Abstract

The quality of the environment is the most important part of human life in dignity and humility. In practice, ecocide are mostly committed by corporations, both national and transnational. Environmental crimes that are structured and systematic or often called ecocide do not concern as an extraordinary crimes. The International Criminal Court (ICC) has proposed to several countries such as Fiji, Vanuatu, and the Maldives that the need to add elements as international criminal crimes categorized as extra ordinary crimes in the Rome Statute and recognized as the fifth type of crime that becomes the jurisdiction of the International Criminal Court for trial. The purpose of this research is as a contribution to answer question. First, to analyze and to understand in developing extraordinary law enforcement against the crime of ecocide as extraordinary crime. Second, law enforcement review against ecocides in various regulations and various court decisions in Indonesia Third, to analyze the concept of international environmental law in the extraordinary enforcement law against ecocide crimes (Extra ordinary Crime) The research method used by researchers is normative juridical approach. This means that the legal material used as a study is secondary data. In this normative legal research it is not closed the possibility that empirical data (field) is also presented as an option to support and sharpen the study

Abstract

Setiap Negara bebas untuk melakukan kerjasama dalam bidang perdagangan dengan Negara mana pun guna meningkatkan perekonomiannya yang didasarkan pada kesepakatan World Trade Organization (WTO). Indonesia sebagai Negara anggota WTO juga telah mengikuti berbagai perjanjian perdagangan internasional baik yang bersifat bilateral maupun multilateral, salah satunya adalah Asean-China Free Trade Agreement (ACFTA). Banyaknya produk China yang masuk ke pasar Indonesia membuat Pemerintah Indonesia harus menjaga kepentingan nasional dengan memberlakukan standardisasi melalui Standar Nasional Indonesia (SNI). Penelitian ini membahas tentang bagaimana standar internasional atas produk barang dalam kerangka kesepakatan WTO, bagaimana kebijakan pemerintah tentang standardisasi barang dalam menghadapi ACFTA, dan bagaimana harmonisasi SNI dengan standar internasional berdasarkan kesepakatan WTO dalam rangka ACFTA. Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan data sekunder dengan pendekatan peraturan perundang-undangan (statute approach) yang dianalisis melalui analisis kualitatif. Standar internasional atas barang melalui kesepakatan WTO kaitannya dengan ACFTA mengacu kepada perjanjian internasional yang telah disepakati melalui kesepakatan WTO yakni Agreement on the Application of Sanitary and Phyto-sanitary Measures (SPS) dan Agreement on Technical Barriers To Trade (TBT). Kebijakan Pemerintah Republik Indonesia tentang standardisasi barang dalam menyikapi ACFTA yakni membuat Undang-Undang mengenai Standardisasi dan Penilaian Kesesuaian Nomor 20 Tahun 2014 serta melakukan kerjasama dengan lembaga eksternal. Harmonisasi SNI dengan standar internasional dilakukan dengan menerapkan prinsip-prinsip Technical Barriers to Trade baik melalui adopsi maupun modifikasi.

Abstract

 Law Number 2 of 2012 states that the acquisition of land for public interests must be accompanied by adequate and fair compensation, as well as the protection and respect of human rights. However, the construction of the Tebing-Tinggi - Kuala Tanjung Toll Road in Sipare-pare and Pasar Lapan Villages, Air Putih Subdistrict, Batu Bara Regency, Indonesia, exemplifies how compensation is frequently unfair. This study seeks to determine the suitability of implementing land acquisition using current laws and regulations. The primary data is gathered through interviews with landowners and the Regional Office of the National Land Agency of the Province of North Sumatra. While secondary data are gathered via literature and legal research. The results revealed that the provided compensation did not meet the requirements of Law No. 2/2012, prompting the public to file an objection with the Kisaran District Court.

Abstract

Digital developments in the banking system occur not only in conventional banks but also in Islamic banks. The digitalization of Islamic financing transactions is also inseparable from technological developments, especially in the use of electronic contracts. Sharia banks implementation of sharia business activities is regulated in the “Compilation of Sharia Economic Law” (KHES). Electronic Contracts are one of the innovations related to commercial life while navigating the legality of making agreements, even though digitally included by Islamic Banks, thus raising questions about the validity and risks of these electronic contracts. Competence, legal relations, objects, free consent, and jurisdiction are indicators of readiness for treaty legal instruments in the development of the current digitalization era. This study examines the legal readiness of agreements facing the era of digitalization of Islamic banking in financing transactions. This study uses an empirical method to examine the provisions of laws and regulations in detail. This was a normative juridical study. The results of the field study show that the electronic contracts implemented by Bank Mega Syariah and Bank Muamalat through e-contracts meet the legal provisions of the agreements stipulated in positive law in Indonesia. The results of the literature study also show that treaty legal instruments as stipulated in BW, Law 11/2008 juncto PP 71/2019 and KHES have accommodated the development of electronic agreement legal needs as an implication of the digitalization era in banking financing transactions.
