Abstract

The orientation of the implementation of regional autonomy is to improve public service and increase regional economy, contained three main missions, namely improve the quality and quantity public service to the society, create efficiency and effectiveness of the resources processing regions, and empower as well as creating the space for the community to participate in development. In connection the composition and regional government administration, after the amendment of constitution of the Republic of Indonesia year 1945, arrangement village or called any others name in terms of his reign reference to the article 18 paragraph (7) statethat “the composition and procedures of governance regulated in a law”. It meansthat article 18 paragraph (7) the constitution of the Republic of Indonesia year 1945 open the possibility of an arrangement in governance system of Indonesia. In the act of consideren was brought up Village has the rights of origin and traditional rights to regulate and manage the interests of the local community and as referred in the article 4 of the law which are to give recognition and respect for the existing Village with its diversity before and after the formation of the Republic of Indonesia

Abstract

Pancasila is a volkgeist (the soul of the nation), which is an ideology in the nation and state. Indonesia as a state of law needs law enforcers who have the soul of Pancasila in building integrity and justice in the midst of society. The purpose of writing this article is to describe the nature of Pancasila as a guideline for law enforcement in demonstrating self-integrity and justice. This writing method is normative writing through an analytical approach. The result of writing this article is Pancasila has an element of value that can be used to build a spirit of integrity for law enforcement and have positive energy in realizing social justice. The role of Pancasila in enhancing the integrity of law enforcement in by encouraging law enforcement officials to live up to, explore, find and find the values contained in the soul of the community in order to create justice that is not only legal justice but also social justice, namely justice that respect equality between humans and other humans in society. Pancasila adalah volkgeist (jiwa bangsa), yang menjadi ideologi dalam berbangsa dan bernegara. Indonesia sebagai negara hukum membutuhkan penegak hukum yang memiliki jiwa pancasila dalam membangun intergritas diri dan keadilan di tengah masyarakat. Tujuan penulisan artikel ini adalah untuk mendeskripsikan hakikat pancasila sebagai pedoman penegakan hukum dalam mewujudkan integritas diri dan keadilan. Metode penulisan ini adalah penulisan secara normative melalui pendekatan analitis (analytical approach). Hasil penulisan artikel ini yaitu pancasila memiliki unsur nilai yang dapat digunakan untuk membangun jiwa integritas bagi penegak hukum dan memiliki energi positif (positive energy) dalam mewujudkan keadilan sosial. Peran pancasila dalam meningkatkan integritas penegakan hukum adalah dengan mendorong aparat-aparat penegak hukum dalam menghayati, menggali, mencari dan menemukan nilai-nilai yang terdapat di dalam jiwa masyarakat agar tercipta keadilan yang bukan hanya keadilan hukum semata melainkan juga keadilan social yaitu keadilan yang menghormati kesetaraan antara manusia dengan manusia lainnya dalam masyarakat.

Abstract

Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia implies that the natural resources which belong to the State are used for the prosperity of the people of Indonesia. Thus, in carrying out the mandate of the Constitution to create justice for the community and national economic development of employment including foreign workers, the government should provide a good mechanism and supervision so that there will be no gap between the mandate of the constitution and the acceleration of economic development involving foreign workers. Labor inspection done by a separate working unit in the agency whose scope of duties and responsibilities is in the field of employment is in the central government, provincial government, and district/ city government. This study used a normative-empirical approach, where the researcher examined the law and its implementation regarding the roles of district/ city governments in the supervision of foreign workers. The purpose of this study was to examine the extent of the roles of district/ city governments in overseeing foreign workers in their regions. The results of the study showed that the roles of district/ city governments in carrying out the supervision of foreign workers in Indonesia were not regulated by laws of No. 23 of 2014 concerning regional government, PP No. 20 of 2018 concerning the use of foreign workers, and Minister of Manpower Regulation No.10 of 2018 concerning procedures for the use of foreign workers. Thus, its implementation made it difficult for district/ city governments to oversee the presence of foreign workers in their areas.

Abstract

Pasal 28D Undang – Undang Dasar Tahun 1945 juga menyebutkan bahwa “Setiap orang berhak atas pengakuan, jaminan, perlindungan, dan kepastian hukum yang adil serta perlakuan yang sama di hadapan hukum”. Artinya bahwa Negara memastikan setiap individu maupun warga Negara mendapatkan akses jaminan keadilan dan kepastian hukum serta kesamaan kedudukan dalam hukum dengan hadirnya undang-undang nomor 16 tahun 2011 tentang bantuan hukum. Metode penelitian yang di gunakan adalah normatif-empiris lebih detailnya mengkaji penerapan ketentuan hukum normatif (undang-undang) terhadap peristiwa hukum yang terjadi dalam masyarakat. Hasil penelitian mencerminkan bahwa implementasi keberadaan Undang – Undang Nomor 16 Tahun 2011 tentang Bantuan Hukum di kabupaten kolaka telah terlaksana dengan baik dan tepat sasaran sesuai dengan cita-cita dan harapan yang telah di amanatkan oleh konstitusi. Hal ini di karenakan semua stakeholder yang berada di kabupaten kolaka memiliki kesadaran kolektif tentang penting akses keadilan public untuk semua warga negara tanpa terkecuali.

Abstract

Human rights are basic rights that are inherent in humans, so the state is obliged to protect, respect and defend them. Same-sex marriage is a human right. The purpose of this paper is to find out how the legal perspective in Indonesia regarding the legality of same-sex marriage on the basis of freedom of human rights. This research method is normative based with an analytical approach. The results of this study conclude that same-sex marriage on the basis of freedom of human rights does not have a philosophical legal standing because it is contrary to the values contained in Pancasila as the ground norm in Indonesia. On the other hand, Sociologically, same-sex marriage is not in accordance with the culture and culture of the Indonesian nation where its citizens are citizens who uphold the values of the Almighty God. Substantially, same-sex marriage legislation is also not contained in Law No.1 of 1974 concerning marriage which has been changed to Law No. 16 of 2019 concerning amendments to Law No. 1 of 1974 concerning marriage.

Abstract

In Bombana district, Southeast Sulawesi Province on February 20, 2022 a democratic party was held through the simultaneous general election of village heads throughout Bombana district which was attended by 109 villages as stipulated in Bombana Regent Decree No. 449 of 2021 Concerning Schedules and Stages of Simultaneous Village Head Elections in 2022. In the implementation of local democracy through simultaneous village head elections, there are many practices of money politics carried out by village head candidates, success teams, and the community itself. The purpose of this research is to find out the factors causing the practice of money politics in the simultaneous village election. The method used in this study is a qualitative method by describing the facts that occur in the field to be explained more deeply through primary data sources, namely interviews, and secondary data, namely books and journals. The results of this study indicate that several factors cause money politics in simultaneous village elections in Bombana district, including the habitual factor that continues to occur at every election moment at all levels of democracy that occurs in Bombana district, and economic factors due to the Covid-19 outbreak that hit Indonesia. nationally 2 years ago, the factor of the absence of a special supervisory agency for village head elections, the factor weak laws and regulations on all hierarchies governing villages, and the absence of political education carried out by the local government and stakeholders in building village community intelligence about the dangers money politic.

Abstract

Eksistensi hukum adat ini baik ditelisik dalam konstitusi maupun dalam beberapa peraturan perundang-undangan dan beberapa putusan Mahkamah Konstitusi sudah begitu banyak dijumpai. Namun bagaimakah implementasi eksistensi hukum adat dalam kehidupan ketatanegaraan Indonesia saat ini ditengah gempuran era globalisasi, budaya asing dan kecanggihan teknologi. Metode yang digunakan dalam penelitian ini adalah penelitian yuridis normative, penelitian ini berupa penelitian kepustakaan yaitu dengan mengkaji bahan pustaka hukum yang berkaitan dengan objek penelitian dengan menggunakan pendekatan filsafat (philosophical approach), undang-undang (statute approach), pendekatan konseptual (conceptual approach). Hasil penelitian ini menunjukan bahwa keberadaan hukum adat dalam ketatanegaraan Indonesia perlu dipertahankan dan diperkuat eksistensinya sebagai sebuah komponen hukum yang hidup dan tumbuh yang tidak terpisahkan dari jiwa dan kehidupan masyarakat Indonesia saat ini. Penguatan implementasinya wajib bagi negara Indonesia karena selain sebagai identitas bangsa, hukum adat juga merupakan ground living law. Selain itu, keberadaannya telah banyak tertuang dalam lintas Undang-undang sektoral, beberapa putusan Mahkamah Konstitusi dan Peraturan Daerah.  Kata kunci: Penguatan; Keberadaan; Hukum Adat; Tata Negara.     The existence of this customary law has been examined both in the constitution and in several laws and regulations and several decisions of the Constitutional Court have been found. But how is the implementation of the existence of customary law in Indonesian constitutional life today amidst the onslaught of the era of globalization, foreign culture and technological sophistication.The method used in this research was normative juridical research. This research was in the form of library research by reviewing legal library materials using a philosophical approach, the statute approach, and conceptual approach. The results of this study show that the existence of customary law in the Indonesian state must be maintained and strengthened its existence as a component of the living and growing law that is inseparable from the soul and life of the Indonesian people today. Strengthening its implementation is mandatory for the Indonesian state because in addition to being the identity of the nation, customary law is also a fundamental law. Abstract

Agar terciptanya keadilan bagi masyarakat dan pembagunan ekonomi nasional lapangan kerja yang melibatkan tenaga kerja asing, haruslah ada mekanisme dan pengawasan yang baik agar tidak terjadinya kesenjangan antara amanat konstitusi dengan percepatan pembangunan ekonomi yang melibatkan tenaga kerja asing. pengawasan ketenagakerjaan oleh unit kerja tersendiri pada instansi yang lingkup tugas dan tanggung jawabnya di bidang ketenagakerjaan pada pemerintah pusat, pemerintah provinsi, dan pemerintah kabupaten/kota. Metode penelitian ini adalah pendekatan normatif- empiris, dimana penelitian tersebut mengkaji undang-undang dan implementasinya terhadap peran pemerintah daerah kabupaten/kota dalam pengawasan tenaga kerja asing. Tujuan penelitian ini adalah untuk mengkaji sejauhmana peran pemerintah daerah kabupaten/kota dalam mengawasi tenaga kerja asing di daerahnya. hasil penelitian menunjukkan bahwa peran pemerintah daerah kabupaten/kota dalam melaksanakan pengawasan tenaga kerja asing di indonesia tidak di atur oleh UU. No. 23 tahun 2014 tentang pemerintahan daerah, PP No. 20 tahun 2018 penggunaan tenaga kerja asing dan Permen ketenagakerjaan No.10 tahun 2018 tentang tata cara penggunaan tenaga kerja asing. Sehingga implementasinya menyulitkan pemerintah daerah kabupaten/kota dalam mengawasi keberadaan tenaga kerja asing yang berada di daerahnya.

Abstract

Mosehe is a symbol or symbol that expresses the conception of the Tolaki tribe, both to humans, the universe and the relationship between humans and other humans. Mosehe is divided into two, namely Mosehemohewu and Moseheowose or Mosehewonua. Mosehemohewu is held in a simple form, namely if there is conflict between humans, both individuals within the family, and between families. The author's focus is Mosehe in the simple form of conflict between individual humans in the family (marital problems). The research method used is empirical legal research. The data used is data that is directly obtained from data sources in the field (field research) and then described. The existence and role of Mosehe in solving problems in marriage in Woiha Village, Tirawuta District, East Kolaka Regency is very important, where the Mosehe ceremony is not only a sacred activity but is also believed to reject all dangers or repel reinforcements. Plays an important role in solving various problems in marital problems, such as elopement, pregnancy out of wedlock and other marital problems, because in the symbol of the mosehe ceremony it is symbolized as an act of purification from all sins/mistakes.
