Abstract

Nahdlatul Ulama is the only major political party representing Muslims in national politics during the implementation of guided democracy. NU's accommodative and flexible political practices have made Nahdlatul Ulama able to live and continue to survive in difficult times. This is inseparable from NU's religious political strategy, which is its guideline. The theological basis based on the theory of fiqh and ushul fiqh can be seen in NU's acceptance of the guided democracy concept. This paper aims to reveal NU's theological foundation in accepting the concept of guided democracy. Data was collected through the study of texts and manuscripts and literature studies. The data analysis technique uses hermeneutic theory to capture symbols in the form of texts originating from Islamic law, namely fiqh, and ushul fiqh, as the basis and foundation of NU accepting guided democracy. The results showed that there were several theories of fiqh and ushul fiqh used by NU, including the concepts of maslahah and mudarat, dar’ul mafasid muqoddamun ala jalbil mashalih, amar ma’ruf nahyil mungkar, ma la yudraku kulluh la yutraku kulluh, al-muhafadthu ala qodim al-shahih wa al-akhdzu bi al-jadid al-ashlah, and the concept of syuro presented by KH Idham Chalid.

Abstract

A sense of justice is an abstract human conception of a desired or proper harmony between order and peace. Legal awareness is often associated with legal suitability, legal design, and legal validity. Legal awareness is the perception of value contained in humans about existing laws. Compliance comes from the word obedience and means obedience, obedience, obedience. To obey means to bow, obey, obey. Obedience means submission, and obedience is the state of submission to something or someone. Compliance, therefore, is the condition that the general public follows the rules of the game (the law). A society's legal culture also recognizes that our society, in its legal consciousness, has laws as rules of the game for living together and as a basis for solving problems arising from the risks of living together. However, from a material point of view, it is very difficult to build a legal culture in this country. This situation is affected by several factors, including: 1) legal factors; 2) law enforcement factors; 3) institutions and facilities; 4) community factors; and 5) cultural factors.

Abstract

Two calendar systems are developing globally, namely the Syamsiyah system (solar system) and the Kamariah system (lunar system). The lunar system is a calendar used by Muslims and has utility in worship rituals based on the calendar period. Qur’an and Hadith have mentioned this completely, namely, one year consists of twelve months. This study aims to determine the determination of the beginning of the lunar month using the rukyat method and to determine the extent to which the implementation of the rukyat method can be accepted by the Indonesian people. The type of research in this article is qualitative research or also known as naturalistic research methods. The data analysis techniques used were condensation, data presentation, and drawing conclusions. The results of the study show that the rukyat method is one of the methods of determining the lunar month, which has been carried out since the time of the Prophet Muhammad p.b.u.h. and his companions, even today it is still used by Muslims around the world, including in Indonesia. Rukyat is a method of determining the beginning of the lunar month by paying attention to important matters and conditions. As for the obstacles of the sighting as determining the beginning of the lunar month, there are several factors, namely the eye of the observer, the shape of the new moon, weather, seeing, the height of the new moon, the distance of the bow and the observer’s psychology

Abstract

This study aims to review and comprehensively explain the legality of Cryptocurrency based on a number of institutional and personal fatawa. To answer the research objectives, it was carried out using descriptive research with a qualitative approach. The research data comes from secondary data in the form of institutional and personal fatawa that have been published online, and are accompanied by supporting writings explaining these fatawa. The collected research data were analyzed by following the steps including material collection, discussion, and descriptive analysis. This research shows that a number of institutional and personal fatawa are divided into three decisions on the legality of Cryptocurrency, namely the first is Halal Cryptocurrency; on the grounds that it can be treated as a form of Maal (property), because it is based on social approval and general use so it is permissible to own;, trade;, transact;, etc. there is a clear decision), on the grounds of excessive gharar (speculation); security risk; can easily be used in illegal activities;. Third, Cryptocurrencies are illegal, for various reasons, they are not currency and are not legal means of payment; decentralized validation; excessive gharar (speculation); can easily be used for maysir (gambling);, and used to fund terrorists;. This research needs to be continued considering the limitations it has, such as seeing arguments against Cryptocurrency due to its properties (characteristics) so it is very good and it takes hard work to see it from various perspectives.
