Abstract

The investigation conducted by the Special Crime Directorate, South Sumatra Regional Police conducted on Tuesday July 18, 2017, related to the reproses of rice is not good quality and contrary to Article 1 paragraph 4 of Law No. 18 of 2012 which basically rice must be good quality. Good quality in terms of decreased quality of rice (yellow, dusty, dull, lice, smelly). The objective of this research is to know the investigation of Bulog Rice. This study uses normative research research methods, namely legal research that focuses on the analysis of legislation. The results of the investigation of the Criminal Investigation of the Coppers occurred on Subdivre Lahat has fulfilled the requirements as required in Article 184 paragraph (1) of the Criminal Procedure, both the requirements of witness testimony and expert information on the quality down rice have met the requirements. so the investigation does not find evidence of criminal incidents as prescribed in Article 62 paragraph (1) in conjunction with Article 8 paragraph (1) a, (2) and (3) of Law no. It is not proven because the reprocessing rice has not been distributed, therefore the investigator issues the SP3 on the grounds that there is insufficient evidence. The investigator's of rice quality drops is basically absent, but there is a mistake in the focus of the investigation of the criminal incident according to Article 62 paragraph (1) jo Article 8 paragraph (1) a, (2) and (3) of Law no. 8 Year 1999.

Abstract

The criminal justice system as described in the KUHAP is an integrated criminal justice system laid out on the principle of "functional differentiation" between law enforcement agencies / institutions according to the stage of the process of authority granted by law.

Abstract

Perkawinan adalah sebuah peribadatan yang ditekankan Allah SWT untuk pasangan yang telah cukup umur guna dapat melahirkan keturunan yang soleh dan soleha. Perkawinan merupakan hubungan abadi antara lelaki serta wanita yang dianggap sah masyarakat serta negara. Pernikahan berdasarkan Kompilasi Hukum Islam, Bab II tentang Asas-Asas Pernikahan Pasal 2 berbunyi “ pernikahan berdasarkan hukum Islam yaitu akad yang amat kokoh ataupun mitssaqan ghalidzan guna mentaati perintah Allah serta menjalankannya ialah peribadatan”. Seiring berjalannya waktu ternyata begitu banyak permintaan dari masyarakat terlebih orang tua untuk menikahkan anaknya yang masihlah dibawah umur. Disinilah letak penyelundupan hukumnya menurut penulis. Adanya unsur kesengajaan dalam masyarakat untuk menikahkan anaknya yang belum memenuhi syarat pernikahan yang diamanatkan oleh UU Nomor 16 Tahun 2019. Menurut penjelasan tersebut, pengkaji sangat memiliki ketertarikan guna mengkaji tesis berjudul “Penyelundupan Hukum Perkawinan Anak Dibawah Umur Melalui Pengesahan Nikah Di Pengadilan Agama Baturaja (Studi Analisis Pasal 7 Ayat (3) Huruf (e) Kompilasi Hukum Islam).”. Pengkaji memakai kategori pengkajian hukum normatif. Mengutip pandangan Jhony Ibrahim yang menjelaskan bahwasanya pengkajian hukum normatif adalah sebuah cara pengkajian ilmiah untuk mendapati sebuah kebenaran melalui logika ilmu melalui sudut pandang normatif. Berdasarkan pengkajian tersebut dapat disimpulkan bahwa Penyebab terjadinya penyelundupan hukum perkawinan anak dibawah umur melalui pengesahan nikah di hampir Pengadilan Agama di Indonesia pada umumnya terkhusus Pengadilan Agama Baturaja berawal dari revisi Undang – Undang Nomor 1 Tahun 1974 yang merevisi usia perkawinan bagi pria dan wanita yaitu sama – sama 19 tahun. Ditambah lagi pada Kompilasi Hukum Islam Pasal 7 ayat (3) huruf (e) yang berbunyi “Perkawinan yang dilakukan oleh mereka yang tidak mempunyai halangan perkawinan Undang – Undang No. 1 Tahun 1974”, tidak memberikan batasan berapa lama suatu pernikahan siri dapat mengajukan permohonan nikah.

Abstract

The existence of informed consent is very important for the party making the health service agreement, so that it can be seen that the existence of informed consent is very important and necessary when sick. The formulation of the problems in this study are 1) What is the civil responsibility of doctors in medical negligence in medical operations related to informed consent? 2) What is the position of awareness of medical action (Informed Consent) regarding the civil responsibility of doctors in medical negligence in medical operations? The research method used is normative juridical research. The data sources used in this study consist of secondary data. Based on the results of the study, it shows that 1) Position of Medical Action Agreement (Informed Consent) to the civil obligations of doctors in medical recognition of medical operations, namely as a means of self-defense against the possibility of claims or lawsuits from patients or their families if one day unwanted consequences arise so as to provide a sense of security in carrying out medical treatment of patients..; 2) Civil Liability of Doctors in Medical Negligence in Medical Operations Related to Medical Action Agreement (Informed Consent) by compensating for material losses in the form of compensation for expenses that have been made by patients to pay all hospital costs and other treatment expenses as well . loss for not being able to work. Meanwhile, non-material losses due to feelings of illness, anxiety, depression and so on, by fulfilling the elements of default, the patient can hold the doctor responsible for what he has suffered. Patients can file a lawsuit against the doctor to the District Court where there is a dispute. Because the doctor's actions are contrary to the principles of decency, prudence and prudence are expected of him which is based on law on default regulated in article 1239 of the Civil Code and failure regulated in article 1366 of the Civil Code and unlawful acts regulated in article 1365 of the Civil Code

Abstract

Fraud in financing of health insurance is alleged to have burdened the cost of health services. The government issued Permenkes 16 of 2019 concerning prevention and handling of fraud and administrative sanctions against fraud in the implementation of JKN in an effort to prevent fraud. However, there is still potential for fraud to increase with pandemic conditions. This research aims to determine the implementation of the JKN Claim and Covid-19 Claim fraud prevention system and forms of fraud at the Prabumulih City Hospital during the Covid. This research can be useful theoretically and practically both in the field of health law politics and used by the Government, BPJS Health and Hospitals in an effort to improve fraud prevention system. The research method is empirical research with primary data sources from interviews with Prabumulih City Health Office, Prabumulih City Health BPJS and 4 Hospitals in Prabumulih. Results of the study shown that implementation of the fraud prevention system for health services at Prabumulih City Hospital during  Covid at the Health Service and BPJS Health KC Prabumulih was quite good, but in Prabumulih City Hospital  needed to be improved. Forms of fraud that can occur during the Covid-19 Pandemic at the Prabumulih City Hospital are fee contributions to participants for the Covid-19 antigen screening examination, extending the length of treatment for Covid-19 claims, submitting repeated claims to both JKN and covid claims and use the identity of another participant by not using the finger print in the participant's eligibility check.

Abstract

Rumusan masalah dalam penelitian ini adalah 1) Apa upaya Dinas Kesehatan terhadap praktek pengobatan tradisional illegal di Kabupaten Banyuasin?; 2) Faktor apa saja yang menjadi kendala Dinas Kesehatan terhadap praktek pengobatan tradisional illegal di Kabupaten Banyuasin?. Metode penelitian yang digunakan adalah penelitian yuridis empiris dan Sumber data yang digunakan dalam penelitian ini terdiri dari data primer dan data sekunder. Berdasarkan hasil penelitian menunjukkan bahwa 1) Upaya Dinas Kesehatan terhadap praktek pengobatan tradisional illegal di Kabupaten Banyuasin yaitu dengan mengadakan program sosialisasi, pembinaan dan pengawasan terhadap pentingnya perizinan bagi praktek pengobatan tradisional dan 2) Faktor yang menjadi kendala Dinas Kesehatan terhadap praktek pengobatan tradisional illegal di Kabupaten Banyuasin yaitu Pertama kedala dari Struktur Hukum. Dinas Kesehatan Kabupaten Banyuasin hanya melakukan penegakkan hukum administrasi, belum ada penegakkan hukum pidana karena sanksi tidak tegas. Kedua, kendala Substansi Hukum, adanya Peraturan Pemerintah Nomor 103 Tahun 2014 tentang Pelayanan Kesehatan Tradisional banyak yang mengabaikan aturannya dan banyak yang tidak mengajukan keahliannya atau mendaftarkan keahliannya pada Dinas Kesehatan, meski Dinas Kesehatan Kabupaten Banyuasin sudah koordinasi dengan asosiasi terkait melalui ketuanya. Namun, belum ada sanksi pidana. Ketiga, kendala dari adanya budaya hukum masyarakat yaitu rendahnya adanya derajat kepatuhan hukum masyarakat terhadap hukum dimana tingkat pemahaman para penyehat tradisional tentang pentingnya mempunyai izin upaya kesehatan tradisional juga masih rendah.

Abstract

The purpose of this article is to examine legal protection for the safety of PT Pertamina Refinery Unit III Plaju workers in the oil refinery project agreement and the legal consequences of termination of employment. The method is normative with secondary data as the main source. The results show that worker safety protection is in accordance with the law, including the provision of protective equipment such as protective clothing, safety shoes and head protection. However, its implementation is not optimal because many workers are not aware of the importance of safety. If employment is terminated, workers are entitled to compensation in accordance with article 165 of the Employment Law. They get severance pay, long service awards and other rights with a certain nominal value. Workers are also considered creditors whose payments take precedence, giving them a priority position in claims.
