Abstract

Pengabdian ini dilakukan dengan judul Sosialisasi Hukum Tentang Peranan PPAT Dalam Pendaftaran Hak Milik Atas Tanah Di Kampung Asei Besar Distrik Sentani Timur Kabupaten Jayapura, kegiatan yang dilakukan kepada mitra dikarenakan adanya kasus dari mitra tentang ketidakpahaman mengenai Pejabat Pembuat Akta Tanah (PPAT) dalam hal pendaftaran hak milik atas tanah untuk menjamin kepastian hukum, sehingga dengan keahlian yang dimiliki pengabdi dapat melakukan sosialisasi hukum tersebut dengan tujuan untuk memberikan pemahaman dan pengetahuan kepada mitra atas peranan PPAT dalam pendaftaran hak milik atas tanah untuk menjamin kepastian hukum serta memberikan pendampingan hukum kepada mitra dalam hal pendaftaran hak milik atas tanah. Metode pelaksanaan pengabdian ini dilakukan dengan cara penerapan IPTEKS melalui ceramah dan diskusi yang dilaksanakan pada hari sabtu, tanggal 29 juli 2023 yang dilaksanakan di Balai Kampung Asei Besar. Kegiatan ini di awali dengan persiapan dan koordinasi, kemudian pemaparan materi dengan memberikan pengetahuan kepada mitra mengenai peranan PPAT dalam pendaftaran hak milik atas tanah. Adapun luaran dari pengabdian ini adalah memberikan pemahaman dan pengetahuan kepada mitra tentang peranan PPAT dalam pendaftaran hak milik atas tanah berdasarkan peraturan perundang-undangan yang berlaku dan faktor-faktor yang dialami oleh PPAT sehingga mengalami keterlambatan dalam pendaftaran hak milik atas tanah.

Abstract

Pengabdian ini dilakukan dengan judul Penerapan IPTEKS tentang gunanya sertifikat hak atas tanah untuk menjamin kepastian hukum bagi masyarakat di Kelurahan Koya Barat Distrik Muara Tami Kota Jayapura, kegiatan yang dilakukan kepada mitra dikarenakan adanya kasus dari mitra tentang ketidakpahaman mengenai prosedur pembuatan sertifikat hak milik atas tanah sehingga dengan keahlian yang dimiliki pengabdi dapat melakukan penerapan IPTEKS tersebut guna agar mitra dapat mengetahui status kepemilikan tanah mereka dan cara pengurusan sertifikat hak milik atas tanah pada Kantor Pertanahan Kota Jayapura untuk menjamin kepastian hukum. Metode pelaksanaan pengabdian ini dilakukan dengan cara penerapan IPTEKS melalui ceramah dan diskusi yang dilaksanakan pada hari rabu, tanggal 26 juli 2023 yang dilaksanakan di Kantor Kelurahan Koya Barat. Kegiatan ini di awali dengan persiapan dan koordinasi, kemudian pemaparan materi dengan memberikan pengetahuan kepada mitra mengenai prosedur pengurusan sertifikat hak milik atas tanah. Adapun luaran dari pengabdian ini adalah memberikan pemahaman kepada mitra tentang status kepemilikan hak-hak atas tanah, pendaftaran tanah, prosedur pengurusan sertifikat hak milik atas tanah dan juga memberikan pendampingan hukum pra ajudikasi dalam proses pengurusan sertifikat pada Kantor Pertanahan Kota Jayapura. Selain itu juga target luaran berikutnya pengabdi akan publikasikan kegiatan ini kedalam jurnal nasional pengabdian masyarakat.

Abstract

Abstract

Pengabdian ini dilakukan dengan judul Penyuluhan Hukum Terhadap Peraturan Menteri Agraria/KBPN Nomor 5 Tahun 1999 Tentang Pedoman Penyelesaian Masalah Hak Ulayat Masyarakat Hukum Adat Di Kampung Nendali Distrik Sentani Timur Kabupaten Jayapura, kegiatan ini dilakukan kepada mitra dikarenakan adanya kasus dari mitra tentang ketidakpahaman mengenai penyelesaian sengketa tanah ulayat berdasarkan peraturan perundang-undangan yang berlaku dan dimana para pihak yang bersengketa tidak ada yang mau mengalah atau mau menang sendiri sehingga dengan keahlian yang dimiliki pengabdi dapat melakukan penyuluhan hukum tersebut guna agar para pihak yang bersengketa dapat mengetahui tentang adanya peraturan perundang-undangan yang mengatur dalam penyelesaian masalah hak ulayat masyarakat hukum adat. Metode pelaksanaan pengabdian ini dilakukan dengan cara penerapan IPTEKS melalui ceramah dan diskusi yang dilaksanakan pada hari sabtu, tanggal 22 juli 2023 yang dilaksanakan di Balai Kampung Nendali dengan memberikan pengetahuan kepada mitra tentang pedoman penyelesaian masalah hak ulayat masyarakat hukum adat. Adapun luaran dari pengabdian ini adalah memberikan pemahaman kepada mitra tentang hal-hal yang menyebabkan sengketa tanah ulayat antar kampung yang satu dengan kampung yang lain dan melakukan pendampingan hukum kepada mitra untuk penyelesaian sengketa batas tanah ulayat didalam masyarakat hukum adat berdasarkan peraturan perundang-undangan yang berlaku. Abstract

This research aims to determine the application of the principle of delimitation contradiction at the Jayapura City Land Office and to determine the resolution of land disputes resulting from the non-implementation of the principle of delimitation contradiction at the Jayapura City Land Office. The research method used is normative juridical and empirical, namely an approach that refers to statutory regulations, library materials, written regulations or other secondary legal materials and looks at their application through field research. The results of this research reveal that the application of the Delimitation Contradiction Principle at the Jayapura City Land Office can actually work well, but if it is related to technical problems in previous maps such as old registration maps that have been lost or have been damaged, there are often overlaps or overlapping plots of land and also what often happens in the field is that the bordering party is not present so BPN entrusts a sheet to fill in the measuring drawings, automatically this is where the application of the Delimitation Contradictory Principle does not work properly and the resolution of land disputes due to not implementing the Delimitation Contradiction Principle is where the BPN facilitates mediation between the two parties rather than having to go to court. If it is still not resolved, a procedural team is created whose members are from the structural work unit in accordance with the procedures for handling land disputes regulated in the Minister of State for Agrarian Affairs/KBPN Regulation No. 5 of 1999. The task of the work team is to receive and resolve land disputes that come to local work environment. So that the resolution of land disputes does not necessarily take place directly through litigation.

Abstract

Ownership of land rights in the Waropen customary law community is very important because the land is a legacy of their ancestors which is used to meet their daily needs. The aim of this research is to find out more about land ownership rights from the perspective of the Waropen customary law community. The approach used is empirical, which looks directly at the reality that occurs among the Waropen traditional law community regarding ownership of land rights which are considered a legacy from their ancestors and are used to meet their daily needs. Data obtained from field observations, both primary and secondary, are then analyzed systematically so that the data can be accounted for. The results of this research reveal that the Waropen Indigenous people recognize 2 (two) types of land rights, namely ownership rights and use rights. Residents of the Waropen indigenous community can have property rights in the form of individual rights, family property rights which are the same as household property rights, and clan property rights or customary rights. Property rights in the Waropen language are called Mipena (Sanggei Village) or Risanau. Mipena or risanau in the traditional concept is originally a former garden. Former garden land refers to ownership of land or an area that is owned. Meanwhile, the right to use is the right to use or collect proceeds from land controlled by the state or land owned by another person, based on a mutual agreement between the land owner and the person who will use the land. In the Waropen indigenous community, this right of use can be differentiated into several groups of users of land rights, including the right to use for fellow Waropen people, this transfer is facilitated by the Government, the right to use for pastors, evangelists, teachers, health workers who come to dedicate themselves in the Waropen area and use rights are also given to traders from Bugis, Makassar, Java and Toraja as a place to carry out business activities.
