Abstract

Kasus prostitusi menjadi fenomena yang selalui mewarnai penegakan hukum di Indonesia. Modus operandinyapun kian berkembang, yang saat ini marak adalah prostitusi online. Meskipun prostitusi telah diatur dalam KUHP dan terkait transaksi online bisa ditemukan dalam UU ITE namun, faktanya kasus prostitusi online sulit untuk diberantas. Hal ini dikarenakan hanya mucikari yang bisa dipertanggungjawabkan secara pidana, sedangkan PSK (Pekerja Seks Komersial) dan pengguna jasa prostitusi online tidak bisa dipertanggungjawabkan secara pidana. Hal ini tentu perlu direkonstruksi kembali sehingga penting untuk dikaji mengenai pengaturan prostitusi online dan politik hukum pemberantasan prostitusi, khususnya terkait kriminalisasi PSK (Pekerja Seks Komersial) dan pengguna jasa prostitusi online. Penelitian ini menggunakan jenis penelitian hukum normatif. Hasil studi menunjukkan bahwa KUHP tidak mengatur pemidanaan terhadap PSK dan Pengguna jasa prostitusi online, sehingga tidak bisa dipertanggungjawabkan secara pidana. Apabila dikaji peraturan di luar KUHP terkait prostitusi online, PSK dan pengguna jasa dapat dijerat dengan menggunakan UU ITE, namun aturan ini masih bersifat umum yang mengatur larangan yang melanggar kesusilaan. Pengaturan prostitusi juga dapat ditemukan dalam Peraturan Daerah (Perda), namun tidak semua daerah memiliki atau mengeluarkan Perda tentang Prostitusi, sehingga keberlakuannya terbatas pada territorial. Politik hukum yang dapat diambil adalah dengan pembaharuan hukum pidana dengan mensinergikan konsep rancangan KUHP yakni dengan mengkriminalisasi dan mengatur pemberian ancaman pidana terhadap PSK dan pengguna jasa prostitusi online agar bisa dipertanggungjawabkan secara pidana (penalisasi).

Abstract

Dewasa ini dalam kehidupan masyarakat sering terjadinya konflik atau sengketa. Termasuk sengketa pertanahan yang marak terjadi di lingkungan masyarakat adat khususnya masyarakat adat di Bali. Berbagai macam cara dilakukan masyarakat untuk menyelesaikan sengketa pertanahan yang terjadi. Baik melalui lembaga pengadilan (litigasi) amupun lembaga di luar pengadilan (non litigasi). Alternatif penyelesaian sengketa banyak ditempuh oleh masyarakat karena dinilai lebih efektif dan tidak memakan waktu dan biaya yan g lebih. Salah satu alternatif penyelesaian sengketa yang sering di tempuh adalah melalui jalur Mediasi atau perdamaian. Apalagi dalam menyelesaikan sengketa tanah adat di Bali. Alternatif Penyelesaian Sengketa tanah adat di Bali sering ditempuh melalui proses mediasi karena dinilai lebih efektif ,tidak memakan waktu lama dan biaya yang tinggi. Dalam penelitian ini dibahas dua permasalahan yakni Bagaimana urgensi mediasi sebagai alternatif penyelesaian sengketa tanah adat di Bali dan Bagaimana proses mediasi dalam alternatif penyelesaian sengketa tanah adat di Bali. Penelitian ini mempergunakan jenis penelitian hukum normatif karena memfokuskan analisa terhadap norma hukum yang muncul dengan menggunakan pendekatan perundang-undangan dan pendekatan analisa konsep hukum. Kompleksnya persoalan tanah adat di Bali dan sedikitnya aturan tertulis mengenai hal itu, maka Mediasi sebagai alternatif penyelesaian sengketa tanah adat di Bali menjadi hal yang sangat urgen karena sengketa dapat diselesaikan secara efektif dan efisien. Dan untuk proses mediasi tidak diatur dalam peraturan perundang- undangan, sehingga proses mediasi cenderung dilakukan menurut kebutuhan para pihak yang bersengketa sesuai dengan arahan dan petunjuk dari mediator.

Abstract

The Law about the Guarantee of Halal Products in Indonesia are crucial, it is normal because Indonesian residents who are Muslim, the state are obliged to guarantee the rights of Muslim consumers. The existence of Law No. 33/ 2014 About JPH, which guides the rights and obligations of business actors with halal products, is expected to provide legal certainty and guarantee for Muslim consumers. Strengthened by the issuance of Government Regulation No.31/ 2019 followed by the issuance of Regulation of the Minister of Religion Number 26/2019 About JPH Administrators. This paper was published to describe the implementing agencies and enforcement of halal certification in Indonesia. The method utilized in this paper is the statutory approach, which is carried out by reviewing all laws that are related to the current legal problem. The result is the existence of PP No.31/2019, it is increasingly clear that the closeness of the halal and haram issues in Indonesia. It shows that there are three institutions urgent they have the authority to carry out halal certification in Indonesia, namely BPJPH, LPH, and MUI. BPJPH has the authority to among others, with the Ministries, the form of cooperation must be in accordance with the duties and functions of each ministry. Meanwhile, the procedure for submitting certification is carried out in six stages, starting from submitting an application, completing inspection, determining the LPH, examining/testing by a halal auditor, determining halalness by MUI and finally get a halal certification. The obligation for halal certification in accordance with UUJPH is enforced from 17 October 2019 to 17 October 2024. The implementation is carried out in stages by taking into account the readiness of business actors, the infrastructure for implementing JPH, considering the type of product as primary needs and being used massively.

Abstract

Penyandang disabilitas memiliki hak, kedudukan dan kewajiban yang sama dengan warga negara lainnya. Berdasarkan data potensial pemilih pemilu (DP4) bulan desember tahun 2018 bahwa penyandang disabilitas di Sumatera Barat sebanyak 9.172 jiwa. Besarnya jumlah disailitas dapat memberikan peluang akan kecurangan dalam pemilihan umum. Tujuan penelitian ini untuk mengetahui pemenuhan hak pilih bagi disabilitas khususnya di provinsi Sumatera Barat. Pendekatan dalam penelitian ini adalah yuridis sosiologis yaitu suatu studi yang meninjau hukum sebagai fakta sosial. Hasil penelitian menunjukan bahwa pemenuhan hak pilih bagi penyandang disabilitas dalam pemilu serentak oleh Komisi Pemilihan Umum (KPU) di Sumatera Barat dilakukan dengan melakukan pendataan, sosialisasi dan memberikan akses. Kendala dalam pemenuhan hak pilih yaitu paradigma keluarga, paradigma petugas dan minimnya data disabilitas.

Abstract

Air transportation services are currently experiencing very rapid development, this is indicated by the emergence of many various air transportation service providers in the Indonesian market. Many passenger rights are not properly cared for or fulfilled by the airline, especially if things happen that are not desired, one of which is the case of flight schedule delays. The formulations of the problems in this study are: 1) What is the legal protection for airplane passengers if there is a delay in flight schedules according to Law No.1 of 2009, 2) What are the efforts that aircraft passengers can make if they have been harmed due to flight schedule delays. This type of research is normative legal research. This study uses the Legislative Approach. The conclusion of this research is that the airline is responsible for delays in flight schedules that cause losses to passengers, here the airline applies the concept of presumption of liability. However, on the one hand, there is a condition where if the delay is due to weather and technical operational factors, the airline is not required to provide compensation to passengers in accordance with Article 146 of Law Number 1 of 2009. The process of compensation activities between consumers and airlines can be carried out when the consumers fly. a summons to the airline, but if it is ignored, the consumer can take court or outside the court route according to law number 8 of 1999 concerning consumer protection.

Abstract

Penerapan asas retroaktif pada kasus bom Bali I berdasarkan Undang-Undang Nomor 16 Tahun 2003 dimaksudkan untuk memberikan rasa keadilan kepada masyarakat, namun uji materil atas penerapan norma retroaktif tersebut dinilai inkonstitusional oleh Mahkamah Konstitusi melalui keputusan nomor 013/PUU-I/2003. Pro dan kontra dari putusan tersebut terjadi di masyarakat, antara menegakkan kepastian hukum atau memenuhi rasa keadilan bagi para korban. Tulisan ini berupaya mengkaji putusan Mahkamah Konstitusi No. 013/UU-I/2003 dengan memaparkan pertimbangan hukum MK dalam memutus perkara tersebut. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Tulisan ini menyimpulkan bahwa asas nonretroaktif merupakan asas yang mutlak harus ditegakkan karena merupakan salah satu asas yang menjamin perlindungan hak asasi manusia yang tidak dapat dikurangi dalam keadaan apapun.

Abstract

The higher the number of people affected by COVID-19, the government continues to aggressively issue regulations to suppress the growth of new cases and minimize new clusters of the spread of COVID-19. The Tabanan City Traditional Village, which has been listed twice as being in the red zone for the spread of Covid-19, is responding to the increasingly rampant Covid-19 pandemic problem by forming a perarem or customary rules that apply to the local Traditional Village, namely the Tabanan City Customary Regulation Number 5 of 2020 on the Regulation of Prevention and Control of Gering Agung Covid-19. This Perarem was ratified on July 19, 2020 and has been gradually socialized to the traditional banjars. The purpose of the formation of this regulation itself is to break the chain of the spread of Covid-19 and increase the discipline of the village community because this regulation also includes fines. As for the problem that will be studied, how are the legal arrangements regarding violations of health protocols during the Covid-19 pandemic in the traditional village of Tabanan city? and how is the ideal reconstruction of customary law in overcoming violations of health protocols during the Covid-19 pandemic in the traditional village of Tabanan city?. The method used in this research is the empirical legal method and is studied with a statutory approach. The results of this study are the traditional village of Tabanan City already has the Pararem of the Traditional Village of Tabanan City Number 5 of 2020 which includes fine sanctions for violators of the health protocol, only that there are still many people who do not comply with these regulations. To overcome this, it is necessary to reconstruct norms so that there are no gaps that can be exploited by health protocol violators.

Abstract

The application of the Online Single Submission (“OSS”) is implemented by the government in order to streamline the business licensing process which has been considered very inefficient and requires a lot of time and money, requiring all Limited Liability Companies (“PT”) established under the laws of the Republic of Indonesia to obtain a Business Identification Number. (“NIB”) and further adjust the permits previously obtained by each of the PT, both those related to operations and non-operations, with the permits issued by OSS. As a result of the implementation of the OSS, companies that have applied for and obtained a Business Permit (Target Business Registration Certificate) but have not yet become effective, must fulfill other commitments, one of which is the Certificate of Feasibility of Function (“SLF”). The formulation of the problem in this study: (i) Application of the arrangement of the Function Feasibility Certificate (SLF) for buildings in the Province of Bali, (ii) the urgency of the implementation of the Commitment to the Certificate of Feasibility of Function (SLF) in the Province of Bali. This research uses normative legal research methods, with a statutory approach and legal concept analysis. The theory used in examining the problems in this research is the theory of economic law, the theory of state sovereignty and the conception of law as a policy process. Through this research, it can be determined the urgency of implementing the commitment to the Certificate of Functional Worth (SLF) for buildings in Denpasar City. Consistency of professional application based on justice, certainty and legal benefits by the government is needed so as to create economic growth through ideal and sustainable tourism in Bali. The benchmark for implementing the SLF commitment is by taking into account various legal factors and the efficiency of government policies in a deep, structured and systematic manner.

Abstract

Technological advances that are developing very rapidly not only have a positive impact on people's lives but also have a negative impact. The ease of freedom of expression by relying on technology brings new developments in types of crime, namely hate speech on social media in the form of typed or video. If this is not regulated further, it will be very worrying, people will cross the line and will cause discomfort or feeling offended by a certain person or group. Criminal law has certainly paid attention to the consequences that will be faced by someone who intentionally or unintentionally commits this crime of hate speech. In this article, we will discuss how criminal law views hate speech crimes and will also discuss how the proof system in this hate speech crime is. The method used is normative legal research which is carried out by examining library materials and the approach used is a legislative approach related to hate speech crimes. The results and discussion obtained are that if we look at the Criminal Code and other laws and regulations, several articles that can be imposed on someone who commits hate speech have been explained. Articles that regulate actions regarding hate speech against a person, group or institution based on the Circular Letter of the Chief of Police No: SE/06/X/2015 are contained in Article 156, Article 157, Article 310, Article 311, then Article 28jis. Article 45 paragraph (2) of Law Number 19 of 2016 concerning information and electronic transactions and Article 16 of Law No. 40 of 2016 concerning the elimination of Racial and Ethnic Discrimination. regulated in the Criminal Code.

Abstract

A crime or a criminal act is a problem that affect humans from time to time, why the commission of a crime can be happening and what pemberantasnya is a problem that little disputed, one of which is of sexual crimes against children. There are several factors of sexual crimes against children the progress in technology that is not only give positive impact but is also negative. Based on the discussion it can problems: is as follows, aims to review the penyabab the pencabulan crimes against children and prevention efforts made by Polresta Denpasar. The research is empirical legal research, empirical research law pull yourself out of the gap between the theory and reality.
