Abstract

There is a tug of authority in resolving insurance disputes outside the court between the Consumer Dispute Settlement Agency (BPSK) based on Law Nomor 8 of 1999 concerning Consumer Protection with Alternative Dispute Resolution Institutions (LAPS) based on Financial Services Authority Regulation Number 1/POJK.07/2014. This encourages the author to conduct legal research in order to determine the authority of BPSK in resolving insurance disputes as well as the legal consequences of the decision after the issuance of the Financial Services Authority Regulation Number 1/POJK.07/2014 using the statutory approach. This legal research results in the finding that BPSK is still authorized to settle insurance disputes following the issuance of the Financial Services Authority Regulation Number 1/POJK.07/2014, this is based on the provisions of the Lex superior derogat legi inferiori principle. Then there is no legal effect on the BPSK decision after the issuance of the Financial Services Authority Regulation. This is because BPSK's decision has been based on Law Number 8 of 1999 concerning Consumer Protection, whose position is higher than the Regulation of the Financial Services Authority. So there is no need for BPSK to follow the provisions of the regulations whose hierarchy of legislation is lower than the Consumer Protection Act. Therefore BPSK's decision is "final and binding" as explained in Article 54 paragraph 3 of the Consumer Protection Act.

Abstract

The Supreme Court stipulates Supreme Court Regulation Number 1 of 2019 in the context of reforming case administration and court proceedings to overcome service barriers in court, especially in the implementation of simple, fast and low-cost principles as well as demands for the development of the era of technology and information as well as the challenges of the Covid-19 pandemic. The application of this Supreme Court regulation also known as e-Court which is a service used for administration in the lawsuit process, simple lawsuits, rebuttal requests, payment of court fees, conducting court summons and notifications, trials, decisions, and legal remedies electronically. The results of the study explain that all District Courts in West Sumatra have implemented e-Court, minimized the occurrence of things that harm the parties, made the case process simpler, accelerated the period of the case and suppressed the expenditure of court fees in accordance with the simple, fast and low-cost principle. However, in practice, there are main problems, namely the lack of Human Resources in the use of technology and information.

Abstract

Minangkabau nature which has beauty, diversity of customs, the majority of which are Muslim, has beautiful nature, mountainous destinations and beautiful beaches, which are a halal tourist attraction in Indonesia in general, West Sumatra in particular. As the main destination for world tourists from other Islamic countries such as Malaysia, Dubai and others. Because West Sumatra is one of the halal tourist destinations, and the lowest government in West Sumatra is Nagari, it is interesting to study..This study uses a legal research method with an empirical/sociologicalapproach legal study(socio legal study) and normative (normative legal study ). The results of the study explain that the prospect of halal tourism that can be developed needs to be socialized to the City and Regency Governments and Nagari Nagari which have tourism potential. to be developed and managed by forming policy policies that are sourced from the Nagari Potential which will later give birth to policies that can contribute to Nagari PAD.

Abstract

The judicial process prioritizes legal certainty both in time and minimizes costs for the parties as Law Number 48 of 2009 in Article 2 and Article 4 paragraph (2) requires the existence of important principles in civil procedural law, namely Simple, Fast, Low Cost. Settlement of disputes at the first level with the a quo principle is certainly the hope of the whole community, especially those who want to resolve disputes through the courts, with the application of this principle, it is hoped that the settlement of cases, especially in the civil sector, will not be delayed and can be resolved in a short period of time, so that the costs incurred by the parties are not too high. However, the settlement of civil disputes through a simple trial under examination is regulated in a limited manner with a material claim value of a maximum of Rp. 500,000,000.00 (five hundred million rupiah) preceded by a dismissal process and the settlement period of this case is not more than 25 (twenty five) ) working days. The results of this study explain firstly the application of Perma Number 4 of 2019 procedures for resolving simple lawsuits at the District Court in West Sumatra can run effectively such as providing convenience for parties to access and register simple lawsuits both online and offline, educating Registrars and Judges about simple lawsuits so that can degrade errors (human error), as well as proven by a matrix of cases per year that are decided through a simple lawsuit. Second, the obstacle that often occurs in the process of resolving simple lawsuits is that judges often do not read the lawsuit comprehensively and immediately set a trial day so that when the trial takes place it is proven that the dispute cannot be resolved with a simple lawsuit (there are provisions in Articles 3 and 4 of this Perma). met) and ended up not being able to continue (NO).

Abstract

Penyelesaian perkara melalui lembaga adat dilakukan dengan asas musyawarah atau kekeluargaan untuk menegakkan hukum, dan menghilangkan akibat lanjut dari suatu perkara. Tujuan tertinggi yang ingin dicapai adalah keseimbangan yang terwujud dalam kerukunan masyarakat. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan historis dan perundang-undangan terkait pembuktian dalam penyelesaian sengketa adat pada peradilan adat. Berdasarkan hasil penelitian diketahui Pembuktian dalam peradilan adat dilakukan oleh para pihak yang bersengketa dan peran aktif dari pemuka adat. Dalam peradilan adat penyelesaian sengketanya dilakukan secara damai, sehingga pembuktiannya ada yang dilakukan para pihak dan ada yang dilakukan oleh pemuka-pemuka adat yang memeriksa perkara. Alat bukti yang digunakan adalah alat bukti tertulis (surat), saksi, keterangan para pihak dan perilaku dari para pihak di tengah-tengah masyarakat.

Abstract

Credit policy is a state goal to provide opportunities for the community to build businesses or businesses that have an impact on the nation's economic drive systemically. Banking financial institutions that serve credit financing products as products that are often in demand by customers in order to open a business by offering a prospectus for business activities. The existence of Rural Banks (BPR) has a significant role for local communities in the context of regional economic development. Broadly speaking, the role of BPR is not only in channeling funds to the public, but the bank and its customers work together to build a project through a financing product called profit sharing (dividend). The research method uses normative juridical (doctrinal research) with a qualitative approach, which in processing and analyzing data does not use numbers, symbols, and mathematical variables, but rather an in-depth understanding by reviewing the laws and regulations. The results of the study explain that, Developments in credit policy resulted in a change and were able to overcome the problem of instability in a country. Rural Banks have a policy of limiting credit distribution which is regulated in a regulation in order to achieve a productivity of capital to be distributed. The government through the Job Creation Law is to create an MSME ecosystem that is more integrated with investment and workers (human resources) for the sake of sustainability and the continuity of productive capital distribution. With the people's credit policy, regional creative products can be recognized and provide business opportunities for business actors in the region

Abstract

Beda pendapat atau sengketa dalam konteks bisnis sering terjadi, dan Indonesia memiliki sebuah Lembaga penyelesaian sengketa alternatif yaitu Arbitrase. Menurut pendapat para ahli, Arbitrase merupakan salah satu cara penyelesaian sengketa yang melibatkan pihak-pihak yang bersengketa untuk sepakat dalam memilih hakim atau para hakim yang akan mengambil keputusan, dan para pihak juga harus sepakat untuk menghormati keputusan yang diambil oleh hakim tersebut. Hingga saat ini masih dominannya penyelesaian sengketa para pihak melalui peradilan (litigation) meskipun penyelesaian alternatif sengketa (non-litigation) sudah diatur melalui peraturan perundang-undangan. Implementasi Lembaga Arbitrase berdasarkan prinsip non-litigious minded sebagaimana penyelesaian sengketa secaramusyawarah dan mencari perdamaian para pihak sehingga meminimalisir permusuhan ataupun dendam dari para pihak bersengketa. Permasalahan penelitian ini adalah pertama, Bagaimana Pelaksanaan Penyelesaian Sengketa Bisnis melalui Arbitrase di Indonesia berdasarkan Prinsip Non-Litigious Minded. Kedua, Bagaimana Para pihak Menghormati Putusan Arbitrase Terhadap Penyelesaian Sengketa Bisnis. Penelitian ini menggunakan metode yuridis normative yang dimana menggunakan sumber data penelitian studi kepustakaan yang menggunakan sumber data sekunder seperti dokumen-dokumen resmi, buku, laporan penelitian, skripsi, tesis, disertasi, dan peraturan perundang-undangan yang berkaitan dengan objek penelitian yang sedang diteliti. Abstract

AbstractStructuring the tourism sector is a concern for the Regional Government, especially in West Sumatra, which continues to develop halal tourism as a hall mark of adaik basandi syara’ syarak basandi Kitabullah. The role of the Government of West Sumatra has been seen in structuring Halal Tourism after the issuance of West Sumatera Provincial Regulation concerning Organizing Halal Tourism. Halal tourism is a set of additional services for amenities, attractions and accessibility that are intended and provided to meet the experiences, needs and desires of Muslim tourists and other tourists who need them.West Sumatra part of the preservation of halal products as well as the application of the upholding philosophy of Islamic and customary values as the foundation of the life of the Minangkabau. In implementing halal tourism, the Government of West Sumatra is responsible for developing Halal Tourism business including providing investment incentives, facilitating investment facilities, as well as facilitating infrastructure facilities in implementing Halal Tourism. The results of this study explain that Regional Regulation concerning the Implementation of Halal Tourism in general has been implemented by the government, with so far establishing halal tourism destinations, including the Baso Pagaruyung Palace in Tanah Datar, Twin Lakes in Solok Regency, and the Islamic Center in Padang. The concept of halal tourism is not to prescribe a place, but rather to provide additional services to tourists who prioritize Muslim tourists and other tourists who need it.Keywords: Halal Tourism; Additional Service; Local Economy. AbstrakPenataan sektor wisata menjadi suatu concern Pemerintah Daerah terutama di Sumatera Barat yang terus mengembangkan Wisata halal sebagai ciri khas dari adaik basandi syara’ syarak basandi kitabullah. Peran Pemerintah Sumatera Barat telah terlihat dalam penataan Wisata halal setelah terbitnya Peraturan Daerah Provinsi Sumatera Barat tentang Penyelenggaraan Wisata Halal. Wisata halal sebagai perangkat layanan tambahan amenitas, atraksi, dan aksesibilitas yang ditujukan dan diberikan untuk memenuhi pengalaman, kebutuhan, dan keinginan wisatawan muslim dan wisatawan yang lain yang membutuhkannya. Keberadaan Wisata halal di Sumatera Barat bagian dari pelestarian produk halal sebagaimana penerapan dari junjungan tinggi filosofi Nilai-nilai Islam dan Adat sebagaimana dasar dari pijakan hidup masyarakat MinangKabau. Dalam penyelenggaraan wisata halal, Pemerintah Sumatera Barat bertanggungjawab dalam pengembangan usaha Pariwisata Halal meliputi pemberian insentif investasi, fasilitas kemudahan investasi, serta fasilitas kemudahan infrastruktur dalam pelaksanaan Pariwisata Halal. Hasil penelitian ini menjelaskan bahwa Penyelenggaraan Pariwisata Halal secara umum telah dilaksanakan oleh pemerintah, dengan sejauh ini telah menetapkan destinasi pariwisata halal antara lain yaitu Istana Baso Pagaruyung di Tanah Datar, Danau Kembar Kabupaten Solok, dan Islamic Center di Padang Panjang. Konsep wisata halal ini bukanlah mensyariat suatu tempat, melainkan lebih kepada pelayanan tambahan (addcended service) yang diberikan kepada wisatawan yang di utamakan wisatawan muslim dan wisatawan lain yang membutuhkan.Kata Kunci: Wisata Halal; Pelayanan Tambahan; Ekonomi Lokal.

Abstract

The role of technology in everyday life has become more sufficient. This technology results in digitalization which gives rise to digital assets that later become crypto assets that use blockchain technology to store data. The development of these crypto assets presents a technology called Non-Fungible Token (NFT) which is a technology linked to a work of art or other digital assets that serves to protect the artwork or digital assets and as proof of ownership. NFT presents a new way for artists to sell their art more safely and avoid harmful actions. However, the widespread use of NFT technology has created a problem due to the lack of legality regarding NFT. The formulation of the problems discussed in this thesis are: 1. What is the legal certainty for digital assets in the form of Non-Fungible Tokens (NFT) on the Opensea digital platform? 2. What is the legality of Smart Contracts in each transaction of Non-Fungible Token (NFT) through the Opensea digital platform? The research method used is a normative juridical research method, taking a statutory approach and having a descriptive-analytical nature. From the results of this research, can be seen that NFT has not been clearly regulated in Indonesian positive law, resulting in a legal vacuum. Regulations regarding Crypto are regulated by Bappebti as the governing body. Bappebti itself has not specifically regulated NFT regulations in Bappebti regulations. Besides that, other arrangements are seen through the Civil Code which regulates NFT as an intangible object ITE Law which regulates the implementation of the transaction. And regarding the protection of its Intelectual Property Rights through the Copyright Law. Then regarding the validity of the Smart Contract in Non-Fungible Token (NFT) transactions it is considered valid in Indonesian positive law based on the Pacta sunt servanda principle and must be based on the compliance of Article 1320 of the Civil Code.
