Abstract

Penelitian ini mengkaji “Dinamika Manhâj Tarjih Muhammadiyah dalam Merespons Masalah Hukum”. Penelitian ini menggunakan desain penelitian kualitatif dengan menggunakan dua pendekatan yaitu historis dan sosiologis. Berdasarkan data yang ada, disimpulkan bahwa manhâj Tarjih Muhammadiyah mengalami evolusi. Perkembangan dan perubahan sosial membuat Majelis Tarjih dituntut untuk terus menerus melakukan rekonstruksi manhâj untuk mengantisipasi berbagai persoalan yang muncul. Pada awal pembentukannya (1928-1954), manhâj tarjih bersifat monodisiplin yaitu mengembalikan persoalan kepada ajaran wahyu (ketentuan Alqur’an dan al-Sunnah al-Shahihah). Lalu, pada 1954-1986, manhâj tarjih bersifat monodisiplin-paratekstual dengan menggunakan sejumlah metode, seperti: ijmâ`, qiyâs, maslahat mursalah, sadd al-zaî`ah, dan `urf. Kemudian, pada 2000- 2018, manhâj tarjih bercorak multidisiplin, baik dari aspek metode, pendekatan dan juga teknik. Bahkan dikembangkan dengan dua asumsi yakni integralistik dan hierarkhis yang terdiri dari qiyam al-asâsiyah, al-ussl al-kulliyah dan al-ahkâm al-furs’iyyah. Rumusan manhâj tarjih dalam setiap episode dengan parameter tantangan, berbagai konteks dan juga keragaman latar belakang aktor yang duduk di dalamnya, telah melahirkan ciri-ciri manhâj tertentu. Hal ini tidak lepas dari semangat tajdid agar ajaran Islam tetap relevan, dan adaptif dalam konteks kekinian.

Abstract

This dissertation aims to; 1) analyzing the dynamics of tarjih in responding to problems that arise in society; 2) analyzing the dynamic pattern of tarjih and 3) evaluating the contribution of tarjih products to the development of Islamic law in Indonesia. This research is a qualitative, type of literature. The data source is taken from Tarjih's decision and writings related to Tarjih. Data were collected through documentation as well as interviews as a complement. The data were analyzed using content analysis, using a sociological-historical approach. Conclusion; first, the dynamics of tarjih in responding to developing problems can be seen in three aspects; a) institutional aspects, there is changes in the nomenclature, organizational structure, requirements for tarjih members and tarjih implementation. b) Manhaj aspect, there are five stages of development, 1) 1928), 2) 1954/1955, 3) 1986, 4) 2000 and 5) 2018. c) In the product aspect, tarjih is dynamic in assessing problems and there are three forms of product. Second, the dynamic pattern of tarjih follows an evolutionary pattern, is multilinier, follows many pathways that influence each other and occur due to changes in society. Third, tarjih contributes to the development of Islamic law in Indonesia, normatively and positively.Keyword: Dynamics, Tarjih, Contribution

Abstract

Abstract: The involvement of women vegetable traders in “poken Jonjong” to make a living for their family add their working hours. It happen because they earn a living in one side, and they are also expected to play a role as a housewife in other side, which is in charge of doing the whole job domestically. Time usage patterns and activities for domestic affairs, employment, social activities and the utilization of spare time, are set in such a way. They manage the time as best as possible and adapt to the environmental component of family, work and community environment with the intention that the family welfare objectives can be achieved. The women vegetable traders in Poken Jonjong, generally decide to contribute for a living (double play) because of economic factors. The traders contributes substantially to the increase in family income. This can be seen from the fulfillment of daily needs in the household, the children can study though only at the level of Senior High School and there are of the traders that can save their money.
