Abstract

General Explanation of Law Number 11 Year 2006 concerning Aceh Government stated that the trip constitutional Republic of Indonesia put Aceh as a unit of regional government that are special and specific, relating to the distinctive character of the historical struggle of the people of Aceh who have endurance and perseverance. Aceh's community life, articulated in a modern perspective of the state and government to be democratic and accountable. Such order of life is the embodiment in the motto Unity in Diversity. Keppres not have the capacity to regulate the power and authority of the judiciary especially Shari'a Courts in Nanggroe Aceh Darussalam. This is because the law has expressly delegated to the Qanun Aceh province to regulate the authority of the Court Syar'iyah based benchmark defined solely by the law that is based on the Islamic Shariah. But if we are concerned about the progress of the preparatory steps undertaken in order to take over its jurisdiction by the Court and the District Court Syar'iyah is still far from optimal, so for the time given device either incomplete legislation, secretariat and other Syari'yah Court administration still seems to take longer for the Court Syari'yah Aceh province can take over completely the authority of the District Court.

Abstract

The movement of feminism is to seek justice, want to put women in a position that is proportional, equal, and equal with men so that no differences were discriminatory. Departing from the realization that Ziba Mir-Hossemi Iran underlines feminist critical theory from a feminist perspective, as well as re examine its validity through the viewpoint of reality and contemporary gender theory. He did not merely expose the gender bias that exists and inherent in the rules of jurisprudence and various contradictions, but also look at whether the rules reflect the Shari'a justice or whether it indicates the importance of individual and communal a Muslim society. Ziba assess that women have a close connection to the discourse on Islamic law, especially in issues around marriage and family. Ziba reminded that although in the debate fiqh women are not much noise because it is dominated by men who have the power as "scholars", does not mean women silent. There are social spaces and the political is always open, where women knit solidarity and social transformation efforts to change the face of a country.

Abstract

Indonesia, with majority population of muslims, was still not able to break away from the coil's economic problems. Utilization of funds infaq mosque just spinning at the mosque operations, for the cost of cleaning, electricity, personnel, and so on. Indeed infaq funds could be more useful, not only for the mosque, but also maintenance costs can be optimized for other things. Other Reforms in order to improve the welfare of the people, the purchase of the means of production, provision of scholarships and many more. This study took place in the Village Kalipakem Donomulyo District of Malang. This study design is Participatory Action Resarch (PAR), which is carried out through four stages, namely: planning (planning), action (action), Observe (observation), reflect (reflection). Each stage PAR here have a different time with each other. Changes resulting from this PAR is as follows: First, the public began to understand how important it is as hard as possible by empowering potential. By utilizing infaq mosque, they are expected to improve the quality of their economy, so that it can be used as a tool to minimize the villagers abroad; Second, people start to feel mutual helping and work together to reduce poverty, either through a scholarship search and borrow money infaq productively to improve the quality of work; Third, people have the skills and knowledge that are more related primarily related jurisprudence mosque Infaq Productive; Fourth, the public as early as possible has anticipated things which could adversely impact on the actions of the exploitation of existing productive infaq funds under the supervision of the local mosque

Abstract

Marriage friend is a form of marriage muslim teenager without providing shelter and sustenance as requirement, but the couple was still living with a parent , the cost of living still depend on both parents, and they could only meet at any time and agree not to have children first while living apart. In other words, an outline of the purpose of marriage friend is not like the purpose of marriage in Islam, according to the author. The goal is not to establish family relationships and build household, but purely sexual relationship and he belongs to the category of marriage are illegal and should not be done. In addition, the marriage friend could not exist the ideals of marriage itself, namely fostering households sakinah mawaddah wa rahmah. Because a husband doesn’t live together in one house, just stay for a while or live separately, he was just using her for purposes not get a descent so that there is no element of responsibility, and it has been any deviation from God's purpose in marriage ordained. Marriage friend or zawaj al-asdiqa 'is more directed at the fulfillment factor mere sexuality, and bring more harm than maslahat. Marital friend obviously more harm and will bring great fitnah among the people, so that marriage friend are better left for wreaking havoc.

Abstract

The study in this article shows that the story of Prophet Yusuf Ya'qub and contains elements of education. The method of teaching which is reflected in the story of Prophet Yaqub and Yusuf-psychological form of interactive dialogue which provides a guide for action and reaction educators learners. While the competence of educators and ethics learners in the story of Jacob and Joseph can be described as the attitudes held by the subject of such learners, such as: patience, secrecy, develop talents individually, look at the social conditions in advance if it will deliver something, conjugate dreams, love, take advantage of the situation, it is easy to forgive, pray for others, and let go and submit to Allah SWT. As educators and learners, if able to implement educational pattern as described above, then God willing, will be born generation, superior and competitive because it is born of the pattern of Qur'anic education. Qur'anic education pattern is a pattern of education is always ascribe all the teaching material to the teachings of monotheism.

Abstract

Abstract

This paper starts from two question as; what do Surabaya community motivate polygamous? and how are the procedures of polygamy in the Marriage Law and Islamic law? This research was qualitative. Therefore, the data collected through the reading of the text of legislation and interviews with the subject of research as well as interviews with people who are competent in the field of the problems studied. Then the results were analyzed using descriptive analytical techniques. The results of this study explained that of the 120 cases of polygamy (officially and Sirri) in Surabaya, hence the reason/motivation and procedures polygamy in Surabaya can be concluded that there are several reasons as the basis of polygamists, there are 64 grounds on which to base polygamy in Surabaya, yet only 38 reasons (applicant) or only 59.3% of applicants who meet the criteria of reason in accordance with the legislation in force, and can be recommended to carry out polygamy. While the findings based on the procedure, which is used polygamists in Surabaya, to 64 cases of polygamy official, the phase of the inspection process in the PA Surabaya, there are 33 polygamists, or 51.5% of qualified and worthy to the next phase. While the remaining 31 polygamists or 48.4% did not qualify cumulative. Meanwhile, the phase of the ceremony, an official of the 64 cases of polygamy, it turns out not all polygamous marriages recorded in VAT and registered at KUA, but married Sirri as many as 9 polygamists or 14%, and there are polygamists who cancel for polygamy. Abstract

The development of education, especially Islamic education in Indonesia have ups and downs. In the early period of Islamic education are dominated by typical salaf pesantren education. Pesantren education emphasizes the mastery of Islamic studies in depth. These studies are made directly to the Islamic treasury in the form of the book in Arabic. This is what arise to the study of the yellow book. According to experts, the lack of a typical Islamic studies schools lies in a dialectic with modern science, especially in the scientific methodology. The solution offered in the form of an integrated Islamic studies between education schools and scientific education. Thus was born the model schools Government Elementary School, MTs, and Madrasah Aliyah to Islamic High School or Institute for Islamic Studies. School integrative model of early development is quite promising. However, the longer school integrative model is considered a shift from the original purpose. In fact, many students and school products integrative model results do not meet expectations. Students and school leavers integrative model is not much different than public school graduates. This then raises its own anxiety over the fate of studies and Islamic education. Regeneration Ulama 'the main purpose of Islamic studies to be neglected. Here, then, Diniyah Formal Education as an alternative to the model of Islamic studies salaf pesantren education and integrative education model. With hope, graduates become mutafaqqih fid-din, deep in the typical Islamic studies pesanten, scientists intellect, berakhlaqul karimah and insightful moderate.

Abstract

Human rights issues are still a never-ending debate, between a Western perspective and an Islamic perspective. Muslims responded in various ways. The difference of views on the articles in the declaration is inseparable from the differences in the background and interpretation of religious and historical texts in the golden age of Islamic history. Among the attitudes of Islamists to the Declaration of Human Rights, as follows: First, reject the Declaration of Human Rights. There are several classical reasons which are the factors behind why Islamists reject them. Among other things, it is a very different socio-cultural condition between the West and Islam. References of different values, in the West embrace liberal values ​​or abandon the values ​​of Christianity, which assume authority entirely in the hands of man, without including the sovereignty of God. The paradigm of some Muslims to this day, still assume that religion has universal coverage, while human rights have only part of the universal religion rather than vice versa. Secondly, to receive fully, for seeing the teachings and values ​​of Islam in a substance. The group is of the opinion that the Declaration of Human Rights is in accordance with the teachings of Islam, both in substance and mission that fought. Abstract

The controversy over the devil as a "convicted" creature, accursed and driven from heavenly pleasures is a dramatic and perennial narrative in every divine religion. Since God proclaimed to create the first ruler of earth (read Adam), the devil not only presents himself as a dissident and seductive creature of Adam and his grandchildren, as the conclusion of the classical and modern interpretations above, but also at the same time the symbol of the negative predisposition or personification of crime. No man is immune to the seduction of the devil, but the devil can not really deceive those who have always maintained their moral integrity from his attacks. The key to the defense of man against the temptations of the devil is the piety of Allah SWT.
