Abstract

Public service is essentially part of the government's role in serving and fulfilling the interests of society. However, in practice, the implementation of public services has not been able to meet public expectations or public service standards stipulated in Law No. 25 of 2009, especially the implementation of public services by the Prosecutor's Office. The method used is socio-legal using a sample, namely the Prosecutor's Office in South Sulawesi. The problems that are present in three fundamental aspects that determine the quality of public services in the Prosecutor's Office starting from the pattern of public service delivery, the quality of human resources, and institutions indicate the need for improvements to excellent public services to realize good governance in Indonesia. Therefore, the conclusion that can be drawn is the implementation of the principles of sipakatau, sipakainge, and sipakalebbi in public services in the Prosecutor's Office is a solution to excellent public services.

Abstract

The purpose of this study is to investigate the application of criminal law following the determination of changes to the omnibus law and the influence such changes have on legal certainty. The study method that is being utilized is known as normative legal research, and it involves approaching the topic from legislative perspectives, conceptual perspectives, and case perspectives. According to the findings of the study, the process of criminal law enforcement has slowed down significantly in several areas where the omnibus law has made changes. This is true not only for cases that have recently taken place, but also for cases that are still in the stages of investigation and prosecution, which has led to a number of criminal cases not being resolved in court. This is due to the fact that the Omnibus Law has removed several criminal provisions from the previous law, including changing criminal sanctions to administrative sanctions. Furthermore, the Constitutional Court's decision on the Omnibus Law has never provided clarity on its application, which has caused criminal law enforcement to become stagnant. The word "stagnation" is synonymous with "bottleneck," "congestion," and "deadlock." After the stipulation of revisions to the Omnibus Law, there was a lull in the activity of criminal law enforcement, which resulted in the absence of legal certainty. Study This purpose is to recite information regarding the enforcement law criminal post determination change omnibus laws and their impact on the certainty law. The method of research that is employed is called normative study of the law, and it involves approaching legislation, approaching concepts, and approaching cases. However, the post-decision Court Constitution did not visit to give clarity regarding the Omnibus Law's enforceability, which led to enforcement law criminal experience stagnation. Satgnation is characterized by bottlenecks, deadlocks, and more bottlenecks. The process of changing the criminal post determination statute came to a standstill as a result. The Omnibus Law has produced outcomes that result in there being no realized certainty law

Abstract

This study examines the problematic regulation of articles of contempt of state institutions in Law No. 1 of 2023 concerning the Criminal Code on the right to freedom of opinion in Indonesia. This type of research is normative legal research that uses a statute, analytical, and conceptual approach. The results of this study show that juridically formal insults to state institutions (President, MPR, DPR, DPD, MA, and MK) are regulated in Article 240 and Article 241 of Law No. 1 of 2023 concerning the Criminal Code as complaint offenses. The existence of articles of contempt of state institutions has negative implications for the right to freedom of opinion if reviewed using the legal system theory with the concept of three elements of the legal system. In legal substance, the article of insult to state institutions is multi-interpretive because there is no clear and concrete distinction between insult and criticism. In legal structure, the article of contempt of state institutions has the potential to be misused because there are power relations both structurally and functionally between law enforcement and state institutions; and (3) legal culture, standardization of articles of insult to state institutions has the potential to degrade the pluralism of habits in society in opinion and expression.

Abstract

Tulisan ini membahas isu tentang kewenangan konkuren di daerah dalam kaitan dengan perangkat daerah yakni dinas daerah dan badan daerah yang menggunakan pendekatan konseptual dan pendekatan perundang-undangan. Tulisan ini berpandangan bahwa pada praktik penyelenggaraan pemerintahan di daerah masih menimbulkan kekaburan atas pemahaman terhadap penentuan nomenklatur lembaga teknis daerah yang menggunakan diksi ‘badan’ dan ‘dinas’ yang terkadang tidak selaras dengan orientasi dari lembaga daerah tersebut. Oleh karenanya, tulisan ini bertujuan memberikan kejelasan penafsiran atas kewenangan dua nomenklatur perangkat daerah sehingga pemerintah daerah lebih mudah mengklasifikasikan struktur pemerintah di daerahnya secara tepat. Selanjutnya, tulisan ini menjelaskan tentang indikasi perbedaan antara dinas dan badan yang memiliki fungsi dan kewenangan yang berbeda secara signifikan yaitu dinas daerah sebagai pelaksana urusan pemerintahan di daerah sedangkan badan sebagai penunjang urusan pemerintahan di daerah.

Abstract

The problem of protecting and recognizing the rights of Customary Law Communities in Indonesia, including in Maluku, from the perspective of local government policies, is still being underestimated, even though Article 18 B paragraph (2) of the constitution has given recognition and respect to the unity of Customary Law Communities and their traditional rights, However is it that to get recognition of the status of customary villages in several negeri in the districts of Maluku and disputes over the mata rumah parentah still occur frequently. This study raises issues regarding legal protection and problems regarding the recognition of the rights of Customary Law Communities in districts/cities in Maluku by using statutory, conceptual approaches and case studies of court decisions relating to the rights of Customary Law Communities. Based on the results of the study it was found that the Provincial Government had issued a policy to provide customary law protection in Maluku which became the basis for establishing customary villages in Ambon City and Tual City, however, there are still regencies that have not provided recognition in the form of regional regulations for establishing customary villages, such as in West Seram Regency and Central Maluku Regency due to weak local government commitment and juridical problems.

Abstract

In the science of law, it is known as a school or school that is adhered to by everyone where there tends to be a dogmatic nature in that school. One of the schools that exist is the school of utilitarianism pioneered by Jeremy Bentham which states that the purpose of law is to provide the greatest happiness to the greatest number. One of the legal policies referred to is the RAPBD which is stipulated through a Regional Regulation whose drafting authority is given to the DPRD together with the Regional Government. Where in the process of drafting the RAPBD as a legal product it must be under the substance of the legal ideals namely certainty, justice, and expediency. So it needs to be investigated academically regarding the role of utilitarianism in the drafting process of the RAPBD. This research is normative research that uses a literature approach where the source of data comes from legislation and legal theories. This research results in the conclusion that the concept of utilitarianism has an important point in the process of preparing the RAPBD because the ultimate goal of the budget is to provide welfare value to society in general.Keywords: APBD; Utilitarianism; RAPBD.

Abstract

Penelitian ini menganalisis mengenai wewenang pemerintah Desa dibidang pertanian yang ditinjau dari perspektif Undang-Undang Nomor 19 Tahun 2013 tentang Perlindungan dan Pemberdayaan Petani. Metode yang digunakan dalam penelitian ini yaitu pendekatan kualitatif dengan subjek pemerintah Desa dan masyarakat petani. Sedangkan teknik pengumpulan data dilakukan melalui observasi, wawancara dan dokumentasi. Hasil penelitian ini menunjukan bahwa pelaksanaan kewenangan Pemerintah Desa Kulo dalam pemberdayaan Petani Desa Kulo Kecamatan Kulo Kabupaten Sidrap telah berjalan dengan baik. Terdapat beberapa pelaksanaan kewenangan yang bersifat substantif dalam pemberdayaan Petani oleh Pemerintah Desa seperti penyaluran informasi, pelatihan dan pendidikan, penyediaan fasilitas, dan penguatan kelembagaan Kelompok Tani, pengawasan dan pelaksanaan distribusi bantuan pupuk, serta pembimbingan Petani. Pemerintah Desa Kulo juga melakukan kegiatan pelatihan pembuatan pupuk kompos dan penggunaan alat pertanian modern seperti handtracktor, robot panen padi dengan melakukan sinergitas dengan Dinas Pertanian.

Abstract

Negara Indonesia menganut sistem demokrasi, wujud kongkrit berjalannya sistem demokrasi salah satunya ialah pelaksanaan pemilihan pemimpin dengan secara langsung untuk mengisi jabatan publik. Praktik mahar partai politik merupaka salah satu fenomena permasalahan hukum yang sangat menarik untuk diteliti. Karena politik dianggap menjadi pintu awal karut marutnya pemerintahan di Indonesia. Penelitian ini bertujuan untuk mengetahui bagaimana praktik mahar partai politik dalam pemilihan kepala daerah yang terjadi dan bagaimana tinjauan fiqih siyasah mengenai praktik mahar partai politik tersebut. Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konsep (conceptual approach) data yang digunakan berfokus pada data sekunder dan dianalisis secara deskriptif kualitatif. Hasil penelitian ini menunjukan pengaturan dan sanksi terhadap mahar politik diatur dalam Undang-undang Nomor 6 Tahun 2020 tentang Pemilihan Gubernur, Bupati dan Walikota, akan tetapi kata mahar politik dan pembatasan pemberiannya tidak secara rinci dijelaskan. Di dalam perundang-undangan istilah mahar politik dipersamakan dengan kata imbalan. Sementara mahar politik dalam tinjauan fiqh siyasah termasuk ke dalam risywah. Pemberian mahar politik jelas di haramkan dan dilarang dalam hukum Islam. Kegiatan politik bekerjasama dalam hal keburukan atau kejahatan bertentangan dengan norma agama. The Indonesian state adheres to a democratic system, one of the concrete manifestations of the running of the democratic system is the implementation of direct elections of leaders to fill public positions. The practice of political party dowry is one of the phenomena of legal issues that are very interesting to study. Because politics is considered to be the starting point for the chaotic government in Indonesia. This research aims to find out how the practice of political party dowries in regional head elections occurs and how fiqih siyasah reviews the practice of political party dowries. This research is a normative juridical research using a statute approach and conceptual approach. The data used focuses on secondary data and is analysed descriptively qualitatively. The results of this study show that the regulation and sanctions against political dowries are regulated in Law Number 6 of 2020 concerning the Election of Governors, Regents and Mayors, but the word political dowry and restrictions on its provision are not explained in detail. In the legislation, the term political dowry is equated with the word reward. Meanwhile, political dowry in the review of fiqh siyasah is included in risywah. The provision of political dowries is clearly forbidden and prohibited in Islamic law. Political activities cooperate in terms of badness or evil contrary to religious norms.
