Abstract

A very important role of a bank as a business entity is a bank that has the function to raise funds from the public in the form of deposits and channel the funds raised to the public. After granting funds from the Bank to the debtor, the next issue of concern is the extraction of funds that have been disbursed through bank credit. Not all credit disbursements can be paid off by the debtor, so often the debtor takes unilateral actions by transferring the loan repayment obligation to a third party without the bank's knowledge. In order to answer the problems in this study, the author uses a type of normative research supported by primary data obtained by the author from interviews with various sources. The intent and purpose to be achieved by the author in this study is the validity of the binding agreement on the sale and purchase of object mortgage rights that are still bound in the bank. Making the Sale and Purchase Agreement by the parties alone has no impact at all on the position of ownership rights on the goods traded. The right to land has not been transferred to the buyer, even though the price has been paid, because the ownership rights to the land have only been transferred to the owner if what has been called juridical delivery. All forms of land rights transfer must be made in an authentic deed. All acts of sale on the object of Underwriting Rights that are not in accordance with the procedure cause the legal act is null and void. This is in line with the provisions of Article 20 paragraph 4 of the Underwriting Rights Act. Therefore, the position of making a binding agreement on buying and selling is not binding legal force

Abstract

The state is obliged to seek public order and public at the same time is obliged to comply with any regulatorion and government decisions relating to public order. In Batam, as well as in other cities in Indonesia, public order offenses are still common, including violations of the prohibition of building in the roads. This is a socio-legal study that uses primary data which were obtained from interviews and observations. Secondary data consists of primary and secondary legal materials were obtained from library research. Batam City Government through the Civil Service Police Unit and the Integrated Team appointed by the Mayor of Batam City are law enforcers who are assigned to ban buildings in the roads area used the following lews as their references: Law No. 38 of 2004 concerning Road and its Government Regulation Implementation, the Batam City Regulation No. 16 of 2007 on Public Order, the Batam City Regional Regulation No. 6 of 2013 on the Civil Service Police Unit and the Batam City Mayor Regulation No. 32 of 2013 on the Job Description of Batam Civil Service Police Unit. The implementation of the laws encounter obstacles, namely law enforcement factors, means and legal facilities, community factors, and cultural factors. Hence, it is suggested that it is a need of policy adjustments to strengthening law enforcement, providing means and facilities,and improving legal cultural of community. === Negara berkewajiban mengupayakan ketertiban umum dan masyarakat pada waktu sama wajib mematuhi setiap pengaturan dan keputusan pemerintah berkaitan dengan ketertiban umum itu. Di Kota Batam, sebagaimana juga di kota lainnya di Indonesia, pelanggaran ketertiban umum masih sering terjadi, termasuk pelanggaran pelarangan membangun di Daerah Milik Jalan. Penelitian ini merupakan penelitian yuridis-sosiologis yang menggunakan data primer yang diperoleh dengan wawancara dan observasi. Data sekunder terdiri dari bahan hukum primer dan sekunder yang diperoleh melalui penelusuran pustaka. Pemerintah Kota Batam melalui Satuan Polisi Pamong Praja dan Tim Terpadu yang diangkat oleh Walikota Batam di dalam melaksanakan penegakan hukum larangan mendirikan bangunan di Daerah Milik Jalan berpedoman pada dan menurut cara yang diatur dalam Undang-Undang Nomor 38 Tahun 2004 tentang Jalan dan Peraturan Pemerintah pelaksanannya, Peraturan Daerah Kota Batam Nomor 16 Tahun 2007 Tentang Ketertiban Umum, Peraturan Daerah Kota Batam Nomor 6 Tahun 2013 Tentang Satuan Polisi Pamong Praja Kota Batam dan Peraturan Walikota Nomor 32 Tahun 2013 Tentang Uraian Tugas Satuan Polisi Pamong Praja Kota Batam. Penegakan hukum larangan ini dalam penerapannya ternyata menghadapi kendala dari faktor penegak hukum, faktor sarana dan fasilitas hukum, faktor masyarakat,dan faktor budaya sehingga dibutuhkan penyesuaian kebijakan, penguatan sarana dan fasilitas penegakan hukum, perbaikan budaya hukum masyarakat.

Abstract

Tujuan penelitian ini adalah menganalisis pengaturan hukum terhadap perlindungan hak cipta pengrajin industri hijab di Kota Batam. Penelitian ini juga bertujuan menganalisis kendala dalam menerapkan perlindungan hak cipta bagi industri hijab di Kota Batam yang merupakan pengetahuan masyarakat tradisional di Kota Batam. Penelitian ini adalah penelitian hukum sosiologis yang menggunakan teknik pengumpulan data berupa wawancara dan observasi. Data dianalisis dengan menggunakan pendekatan kualitatif. Hasil penelitian mengungkapkan bahwa perlidungan hak cipta bagi industri hijab di Batam didasarkan pada Undang-Undang No.28 Tahun 2014 tentang Hak Cipta.

Abstract

This research aims to determine how the arbitration principles applied in the consumer disputes settlement based on Law No. 8 of 1999. This research used a normative legal research. After analyzing the data research, it can be seen that the implementation of the Arbitration principles in consumer dispute settlement in terms of Law No. 8 of 1999 was deviating from the Arbitration principles of arbitration pursuant to Law of Arbitration namely Law No. 30 of 1999. Among them was a court intervention in the Arbitration’s settlement in Consumer Dispute Settlement Board, whereas with the presence of the arbitration agreement, it should remove the authority of the district court to check the dispute. This kind of Consumer dispute settlement process, also adheres to the principle of final and binding decision, as referred to article 54 paragraph ( 3 ) of Law No. 8 of 1999, but it still opens for legal remedy of appeal so that it raises legal uncertainty. Hence, the arbitration principles cannot be applied in consumer dispute resolution pursuant to Law No. 8 of 1999 and may raise new legal issues. === Penelitian ini bertujuan untuk mengetahui bagaimanakah prinsip-prinsip arbitrase yang diterapkan dalam penyelesaian sengketa konsumen berdasarkan Undang-undang Nomor 8 tahun 1999. Penelitian ini merupakan penelitian yuridis normatif. Setelah dilakukan analisis terhadap data-data penelitian, dapat diketahui bahwa penerapan prinsip-prinsip arbitrase pada penyelesaian sengketa konsumen ditinjau dari Undang-undang Nomor 8 tahun 1999 tentang Perlindungan Konsumen adalah menyimpang dari prinsip-prinsip arbitrase menurut Undang-undang Arbitrase nasional yaitu Undang-undang Nomor 30 tahun 1999. Diantaranya adanya campur tangan pengadilan dalam penyelesaian secara Arbitrase di BPSK, padahal dengan adanya perjanjian arbitrase menghapus wewenang pengadilan negeri untuk memeriksa sengketa tersebut. Proses penyelesaian sengketa konsumen melalui BPSK, juga menganut prinsip putusan final dan mengikat, sebagaimana yang dimaksud di dalam Pasal 54 ayat (3) Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, namun masih dapat dilakukan upaya hukum keberatan yang dapat dilakukan oleh para pihak sehingga menimbulkan adanya ketidakpastian hukum. Atas dasar itulah prinsip-prinsip arbitrase tidak dapat diterapkan dalam penyelesaian sengketa konsumen menurut Undang-undang Nomor 8 tahun 1999 tentang Perlindungan konsumen dan menimbulkan permasalahan hukum baru.

Abstract

The law is an important instrument in a country. The law is a legal basis that is the basis for the implementation of all policies made by the government. In drafting a regulation, it must be sourced from the rules above so that it cannot be contradictory to the rules above. This study uses a qualitative method of judicial juridical, juridical imply legal research examines the implementation of positive legal provisions in each particular law. That is reviewing the Spatial Planning Law associated with Regional Regulation Number 7 of 2012 concerning the Karimun Regency Spatial Plan which was issued before the Establishment of Regional Regulation No. 1 of 2017 concerning the Riau Islands Province Spatial Plan. The results of the study show that in the preparation of spatial plans. according to Article 25 paragraph (1) of the UUPR, the drafting of the Regional Regulations for District Spatial Planning must refer to the provincial spatial plan and the national spatial plan. the issuance of Regional Regulation Number 7 of 2012 concerning Karimun Regency Spatial Planning which was published before the Regional Regulation Number 1 of 2017 concerning the Regional Spatial Plan of Riau Islands Province. Incompatibility was found on maps of space patterns and forest designation between Karimun Regency and Riau Islands Province, resulting in lack of legal certainty. Abstract

In order to solve the population problem particularly high population growth, the Government issued the Policy of Family Planning (KB). The implementation of KB programs in Indonesia is strengthened by the enactment of Law No. 52 of 2009 on Population Development and Family Development. Based on the Law, KB is interpreted as an attempt to regulate the child's birth, the distance and the ideal age to give birth, birth control through the promotion, protection and assistance in accordance with the reproduction rights to create quality family. The KB program aims to meet the demand for KB and reproductive health quality and controlling the birth rate, which in turn to improve the quality of people and small families. The purpose of this study was to analyze the implementation of Law No. 52 of 2009 on Population Development and Family Development to support the programs of KB services in Batam, as well as to discover the obstacles, support and solutions in the implementation of the policy. The data collection conducted by interviews and field observations with a sample of the KB Field Extension Workers (field officers) in Batam City. Based on the research results, the programs of KB services in the Batam City has not been effective because of the inadequate structure, substance and culture which are reflected as evidenced by Nomenlektur Family Planning Agency that has not stood itself, but it has embodied in the form of institutional insertion and the lack of resources, skills and abilities as well as a load-intensive tasks of Family Planning Officers in Batam City. Dalam rangka mengatasi masalah kependudukan khususnya tingginya pertumbuhan penduduk, Pemerintah mengeluarkan Kebijakan Keluarga Berencana (KB). Pelaksanaan program KB di Indonesia diperkuat dengan ditetapkannya Undang-Undang Nomor 52 Tahun 2009 tentang Perkembangan Kependudukan dan Pembangunan Keluarga. Berdasarkan Undang-Undang tersebut KB diartikan sebagai upaya mengatur kelahiran anak, jarak dan usia ideal melahirkan, mengatur kehamilan melalui promosi, perlindungan dan bantuan sesuai dengan hak reproduksi untuk mewujudkan keluarga yang berkualitas. Program KB bertujuan untuk memenuhi permintaan pelayanan KB dan Kesehatan Reproduksi (KR) yang berkualitas serta mengendalikan angka kelahiran yang pada akhirnya meningkatkan kualitas penduduk dan mewujudkan keluarga-keluarga kecil berkualitas. Tujuan penelitian ini adalah menganalisis implementasi Undang-Undang Nomor 52 Tahun 2009 tentang Perkembangan Kependudukan dan Pembangunan Keluarga dalam menunjang program pelayanan keluarga berencana di Kota Batam, serta menemukan hambatan-hambatan, penunjang dan solusinya dalam implementasi kebijakan tersebut. Pengumpulan data dilakukan secara wawancara dan observasi lapangan dengan sampel para Tenaga Penyuluh Lapangan Keluarga Berencana (PLKB) Kota Batam. Berdasarkan hasil penelitian bahwa pelayanan KB di Kota Batam belum efektif, di karenakan struktur, subtansi dan kultur yang tidak memadai, tercermin dengan Nomenlektur Badan Keluarga Berencana yang belum berdiri sendiri, tapi masih dalam bentuk penyisipan kelembagaan dan keterbatasan jumlah, kemampuan dan keterampilan serta beban tugas yang banyak dari petugas yang membidangi KB di Kota Batam.

Abstract

Sengketa Informasi Publik merupakan sengketa yang terjadi antara Badan Publik dan Pengguna Informasi Publik berkaitan dengan hak memperoleh dan menggunakan informasi menurut ketentuan yang diatur dalam Undang-Undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik, para pihak yang tidak puas terhadap Putusan Komisi Informasi dapat melakukan gugatan kepada Pengadilan Tata Usaha Negara (PTUN). Artikel ini membahas dua permasalahan utama, pertama bagaimanakah penyelesaian sengketa informasi publik di PTUN Indonesia dengan studi kasus Putusan PTUN Jakarta Nomor 3/G/KI/2016/TUN, Kedua, bagaimana model penyelesaian sengketa informasi publik di PTUN Korea Selatan? Metode penelitian yang digunakan adalah penelitian hukum nomatif dengan pendekatan undang-undang dan pendekatan komparasi. Hasil penelitian menunjukkan PTUN Indonesia mempunyai kewenangan absolut dalam penyelesaian sengketa informasi publik apabila telah terlebih dahulu diputus melalui ajudikasi non litigasi oleh Komisi Informasi dan proses penyelesaian sengketa informasi publik di PTUN merupakan penyelesaian sederhana karena pemeriksaan hanya dilakukan terhadap Putusan Komisi Informasi Pusat, berkas perkara serta permohonan keberatan dan jawaban atau keberatan tertulis dari para pihak tanpa mediasi. Sedangkan di PTUN Korea Selatan pemohon infomasi dapat langsung mengajukan keberatan terhadap badan publik yang memutuskan untuk menolak menyampaikan informasi melalui banding administratif atau litigasi administratif.

Abstract

Abstract In the case of Buni Yani propaganda that spread the video of Basuki Tjahaja Purnama alias Ahok's speech which was carried out in a campaign with explanation of Surat Al Maidah 51. Buni Yani did engineering on the video and uploaded it to his Facebook page by adding caption. Buni Yani's actions result in hatred or hostility of Muslims against Basuki Tjahaja Purnama who is ethnic Chinese and non-Muslim or Christian faithful. The purpose of this study is analyze and describe Buni Yani propaganda action, effectiveness Law Number 11 of 2008 Concerning Electronic Information And Transactions of handling propaganda matters in Indonesia especially in Basuki Tjahaja Purnama and Buni Yani case and another effective factor to deal with the issue of propaganda in Indonesia. This research is normative law research (juridical). The method that used in this research is secondary data collection with books, journals, research result, internet search and important document of institution in this research. This study using law effectiveness as main analysis in this research. Result of this study, outline of law factor and outline of law enforcement factor has been effectively respond Basuki Tjahaja Purnama and Buni Yani case while tool factor or factor that support enforcement, society factor, and culture factor that less effective and development needed in order to resolve propaganda electronic information effectively and efficiently. Abstrak Pada kasus propaganda Buni Yani yang menyebarkan video pidato Basuki Tjahaja Purnama alias Ahok yang dilakukan dalam menjalani kampanye dengan penjelasan tentang Surat Al Maidah 51. Buni Yani melakukan rekayasa terhadap video tersebut dan diunggahkan ke laman Facebook-nya dengan menambahkan caption. Perbuatan Buni Yani tersebut mengakibatkan kebencian atau permusuhan umat Islam terhadap Basuki Tjahaja Purnama yang beretnis Tionghoa dan beragama non Islam atau beragama Kristen. Tujuan dari penelitian ini adalah untuk menganalisis dan menguraikan perbuatan propaganda Buni Yani, efektivitas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik dalam menangani persoalan propaganda di Indonesia khusus dalam kasus Basuki Tjahaja Purnama dan Buni Yani dan faktor lain yang efektif untuk menangani persoalan propaganda di Indonesia. Penelitian ini merupakan penelitian Hukum Normatif (Yuridis). Metode yang digunakan dalam penelitian ini adalah pengumpulan data sekunder dengan mengumpulkan buku, jurnal, hasil penelitian, penelusuran internet dan dokumentasi berkas-berkasi penting dari institusi yang diteliti. Penelitian ini menggunakan teori kefektivitas hukum sebagai dasar analisis di dalam penelitian ini. Berdasarkan hasil penelitian, secara garis besar faktor hukum dan faktor penegak hukum telah efektif dalam menanggapi kasus Basuki Tjahaja Purnama dan Buni Yani sedangkan faktor sarana atau fasilitas yang mendukung penegakkan hukum, faktor masyarakat, dan faktor kebudayaan masih kurang efektif dan perlu dilakukan pengembangan agar dapat mengatasi informasi elektronik yang bersifat propaganda secara efektif dan efesien.

Abstract

Peraturan Pemerintah Nomor 99 Tahun 2012 tentang Perubahan Kedua atas Peraturan Pemerintah Nomor 32 Tahun 1999 tentang Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyarakatan yang ditetapkan pada tanggal 12 November 2012, yang mengatur mengenai syarat dan tata cara pelaksanaan hak warga binaan khususnya tindak pidana terorisme, narkotika dan prekursor narkotika, psikotropika, korupsi, kejahatan terhadap keamanan negara dan kejahatan hak asasi manusia yang berat serta kejahatan transnasional terorganisasi lainnya dalam pelaksanaannya masih menimbulkan beberapa permasalahan. Permasalahan dalam penelitian ini diteliti dengan menggunakan penelitian hukum normatif. Penelitian ini menemukan bahwa terdapat permasalahan dalam penegakan hukum dalam pemberian remisi kepada narapidana tindak pidana tertentu. Asas persamaan di depan hukum merupakan asas mutlak dari hak asasi manusia, namun asas tersebut dilanggar dalam pembatasan pemberian remisi dalam PP No. 99 Tahun 2012.

Abstract

Witness is a person who sees, hears, and directly experiences the occurrence of a criminal act. The information conveyed by the witness can assist the investigation process to the court to reveal the actual criminal suspect. Meanwhile, victim is a person experiencing the occurrence of a criminal act that causes harm materially or physically. This study uses empirical research methods which in this study the writer used research from primary data.The results of this study are witnesses and victims have priority in their statements during the investigation process of criminal cases both at the investigation stage and the court investigation stage. The implementation of protection as in the Act on Witness and Victim Protection in Batam City has not been fully effective because there are several rights of witnesses and/or victims that cannot be fulfilled by the Police since there are no special authority and special budget to provide protection for witnesses and/or victims in criminal cases in Batam city.
