Abstract

Tujuan Penelitian ini untuk mengetahui tiga hal, Untuk mengetahui peranan dan tanggung jawab Dinas Perhubungan terhadap penguasaan sementara atas kendaraan roda empat dalam hal pelanggaran parkir di Medan. Kedua, untuk melihat apa saja yang menjadi kendala untuk pelaksanaan penguasaan sementara atas kendaraan roda empat dalam hal pelanggaran parkir di Kota Medan, dan Ketiga, untuk mengetahui tindakan yang diperbuat oleh Dinas Perhubungan dalam mengatasi permasalahan parkir liar di Kota Medan. Jenis penelitian ini menggunakan ialah penelitian hukum normatif ini bersifat penelitian deskriptif kualitatif. Data yang diambil ialah bahan sekunder yang relevan di dalam masalah penelitian ini. Sumber dan jenis statistik dalam hal ini penelitian adalah data sekunder yang diperoleh dari bahan penelitian berupa bahan-bahan pidana, yang meliputi dari bahan-bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukan bahwa 1)kedudukan dan kewajiban Departemen Perhubungan untuk menderek mobil roda empat adalah bahwa Departemen Perhubungan wajib memposting pemberitahuan tertulis kepada pemilik mobil dalam waktu 1x24 jam 2) Kendala yang mungkin sering dialami pada beberapa titik sosialisasi liputan penarikan diselesaikan melalui Dinas Perhubungan Kota Medan. Meliputi : Tidak banyak ahli, khususnya di bidang IT dan komunikasi; Kurangnya kemampuan dan catatan tentang contributor dari Dinas Perhubungan Kota medan; Kurang Kehati-hatian akibat parkir di bahu jalan; Minat masyarakat masih rendah terhadap liputan penarikan yang dilakukan Dinas perhubungan Kota Medan; Ada kepercayaan masyarakat terhadap rambu-rambu pengunjung; dan Minimnya anggaran yang dimiliki melalui sarana jalan Dinas Perhubungan, agar mobil derek tidak lagi sesuai dengan keinginan di dalam kawasan 3) Upaya dan pergerakan yang dilakukan melalui sarana Dinas Perhubungan dalam mengatasi perpakiran Pelanggaran di Kota Medan adalah menyebarluaskan fakta kepada masyarakat luas tentang Peraturan Walikota” Medan Nomor 70 Tahun 2017”

Abstract

Every party who wishes to file a lawsuit must have sufficient legal interest. To overcome the deficiencies faced by justice seekers in fighting for their interests, Article 119 HIR / Article 143 RBG authorizes the Chair of the District Court (PN) to advise and assist the plaintiffs in filing their claims. This type of research is normative juridical namely a research that deductively begins the analysis of the articles in the legislation governing the problem. The legal provisions are that the Lubuk Pakam District Court in this case is to resolve inheritance disputes over land disputes which incidentally become the Absolute Competence of the Religious Court, because it is very caseistic of a case which will later be entered and examined by a Judge. Legal protection there are parties to a dispute related to the non-receipt of a lawsuit due to absolute competence in court that legal protection there are parties to a dispute related to the non-receipt of a lawsuit due to absolute competence in court equally as getting legal protection means that both parties receive equal treatment by the court.

Abstract

Artikel ini dimaksudkan untuk menjelaskan edukasi kepada masyarakat terkait Akad Pembiyaan di PT BSI ex. BRI Syari'ah Cabang Binjai. Kelompok masyarakat yang ditunjuk adalah masyarakat yang terletak di Jalan Baskom Kelurahan Nangka Kecamatan Binjai Utara Sumatera Utara. Metode yang digunakan yuridis normatif dan empiris. Data dikumpulkan dan dianalisis secara kualitatif dari pendekatan perundang-undangan  dan pendekatan yuridis sosiologis. Kajian ini menyimpulkan bahwa pentingnya edukasi kepada masyarakat sebagai nasabah terkait upaya meningkatkan pengetahuan mengenai akad pembiayaan perbankan Syariah, dan  kesadaran hukum nasabah guna meminimalisir resiko serta untuk mengetahui bagaimana perlindungan hukum dari setiap akad pembiayaan yang dibuat nasabah dengan pihak bank syari’ah.

Abstract

Transaksi mudharabah adalah bentuk kerja sama antara dua pihak atau lebih yaitu pemilik modal (shahibul maal) mempercayakan sejumlah modal kepada pengelola (mudharib) dengan suatu perjanjian pembagian keuntungan. Bentuk ini menegaskan kerjasama dengan sumbangan seratus persen modal dari shahibul maal dan pengusaha kepada mudharib. Bank SUMUT Syariah di Kota Medan yang telah memiliki fasilitas mudharabah, justru lebih menjalankan transaksi akad pembiayaan yang lazim. Mereka terkesan tidak secara serius untuk menerapkan akad pembiayaan secara mudharabah kepada para pedagang kecil dan menengah (UKM). Masyarakat yang ingin mendapatkan fasilitas pembiayaan mudharabah menjadi kecewa. Tulisan ini akan membahas mengenai persoalan-persoalan pelaksanaan akad pembiayaan mudharabah di bank SUMUT Syariah di Kota Medan. Hasil yang dicapai dari kajian ini adalah untuk menganalisis penerapan sistem mudharabah di bank SUMUT Syariah di Kota Medan sehingga diharapkan dapat menguatkan UKM dalam penyediaan modal usaha dan penyempurnaan pembuatan akta pembiayaan mudharabah yang lebih berpihak kepada mudharib.

Abstract

This study aims to find out the essence of the importance of recording marriages in Muslim communities in Kampung Nangka Village, North Binjai. As mandated by Article 1 of Law no. 1 of 1974 concerning Marriage that marriage is an inner and outer bond of a man and a woman as husband and wife with the aim of forming a happy and eternal family based on God Almighty. One of the most important things to do is register the marriage. The fact is that in the community, especially in remote areas, marriage registration in official state documents is rarely done. This research is a normative legal research with analytical descriptive nature by using a literature approach and a field approach. Analysis of the data obtained in this study was carried out qualitatively. The results of the study indicate that the problem of the lack of marriage registration is caused by several factors, such as the lack of knowledge of some people to the laws and regulations regarding marriage, both from the Islamic legal aspect and the positive legal aspect, the existence of some people who still carry out unregistered marriages for various reasons. This can prevent problems that can harm one party if the marriage is not recorded. Many people do not understand the importance of registering marriages that have been carried out and the consequences because marriages are not registered

Abstract

The purpose of this study was to determine the legal rules of restorative justice in the settlement of cases of Domestic Violence (KDRT) at the North Sumatra Regional Police. According to Law Number 2 of 2002 concerning the Police and the factors that cause restorative justice to not work. Research on the Settlement of Domestic Violence Cases through Restorative Justice the North Sumatra Police Case Study is a normative legal research. Normative legal research aims to examine library legal materials. In the Domestic Violence Law No. 23 of 2004 which is a criminal act of complaint and the reporter and victim are people who live within the scope of the household, but the law only confirms that there are no criminal provisions prioritizing the settlement of restorative justice for domestic violence which is minor and constitutes a criminal complaint. The concept of restorative justice is another method used to handle criminal cases. This concept prioritizes the integrity of perpetrators, victims and society as a unit to find solutions and return to a good relationship pattern between victims and perpetrators of criminal acts and one way that can be done in this concept is penal mediation.

Abstract

This research focuses on the role of land rent management (BPHTB). Increase in Regional Original Income (PAD) at the Regional Revenue Management Agency (BPPD) of Deli Serdang Regency. The problem of this research is the management of BPHTB with the increase of PAD in the BPPD of Deli Serdang Regency? The purpose of this study is to find out and analyze the management of BPHTB along with increasing PAD at BPPD Deli Serdang Regency in 2021. The method used in this research is a descriptive survey although the design used is a qualitative research design. research results etc. Data processing shows that managing the (BPHTB) in increasing local revenue (PAD) is quite helpful in increasing PAD.

Abstract

This study uses normative legal research using statutory approaches (Statute Approach) and case approaches (Case Approach) and data collection in this study uses library research (Library Research). In this study there are 3 (three) main points of discussion. First, the summons for the General Meeting of Shareholders (GMS) by the shareholders at PT. Mitra Utama Award is in accordance with the provisions of the Limited Liability Company Law. Second, regarding the consideration of the panel of judges, it has fulfilled the principles of legal certainty and justice. Third, the legal consequences of the Board of Directors not holding a General Meeting of Shareholders and violating the fiduciary duty principle where if a loss occurs due to negligence by the Board of Directors, the Board of Directors is fully responsible personally and jointly. For this reason, it is hoped that the settlement of this case is through deliberation efforts and following the regulations in the implementing regulations of Law Number 40 of 2007 concerning Limited Liability Companies.

Abstract

Banking institutions have an important role in economic development with lending activities regulated in credit agreements. In the credit agreement between PT. BRI Agro Niaga Pekanbaru and PT. Sipakko Jaya Abadi with PTPN V there are efforts to secure credit with collateral and cessie required as collateral. This study uses empirical normative legal research methods. The data used include primary, secondary and tertiary data. Collecting data using library research and field research with interviews. Furthermore, the data were analyzed using qualitative data analysis methods. The results of the study indicate that the credit agreement between PT. BRI Agro Niaga Pekanbaru and PT. Sipakko Jaya Abadi has complied with the legal basis in force in Indonesia and the legal relationship that exists between PT. BRI Agro Niaga Pekanbaru as creditor and PT. Sipako Jaya Abadi as the debtor with PTPN V as the third party is PT. Sipakko Jaya Abadi entered into a credit agreement with PT. BRI Agro Niaga Pekanbaru with the aim of financing the work contract with PTPN V. The implementation of the Mortgage Guarantee with the required cessie as collateral is not in accordance with the legal basis and because essentially the cessie is a transfer of receivables. The execution of the guarantee in the credit agreement cannot be carried out on the cessie required as collateral.

Abstract

The existence of the earth cannot be separated from human life, the state is obliged to guarantee and protect the rights of citizens to acquire, own and enjoy property rights over land. However, because land area is determined by the increasing needs of the state's economy, this often creates land disputes as stated in the Supreme Court Decision 1545/K/Pdt/2019, where one party obtains ownership rights to land in good faith. This research is descriptive in nature and uses a normative legal approach. Information obtained through library research (library research). Based on the research results, there are vague indications that fraudulent acts may contain an element of offense under § 531 BGB, namely. H. the buyer knows the defect of the goods, but the buyer still buys the goods and the legal consequences of transferring the property can be canceled and the rights can be returned to the original owner, the buyer can also be punished for all costs, losses and interest incurred. From this it can be concluded that the form of fraud in Decision No. 1545/K/Pdt/2019 because the purchase of goods by Defendant II to Pelawan is invalid because it is no longer the direct owner, so it is appropriate that Pelawan's resistance cannot be accepted because it is against the law.
