Abstract

Banking activities conducted based on the Principle of Fiduciary between the bank and its customers. Society will entrust his money to the bank if the bank can provide a guarantee that all the information about the customer can be kept confidential by the bank. To maintain customer confidence in the bank in carrying out business activities must also apply the principle of confidentiality. The principle applied by the bank secrecy is a form of commitment and bank protection in keeping customers' personal data. However, what happens today is that many people who complain of financial institutions that offer their products through long-distance phone lines (telemarketing). This is a big question that customers experiencing financial services product offerings through the phone line. Customers generally concluded unilaterally that the banks where they deposit funds, have provided their personal data to other parties (financial institutions). This is of course contrary to the principles of fiduciary and confidentiality that must be firmly held by the bank as a financial institution that is dependent on the source of funds from the public (depositors). Protection of confidentiality of customers' personal data, in addition to the duty of the bank, also the responsibility of policy makers in the banking business. Birth of Law Number 21 Year 2011 concerning the Financial Services Authority, authorizes the protection of the confidentiality of customers' personal data, which had previously been the Bank Indonesia's duty, then switching function to the Financial Services Authority. Financial Services Authority as an agency that has the task of regulating and supervising the financial services institution, is able to provide legal protection for the consumer in this case bank customers, so as to foster consumer confidence in the financial institution. Abstract

The most of the world’s trade is carried by sea. There is always a risk that the object of the trade may be delayed, damaged or lost in transit.Many events can occur during transit. For example, traders may be involved in an accident whereby the goods are destroyed or might be stolen.The result can be loss of profits. Traders should therefore insure their goods against loss, damage or delay in transit to minimize the impact of such incidents on their business by being properly insured. One of mechanism by cover the risk of loss or damage the goods with marine insurance. This can cover the whole journey-over land as well as sea. Basically, marine insurance is third party vesselinsurance. This insurance covers liability for loss or damage to someone else’s property, arising from operation of the vessel. Third party vessel insurance, more commonly knowns as legal liability insurance (Protection and Indemnity insurance).There are many insurable interest can be covers by marine insurance, especially on legal liability insurance. The insurable interest in marine insurance like liability in respect of passanger, cargo liability, liability in respect of the crew members, ship collision, sea pollution risk, towage liabilities, liability for obstruction and wreck removal, and liability of damage to property port and navigation tools/telecommunications cruise. The problem in this research is the importance of legal liability insurance for the transfer of risk if loss or damage may be happen to the third party, arising from operation of the vessel.The second problem is about regulation on marine insurance in Indonesia.This research classified by normative legal research with descriptive type of explanatory and analytical approach to normative legal substance (approach of legal content analisys).The outcome of the research shows that the legal liability insurance has an important role for protecting the third parties for loss or damage, arising from operation of the vessel at sea. The second problem in this research is the regulation regarding marine insurance in Indonesia. Marine Insurance Regulation in Indonesia is Commercial Code since 1847 which is regulated colonial legacy from Deutch, had been outstanding for more than 150 years. While the development of today's insurance business has been growing very rapidly.It is necessary to create regulations governing marine insurance. Abstract

Indonesia is an archipelagic state which surrounded by the sea. Indonesia's marine area is 5.8 million square kilometers comprising the territorial area of 3.2 million square kilometers and the Indonesian Exclusive Economic Zone (ZEEI) of 2.7 million square kilometers. In addition, there are 17,504 islands in Indonesia with 95 181 square kilometer coastline. With that area, it should be utilized to the overall prosperity of the people in order to improve standard of living. Especially for fishermen who depend for their livelihood on fishing in the sea. The majority of fishing boats are not equipped for serious medical emergencies, and most boats are usually Several hundred miles away from the nearest medical facility. Many events can occur during deep-sea fishing, such as changing weather conditions, ship collisions, which can lead to lost profits or lost their lifes, can be happen to fishermen. For that reason, they need mechanism to overcome the risk of losses With insurance mechanism, they can minimize the loss of profit or their life that would cause the families of fishermen to lose income for their family's livelihood. Recently, The House of Representatives passing Law Number 7 of 2016 Regarding The Protection and Empowerment of Fishermen, Fish Farmers and Salt Farmers. The Law stipulates that both central and local governments must protect people working in these sectors from occupational risks, including work accidents and equipment damage. Also, Maritime and Fisheries Minister, Susi Pudjiastuti, said Maritime and Fisheries Ministry was seriously realizing the fishermen insurance. The fishermen insurance will cover life and business insurances. Therefore, fishermen will have guarantee over the risks of fishing, aquaculture, and fish-salting businesses. Kawasan laut Indonesia adalah 5,8 juta kilometer persegi yang terdiri dari wilayah teritorial 3,2 juta kilometer persegi dan Zona Ekonomi Eksklusif Indonesia (ZEEI) 2,7 juta kilometer persegi. Selain itu, ada 17.504 pulau di Indonesia dengan garis pantai 95.181 kilometer persegi. Dengan wilayah seluas itu, harus dapat dimanfaatkan secara keseluruhan untuk kemakmuran rakyat agar dapat meningkatkan taraf hidup yang lebih baik. Khususnya bagi nelayan yang menggantungkan hidupnya dari mencari ikan di laut. Kebanyakan kapal nelayan dalam mencari ikan, jauh dari tempat medis terdekat. Peristiwa yang tidak diinginkan, seperti peristiwa alam badai, tabrakan kapal yang mengakibatkan kehilangan keuntungan atau kehilangan nyawa, sangat mungkin terjadi bagi nelayan saat melaut. Untuk itu diperlukan suatu mekanisme peralihan risiko kerugian yang dialami nelayan ketika menangkap ikan di laut. Dengan mekanisme peralihan risiko kerugian, nelayan dapat meminimalisir kehilangan keuntungan ataupun kerugian atas hasil tangkap ikan maupun terhadap kehilangan nyawa yang akan membuat keluarga nelayan menjadi kehilangan penghasilan bagi nafkah keluarganya. Baru-baru ini, Dewan Perwakilan Rakyat mengesahkan Undang-Undang Nomor 7 Tahun 2016 Tentang Perlindungan dan Pemberdayaan Nelayan, Petani Tani dan Petani Garam. Undang-undang tersebut menetapkan bahwa pemerintah pusat dan daerah harus melindungi orang-orang yang bekerja di sektor laut dari risiko pekerjaan, termasuk kecelakaan kerja, sakit, dan kerusakan peralatan untuk melaut. Selain itu, Menteri Kelautan dan Perikanan Susi Pudjiastuti mengatakan, Kementerian Kelautan dan Perikanan (KKP) serius mewujudkan asuransi nelayan. Asuransi nelayan akan mencakup asuransi jiwa dan bisnis. Oleh karena itu, nelayan akan memiliki jaminan atas risiko usaha penangkapan ikan, akuakultur, dan penggalangan ikan. Abstract

This paper discusses the regulation regarding the use of brands originating from fictional characters, both from famous comics and animation, which are registered or unregistered for use by other parties. This normative legal approach examines laws and regulations, legal doctrines, and legal documents relating to brands originating from fictional characters. The results show that the unauthorized use of Marks derived from a wll-known animation characters by other parties can be sued under Law Number 20 of 2016 concerning Marks and Geographical Indications, because they can mislead the public regarding the origin, quality, type, size, variety, the purpose of using goods and/or services. Meanwhile, since Article 83 does not stipulate that the unauthorized use of a mark by another party must be registered, the owner of a registered mark may file a lawsuit against the use of a mark originating from a well-known fictional character against another party even though the other party does not register it.

Abstract

Beberapa waktu lalu viral isu mengenai sistem pembayaran COD yang bermasalah. Hal ini terjadi karena kurangnya pemahaman masyarakat terhadap aturan hukum berbelanja online, baik yang diatur dalam undang-undang maupun dalam ketentuan layanan dalam situs belanja online, yang merupakan kontrak elektronik baku. Sehingga pembeli tidak mengetahui langkah hukum yang tepat yang diambil untuk mengatasi kerugian yang diderita. Penelitian ini menjadi penting untuk mengukur pemahaman masyarakat terhadap berbagai ketentuan hukum mengenai berbelanja online di Kota Tanjungpinang. Baik yang diatur dalam peraturan dan ketentuan layanan pada situs belanja online tertentu. Penelitian ini tergolong penelitian hukum normatif-empiris dengan menggunakan data primer dan data sekunder. Hasil penelitian menunjukkan bahwa sebagian besar masyarakat belum mengetahui tentang kegiatan berbelanja baik ketentuan yang diatur dalam perundang-undangan maupun kontrak elektronik baku dalam situs e-commerce.

Abstract

Tulisan ini menyoroti perlunya perhatian khusus terhadap anak-anak yang tinggal di pulau ini, karena mereka sering menghadapi tantangan unik dan terbatasnya akses terhadap layanan pendidikan yang memadai. Dalam konteks ini, edukasi tentang hak anak menjadi sangat penting. Anak-anak di pulau ini memiliki hak yang sama dengan anak-anak di tempat lain untuk mendapatkan pendidikan berkualitas, kesehatan, perlindungan, dan partisipasi dalam proses pembelajaran. Tulisan ini akan membahas strategi dan upaya yang dapat dilakukan oleh sekolah menengah di Pulau Terluar Belakang Padang untuk memastikan bahwa hak-hak ini dihormati dan dipenuhi. Melalui penekanan pada edukasi hak anak, diharapkan para siswa di pulau ini dapat mengembangkan pemahaman yang lebih baik tentang hak-hak mereka, mendorong partisipasi aktif dalam kehidupan sekolah, dan meningkatkan kualitas pendidikan mereka secara keseluruhan. Dengan meningkatnya kesadaran dan perhatian terhadap hak anak di sekolah menengah ini, diharapkan akan tercipta lingkungan pendidikan yang inklusif, adil, dan berdaya guna bagi anak-anak di Pulau Terluar Belakang Padang.

Abstract

Purpose: E-commerce is a sale and purchase agreement made through internet media which brings convenience and practicality to carry out buying and selling. One of them is the Shopee e-commerce which offers buying and selling mystery boxes. Mystery box is a sales system in the form of boxes/packages whose contents are not known exactly what goods will be obtained by the buyer.  Methodology: Mystery box buying and selling is carried out on the Shopee e-commerce site by marketing the product without clearly stating the product promised, so the seller only presents the product that the buyer is likely to be able to get at the price that must be paid. What's more, the seller has included a standard clause that the goods that have been received by the buyer cannot be returned or returned. Regarding agreements like this, it is not yet known what goods will become the object of the agreement, so is this mystery box sale and purchase agreement appropriate and reasonable under the law of an agreement through an electronic system and does such a transaction fulfill the legal requirements of an agreement contained in Article 1320 of the Civil Code. The purpose of this study is to find out how the application of Article 1320 of the Civil Code to the mystery box sale and purchase agreement on the Shopee e-commerce site has been fulfilled and the legal consequences for the parties to the mystery box sale and purchase agreement on the Shopee e-commerce site. This research uses a normative legal method with a statutory approach. Results: The results showed that the mystery box sale and purchase agreement on the Shopee e-commerce site did not fulfill the requirements in Article 1320 of the Civil Code, namely subjective requirements and objective requirements. If an agreement is canceled because it does not fulfill the legal requirements of Article 1320 of the Civil Code regarding subjective conditions, the agreement can be canceled and if the objective conditions are not met, the agreement is null and void.
