Abstract

Partisipasi masyarakat merupakan salah satu unsur penting yang harus diperhatikan dalam Pembentukan Peraturan Daerah (Perda). Undang-Undang No. 12 tahun 2011 tentang pembentukan peraturan perundang-undangan, dalam pasal 96 secara jelas mengatur mengenai Partisipasi Masyarakat Dalam Pembentukan Peraturan Perundang-Undangan termasuk Perda. Undang- Undang No. 23 tahun 2014 tentang Pemerintahan Daerah, dalam pasal 354 juga mengatur mengenai partisipasi masyarakat dalam pembentukan peraturan daerah. Dalam Peraturan Menteri Dalam Negeri Nomor 80 Tahun 2015 tentang Pembentukan Produk Hukum Daerah terdapat satu pasal yang mengatur tentang partisipasi masyarakat yaitu Pasal 166, dimana dalam pasal tersebut mengatur bahwa masyarakat berhak memberikan masukan secara lisan dan/atau tertulis dalam pembentukan peraturan daerah, peraturan kepala daerah, peraturan bersama kepala daerah dan/atau peraturan DPRD. Partisipasi masyarakat ini merupakan salah satu bentuk partisipasi politik masyarakat yang sangat penting dalam rangka menciptakan good governance. Oleh karena itu pelaksanaan partisipasi masyarakat dalam pembentukan peraturan perundang-undangan termasuk Perda haruslah diatur secara jelas

Abstract

Marriage is a bond of agreement between human individuals to build a household ship with a happy and eternal goal until the end of their life. In a marriage, there are many factors supporting similarities, differences, economics, religion, social status and so on. Our aim is to research to find out whether it is permissible to marry religious differences are in accordance with the results of the methodology that we are looking for, namely in accordance with the perfective Indonesian positive law, religious law and sociological views on interfaith marriages. Indonesia has its own regulations which are regulated in its law book in the Civil Code, while according to the perspective of religious law in Indonesia, marriages from people of different religions are not allowed, they are considered invalid or forbidden, the sociological view of marriages between different religions is considered valid. Just because in social science a marriage occurs because of mutual love and does not prioritize religion because love occurs because there are similarities and differences that complement each other and there is an attitude of tolerance between partners so that the marriage is eternal and happy.

Abstract

The concept of the creative economy revolves around fostering community participation and developing the micro, small, and medium enterprise (MSME) sector. This orientation is closely linked to the presence of Village-Owned Enterprises (BUMDes) institutions. However, legal challenges arise when separate regulations govern MSMEs and BUMDes, hindering the optimization of the creative economy within society. This article aims to address these legal issues by examining the integration of BUMDes and MSMEs to enhance the creative economy in Indonesia. Drawing on normative research, this article takes a conceptual and statutory approach to shed light on the matter. The findings affirm the need for specific legal policies that facilitate the integration of MSMEs and BUMDes, enabling them to collaborate and regulate their potential collectively. Special regulations should be established to govern the various aspects of integration, including the forms of integration, the fields that can be integrated, and the legal processes involved in developing the creative economy. By establishing comprehensive regulations, Indonesia can foster a conducive environment for the creative economy to thrive, promoting collaboration between MSMEs and BUMDes while harnessing their potential for societal development.

Abstract

Family plays a central role in maintaining the stability and continuity of a nation, and marriage is the primary foundation for forming a legally recognized family. The Family Card records marital status and holds a crucial role in family administration and the legal rights of family members. However, practices in the field often do not align with the rules of recording marriages in the Family Card. This research aims to examine the influence of marriage clauses in the Family Card on the legal status of marriage from the perspective of family law, as well as its impacts in the social context. Using a normative legal research method, with a legislative approach and data from relevant legal documents, this study contributes to understanding and addressing family law issues in Indonesia while adapting to the diverse social and religious realities of the community. The research findings show that recording marriage in the Family Card has a significant impact from the perspective of family law in Indonesia. Recorded status in the Family Card provides legal certainty, better legal protection, and easier access to rights and benefits. Conversely, "Not Recorded" status can create legal uncertainty, obstacles in obtaining rights and benefits, and a higher risk of legal consequences in divorce and inheritance rights. The social impacts of the existence of marriage clauses recorded or not recorded in the Family Card are diverse. Recorded marriages create positive social recognition, family support, and easier access to social programs, while unrecorded marriages can result in social stigma, discrimination, and uncertainty regarding the rights of children born from such marriages.

Abstract

The purpose of this research is to analyze Human Rights in Indonesia from a Legal Perspective and a Customary Life Perspective. Based on Indonesian law and the way of life in each region, regional regulations are established to protect inhabitants' human rights. This research was carried out using normative methods with research through a literature study. As a guarantee of the notion of equality among all humans, HAM, or human rights, is a fundamental value that must be safeguarded and maintained. It is not just in Indonesia but anywhere else in the world. Right now, there is an imbalance between the respect for human rights and how those rights are put into practice. In spite of these circumstances, Indonesian conversation and debate are nonetheless highly fascinating. With regard to human rights, in particular. In order to examine human rights in relation to various legal and customary aspects of life in Indonesia, this research was conducted utilizing the literature review technique. The findings of this research describe the state of human rights in light of Indonesia's legislative and cultural traditions. The issue of indigenous peoples has indeed become one of the strongest issues in international development. Indigenous peoples are a community group that must receive attention in mitigation and adaptation efforts.
