Abstract

Perdamaian yang telah di buat oleh para pihak yang bersengketa, di hadapan notaris dengan suatu akta notariil, diharapkan dapat mengakhiri perselisihan, memberikan suatu kepastian hukum diantara mereka yang berselisih. Akta perdamaian itu pun diharapkan memberikan kepastian hukum, bermanfaat dan memberikan keadilan diantara mereka yang berselisih dan bagi keturunannya kelak. Dengan demikian maka akan tercipta suatu ketenangan hidup, kedamaian dan kerukunan diantara mereka yang berselisih. Namun apabila akta perdamaian yang telah dibuat diantara mereka, apalagi yang telah dibuat dihadapan notaris dengan akta perdamaian notariil kemudian dapat dipersengketakan lagi, tentunya akta perdamaian yang telah dibuat itu membuat para pihak atau salah satu pihak atau ahli warisnya merasa tidak terpenuhinya kepastian hukum yang diharapkan. Akta perdamaian yang telah dibuat itu juga menjadi tidak bermanfaat dan terlanggar rasa keadilan dari para pihak yang telah membuatnya dengan itikad baik. Tentunya hal ini juga akan menimbulkan keragu-raguan baik diantara para pihak maupun di masyarakat. Oleh karenanya diperlukan pemahaman dan kejelasan berkenaan dengan hakekat dari perdamaian itu sendiri dan kekuatan mengikat akta perdamaian notariil dalam pembuktian di pengadilan.

Abstract

This research aims is to analyze the validity of the transfer of land rights Pura profit in the perspective of legal certainty and protection of the law in the conservation of land Pura profit in Badung regency. This research is an empirical law study using primary data and secondary data. An Approach used in the form of the approach of legislation analysis, case and custom law. Based on the results of the research can be analyzed that the sale and purchase of land Pura profit executed after the fulfilled special terms and general terms according to the customary law and law of the country. The purpose is for the legal certainty and legal protection for both the buyer and the existence of the temple itself. Therefore, for Pura profit is expected to be innovatively able to manage temple income to be useful to support the activities of temple balance.

Abstract

Public service as a reflection of service form to the public to complete the right and fundamental need and administrative service as it set in constitution of Republic Indonesia of 1945. State have an obligation to complete the right of every citizen through government system to increase quality and to guarantee public service in accordance with general principles of good governance. In fact, there are so many problems of public service, including incondidtence of public service. Therefore, this research is formulated into the roles and functions of public services in realizing good governance, the reform of the national legal system currently have the ability to transform the values of public services into the system of good governance based on the Constitution of the Republic of Indonesia 1945 and efforts to optimize public services that can achieve good governance. The analysis is carried out based on the rechtsstaats theory, stuffen theory and law enforcement theory that is adapted to the basis of ideology (rechtidee) and Indonesian constitution. The result is concluded that the role and function of public services is one reflection of Indonesia that guarantees legal certainty and protection of people's rights.The transformation of the values of public services is a product of the current national legal system reform which is intended as an effort to improve quality and ensure the provision of public services. Indeed, the realization of good governance must begin with the quality and validity of the implementation of public services.

Abstract

Tujuan penelitianpertama untuk menganalisis ketentuan baru yang diatur pada PP Nomor 24 Tahun 2016 tentang Perubahan atas PP Nomor 37 Tahun 1998 tentang PPAT. Kedua Untuk mengkritisi eksistensi PPAT dalam kaitannya dengan pendaftaran tanah di Indonesia terjadi dengan terbitnya Peraturan Pemerintah Nomor 24 Tahun 2016.Metode penelitian yuridis normative, dengan mengunakan pendekatan perundang-undangan (Statuta approach) pedekatan konseptual (conceptual approach) dan pendekatan sejarah (historical approach).Pengumpulan bahan hukum meliputi bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier. Dalam menganalisis bahan hukum dilakukan dengan cara mengkasifikasikan peraturan yang terkait dengan PPAT dan pendaftaran tanah dan mengsistemasikan peraturan perundang-undangan serta menginterpretasikan peraturan perundang-undangan. Kesimpulan berdasarkan hasil penelitian dapat disimpulkan bahwa : Dengan disempurnakannya PP nomor 37 Tahun 1998 menjadi PP Nomor 24 Tahun 2016 tentang PPAT, yang mengalami perubahan hanya terkait denganpersoalan usia calon PPAT dan kewajiban magang sebelum calon PPAT di angkat, penambahan masa kerja PPAT semula 65 (enam puluh lima ) tahun dapat diperpanjang menjadi 67 (enam puluh tujuh) tahun,Penambahan jenis pemberhentian terhadap PPAT, perluasan daerah kerja semula 1 (satu) wilayah kerja kabupaten/kota menjadi 1 (satu) wilayah kerja provinsi terakhir penambahan larangan rangkap jabatan. Sedangkan untuk aspek yuridis Peraturan Pemerintah Nomor 24 Tahun 2016 Tentang Perubahan atas PP Nomor 37 Tahun 1998 tetap menindaklanjuti PP Nomor 24 Tahun 1997 Tentang Pendaftaran Tanah, ketentuan perubahan dimaksud, sesungguhnya menuntut adanya sistim pendaftaran tanah on line dan reforma agraria pada kementerian agraria dan jajarannya, tanpa sinergi teknologi dan pelayanan bidang pertanahan maka fungsi PP Nomor 24 tahun 2016 tidak mmberikan fungsi signifikan dengan pelayanan cepat, murah dan sederhana dalam proses pendaftaran tanah.

Abstract

The Collective Labor Agreement is one of working agreements negotiated by workers joining the trade union organizations together with employers as employment providers. In the making of the agreement, it must first be negotiated by both parties. In particular, in order for the trade union to attend the negotiation, it must meet the requirement stipulated in the provisions of law and regulation stipulated in Laws Number 13 Year 2003 on Labor and Ministerial Regulation Number 28 Year 2014. The two regulations have non-interrelated arrangements or in other words it can be said as conflict of norms, hence this present study is conducted to examine the validity of enactment of collective labor agreement in a company and the legal protection for the trade union under the collective labor agreement. The study makes use of normative research method, i.e. by reviewing the documents of legislations and the literatures with legislation and conceptual approach. The result of the study shows that the validity of enactment of collective labor agreement refers to its relation with legal validity of a norm in the principle of legislation lex superior derogate lex impriori, so that the labor laws is enacted, but not apart from the role of labor ministerial regulations. The validity of the legitimate terms of an agreement is also needed to underlie a collective agreement. The legal protection that can be applied for trade union is in the form of supervision as well as legal protection both preventive and repressive outlined in the collective labor agreement content.

Abstract

Abstract The national economic development in Indonesia is inseparable from the banking role. The existence of the stipulation of Government Regulation in Lieu of Law (PERPU) Number 1 of 2017 on Access to Financial Information for Tax Purposes will certainly affect the regulation of the banking sector in particular related to bank secrets. The establishment of the Perpu appears to have attracted the attention of the government to immediately pass it into law. It is proven which on 23 August 2017 President Joko Widodo has authorized the Perpu to become a law through Law Number 9 of 2017 on Stipulation of Government Regulation in Lieu of Law (PERPPU) Number 1 of 2017 on Access to Financial Information for Tax Purposes into the Law -What. The policy is a form of Indonesia's commitment to participate in the automatic exchange of information globally for tax purposes. The automatic opening of bank secrets for tax purposes will certainly affect the previous banking arrangements, especially those related to bank secrets. Therefore, in order to avoid overlapping arrangements, the state of Indonesia needs to harmonize all regulations relating to bank secrets and the opening of bank secrets for tax purposes. Abstract

The aims of this study are to investigate the legal certainty of the Land Deed Official that does not meet the minimum price standard on purchasing apartment units for foreigners domiciled in Indonesia and to examine the consequences of the Land Deed Official that does not meet the minimum price standard on purchasing flats for foreigners. This study is normative legal research that uses a statutory approach and a legal concept analysis approach. Legal materials are collected using the snowball method and analyzed systematically with legal discovery techniques. The results showed that the legal certainty of the Land Deed Official that does not meet the minimum price standard in purchasing flats for foreigners according to the provisions of Article 11 of the Republic of Indonesia Government Regulation Number 103 Year 2015 on Housing Ownership or Occupancy by Foreigners Occupied in Indonesia. the law and the legal consequences of the Land Deed Official which does not meet the minimum price standard for the purchase of flats for foreigners are null and void, because they are contrary to the legal objective conditions of the agreement stipulated in the provisions of Article 1320 of the Civil Code about a particular measure that is clear, required and justified by law.

Abstract

Pada dasarnya hak ingkar adalah hak untuk mengundurkan diri dari memberikan kesaksian dimuka Pengadilan dalam masalah Perdata maupun Pidana. Dalam perkara perdata notaris lebih leluasa untuk menggunakan hak ingkar yang diberikan undang-undang kepadanya. Istilah hak ingkar ini merupakan terjemahan dari bahasa Belanda verschoningsrecht yang artinya adalah hak untuk dibebaskan dari memberikan keterangan sebagai saksi dalam suatu perkara perdata maupun pidana. Hak ini merupakan pengecualian dari prinsip umum bahwa setiap orang yang dipanggil sebagai saksi wajib memberikan kesaksian itu. Hak Ingkar dapat dilihat dalam Pasal 16 ayat (1) huruf e UU No 30 Tahun 2004 tentang Jabatan Notaris.

Abstract

Indonesia's position in electoral development is getting better because of the legislation. It is different when a strong bargaining position is artificial. In this case, the state becomes strong because of its own efforts such as having sophisticated technology programs, producing sophisticated weapons, or having world-class athletes. The problem is when the candidate listed in the empty ballot has been elected by the community but the chosen one does not win, then such election is actually not of the will of the community. This study uses normative legal study design which means that it is normative juridical legal research. The approaches used in legal research are statute approach, case approach, and conceptual approach. Future elections will no longer change when there is no legal clarity in Indonesia if the robot is included in it. The election aimed at robots for is not being a contradiction but is a way out to produce elections that are truly fair. When we choose robots in the elections, artificial intelligence holds norms in society. Artificial intelligence will become a habit in Indonesia, turning to jus cogens because its main nature is indirect force.
