Abstract

Marriage registration is important for the validity of a marriage because it will provide legal protection and guarantee the rights arising from marriage. Marriages with falsified registration as in this study are sirri marriages where the husband and wife consciously take legal action in the form of forging marriage books. This paper describes the problems, firstly marital status with its falsified recording from the perspective of positive law and Islamic law. Second, the judge's legal considerations. Third, legal protection of rights arising from marriages without registration. The research method used is analytical descriptive. The results of the study show that: First, marital status with falsified records from the perspective of positive law and Islamic law (in this case the Compilation of Islamic Law) is valid and has legal force. However, there are negative implications for the non-fulfillment of the wife's rights as a result of divorce, if the excerpt of a marriage certificate that has been decided by the District Court has no legal force/fake is used as evidence in a divorce case at the Religious Court. Second, the Judge at the Religious Court in his legal considerations stated that even though the marriage certificate was fake, this certificate was made consciously and is known together. The Mataram District Court Judge in his legal considerations was a decision regarding an alleged unlawful act in the form of a fake marriage certificate, not a decision that annulled the marriage. As for marriages carried out without registration, the state cannot provide legal protection unless there is material truth that can be proven in court.

Abstract

Government initiatives to improve public services are critically necessary by taking into account the region’s entire potential. The regional government employs infrastructure development for public services by allocating funds in the form Regional Government Budget (RGB)) from the regional capital expenditure budgets. The infrastructure development allows the regional government to collect levies and taxes on to boost the Local Own-Source   Revenue This study aims to investigate the causality between regional capital expenditure and Local Own-Source Revenue in 11 regencies / cities in Maluku province for a 10-year period (2011-2020). A quantitative method using a Granger causality approach was employed. The data was collected using a purposive sampling method from the Statistics Indonesia of Maluku and analysis with Multiple Linear Regression Method. The results show that there is a unidirectional relationship between the Local Own-Source Revenue and regional capital expenditure. However, there is no causal relationship between regional capital expenditure and Regional Original Income. These results indicate that capital expenditure does not indicate the funding source for Local Own-Source. The implication is that Local Own-SOurce has not been able to meet capital expenditure needs. Therefore, the ability of regional governments to optimize regional income sources through extensification and intensification of potential economic sources reduces regional governments' dependence on central government finance.

Therefore, using safety motivation as a mediating mechanism, this research attempts to understand and quantify the impact of safety leadership, social capital, and safety awareness on ship crew SCB. The study employs a causal design and survey methods in a quantitative manner. 120 crew members of passenger ships that were docked at Tanjung Priok Port in Jakarta made up the sample. A Likert scale questionnaire was utilized as the research tool for safety leadership, social capital, safety awareness, safety motivation, and SCB. Google Forms-formatted questionnaires were sent out by email and WhatsApp. Partial least squares (PLS)-based structural equation modeling (SEM) analysis was used to analyze the data. The study's findings indicate that safety leadership, social capital, safety awareness, and safety motivation all have a significant impact on SCB; additionally, safety leadership, social capital, and safety awareness all have a significant impact on safety motivation, which in turn has a significant impact on SCB through safety motivation. These results validate the novelty of the safety leadership, social capital, and safety awareness mediation model's effect on the SCB of passenger ship crew through safety motivation.
