study intends to identify the values of maqasid shariah in the indicators of religious moderation formulated by the Ministry of Religion of the Republic of Indonesia. This literature research uses a normative-philosophical approach. The analytical theory used is the concept of the maqasid shariah approach developed by Jasser Auda. The results show that there are dimensions of maqasid shariah values in the four indicators of religious moderation in Indonesia. First, the dimension of the value of hifz waton (maintaining the benefit of the state) in the attitude indicator of national commitment. Hifz waton can be a paradigm in an effort to maintain the benefit of state life. Second, the value dimension of hifz 'ird (maintaining the benefit of honor and human dignity) in anti-radicalism indicators. The manifestation of hifz 'ird is in line with various efforts that uphold human values, including the safety of the human soul (hifz nafs). Third, the dimension of the value of the hifz ummah in the indicator of tolerance and accommodative to local culture. The manifestation of the hifz ummah through a tolerance and accommodative attitude towards the diversity of local Indonesian culture will be able to show the universal teachings of Islam, namely rahmatan lil alamin. The theoretical implication of this research is that the indicators of religious moderation in Indonesia are parallel to the universal benefit values that are the orientation of Islamic law (maqasid shariah). The limitation of this research is that it has not studied the form of transformation of religious moderation values in the positivity of Islamic law in Indonesia.

Abstract

This study intends to identify the dimensions.of the priority fiqh paradigm(fiqh al-Awlawiyyât) in the formulation of the MUI Fatwa No. 02 of 2021 Regarding Covid-19 Vaccine Products From Sinovac Life Sciences Co. Ltd. China And Pt. Bio Farma (Persero). This qualitative research is in the form of a literature review using a philosophical normative approach. The analytical theory used is the priority fiqh paradigm that was initiated by Yusuf al-Qaradawi. The results showed that there were dimensions of the priority fiqh paradigm in the formulation of the MUI fatwa on the halalness of the Sinovac vaccine. First, the dimension of the fiqh al-maqasid paradigm (fiqh objectives) in the use of a theological foundation that contains a universal legal message about the importance of the orientation to maintain the benefit of the human soul (hifz nafs). Second, the dimension of the fiqh al-muwazanat paradigm (consideration fiqh) in the use of the basic principles of Islamic law (qawaid fiqhiyah) and classical fiqh thinking which emphasizes preventive efforts (saddal-dzari'ah) and universal benefit (maslahah mursalah). Meanwhile, the dimensions of the muwazanah fiqh paradigm can also be seen in the use of various classical fiqh opinions which are the basis for the formulation of the MUI fatwa, dominated by the opinions of the Shafi'i school of jurisprudence, which have acceptability for Muslims in Indonesia. Third, the dimension of the fiqh al-wâqi' paradigm (fiqh of reality) in the involvement of experts in the analysis of vaccines. This shows that MUI emphasizes the importance of integrating the formulation of fatwas with competent and developing scientific thinking, not just based on speculation. The theoretical implication of this research shows that the formulation of the MUI fatwa related to the halalness of the Sinovac vaccine has a paradigmatic priority scale for considering the level of benefit for life safety. The limitation of this research is that it has not examined the concrete role of MUI in disseminating the.fatwa on the halalness of the Sinovac vaccine as a form of synergy with the vaccination program in Indonesia

Abstract

Sungguh disayangkan, masih terdapat sebagian aktifitas dakwah di tengah masyarakat Indonesia yang menunjukan wajah dakwah ekslusif, intoleran, bahkan cenderung kontra-produktif dengan semangat nasionalisme. Merespons fenomena tersebut, pada tahun 2017, Majelis Ulama Indonesia pada menerbitkan buku pedoman dakwah yang diproyeksikan sebagai kode etik bagi para pendakwah di Indonesia. Penelitian kualitatif dalam bentuk kajian pustaka ini bertujuan untuk melakukan identifikasi terhadap keberadaan dimensi nilai-nilai mqasid syariah  pada rumusan orientasi dakwah oleh Majelis Ulama Indonesia. Penelitian ini menggunakan pendekatan normatif-filosofis. Konsep maqasid syariah kontemporer yang dikonseptualisasikan oleh Jasser Auda digunakan sebagai teori analisis penelitian ini. Hasil penelitian menunjukan terdapat dimensi nilai-nilai maqasid syariah dalam rumusan orientasi dakwah oleh Majelis Ulama Indonesia. Pertama, nilai hifz din dan hifz nafs dalam orientasi pembentukan kepribadian umat Islam yang religus-humanis. Kedua, nilai hifz waton dalam orientasi pembentukan kepribadian umat Islam yang nasionalis dan pluralis. Ketiga, nilai hifz ummah dalam orientasi pembentukan kepribadian umat islam yang sejahtera dan harmonis. Implikasi teoritik penelitian ini membuktikan nilai maqasid syariah dapat menjadi landasan nilai, pendekatan maupun paradigma dakwah Islam di tengah kehidupan masyarakat multikultural. Keterbatasan penelitian ini belum mengkaji langkah konkrit oleh Majelis Ulama Indonesia dalam mengfasilitasi terwujudnya aktifitas dakwah di Indonesia agar sejalan dengan ragam orientasi dakwah yang telah dirumuskannya.

Abstract

Penelitian kualitatif berupa studi pustaka ini bertujuan untuk mengidentifikasi dimensi nilai-nilai Islam kosmopolitan dalam orientasi pendidikan Pesantren yang termaktub pada Undang-undang No.18 Tahun 2019 tentang Pesantren. Penelitian normatif-filosofis ini menggunakan paradigma  Islam kosmopolitan yang dirumuskan Abdurrahman Wahid. Hasil penelitian menunjukan terdapat dimensi nilai-nilai Islam kosmopolitan dalam orientasi pendidikan Pesantren yang termaktub pada Undang-undang No.18 Tahun 2019 tentang Pesantren. Pertama, nilai universalisme Islam dalam orientasi pembentukan karakter santri yang religius dan humanis. Keberadaan Pesantren diharapkan dapat menanamkan nilai-nilai religiusitas dan universalisme Islam agar dapat diejawantahkan oleh santri guna kemaslahatan kehidupan umat manusia secara universal. Kedua, nilai pribumisasi Islam dalam orientasi  pembentukan karakter santri yang moderat, nasionalis dan pluralis. Keberadaan Pesantren  diharapakan dapat membentuk karakter santri yang dapat menghargai, menghormati, dan menerima realitas kemajemukan sosial masyarakat Indonesia Ketiga, nilai subkultur dalam orientasi pembentukan karakter santri yang akademis dan berjiwa sosial. Keberadaan Pesantren diharapkan dapat bertransformasi pada kehidupan sosial masyarakat di lingkungan sekitarnya tanpa harus mengorbankan identitas dirinya sebagai lembaga pendidikan Islam. Implikasi teoritik penelitian ini menunjukan bahwa kosmopolitanisme Islam dapat menjadi basis nilai, pendekatan maupun paradigma guna membangun orientasi pendidikan Islam dalam mewujdukan kemaslahatan bagi kehidupan universal. Keterbatasan penelitian ini belum mengkaji terkait bentuk seperti apa strategi kongkrit yang diinisiasi oleh pemerintah Indonesia dalam menanamkan ragam nilai kosmopolitanisme Islam dalam segala aktifitas lembaga pendidikan Pesantren di Indonesia.

Abstract

The dichotomous and even confrontational paradigm of the relationship between Islamic teachings and Pancasila as a state ideology is still found in indonesian Muslims. This should not need to happen, because in fact the teachings of Islam and Pancasila have a universal intersection of values for the plurality of social life. This study aims to identify the value of Islamic prophetic social education in the construction of Pancasila. Quality research in the form of literature studies uses a normative-philosophical approach. Secondary data in the form of relevant journals, books, theses and dissertations. The three values in the idea of Islamic Prophetic Social Sciences formulated by Kuntowijoyo in the form of the values of humanization, liberation and transcendence became the analytical theory of the discussion of this research. These three values will be used to identify various prophetic social education values contained in the Pancasila precepts. The nature of this research approach is descriptive-analytic. Data analysis techniques include data reduction, data presentation, and data verification. The results showed that there was a dimension to the values of prophetic social education contained in Pancasila. First, the educational value of transcendence in the precepts of the Almighty godhead. The existence of the contained divine value can be a basis for values, paradigms and approaches in transforming the value of transcendence in all forms of educational activities. Second, the value of humanist education in the precepts of humanity and the precepts of unity. The existence of human values and unity can be a basin of values, paradigms and approaches to humanist educational activities that have an orientation of human empowerment of the urgency of science as well as positioning humans with all their potential. Third, the value of liberated education in the precepts of democracy and social justice. The existence of these values can be a basis for values, paradigms and approaches in liberation education that have an orientation to guide individuals so that they can be free from the intervention of any party or group that has a negative impact on social life.The theoretical implications of the findings of this study show that there is a meeting point for the content of universal values in Pancasila with the social teachings of Islamic religion. The limitations of this research can also be a lacuna (gap) for the next research, namely this research has not examined how the role of the government in disseminating the intersection of the social values of Islamic religion contained in the construction of Pancasila in the praxis life of Indonesian society.

Abstract

This study intends to identify the epistemology of the Fatwa of the Indonesian Ulema Council on the monasticism of money politic. Qualitative research in the form of literature studies uses a normative-philosophical approach. The primary data of this study is in the form of a document of the Ijtima' Ulama Decree of the Indonesian Fatwa Commission in 2018. Secondary data uses a variety of correlative scientific literature with a focus on discussion. The theory of idealism and the realism of Islamic law became the theory of analysis of this research. Data collection through documentation. Meanwhile, data analysis goes through the stages of data reduction, data presentation, and data verification. This research shows the epistemological construction of the fatwa of the Indonesian Ulema Council on the political monastery of money not only based on the idealistic-normative-deductive epistemology of Islamic law, but also emphasizes the aspects of Islamic legal realism in the form of considerations about the effectiveness of the fatwa in the midst of community life. The theoretical implications of this study show that the provisions of Islamic law (fatwa) related to the prohibition of money politics require considerations of legal formulations that do not only refer to normative idealism of law, but also legal realism. The limitations of this study have not identified the method of interpretation of the Indonesian Ulema Council on various theological foundations of monasticism of money politics.

Abstract

Efforts to overcome the phenomenon of social conflict between religious communities can actually refer to the universal social values contained in each religion itself. This study intends to identify the paradigm of social-community fiqh in the paradigm of reconciliation of inter-religious conflicts by Religious Harmony Forum, Jayapura City. The value of Islamic universalism and Islamic indigenization in the social-community fiqh paradigm (fiqh muamalah ijtimaiyah) formulated by Abdurrahaman Wahid became the theory of analysis in the discussion of this research. The results showed that there were dimensions of social-community fiqh (fiqh muamalah ijtimaiyah) in the paradigm of inter-religious conflict reconciliation by Religious Harmony Forum Jayapura City. First, the value of Islamic universalism in the socio-religious-based conflict reconciliation paradigm. This can be seen from inclusive religious social values such as tolerance, openness and social care in the dialogue space between interfaith leaders and community leaders regarding inter-religious harmony. Second, the value of Islamic indigenization in the cultural-based conflict reconciliation paradigm. This can be seen from the value of local wisdom that are in line with Islamic teachings in the space of religious and social aspirations. The theoretical implication of this research shows that Islamic religious social valuescan be the basis of the social-community fiqh paradigm in realizing a harmonious social life between religious communities. The limitation of the research is that it has not studied what factors are the obstacles and support for the Jayapura City Religious Harmony Forum in efforts to reconcile conflicts between religious communities.
