Abstract

The judicial process prioritizes legal certainty both in time and minimizes costs for the parties as Law Number 48 of 2009 in Article 2 and Article 4 paragraph (2) requires the existence of important principles in civil procedural law, namely Simple, Fast, Low Cost. Settlement of disputes at the first level with the a quo principle is certainly the hope of the whole community, especially those who want to resolve disputes through the courts, with the application of this principle, it is hoped that the settlement of cases, especially in the civil sector, will not be delayed and can be resolved in a short period of time, so that the costs incurred by the parties are not too high. However, the settlement of civil disputes through a simple trial under examination is regulated in a limited manner with a material claim value of a maximum of Rp. 500,000,000.00 (five hundred million rupiah) preceded by a dismissal process and the settlement period of this case is not more than 25 (twenty five) ) working days. The results of this study explain firstly the application of Perma Number 4 of 2019 procedures for resolving simple lawsuits at the District Court in West Sumatra can run effectively such as providing convenience for parties to access and register simple lawsuits both online and offline, educating Registrars and Judges about simple lawsuits so that can degrade errors (human error), as well as proven by a matrix of cases per year that are decided through a simple lawsuit. Abstract

The role of technology in everyday life has become more sufficient. This technology results in digitalization which gives rise to digital assets that later become crypto assets that use blockchain technology to store data. The development of these crypto assets presents a technology called Non-Fungible Token (NFT) which is a technology linked to a work of art or other digital assets that serves to protect the artwork or digital assets and as proof of ownership. NFT presents a new way for artists to sell their art more safely and avoid harmful actions. However, the widespread use of NFT technology has created a problem due to the lack of legality regarding NFT. The formulation of the problems discussed in this thesis are: 1. What is the legal certainty for digital assets in the form of Non-Fungible Tokens (NFT) on the Opensea digital platform? 2. What is the legality of Smart Contracts in each transaction of Non-Fungible Token (NFT) through the Opensea digital platform? The research method used is a normative juridical research method, taking a statutory approach and having a descriptive-analytical nature. From the results of this research, can be seen that NFT has not been clearly regulated in Indonesian positive law, resulting in a legal vacuum. Regulations regarding Crypto are regulated by Bappebti as the governing body. Bappebti itself has not specifically regulated NFT regulations in Bappebti regulations. Besides that, other arrangements are seen through the Civil Code which regulates NFT as an intangible object ITE Law which regulates the implementation of the transaction. And regarding the protection of its Intelectual Property Rights through the Copyright Law. Then regarding the validity of the Smart Contract in Non-Fungible Token (NFT) transactions it is considered valid in Indonesian positive law based on the Pacta sunt servanda principle and must be based on the compliance of Article 1320 of the Civil Code.

Abstract

Perbankan merupakan salah satu industri jasa keuangan yang memegang peranan penting dalam hal meningkatkan kegiatan perekonomian. Perkembangan ekonomi justru memaksa perbankan untuk terus melakukan inovasi terutama ke ranah digitalisasi. Era digitalisasi telah menempatkan peran teknologi informasi dan komunikasi di pada posisi yang amat strategis karena menghadirkan suatu dunia tanpa batas, jarak, ruang, dan waktu, yang berdampak pada peningkatan produktivitas dan efisiensi. Pengaruh globalisasi dengan penggunaan sarana teknologi informasi dan komunikasi telah mengubah pola hidup masyarakat, dan berkembang dalam tatanan kehidupan baru serta mendorong terjadinya perubahan sosial, ekonomi, budaya, keamanan, dan penegakan hukum. Tingkat keamanan Bank Digital tersebut masih menjadi pertanyaan, bentuk pengawasan pada uji dan standar pelaksanaan dibutuhkan guna menghindari hal-hal yang dapat merugikan berbagai pihak. Penelitian ini akan menjawab permasalahan hukum untuk menemukan suatu solusi demi kepentingan nasabah yaitu, pertama Penelitian ini menggunakan metode penelitian hukum (doctrinal research) dengan pendekatan undang-undangan (statue approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian ini menjelaskan bahwa Perlindungan nasabah atas layanan perbankan digital dapat dilakukan dengan mencegah atau menanggulangi keadaan yang tidak diharapkan nantinya oleh nasabah yang masih berdasarkan ketentuan perlindungan nasabah perbankan digital masih sama dengan perbankan konvensional. Upaya hukum nasabah pada bank digital tidak ada perbedaan dan sama seperti penyelesaian sengketa konsumen pada bank umum lainnya yang telah diatur. Pengembalian nilai kerugian terhadap nasabah bank digital masih mengacu pada ketentuan Pasal 7 huruf f UU Nomor 8 Tahun 1999 yang menjelaskan bahwa “pelaku usaha berkewajiban untuk memberi kompensasi, ganti rugi, dan/atau penggantian atas kerugian akibat penggunaan, pemakaian, dan pemanfaatan barang dan/atau jasa yang diperdagangkan.

Abstract

Marriage in society many occur without registration by the state, or known marriages have not been registered. According to The Domestic Affairs Minister Number 108 Year 2019 regarding the terms and regulations of the registration of the population and the civil record of married couples who have no record of marriage books can also record marriages in the occupational and civil record service by signing a waivement of marriage responsibilities. The purpose of this study is to find out the mechanisms and consequences of the law of issuing family cards for unregistered married couples using a letter of absolute liability based on The Domestic Affairs Minister Number 108 Year 2019. Research using normative juridical method with the nature of descriptive analysis research. The results of this study explain that violations ways to make a new family card for unregistered married couples must complete the requirements of filling the form F1.05 or A letter of absolute liability of marriage/divorce has not been registered and known by two witnesses and attaching a letter marriage has not been registered. Second, The legal result of publishing a family card for a married couple has not been recorded using a a letter of absolute liability based on Domestic affairs minister number 108 year 2019. In general, the increase in marriage practice has not been registered, Increased application for marriage books through the validation path, Increased demand for marriage confirmation, It also affects wife and children.
