Abstract

Penelitian ini bertujuan untuk mengetahui sinkronisasi secara horisontal maupun vertikal peraturan perundang-undangan tentang perkawinan beda agama di Indonesia. Penelitian ini termasuk dalam kategori penelitian hukum normatif, yang diproyeksikan untuk meneliti harmonisasi peraturan perundang-undangan mengenai perkawinan beda agama. Pendekatan penelitian ini adalah pendekatan perundang-undangan (statue approach). Teknik pengumpul­an data dilakukan dengan studi pustaka terhadap bahan hukum primer dan bahan hukum sekunder. Teknik analisa data dilakukan melalui sinkronisasi secara horisontal dan vertikal. Adapun temuan dalam penelitian ini adalah: pertama, secara horisontal terjadi ketidak­sinkronan antara UU No. 1 Tahun 1974 tentang Perkawinan dan UU No. 23 Tahun 2006 tentang Administrasi Kependudukan. Menurut UU Perkawinan, perkawinan beda agama dilarang, sedang dalam UU Administrasi Ke­pendudukan, hal itu diperbolehkan. Kedua, secara vertikal antara UU Perkawinan dengan PP No. 9 Tahun 1975 dan Inpres No. 9 Tahun 1991 sudah terdapat sinkronisasi yaitu melarang perkawinan beda agama. Tetapi dengan Peraturan Perkawinan Campur­an No. 158 Tahun 1898 terjadi ketidaksinkronan. UU Perkawinan melarang perkawinan mereka yang berbeda agama, sedangkan menurut Peraturan Perkawinan Campuran, perbedaan agama bukan penghalang melangsungkan per­kawinan.***This research aims to know the horizontal and vertical synchronization of legislation on interfaith marriage in Indonesia. According to the marriage regulation, interfaith marriage is prohibited meanwhile Demographic and Civic Adminis­tration regulation allows it. The second, vertically, between the Marriage regulation of the Government Regulation No. 9 of 1975 and Presidential Decree No. 9 of 1991 already contained synchronization that prohibits interfaith marriage. However, the Cross Marriage Regulation No. 158 of 1898 occurred discrepancies in where Marriage regulation prohibits people to do the interfaith marriage, meanwhile according to the Cross Marriage Regulation, interfaith is not a barrier to marry.***Keywords: sinkronisasi horisontal, sinkronisasi vertikal, peraturan perundang-undangan, perkawinan beda agama

Abstract

Artikel ini bertujuan untuk mengetahui bagaimana implementasi putusan Mahkamah Konstitusi No. 46/PUU-VIII/2010 tentang Hak Perdata Anak Luar Kawin di Pengadilan Negeri dan Pengadilan Agama Surakarta, khususnya pendapat para hakim mengenai implementasi putusan tersebut. Metode penelitian yang digunakan dalam karya tulis ini menggunakan pendekatan socio legal study, bagaimana putusan MK tentang anak luar kawin diimplementasikan dalam putusannya. Jenis penelitiannya adalah penelitian lapangan, yaitu menggali pendapat hakim mengenai implementasi putusan MK tersebut. Lokasi penelitian di Pengadilan Negeri dan Pengadilan Agama Surakarta. Pengumpulan data primer dilakukan dengan wawancara terstrukutur, sedangkan pengumpulan data sekunder dilakukan melalui studi pustaka bahan hukum primer dan bahan hukum sekunder. Untuk memperoleh jawaban atas permasalahan penelitian dilakukan 3 alur kegiatan yang terjadi secara bersamaan yaitu reduksi data, penyajian data, penarikan kesimpulan/verifikasi silogisme deduksi. Melalui karya tulis ini diperoleh hasil bahwa pertama, putusan Mahkamah Konstitusi No. 46/PUU-VIII/2010 belum dapat diimplementasikan secara penuh baik di pengadilan agama maupun di pengadilan negeri. Kedua, di Pengadilan Agama, putusan tersebut dianggap bertentangan dengan hukum Islam yang menyatakan anak luar kawin hanya mempunyai hubungan perdata dengan ibunya dan keluarga ibunya, sehingga anak luar kawin tidak dapat bernasab dengan ayah biologisnya serta tidak mendapatkan hak waris dan wali. Ketiga, menurut hakim di Pengadilan Negeri, putusan MK tersebut sudah diakomodasi di dalam KUH Perdata bahwa anak luar kawin dapat diakui melalui pengadilan, dan terhadap pengakuan tersebut anak luar kawin memperoleh hak waris yang besarnya tidak penuh seperti anak sah.Kata kunci: Putusan Mahkamah Konstitusi, Implementasi, Hak Perdata, Anak Luar Kawin.

Abstract

This fostering program on waste management to the community of Gagaksipat is to provide the knowledge on how to manage waste properly. Further, it also aims not only to reduce waste but also to get beneficiat profit from the waste. The participants for this programm were 60 residents of Gagaksipat Village, Ngemplak, Boyolali through purposive sampling. As the partners for the programm is Team from the Kopen Tourism and Education Village (KWEK) Kopen 1/7 Ngadirejo Kartasura Sukoharjo. The technique carried out was in the form of training and continued with monitoring and evaluating at the end of the activity. The theoretical basis of this activity is UU No. 18 of 2008 concerning waste processing. The seriousness and necessity of waste management starts from upstream to downstream with the implementation of concepts such as 3R (Reuse, Reduse, Recycle) and then up to 5R (Revalue and Recovery). The results of this fostering progamm will make the community more aware of and contribute to good and healthy waste management; provide community supplies to manage organic waste properly through biopori activities and provide supplies to the community to manage inorganic waste through waste management skills. Program pendampingan ini bertujuan untuk memberikan pelatihan managemen pengelolaan sampah kepada masyarakat agar sampah dikelola dengan baik, tidak menumpuk yang mengakibatkan pencemaran lingkungan dan membahayakan kehidupan terutama bagi kesehatan masyarakat. Pendampingan ini mengupas tentang pengelolaan sampah dengan baik agar tidak membuat petaka, tetapi mendatangkan manfaat secara ekonomi bagi masyarakat.Subyek pendampingan ini adalah 60 warga Desa Gagaksipat Kecamatan Ngemplak Kabupaten Boyolali yang diperoleh melalui purposive sampling. Adapun mitra pendamping dalam pelatihan ini adalah Tim dari Kampung Wisata dan Edukasi Kopen (KWEK) Kopen 1/7 Ngadirejo Kartasura Sukoharjo.Teknik yang dilakukan dalam pendampingan ini berbentuk pelatihan dan dilanjutkan dengan monitoring dan evaluasi diakhir kegiatan. Landasan teori kegiatan ini adalah UU No. 18 Tahun 2008 tentang pengolahan sampah. Keseriusan dan keharusan pengelolaan sampah mulai diperhatikan dari hulu sampai hilir dengan implementasi konsep seperti 3R (Reuse, Reduse, Recycle) kemudian sampai 5R (Revalue dan Recovery). Hasil dari pendampingan ini membuat masyarakat semakin menumbuhkan kesadaran dan peranan terhadap pengelolaan sampah yang baik dan sehat; memberikan bekal masyarakat untuk mengelola sampah organik dengan baik melalui kegiatan biopori dan memberikan bekal kepada masyarakat untuk mengelola sampah anorganik melalui keterampilan pengelolaan sampah.

Abstract

This study aims to determine the application of sharia principles in sharia economic dispute resolution in the National Sharia Arbitration Agency (Basyarnas). This study uses a method of socio legal study, how sharia principles are applied in resolving sharia economic disputes so that they can provide justice for both parties. Secondary data collection is carried out through a literature study of primary legal materials and secondary legal material. Some data was requested for confirmation from the National Sharia Arbitration Agency (Basyarnas) in the Yogyakarta region. To obtain answers to the research problems, 3 activities were carried out simultaneously, namely data reduction, data presentation, conclusion drawing / syllogistic verification of deduction. The results of the research and discussion obtained several conclusions, namely first, Islamic principles have not been maximally implemented by Basyarnas, this can be seen from the basis of the consideration of Basyarnas law in its decision. Basyarnas should also correct in terms of the contract, whether it is in accordance with sharia principles or not so that the arising of the dispute is not solely due to the default of the customer but can also be caused by incompatibility with sharia principles. Second, according to Antony Allot's theory of legal effectiveness, the application of sharia principles in sharia economic dispute resolution has not been carried out in accordance with sharia principles, this is due to the lack of clarity in the case in Basyarnas' decision.

Abstract

The purpose of this study is to explain the influence of the positivism paradigm in making land acquisition law and its application which is oriented towards formalism in Indonesia. This type of research is normative and prescriptive legal research, a paradigm that should be used to develop land acquisition law that can realize respect for land rights. To answer the research problem a concept approach is used with the analysis of the syllogism of deduction and interpretation. The paradigm of science as its major premise, while the regulation and application of land acquisition for public use as a minor premise. The results of this study are the positivism paradigm imbued with capitalism causing compensatory injustice and formal injustice in land acquisition for public use. Globalization, through international treaties, causes the importation of the laws of donor countries, which have a capitalist ideology to the Indonesian legal system, which has a family ideology. This harmonization problem if not resolved properly can cause injustice. To realize convergence, it is necessary to consider the use of realistic socio legal theory in land acquisition legal research. Keywords: Positivism, Realistic Legal Socio, Land Acquisition, Justice.

Abstract

This paper aims to find the coherence of sharia principles towards Pancasila. Pancasila as the philosophical basis of the state has an important role in the life of the nation and state. The principles of sharia are important principles for Muslims in muamalah. The type of research used is normative legal research to find coherence between sharia principles in Pancasila. The approach used is a conceptual approach. Secondary data were collected through literature study. Analyze the data using the syllogism method of deduction and interpretation, where the sharia principle is coherent with Pancasila. The results showed that first, the concept of ownership of property and payment of zakat and justice is coherent with the first, second and fifth precepts of Pancasila. Second, the principle of willingness is coherent with the second principle of humanity which is just and civilized, the principle of equality is coherent with the third principle of Indonesian unity, the principle of honesty and truth is coherent with the principle of the Almighty God and the second principle of fair and civilized humanity, the principle of benefit and mutual advantageous in line with the fifth precepts of social justice for all Indonesian people, the written principle in sharia principles is in line or coherent with the fourth principle of populism, which is led by wisdom in deliberation / marriage.   Keywords: Coherence; Sharia Principles; Pancasila.

Abstract

The purpose of this study is to determine the philosophical basis in the legal finding school of thoughts used by religious court judges and their orientation in resolving sharia economic disputes. The research problem is answered by using a normative method with a case and conceptual approach. The results of the research and discussion conclude that first, sharia economic dispute resolution has a philosophical foundation from the values of Pancasila, especially the first, second and fifth principles. Second, there are two different orientations of religious court judges in deciding sharia economic disputes, namely legism oriented and begriffjurisprudenz orientation. Amongst the various decisions, there are judges that are still oriented towards legism, namely deciding disputes based on existing positive laws, based on the Civil Code (KUHPer) even though the dispute is a sharia economic dispute. There are also many judges who have an orientation to begriffjurisprudenz, in this case the judge uses the basis of Islamic law, namely the Al Quran, Hadith and the Fatwa of the National Sharia Council (DSN) of the Indonesian Ulama Council (MUI) and the Compilation of Sharia Economic Law (KHES) in their decisions in addition to using the Civil Code (positive law).
