Abstract

The research focused on the importance of the establishment of special courts within the Religious Courts in the settlement of sharia economic disputes, and the legal construction of the establishment of a special syariah economic court within the Religious Courts. The results of research: First,the establishment of a special syariah economic court within the Religious Courts can achieve efficiency and professional realization so that the belief of sharia economic community towards the Religious Courts is realized. Second,the construction of the special law court of Islamic law within the Religious Courts is the 1945 Constitution and Law Number 48 Year 2009 on Judicial Power, and the position within the Religious Courts under the Supreme Courtin accordance with Law No. 3 of 2006 on Amendment to Law Number 7 of 1989 concerning Religious Courts jo Law Number 50 Year 2009 concerning Second Amendment to Law Number 7 Year 1989 on Religious Courts. DOI: 10.15408/ajis.v17i2.6082

Abstract

There is a tug of authority in resolving insurance disputes outside the court between the Consumer Dispute Settlement Agency (BPSK) based on Law Nomor 8 of 1999 concerning Consumer Protection with Alternative Dispute Resolution Institutions (LAPS) based on Financial Services Authority Regulation Number 1/POJK.07/2014. This encourages the author to conduct legal research in order to determine the authority of BPSK in resolving insurance disputes as well as the legal consequences of the decision after the issuance of the Financial Services Authority Regulation Number 1/POJK.07/2014 using the statutory approach. This legal research results in the finding that BPSK is still authorized to settle insurance disputes following the issuance of the Financial Services Authority Regulation Number 1/POJK.07/2014, this is based on the provisions of the Lex superior derogat legi inferiori principle. Then there is no legal effect on the BPSK decision after the issuance of the Financial Services Authority Regulation. This is because BPSK's decision has been based on Law Number 8 of 1999 concerning Consumer Protection, whose position is higher than the Regulation of the Financial Services Authority. So there is no need for BPSK to follow the provisions of the regulations whose hierarchy of legislation is lower than the Consumer Protection Act. Therefore BPSK's decision is "final and binding" as explained in Article 54 paragraph 3 of the Consumer Protection Act.

Abstract

Dasar hukum perkawinan yaitu undang-undang nomor 1 Tahun 1974 poin c, mewajibkan seorang mantan suami untuk memberikan nafkah muth’ah, nafkah iddah, dan nafkah madhiyah kepada mantan istrinya. Hal tersebut berguna untuk menentukan besarnya pemberian nafkah yang akan diberikan kepada mantan istri sebelum sidang talak diucapkan. Berdasarkan latar belakang tersebut, dapat dirumuskan permasalahan yang diteliti yaitu pertimbangan hakim sebagai dasar pertimbangan didalam pemberian nafkah akibat cerai talak. Dalam penelitian penulis melakukan pendekatan yuridis empiris dan bersifat deskriptif analitis, yaitu dengan cara mengumpulkan hasil wawancara maupun studi dokumen. Berdasarkan hasil penelitian yang penulis temui, didalam memerintahkan pemberian nafkah, hakim memiliki dasar pertimbangan dengan melihat dari kesanggupan dan kemampuan suami. Apabila mantan istri (penggugat rekonvensi atau termohon) meminta nafkah pasca cerai serta nafkah anak tidak sesuai dengan kesanggupan mantan suami, maka hakim memiliki pertimbangan tersendiri untuk hal tersebut. Tujuan dari kebijakan tersebut untuk memberikan perlindungan hak dan keadilan bagi istri yang ditalak suaminya.

Abstract

The causes of the still high stunting rate in Indonesia are very complex. This includes the Indragiri Hilir Regency. The number of cases of stunting that is the cause is more to do with economic problems and poor families. based on data from the Health Service (Diskes) the stunting rate in Inhil still reaches 3.15 percent. Therefore, appropriate steps are needed to reduce and prevent stunting, one of which is by distributing zakat to families affected by stunting. However, this needs to be studied according to Islamic law, are those affected by stunting the party (group) entitled to receive zakat? This research is normative legal research. With secondary data in the form of primary legal materials, secondary legal materials, and tertiary legal materials with qualitative data analysis by drawing deductive conclusions. The results of the study show that in Islamic law there are eight asnab (classes) who are entitled to receive zakat, namely 1. Fakir 2. Poor 3. 'Amilin (zakat manager) 4. Muallaf. 5). Riqab (slave), 6). Gharimin (People who are in debt), 7). Sabilillah (people who fight in the way of Allah), 8). Ibn Sabil. Of the eight groups referred to by residents in Indragiri Hilir who are affected by stunting, they are included in the poor category, so according to Islamic law, they are entitled to receive zakat. Penyebab masih tingginya angka stunting di Indonesia sangat kompleks. Termasuk juga di Kabupaten Indragiri Hilir Banyaknya kasus-kasus terjadinya stunting yang menjadi penyebabnya lebih kepada persoalan ekonomi dan keluarga yang tidak mampu. berdasarkan data Dinas Kesehatan (Diskes) angka stunting di Inhil masih mencapai angka 3,15 persen. Oleh karena itu perlu langkah-langkah yang tepat guna menurunkan dan mencegah terjadinya stunting salah satunya dengan penyaluran zakat kepada keluarga yang etrdampak stunting. Namun hal tersebut perlu dikaji menurut hukum Islam apakah mereka yang terdampak stunting merupakan pihak (golongan) yang berhak menerima zakat?. Penelitian ini merupakan penelitian hukum normatif. Dengan data-data sekunder berupa bahan hukum primer, bahan hukum sekunder, bahan hukum tersier dengan analisa datanya berupa kualitatif dengan menarik kesimpulan secara deduktif. Hasil penelitian bahwa dalam hukum Islam ada delapan asnab (golongan) yang berhak menerima zakat yaitu 1.Fakir 2. Miskin 3. ‘Amilin (Pengelola zakat) 4. Muallaf. 5). Riqab (budak), 6). Gharimin (Orang yang dililit hutang), 7). Sabilillah (orang yang berperang di jalan Allah), 8). Ibnu Sabil. Dari delapan golongan yang dimaksud warga yang ada di Indragiri Hilir yang terdampak stunting merupakan mereka yang termasuk dalam kategori miskin, maka menurut hukum Islam mereka berhak menerima zakat.

Abstract

Perkawinan merupakan suatu hal yang penting dalam kehidupan manusia, dari perkawinan tersebut seseorang akan dapat memperoleh keseimbangan baik secara biologis, psikologis, maupun sosial. Menurut Undang-Undang Nomor 1 Tahun 1974, yang dimaksud dengan ikatan jasmani dan rohani antara seorang pria dan seorang wanita sebagai suami istri untuk membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Lahirnya Undang-Undang Nomor 16 Tahun 2019 tentang perubahan atas Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan yang mengatur bahwa usia perkawinan bagi laki-laki dan perempuan adalah 19 tahun tentunya akan menambah jumlah permohonan dispensasi perkawinan di bawah umur di Pengadilan Agama. . Tulisan ini dibuat dalam bentuk tulisan yuridis empiris (hukum sebagai realitas sosial, budaya, atau das sein). Dari hasil penelitian penulis, faktor pendorong untuk mengajukan dispensasi nikah antara lain pertama, faktor ekonomi, kedua, faktor pendidikan orang tua, ketiga, hubungan biologis, dan keempat, kehamilan di luar nikah. Pengadilan Agama Klas IB Tanjung Pati telah mengimplementasikan Undang-Undang Nomor 16 Tahun 2019. Berlakunya undang-undang tersebut ibarat pisau bermata dua, di satu sisi undang-undang menginginkan pendidikan yang layak bagi anak, dan di sisi lain menyangkut kebutuhan komunitas.

Abstract

Indonesia is a country that has ethnic and cultural diversity, this becomes an advantage as well as a weakness if the government is not able to develop rules and policies that represent the needs of its citizens.This can be seen in the system of inheritance distribution in Indonesia which adheres to three systems of inheritance law, namely Customary Inheritance Law, Islamic Inheritance Law and Indonesian Civil Inheritance Law. The legal system of heirs is influenced by the kinship system owned by a region. Indonesia knows 3 (three) kinship systems, namely matrilineal, patrilineal and parental kinship systems. The matrilineal kinship system sees the maternal lineage, the patrilineal kinship system sees the paternal lineage, and the parental kinship system sees the maternal and maternal lineage. The Minangkabau are a growing tribe in West Sumatra Province, where the people adopt a matrilineal kinship system, a kinship system and the Inheritance is inherited according to the lineage of the Mother. This means that boys and girls and their families, including racism mother, who inherited the property. Basic on decision No 292 / K / Ag / 2019 that the origin of the land on the decision proved to be the executor of Appeal, but still devolved court Religion. This is contrary to the West Sumatra Regional Regulation No. 16 of 2008 Article 12 paragraph 2 on Ulayat Land and its Use, if the peace decision is not accepted by the disputing party as referred to in paragraph 1 then the disputing parties may take the matter to the District Court. It is clear that the regulation states that the Religious Court does not have the authority to examine and adjudicate matters a quo. Inheritance of High Estate in Minangkabau is only regulated in the provisions of customary law which sometimes when there is a dispute over the division of heirs of High Estate, often overrides the provisions of customary law in resolving disputes so that in its application some rules even make the essentials of High Estate reduced or even lost.

Abstract

Waqf is known as an asset of the people that can be utilized at all times. However, the productive management and development of waqf assets for social welfare has yet to be realized optimally. The enactment of Law No. 41 of 2004 concerning waqf has become a momentum to realize waqf productively. The waqf foundation Ar-Risalah and Persyarikatan Muhammadiyah which acts as nazhir waqf has the duty and responsibility to manage and develop waqf assets from wakif to productive ones. The research method used in this study uses empirical juridical research method. Based on research that productive waqf management implemented by the Ar-Risalah waqf foundation is by empowering plantations such as oil palm, banana and coconut plantations as well as renting shops, mini markets and renting waqf houses. Whereas the management of productive waqf by the Muhamadiyah Association is in the form of increasing the value of waqf assets by utilizing the functions of buildings such as the Muhammadiyah Taqwa Mosque and Muhamadiyah Dakwah Building which stand on waqf land to be developed into rental shops as a place to sell and use excess land to gain profits from renting parking spaces. The efforts of the Ar-Risalah Wakaf Foundation in developing waqf assets to become productive waqf for social welfare by managing waqf assets to be used as a source of income, one of which is by investing in the development of waqf land. Meanwhile, the efforts of Persyarikatan Muhamadiyah to form a cash waqf body as a form of management and development in a productive direction. The form of increasing social welfare carried out by nazhir waqf is by carrying out social empowerment, such as providing a place of business to be used as a place to open a business by the local community.

Abstract

The implementation of SDGs is in line with the principles of Islamic teachings that prohibit destruction on earth (ifsad fil-ardhi), both physical damage and non-physical damage.  In addition, the principle of sustainability, in accordance with Maqashid Sharia by maintaining religion, preserving the soul, maintaining  reason, or nurturing offspring, and maintaining property. The application of Islamic economics and finance is no different from the SDGs. The role of Islamic economy and finance strengthens the target of SDGs, one of which is by implementing Value Based Intermediation (VBI).Value Based Intermediation (VBI) aims to reorient the business model of Islamic finance with the aim of realizing the objectives of sharia so that it can generate positive and sustainable impacts for the economy, society, and the environment through practices, processes, offers, and behaviors. Value-based intermediation (VBI) aims to deliver the desired outcomes of Sharia through practices, behaviours and offerings that generate positive and sustainable impacts on society, economy, community and environment, consistent with sustainable shareholder benefits as well as long-term interests. VBI also emphasizes on minimizing and preventing negative impacts arising from the practices, behaviors, and offerings of the Islamic banking industry.The expected results of Sharia focus on improving people's welfare through the preservation of people's wealth, faith, life, offspring, and intelligence in accordance with the maqasid of Sharia. In the context of Islamic finance business, one of which is Islamic banking focuses on encouraging to generate, accumulate, and distribute wealth fairly.

Abstract

This study aims to determine the causal-comparative relationship between the variable of APBD grant funding assistance and BAZNAS management performance. This study involved all BAZNAS in West Sumatra Province selected by total sampling with data sourced from PuskasBAZNAS publication. Simple linear regression analysis tested the comparative causal relationship between the two variables. The research show that the variable of APBDfunding does not affect to the management performance of BAZNAS in West Sumatra Province, but it is influenced by other factors, such as leadership, employees and organisational culture, availability of financial resources, governance, policies and strategies, technology utilisation, muzakki trust in BAZNAS, transparency and accountability, and local cultural values. The implication of this research is as a basis for future local government policy considerations in allocating APBD grant funding assistance, and for BAZNAS efforts to improve the efficiency and effectiveness of BAZNAS in zakat management.

Abstract

A mixed marriage will bring legal consequences to the parties who do it, namely related to property in the marriage. The joint assets formed during the marriage are not only located in the territory of Indonesia, but also located abroad (Singapore). This study examines the position of joint assets in mixed marriages located outside the territory of Indonesia who filed for divorce and property claims in the District Court. The purpose of this article, which is based on the results of this research, aims to determine legal certainty regarding the status of joint property in mixed marriages located abroad (Singapore) based on Decision No. 552 / Pdt.G/2013/PN.Dps) by Judge. The research method used in this study is a normative legal research method with a source of law, namely statutory regulations. The research method used is a normative juridical approach. Research specifications use analytical descriptive and data sources use secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. Materials from the results of this study indicate that joint assets located abroad (Singapore) are subject to the Indonesian Judge's decision. In the eligibility conditions in the Strata Title rules that apply in Singapore, the holder of a Permanent Resident permit has the right to transfer or sell property located in that country.
