Abstract

What Paul A. Samuelson discloses in The Family of Economic which he calls The Main Stream of Economic, if we look further we will soon encounter a vacuum of economic thought from the first year of the AD until the discovery of ST. Tomas Aquinas in 1270 AD at that time interval according to "The family tree of economic" is filled with the normative scholastic thought.It is an unavoidable fact that Muslims have lost their thinking power for hundreds of years. Imitation of the western mind without any cross check the source of thought makes Muslims blinded by innovations that are born in various fields. The view of Muslims seems to be closed by the concepts laid down, so the effort to compromise them with Islamic concepts seems unthinkable. Muslim dependence on the concept offered makes it inferior to the Islamic ability to find solutions to the problem of life in all things. Yet Allah promises perfection of Islam as Religion as well as life guidance.Historical books of economic thought do not exist, or if any such as Schumpeter merely touches on a few lines of explanation of the old contributions of Islam. A very ironic thing, given Adam Smith, who is famous as the father of Economics mentioned in "The Wealth Of Nation" that the advanced economy is an Arab economy led by Muhammad and His Immediate Successor.This irrationality recurred when Samuelson explained the diagram of the origin of economics. He listed the Bible as the origin of the science, none of the economists objected when the Islamic scientists reappointed Islamic economics and made the Qur'an and Hadith a source of reference for many economists who rejected it including Muslim economists.To quote Adiwarman Karim's statement, if we would honestly admit that economics is the heritage of human civilization, it is like a tiered building of the level that every people has contributed to thinking in their own time. Fortunately, the storm of the economic crisis makes our minds re-enlightened with a reality that the Islamic economic system that is endorsed by Islamic financial institutions is more able to survive than the capitalist and socialist economic system.

Abstract

Hasbi ash shiddieqy melihat betapa banyak ummat islam indonesia yang tertarik mendalami ajaran islam, termasuk tafsir alquran. Tapi sayang kebanyakan diantara mereka tidak menguasai bahasa arab, padahal kitab-kitab tafsir umumnya berbahasa arab, maka ia tulis tafsir ini untuk memudahkan mereka yang tertarik mendalami tafsir al-quran.Salah satu motivasi penulisan tafsir bagi hasbi adalah sebagai berikut : Perkembangan perguruan tinggi di indonesia membutuhkan untuk melebarkan atau meluaskan perkembangan kebudayaan islam. Abstract

Ulama Fiqh mendefinisikan Mudharabah atau Qiradh adalah Pemilik modal (shahibul maal) menyerahkan modalnya kepada pekerja (pedagang) untuk diperdagangkan, sedangkan keuntungan dagang itu menjadi milik bersama dan dibagi menurut kesepakatan antar kedua belah pihak, artinya sepanjang modal masih dipergunakan oleh pekerja (mudharib) maka sepanjang itu pula pembagian keuntungan harus terus dilakukan, namun jika usaha mengalami kerugian maka seharusnya pula lah kerugian itu di tanggung oleh keduanya (mudharib dan shahibul maal). Dalam fiqih adalah suatu kontrak dimana mudharib memiliki kebebasan yang diperlukan untuk menjalankan mudharabah dalam rangka menghasilkan laba. Karena mudharib merupakan pihak yang lebih lemah didalam kontrak yang per definisi, memberikan keterampilannya sebagai modal pada mudharabah, Fuqaha tidak membolehkan adanya tuntutan jaminan terhadap mudharib. Pada dasarnya aktifitas dalam aqad mudharabah dibolehkan dalam fiqhi, sepanjang aqad yang dijalankan tidak ada pemaksaan dan keterpaksaan antara kedua belah pihak. Disamping itu dalam konteks pemberdyaan ummat maka sangat dianjurkan bagi orang yang memiliki kelebihan modal untuk memberikan kepada sesama hamba Allah, khususnya yang mempunyai keterampilan dalam mengelola suatu usaha namun terbatas/tidak memiliki modal. Tulisan ini lebih memperjelas bagaimana seharusnya aqad mudharabah yang harus di jalankan dalam aktifitas ekonomi khususnya dalam dunia perbankan.

Abstract

In Islam, economic activity history, important of him the existence of money affirmed by the opinion of Rasulullah Saw mentioning and suggesting that better commerce justice is commerce using money media dram or dinner is not a transfer of goods barterable to generate lap on the happening of transfer of different goods of a kind quality. With the existence of money, economic reality in perspective of Islam can take place better, that is looking after of and the increasing of rotation of estate velocity among human being the economic perpetrator. With the existence of money, social and economic activity earn more fluent well-held and can take place with quicker acceleration also.

Abstract

The protection of Muslim consumers against halal products is not just halal labeling contained in the Food Law, but must have integrity of other economic laws, so there is guarantee of the implementation of halal labeling. This is closely related to matters of a business nature, such as trade agreements, distribution, advertising, packaging, negligence and misuse of halal labeling. This paper concludes that first, the position of Muslim consumer protection against halal products in Islamic Economic Law has a great attention. Second, the concept of Muslim consumer protection against halal products in Indonesian Economic Law has a strong juridical foundation, that is stated in the 1945 Constitution Article 29 paragraph (1) and (2), which contains about the freedom to implement religious shari'ah. Third, basically the Indonesian Economic Law contains the protection of Muslim consumers against "labeling and Halal certification "almost entirely contains the halal provisions and patterns of Muslim food in Islamic Law.

Abstract

Penanganan terhadap Anak berkonflik Hukum (Juvenile Deliquency) dalamUndang-Undang Peradilan anak mengenal konsep Diversi yang dipandangmemberikan keadilan pemulihan yang dipahami dalam konsep Restorative Justice.Status dan kondisi anak dalam keadaan melakukan tindak pidana dipandangmemberinya perlakuan yang seharusnya berbeda dengan orang dewasa. Beberapaalasan menyertainya antara lain bahwa tindakan yang dilakukannya tidakmemenuhi unsure ksalahan atas tindakannya karena pertanggungjawaban atstindakannya belum dapat terpenui oleh kondisi kejiwaan yang dimilikinya. Belumlagi dilihat dalam sudut pandang bahwa anak adalah generasi bangsa yangmembutuhkan dan berhak atas keberlanjutan hidupnya. Diversi Dipandang sebagaikonsep yang ideal dalam penanganan berkonflik Hukum sehingga mesti menjadiPrioritas penangannan dalam setiap tahp proses pidana, penyidikan, penuntutanhingga pda proses peradilan.

AbstrakMenurut Shumpeter (1934), Enterprenuership is driving force behind economic growth.Kewirausahaan merupakan komponen vital dalam pembangunan ekonomi.2 Jika Indonesiaingin maju seperti negara lain, maka pembangunan kewirausahaan harus dimulai darisekarang. Untuk mengembangkan kewirausahaan, perlu disusun kurikulum yangmemadai, mulai dari pendidikan usia dini sampai Perguruan Tinggi. Prinsipnya adalahmereka harus dibuat tertarik dan termotivasi, kedua mereka harus bisa dibuat melihatadanya kesempatan untuk bisnis yang menguntungkan (opportunity factors), ketiga,mereka harus memiliki beberapa keahlian seperti social skill, indutrial skill, organizasionalskill dan strategic skill. Abstract

This study entitled "A review of criminal law and Islamic law on the crime of abortion (a comparative study). The main issue to be discussed in this thesis is "Is abortion as a crime by reason of an emergency can be used as a common criminal deletion / Islam and How comparative criminal law and Islamic law against the crime of abortion"? in order to determine the concepts offered between criminal law and Islamic law in view of the phenomenon of abortion crimes committed by people who are not responsible or with a specific reason. In this study, the authors used a qualitative study using descriptive analysis that describes the issues to be studied. And the collection of data in this thesis done in literature. Namely, by collecting data obtained from literature sources such as books, legislation, magazines and newspapers. The data have been collected and inventoried and further grouped or classified according to the materials and problems. From the results of research conducted by the authors find that abortion is justified by the positive law and the law of Islam is the act of abortion is performed when the pregnancy could endanger the lives of pregnant women and fetuses, thepermissibility of abortion must refer to the provisions of the medical, so that in practice does not mebawa even worse consequences for the mother, and especially in Islamic law should be referred to the shar'i predetermined While abortion is a criminal act (abortion provokatus criminalis) is an act of abortions performed for no apparent reason, for example, the fear of poverty or fear of pregnancy is a disgrace. Islamic law and positive law equally see it as a crime (criminal offense), so as to provide penalties for those who do.

Abstract

Penelitian this is a study, with the study of Science Falak as arithmetic, to be used by Muslims in the practice of daily worship, particularly worship prayer, fasting and pilgrimage. The subject is the preliminary determination of the time of prayer, precisely and thoroughly based on the regional data and the formula of prayer time. The discussion in penelitian this, is the determination of the times of prayer between traditionalism and moderenisme, performed traditional and modern with the theory and practice, how astronomy as arithmetic, determine the start time of prayer precisely and accurately in a place, accuracy and thoroughness can be demonstrated and justified Scientifically, based on the initial formula of prayer time. The initial determination of the times of prayer, the beginning of Ramadan, one of Syawal and Zulhijjah, And the determination of Eid-ul-Fitr and Eid al-Adha, as well as great days for Muslims. The results of hisab and Rukyah can be proven and accounted for scientifically. The results showed that the science of Falak as the science of reckoning is very useful for Muslims in setting the times of worship. Such as setting the beginning of the month of Ramadan, the direction of Qiblah, set the time to break the fast and the time of dawn. Set a start and finish time of fasting Ramadan, set Idul Fitri and Idul Adha, Position The direction in an area, starting with the methods or practical ways, namely matode (Reckoning) and methods Rukyat.

Abstract

Masih ada kaum Muslilmin yang dilematis antara menganggap boleh atau tidakboleh nikah lintas agama dan bahkan masih banyak yang mengira bahwa nikah itutidak mengenal lintas agama. Paham ini tidak serta-merta keliru tapi juga tidakserta-merta betul. Mengapa demikian? Awal-awal periodisasi Islam di Mekahmemang hukum itulah yang berlaku, “Haram nikah lintas agama.” Namun,periodisasi Islam selanjutnya di Madinah, nampaknya Islam tampil lebih toleran,lebih kondusif dengan masyarakat heterogen dalam hal interaksi sosial lintas etnisdan lintas agama sehingga nikah lintas agama pun dibolehkan kendatipun tetapbersyarat. Seperti apa syarat kebolehannya? Dapatkan jawabannya dalam tulisan inidan temukan konsekwensi hukumnya.Kata kunci : Nikah, Lintas Agama, Hukum Islam
