Abstract

One of the most common crimes in society is child abuse. Article 351 paragraph (1) of the Penal Code (KUHP) regulates and threatens criminal offenses in Indonesian criminal law. Medan District Court Decision No. 1621/Pid.B/2023/PN Mdn, regarding criminal abuses, will be discussed in this article. This study analyzes events and court decisions. Research methods include analysis of court decisions and legal analysis of criminal behavior. Research results show that, according to the provisions of the Penal Code, abuse crimes can be classified into many types, including general abuse, mild abuse, intentional abuse and severe abuse. Important. Preventive and repressive measures are necessary to combat criminal acts. Criminal law is used to solve problems in society, while non-criminal methods focus on prevention. To bring justice to victims and all parties involved, law enforcement must understand the behavioral factors associated with criminal abuse.

Abstract

This research was conducted at the Medan District Court by following cases and decisions regarding criminal acts of motor vehicle theft. The results found in this case were that the suspect had been found and taken to legal action and was subject to a criminal offense for 2 years and six months. However, with light sentences and sanctions that are not too heavy, the public will not be more deterred from committing crimes. The method used in this research is a qualitative research method which is closely related to the social definition paradigm.

Abstract

This research explores law enforcement against children as perpetrators of criminal acts of theft with violence through case study analysis of Medan District Court Decision Number: 77/ Pid.Sus – Anak /2023/ PN Mdn. The research method used is a qualitative descriptive research method with the proportion of research using library research. This is used to carry out analysis related to the issue being raised. The application of the law to Bayu Nugroho Karen, a child who is in conflict with the law as a perpetrator of the crime of theft with violence is in accordance with the provisions of the Criminal Procedure Code and Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. Where children can be held accountable for their actions and their rights as children who have committed criminal acts guaranteed in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System have been fulfilled in Decision number 77/Pid.Sus-Anak/2023/PN Mdn, dated 31 August 2023.

Abstract

The position of witnesses in the criminal justice process occupies a key position, as seen in Article 184 of the Criminal Procedure Code (hereinafter abbreviated to KUHAP). The method used is library research, collecting data by searching for sources and constructing them from various sources such as books, journals and existing research. In the criminal justice system, witnesses have not been maximally protected in a number of laws and regulations such as in the Criminal Procedure Code and in the Criminal Code, where witnesses have not received maximum attention because in the law above, almost in the articles of the Criminal Procedure Code there is not a single article that specifically regulates witness protection and almost every article in the Criminal Procedure Code and the Criminal Code, witness rights are always included with the rights of victims. The Criminal Procedure Code, which has so far been the basis for proceedings in Indonesian criminal justice, does not regulate the rights and protection of witnesses fundamentally or specifically even though there are several provisions. in the Criminal Procedure Code which regulates, regarding the rights of a witness as Article 108 paragraph (1) reads: every person who experiences, sees and witnesses and/or becomes a victim of an incident which constitutes a criminal act has the right to submit a report or complaint to the investigator or investigator either verbally or verbally. writing.

Abstract

The act of physical assault is one of the persistent phenomena that is difficult to eradicate in society. Various acts of violence, such as physical abuse and battery, often result in injuries to the victim's body or body parts, and sometimes even lead to lifelong physical disabilities or, in severe cases, death. In criminal cases, witnesses hold a crucial position in determining prosecution, as they are considered lawful instruments. This study examines the role of witnesses in the prosecution of cases of fatal assault. The research method employed in this study is normative legal research, also known as doctrinal legal research or library-based legal research. This type of research is conducted by examining secondary data, including primary legal materials, secondary legal materials, and tertiary legal materials. Based on the research findings, it can be concluded that witnesses play a significant and pivotal role in uncovering the truth and facilitating prosecution. From both legal and sociological perspectives, the role of witnesses includes providing evidence, giving testimony, and supporting the public prosecutor. As such, it can be concluded that witnesses have an important role in prosecution, as stipulated in Article 184 paragraph (1) of the Criminal Code.

Abstract

When deciding to have a pet, of course a person cannot be separated from the risks and responsibilities for their pet. In the criminal law, article 490 of the Criminal Code explains that pet owners must be responsible for all actions caused by their animals. The results of this research show protection for dog bite victims that unlawful acts caused by animals according to criminal law in Article 359 of the Criminal Code can be held accountable to the owner of the pet dog because his mistake (negligence) caused another person to die, punishable by a maximum prison sentence of five year or a maximum imprisonment of one year. A sociological legal perspective views the effectiveness of law in society regarding unexpected negligence caused by pets, that there is still a lack of firm rules for each individual to regulate specific procedures and standards that must be met by dog pet owners. The spread of rabies to victims is due to the lack of public knowledge regarding procedures for dealing with rabies and preventive measures after the bite of a rabid animal.

Abstract

Legal protection for plaintiffs in land grabbing cases needs to be carried out by law enforcers to avoid undesirable incidents. Land grabbing has a detrimental impact on parties whose ownership rights are illegally owned by perpetrators who do not want to suffer losses. The plaintiff has rented a plot of land and buildings to the defendant for Rp. 15,000,000/year, but it has been 11 years now that the defendant has not had good faith in paying rent to the plaintiff, and has claimed that the land and building rented by the defendant to the plaintiff belong to the defendant. Before the plaintiff brought this case to court, the plaintiff had first carried out an injunction through the plaintiff's attorney against the defendant, but the defendant did not heed it. Due to this unlawful action, the plaintiff suffered a loss of Rp. 165,000,000,- (one hundred and sixty five million rupiah). For the losses suffered by the plaintiff, the defendant must also be sentenced according to Article 1365 of the Civil Code, Article 1366 of the Civil Code, Article 1367 of the Civil Code, Article 385 paragraph (1) of the Criminal Code, or according to other laws and regulations.

Abstract

This research discusses how to enforce the law against criminal acts of theft. This research is a case study research using a normative juridical approach. The normative juridical approach is a method of research carried out by studying the main legal materials such as theories, concepts, legal principles and statutory regulations related to this research. The results of the research show that the acts of theft that occurred have been carried out repeatedly so that this criminal act is a recidivist crime. The Criminal Code has regulated it and must be carried out by law enforcers who implement these regulations, as an embodiment of what is regulated in the Criminal Code. In efforts to enforce the law against criminal acts of theft, especially recidivism, it is necessary to implement the things that have been included in the statutory regulations, so that a sense of security, comfort and peace can be created in the environment and relationships within the family and social community. There are several factors that influence these crimes, including internal factors, external factors and economic factors.

Abstract

Penelitian ini dilakukan dengan tujuan utama untuk melakukan analisis yang mendalam terhadap proses hukum, acara pidana, dan kasus korupsi dalam konteks penanganan kasus korupsi di Pengadilan Negeri. Latar belakang penelitian ini didorong oleh pentingnya pemahaman yang mendalam terhadap aspek-aspek hukum yang terlibat dalam upaya memerangi korupsi, yang merupakan masalah serius di banyak negara. Kasus korupsi sering kali melibatkan penyalahgunaan kepercayaan, penyelewengan kekuasaan, dan dampak sosial serta ekonomi yang merugikan masyarakat. Oleh karena itu, pemahaman yang baik tentang proses hukum yang digunakan untuk menangani kasus korupsi di pengadilan negeri sangat penting. Metode penelitian yang digunakan dalam studi ini melibatkan analisis dokumen hukum terkait kasus-kasus korupsi, studi kasus untuk menggambarkan tahapan dan prosedur yang terlibat dalam pengadilan, serta wawancara dengan praktisi hukum yang terlibat dalam penanganan kasus korupsi. Melalui metode ini, penelitian mencoba merinci peraturan dan prosedur yang mengatur proses hukum acara pidana, serta mengidentifikasi hambatan dan tantangan yang mungkin muncul dalam penanganan kasus korupsi di pengadilan negeri. Hasil penelitian memberikan pemahaman yang lebih baik tentang sistem peradilan dan proses hukum yang berlaku dalam konteks penanganan kasus korupsi. Hasil ini juga dapat memberikan wawasan yang lebih mendalam tentang bagaimana peradilan dapat meningkatkan efektivitasnya dalam memerangi tindakan korupsi. Dengan pemahaman yang lebih baik tentang proses hukum, praktisi hukum, penegak hukum, dan pemangku kepentingan lainnya dapat bekerja sama untuk memperkuat sistem peradilan dan memberantas korupsi, yang pada akhirnya akan memberikan manfaat besar bagi masyarakat dan pemerintah.

Abstract

Criminal law consists of regulations. which determines what is prohibited and what is permitted in criminal cases, and determines the punishment that can be given to people who commit them. It is easy to measure the success of Indonesia's legal reform. One of the criminal acts of theft that is often considered to occur very often is motorbike theft. Motorbikes are an important means of transportation for most Indonesian people because the price is affordable for most people with middle to lower incomes, where the increase in the number of motorized vehicles is in line with the increase in the number of crimes involving motorbikes which has led to the crime of motorbike theft. The author uses qualitative legal research with secondary data sources in this research. In this article, the research method used is the normative news method. The Police of the Republic of Indonesia have direct authority to carry out all criminal acts, including theft with violence. This is in accordance with the police's duty to maintain security and public order, protection, protection and community service, as well as law enforcement. In the law enforcement process, efforts are made to uphold functions with legal norms as guidelines for behavior in traffic or legal relations in society and the state where there are perpetrators who commit the criminal act in question, in the sense of people who, with some intention or something unintentional, as required by law, have left a consequence of climbing the law whether it is subjective elements or other elements and in article 362 of the Criminal Code it is explained that the act of taking an item which in whole or in part includes a statement by another person with the intention of possessing the item in violation of the rights.
