Abstract

This research discusses the use of coconut coir waste into flower pots to support the economy of the residents of Pengalihan Village in the era of the Covid-19 pandemic. The main income of the majority of the people of Pengalihan Village is from coconut plantations. As for what people produce from coconut plantations, only round coconut, white copra, and shell charcoal are produced, but currently the selling price of coconut has decreased slightly so that it affects people's income. Actually, the utilization of the results of the coconut plant is very large, one of which is from the coir itself. This study concludes that the use of coconut coir waste is very effective and can be an alternative choice to support the economy of the Pengalihan Village community in the Covid-19 Pandemic era. Coconut coir waste is one of the easily obtained biomass and is a by-product of agriculture. Coconut coir waste has the potential to be used as flower pots because it contains cellulose which in its molecular structure contains a carboxyl group and lignin which contains phenolic acid which is needed for plants.

Abstract

Dalam sistem peradilan pidana di Indonesia, sedangkan induk perundang- undangan pidana formil (hukum acaranya) adalah Kitab Undang Undang Hukum Acara Pidana (KUHAP). Unsur ketiga dalam sistem hukum adalah Kultur hukum yakni kebiasaan atau budaya masyarakat yang menyertai dalam penegakan hukum. Kultur hukum tersebut berada pada masyarakat maupun pada aparat penegak hukum. Civil law system merupakan sebuah sistem hukum, yang mana memiliki aturan hakim tidak boleh terikat kepada presedent, sehingga undang-undang menjadi sumber utama hukum pidana menerapkan ultimatum remedium dalam penegakan hukum pidana. penerapan hukum haruslah dipandang dari 3 dimensi. Instrument yang dibutuhkan dalam penegakan hukum meliputi struktur hukum “legal structure”, substansi hukum “legal substance” dan budaya hukum “legal culture” Ultimum remedium merupakan salah satu asas yang terdapat di dalam hukum pidana Indonesia yang menyatakan bahwa hukum pidana hendaklah dijadikan upaya terakhir dalam hal penegakan hukum.

Abstract

ABSTRACT This paper is intended to examine the impact of Maqashid Shari'ah in Ijtihad. Maqashid Syari'ah was originally a sub-discussion in the study of Ushul Fiqh. But now Maqashid Shari'ah has its own study. Likewise with Ijtihad which is part of the discussion of Ushul Fiqh. Usul Fiqh experts usually put the discussion of Ijtihad at the end of each of their works. This does not indicate that the study of Ijtihad is not important compared to other studies. This is because ijtihad is the conclusion of all the discussions in ushul fiqh. Ijtihad is an effort made by experts in Islamic law to explore laws that do not have clear arguments from sources of Islamic law. Those who perform Ijtihad are called Mujtahid. To achieve this goal, this article begins with a discussion of the meaning of Maqashid Shari'ah and its benefits, the meaning of Ijtihad and its urgency. The Maqashid impact in Ijtihad. The danger of an excessive Maqashid approach in Ijtihad without paying attention to the rules that have been set. The method used in writing this article is a literature review method by reviewing and referring directly to primary and secondary references in the study of Maqashid and Ijtihad. Keywords: Maqashid Syari’ah, Ijtihad, and Syari’ah.

Abstract

Perangkat desa adalah pejabat pelayan publik, mereka dituntut untuk menjalankan tugasnya melayani masyarakat. Didalam Pasal 50 Ayat (1) Undang-Undang Nomor 6 Tahun 2014 tentang Desa menyatakan bahwa Perangkat Desa harus berpendidikan minimal tamatan SLTA/sederajat. yang jadi permasalahan, bahwa masih banyak perangkat desa di Desa tempat penelitian ini (Pasir Emas Kecamatan Batang Tuaka) yang tidak memiliki pendidikan seperti yang dimaksud. Namun demikian, Perangkat Desa yang bukan lulusan SMA/sederajat masih bisa bertugas sampai masa jabatannya berakhir. Jadi tidak benar Perangkat Desa yang lulus di bawah tingkat SMA harus mundur atau diberhentikan saat ini juga. Pasal 50 ayat (1) Undang-Undang Republik Indonesia Nomor 6 Tahun 2014 tentang Desa memang mensyaratkan pendidikan paling rendah bagi perangkat desa ialah tingkat SMA. Akan tetapi, di Undang-Undang tersebut terdapat ketentuan peralihan yang menyebutkan bahwa perangkat desa yang diangkat sebelum ditetapkan Undang-Undang ini masih tetap melaksanakan tugasnya, sampai habis masa tugas berdasarkan surat keputusan pengangkatannya.

Abstract

This paper examines the contemporary ijtihad methodology from the perspective of a well-known Islamic law expert from the Middle East, Yusuf Al-Qardhawi through his writing entitled Al-Ijtihad fi al-Shari'at al-Islamiah ma'a Nazharat Tahliliyah fi al-Ijtihadi al-Mu. 'ashir (Ijtihad in Islamic Shari'ah: Focus on Contemporary Ijtihad Analysis). The research method used in this paper is a literature review method by directly referring to primary sources with direct analysis of the books written above as well as studies or opinions of other figures regarding the book. In this study it was found that Yusuf Al-Qardhawi offered three contemporary ijtihad concepts, namely, Intiqa'i/tarjihi ijtihad, Insha'i ijtihad, and ijtihad which integrates both Intiqai and Insha'i methods.

Abstract

 The death association of Al-Ikhlas referred to above is a group of people formed to achieve a common goal. Where the purpose of forming the Al-Ikhlas death association is to help members who are members of it in the event of death. This association provides compensation in the form of funds obtained through the contributions of each member to families who have died in order to make it easier for the family to organize the management of the remains. The Al-Ikhlas Death Association was founded in 2015 which was initiated by one of the religious leaders on Jl. H. Arief Tembilahan Hulu. Untilnow, the Al-Ikhlas death association has 284 members. This research was conducted to understand and examine the implementation of Islamic Inheritance Law in the Al-Ikhlas death association Jln. H. Arief Tembilahan Hulu, 2022. The type of research applied is empirical legal research (socio-legal) or sociological jurisprudence. Based on the results of the research, it was found that in the communion community with the death of Al-Ikhlas Jln. H. Arief Tembilahan Hulu, in 2022 the law of inheritance explains that there is an impact of Islamic inheritance law on the inheritance law of the fellowship of Al-Ikhlas's death Jln. H. Arief Tembilahan Hulu, 2022. Its application in the Al-Ikhlas death fellowship community Jln. H. Arief Tembilahan Hulu, in 2022 he has implemented the provisions contained in the Islamic Inheritance Law.

Abstract

AbstractMarriage is a means of social and divine interaction. Islam strongly recommends that marriage relations must be accompanied by an element of equivalence or harmony. One of the elements of equivalence or harmony is in terms of religious beliefs. This research was conducted with the aim of knowing (1) how is the view of Islamic law in addressing interfaith marriages between Muslims and non-Muslims; (2) what are the social impacts of interfaith marriages between Muslims and non-Muslims. This research is a type of library research, by examining and reviewing sources from books and literature related to the issues discussed, or other supporting sources. The final conclusion of this study: First, interfaith marriages between Muslims and non-Muslims when viewed from the perspective of Islamic law can be divided into four categories, along with their respective laws. Second: regarding what is meant by Ahlul Kitab women who are allowed to marry Muslim men, there are many differences of opinion among scholars, there are some who forbid it on the grounds that Ahlul Kitab are also polytheists, but the majority of scholars still allow it, some allow it with conditions and there are also allowed it unconditionally. Third: it is permissible for a Muslim man to marry a Biblical woman with the intention that he is able to influence his wife and children to embrace Islam, because he tends to have power. Fourth: If viewed from a benefit perspective, the marriage of a Muslim man to a Muslim woman who is muhshanah at the moment is Indonesian scholars, especially through the fatwa of the Indonesian Ulema Council (MUI) forbidding this marriage. The social impact of interfaith marriages between Muslims and non-Muslims will harm the values of Islamic religious teachings, and will greatly affect the domestic life between husband and wife as well as the process of education and upbringing of their offspring.

Abstract

Every life in the world will surely end in death. The death of a human being will result in an exchange of property rights from someone who has died (deceased) for his living heirs, an exchange of registered property rights in the form of animate assets or inanimate assets. With this commonly referred to as inheritance. Indonesia is the country with the largest Muslim population in the world. As Muslims, it has become an obligation to be close to Islam by understanding and studying provisions in Islamic law, including the method of inheritance distribution. But do people still understand and use Islamic inheritance laws in dividing their inheritance at this time? The method used by researchers in this study is empirical legal research or legal sociology, which is descriptive qualitative in nature. This research intends to describe or interpret a case seriously and is done by gathering as much information as possible. In writing this article, the writer can conclude that, the people of Dusun Sawit, Suhada Village, Enok District, Indragiri Hilir Regency, it turns out that the majority of the people do not understand Islamic inheritance law.

Abstract

This research is a type of library research, by examining sources from books and literature related to the issues discussed, or other supporting sources. With the focal point of Imam Shafi'i's Ijtihad, known as qaul qadim and qaul jadid in a review of the history and sociology of Islamic law. The conclusion in this study is that the two styles of Imam Syafi'i's ijtihad, both qaul qadim and qaul Jadid, according to some contemporary researchers, conclude that social condition factors have an influence on Islamic legal considerations contained in the fatwa resulting from a different ijtihad or a change in fatwa caused by considerations of reality. Social studies show that the determination of Imam Shafi'i's law is very sociological. Although this assumption is not agreed upon by some researchers. They denied that the different environmental conditions between Iraq and Egypt were not the cause of the emergence of qaul jadid, but that the difference in fatwas was partly due to Imam Syafi'i's growing knowledge with the discovery of hadiths that he had not previously encountered. Although they do not deny that social factors in society can influence the outcome of an ijtihad if it is related to the field of muamalah which is based on zhanni arguments such as masalahah or urf. But not in the field of worship which is based on qath'i. texts.

Abstract

This paper analyzes the role of maqashid al-syariah by maintaining five main points in relation to sexual violence and promiscuity that occurs in society. To find the answer to the analysis, the library research method was used by reviewing and referring directly to primary and secondary references in the study of Maqashid Syari'ah. The results of the analysis show that maqashid al-syariah has a role in maintaining five main things to review as a preventive in sexual violence and promiscuity. Maqashid al-Sharia is a concept that emphasizes the purpose of establishing Islamic law in an effort to maintain the benefit of human life, with the aim of bringing benefits and avoiding harm. To maintain the continuity and dynamism of Islamic Shari'a in the present context, maqashid al-Sharia is absolutely necessary.
