Abstract

Pandemi Covid-19 memberikan dampak pada hampir seluruh sektor dalam kehidupan, termasuk Desa. Menimbang pentingnya peran Desa dalam ketahanan nasional, pemerintah pusat memberikan aloksasi dan prioritas lebih pada keuangan Desa untuk menunjang pemulihan ekonomi nasional sekaligus akselerasi pencapaian SDGs Desa. Hasilnya, Desa dan pemerintahannya mendapatkan amanah lebih untuk mengelola keuangan desa dengan pemberian BLT-DD. Isu-isu hukum tentang penyalahgunaan sumber dana desa oleh kepala desa sudah banyak terjadi. Penyebaran isu tersebut dikarenakan belum pahamnya baik pemerintah desa atau masyarakat setempat tentang proses pengelolaan keuangan desa. Salah satunya adalah implementasi psinsip partisipatif dalam setiap prosesnya. Tim penulis menggunakan metode penelitian hukum sosio-legal dengan dua pendekatan: statute approach dan conceptual approach untuk mengidentifikasi permasalahan dan menyusun solusi sesuai kebutuhan desa mitra. Hasilnya, tim memberikan rancangan peraturan desa sebagai bentuk perlindungan hukum bagi keduanya untuk mengimplementasikan prinsip partisipatif dan keterbukaan selama pengelolaan keuangan. Selain itu, tim membangun laman sosial media yang dapat dimanfaatkan menjadi sarana partisipasi dan transparansi sekaligus media promosi kekayaan daerah setempat. Harapannya, produk tersebut dapat meningkatkan kesejahteraan masyarakat desa.   Implementation of Participatory Principles in Village Financial Management (Case Study in Jabung Village, Lamongan Regency) The Covid-19 pandemic impacts on almost all sectors of life, including the life in the villages. Considering the importance of the role of the Village in national resilience, the central government gives more allocation and priority to Village finances to support national economic recovery as well as accelerate the achievement of the Village SDGs. As a result, the village and its government get more mandate to manage village finances by providing BLT-DD (Cash Transfer Program-Village Fund). There are many legal issues regarding the misuse of village funds by village headmen. The spread of the issue was due to the lack of understanding of either the village government or the local community about the village financial management process. One of them is the implementation of participatory principles in every process. The writing team uses socio-legal research methods with two approaches: a statute approach and a conceptual approach to identify problems and develop solutions according to the needs of partner villages. As a result, the team provided a draft village regulation as a form of legal protection for both of them to implement the principles of participatory and openness during financial management. In addition, the team builds social media pages that can be used as a means of participation and transparency as well as media for promoting local wealth. It is hoped that these products can improve the welfare of rural communities.

Abstract

Trenggalek is one of the potential regencies in East Java, with many beautiful tourist destinations. Realizing this fact, the government of Trenggalek has set a target to develop 100 tourist villages in Trenggalek by 2024. Tourist villages are now becoming one of the main attractions in Trenggalek. To make the villages more known and visited by tourists, some support is needed, one of which is the involvement of tour guides skilled in using English. Therefore, the community service team from UPN "Veteran" Jawa Timur under the scheme PIKAT (Pemanfaatan Ipteks Bagi Masyarakat = Utilization of Science and Technology for Society) held an English for Tour Guide program in Pandean Village, Dongko Sub-district, Trenggalek. Supported by the Department of Tourism and Culture of Trenggalek. This program has been held since July and is still running.  The service program consists of three main activities, namely: (1) preparation, debriefing, and pre-departure; (2) implementation; and (3) evaluation. The tour guides joined and attended the program enthusiastically. They were actively involved in the discussions, sharing sessions, and role-plays. It is expected that this program can be impactful for tour guides in tourist villages in Trenggalek and can be extended in a broader scope in the future. In addition, more tourists are interested in visiting Trenggalek, from East Java and around Indonesia.

Abstract

Social forestry has been implemented for decades in Indonesia to escalate society’s welfare. In particular, it is designed to grow the economy of forest-surrounded village societies by utilizing forest natural resources in specific schemes such as Village Forest. Government Regulation No.6/2007 regarding Forest Management and Preparation of Forest Management Plans and Forest Utilization regulated that Village Forest is manageable by villages and exploitable for village welfare. The Job Creation Law (JCL) enactment now recognizes the existence of social forestry under Article 26 para (2) JCL. It is grounded in the notion that social forestry potentially supports the national investment climate and national SDGs Agenda, particularly the scheme of village forest utilization, as village governances contribute to more than 90% of national power. Based on that notion, the government introduced the SDGs Village Agenda, which is expected to contribute to most national targets. Applying normative legal research as the primary method with the empirical and conceptual approach, it is discovered that the well-utilization of village forests has escalated the IDM level, which also represents SDG’s Desa Agenda. The discussion covers the authority of the Village-Owned Enterprises (BUMDes) in utilizing village forest post-JCL, the ways of utilization, and the success story of villages – learning from Labbo Village, Bantaeng. Indeed, using the village forest supports the escalation of IDM Level and SDGS Agenda achievement.

Abstract

Blue Economy is a concept of the use of marine resources for the economic growth, the improvement of livelihood, along with the preservation of marine ecosystems. This article discusses the potential of the blue economy for sustainable development efforts that have been the focus of many countries since the 1972 Stockholm Environmental Conference. Basically, the use of marine resources has been regulated in the United Nations on the Law of the Sea 1982 and other international legal instruments. However, special management systems and regulations are needed at international and national levels to implement the components of Blue Economy activities that prioritize sustainable development and the preservation of the marine environment. In addition, another potential of the Blue Economy is its relation to the fulfilment of Human Rights in Indonesia, which will be reviewed normatively through national legislation and international law study.

Abstract

AbstractSocial forestry has been an instrument of government to escalate community welfare. Forest village in Indonesia is one of the schemes recognized in the national social forestry program since 2007. The economic potential of forest village management is now realized in the Government Regulation in Lieu of Law No.2/2022 regarding Job Creation, specifically designed to accelerate the national economy. The ease offered by the JCL changes nothing to the community perspective in benefiting Village forests through a collaborative scheme between Village-owned enterprises and other groups. Thus, it is essential to portray this collaboration’s potency to provide village community welfare further. This study uses the socio-legal method by applying statutory and conceptual approaches supported by interview’s respond from the governments. This study’s result shows that the village-owned enterprises shall collaborate in benefiting the village forest to escalate the village IDM level which also represents the achievement of Village SDGs. AbstrakPerhutanan sosial telah menjadi instrumen Pemerintah untuk meningkatkan kesejahteraan masyarakat. Hutan desa di Indonesia merupakan salah satu skema yang diakui dalam program perhutanan sosial nasional sejak tahun 2007. Potensi ekonomi pengelolaan desa hutan kini diakui dalam Perpu No.2/2022 tentang Cipta Kerja (Perpu Cipta Kerja) yang dirancang khusus untuk mengakselerasi perekonomian nasional. Kemudahan yang ditawarkan dalam peraaturan tersebut tidak mengubah cara pandang masyarakat dalam memanfaatkan hutan Desa melalui skema kerjasama antara Badan Usaha Milik Desa dengan kelompok lain. Oleh karena itu, penting untuk menggambarkan potensi kerjasama ini yang bertujuan untuk lebih memberikan kesejahteraan masyarakat desa. Penelitian ini menggunakan metode yuridis sosiologis yang didukung oleh hasil wawancara pemerintah terkait. Hasil penelitian menunjukkan bahwa BUMDes dapat berkolaborasi dalam memanfaatkan hutan desa untuk meningkatkan level IDM desa yang juga merupakan pencapaian Tujuan Pembangunan Nasional Desa (TPB Desa). Pada akhirnya, ini berkontribusi pada pencapaian Tujuan Pembangunan Berkelanjutan Nasional (TPB Nasional).Kata Kunci: BUMDes; Indeks Desa Membangun; Tujuan Pembangunan Berkelanjutan; Perhutanan Sosial; Hutan Desa.
