Abstract

To assess and find a sharia law on contemporary issues, including economic activity, it is absolutely required ushul fiqh. Supposing, ushul fiqh is the production process to produce a product of jurisprudence by means of operational standards qawa'id fiqhiyyah. A law of fiqih can not be removed from the proposition/source (the text of the al-Quran and Hadith) without going through the ushul fiqh and qawa'id fiqhiyyah. Not all qawa'id fiqhiyyah can accommodate interests in activities mu'amalah instead. Only a few of qawa'id is associated with transactions of mu'amalah instead. Thus, as the increased complexity of a trade and needs, it is of course necessary to study qa'idah even more, with reference to the methods outlined in ushul fiqh. Keywords: Qawa’id al-Fiqh, Principles of Sharia Economics

Abstract

The theory of Karl Marx’s Historical Materialism states that system of ownership is a necessity in the social system. Marx declares the social system development takes place in five stages. The first stage is primitive-communal society has have not recognized the system of ownership. The second stage is the stage of division of labor and the emergence of ownership. The third stage is formation of feudal society. The fourth stage is development of a capitalist community. The final stage is stage of development of the social system which is the formation of a socialist-communist society. If seen from ownership, the social-communal system is divided into three sections; the stage of primitive-communal society, the division of labor and the stages of ownership, and phase of the ownership elimination. According to Marx, the ownership of proletariat workers system suffers exploitation and alienation. Both of these things can only be solved by removing the ownership system which is replaced by the role of collective ownership. For Islamic economics, exploitation and alienation experienced by the proletariat workers are the result of inconsistencies in wealth management and distribution system in the capitalist system, not proprietary. Islamic Economics is looking at the role of individuals in managing their wealth and their distribution pattern. Keywords: Historical Materialism, Ownership, Exploitation, Alienation

Abstract

Islamic banking development that is increasingly requires the development of Islamic banking products, which are used to meet the needs and demands of its customers. Islamic banking can overcome or manage their liquidity in an Islamic way, both the sukuk and other types of investments, which certainly does not violate the Islamic sharia. The keys are used by banks in their liquidity management is the availability of primary and secondary reserves. In fulfillment of secondary reserve, bank can invest idle fund in Money Market. Islamic interbank money market is able to support smooth for Islamic banking to use Islamic interbank money market as a means to organize and manage liquidity. Interbank money market with Sharia principle is one of the facilities provided by Bank Indonesia as control of Indonesia banking in terms of utilization of idle funds held by Islamic banking. Interbank money market with Sharia, which has the right to publish is only a BUS or UUS because, in the future, BUS or UUS will be the manager of the funds, both in terms of SIMA (Mudharabah Interbank Investment Certificate) or SIKA (Commodity Interbank Certificate). Commodity Certificates based on Sharia (SIKA) is different with SIMA. SIKA uses murabahah contract. The trade is conducted in the commodity exchange. The interbank money market with Sharia principles is not much different from the risks that exist in the money market in general. Abstract

Since established in 2007, Indonesian waqf Board (BWI) which is based upon the mandate of Law No. 41 of 2004 on waqf has had a significant role in the dynamics of waqf management in Indonesia. However, a significant role still has not been completed. The problems of waqf in Indonesia still exist, especially with regard to waqf money (cash waqf). The study is to answer question; how is the role of Indonesian Waqf Board and any effort which should be done, so that the potential of existing cash waqf in Indonesia can grow and develop. From this research, it can be concluded that the role of Indonesian Waqf Board in developing prospects in Indonesia is less maximal. Waqf money can not be mapped on the following things; First, professional nazhir coaching, particularly against individuals or legal entities who are given authority and responsibility as nazhir of money waqf. To improve the quality of human nazhir resources, it can be needed policies that are tentative, or even a steady, so that taste and look for nazhir usefulness. Second, involving strategic business partners engaged in financial services (especially sharia-based), such as banks, cooperatives, Baitul Maal wal Tamwil (BMT) and the like, in the process of promotion and dissemination of money waqf that is being developed by BWI.  All that prospects and public confidence in the waqf money at BWI can flourish. Keywords: Cash Waqf, BWI, Nazhir, Law of the RI Number 41 of 2004 on Waqf

Abstract

The development of capital markets in Indonesia is encouraging. It brings a positive impact on the development of the investment system in accordance with the basic principles of sharia, in the capital markets sector in Indonesia, or better known by the term Islamic capital market. Islamic capital market is developed with the aim of accommodating the needs of Muslims in Indonesia that performs investment in capital market products in accordance with the basic principles of sharia. As we know that Indonesia is a country with a predominantly Islamic population makes Indonesia has a potential market for Islamic products. The problems of this study are the factors that influence the growth and development of Sharia Mutual Funds in Indonesia until 2014. The purpose of this study is to determine the factors that affect the growth and development of Sharia Mutual Fund in Indonesia, in particular on the list of Sharia Mutual Funds issued by OJK (Financial Services Authority) to 2014. This research is a qualitative research that does not test the hypothesis, but is intended to gain a deeper understanding of the various variables describing the past circumstances or phenomenon is happening today. The data used in this research is secondary data. This research is conducted by analyzing data collected by the author, which is derived from the issuer's financial statements, related websites, journals of sharia economic, sharia economic papers and other related sources. The analysis technique used by the author in this study is descriptive-qualitative method, a method that is done by collecting data, compiling and interpreting the results in order to obtain a clear picture of the growth and development of Sharia Mutual Funds in Indonesia until 2014. The results of this study shows that the main factor affecting the growth and development of Sharia Mutual Fund in Indonesia is the active role of government, both in terms of regulation or other supports, affecting various aspects, such as the development of product innovation. Keywords: Mutual Funds, Islamic Mutual Fund, the Government of Indonesia

Abstract

Islam as a religion has rules about life and the life of mankind in plenary, although sometimes it is only globally. The dimension of relationship between humans and god is static, while the dimension of relationship between human and social environment is dynamic and flexible. The second dimension of man is given the broader freedom to make rules and regulations according with the circumstance and condition of times by sticking to the rules of Shari'a. This article will try to elaborate the economic thought of Yahya ibn Umar in his book "Ahkam al-Suq", which is of relevance to the conventional economics. The objective of research is to know whether the brilliant idea of Yahya ibn Umar in his time (Century III H) is still relevant to be applied to the modern era or not. Abstract

Al-Quran and Hadith are a source of primary law which is to be reference of any decision on Islamic law. The determination of sharia law should be preceded by the unveiling on sharia destinations or secrets. The secret destination is called maqashid al-Shariah. It is important to make maqashid al-Shariah as a paradigm in the determination of the law, especially for issues that are not explicitly mentioned in the al-Quran and Hadith, especially in this modern era, which is human life experience a lot of progress in various fields. One of areas that have developed very rapidly is economics. Nowadays, a lot of new economic transactions emerge that has never existed in the previous era. The progress is very visible in the banking sector. The vital position of banking in the economy makes a lot of product innovation to meet the needs of the majority of people who depended on it, either directly or indirectly. One of the products which is resulted by the application of maqashid in the field of economics of banking is a tool called Maqashid al-Shariah Index (MSI). This measure is used to determine the performance of a company by using maqashid as a base of orientation. MSI may be an alternative in assessing the performance of a bank compared with measuring devices that have been there before, such as CAMEL, EVA, ROA, and ROE. In fact, MSI has advantages in considering the non-financial aspects, in fact, have a positive impact on the long-term financial performance. Keywords: Maqashid al-Sharia Index, Economic Matters

Abstract

Franchising is a business of cooperation among the parties. One party is called a franchisor and another party is called the franchisee to increase market penetration, growing new businesses and open working opportunity. Maslahah mursalah is used to address and answer new issues and developments that arise due to the progress of science and modern technology, both in setting the law against new problems, no provision of law and a new law to replace the old laws that do not conform any more with the circumstances, situations, conditions and welfare of the people of today. Maslahah mursalah is one method of laws istinbath that is made hujjah. For examples of problems set by maslahah mursalah ruling, it is shown that laws enacted by the method is more nurturing and more able to realize the sharia objectives, and it is the effectiveness of maslahah mursalah in setting the Islamic rules. Franchise system has a lot of benefit. Although not perfect, but overall it gives any favor by minimizing business risks, taking maslahah and keep madharat. The franchise system, of course, has been in accordance with the rules of maslahah mursalah. Keywords: Franchising, Business, Maslahah Mursalah

Abstract

The development of sharia-based insurance is very closely followed by people's understanding of the sharia insurance contract, the position of the parties in the sharia insurance so that each of interest group get legal protection. The legal protection is expected to provide the values of truth, order, justice and benefit both sides party. Sharia insurance or takaful is basically ta’awun agreement between insurance participant and group of people. The aim is to guarantee and protect each other in dealing with the effects of a particular event is not expected that impinge on other participants. Insurance history has existed since the time of BCE and occurs at the time of ancient Egypt that is at the discretion of the Prophet Yusuf. But the existence of Islamic insurance in Indonesia is too late. Takaful in Muslim-majority country has existed since 1979, even with the non-Muslim majority states Indonesia defeated first. For example, in Luxemburg Takaful insurance evolved since 1983. Meanwhile, in Indonesia Islamic insurance start operating in 1995. The contract of sharia insurance is implemented by combining several contracts, namely mudharabah, tabarru, wakalah and hibah in one treaty. At glance, conventional and sharia insurance will appear same. But, in fact it is different. Abstract

Throughout my experience in tracking down and reading books on faith-based economics, in this case Islam, there are no books that specifically list the title of "Islamic economics". If there is, it is only initiated or introduced. Most books coming down to us still use the titles starting with the word, for example, system, concept, principle, or the doctrine of Islamic economics. Why do the authors of the book Islamic economics seem not dared to give his book title with label "science"? I presume that Islamic economics has not been considered as a science. In building a science, methodology is required. Islamic Economics also requires a well-established methodology to build the foundation of science. The study answers questions; how is methodology which is offered by Muhammad Akram Khan to build Islamic economics. The method used in this research is the study of literature with qualitative approach.The result of study concludes that Khan offers methodology of Islamic economics, if summarized, written as follows: First, Islamic economics uses a framework derived from the texts of divinity (revelation). Second, Islamic economics uses the inductive method, which gives witness to the truth or falsity assumptions and predictions about the two criteria of rationality and empirical evidence. Third, Islamic economy is built on ethical values such as justice, virtue, moderation, sacrifice, caring for others, in the analysis, as behavioral parameters. Fourth, Islamic economics is a normative discipline. Islamic Economics investigates ways and means to change the existing economy with Islamic economy. Fifth, Islamic economics ask different questions with conventional economics. Its attention is on welfare (falah) human and creating social and institutional conditions that maximize falah in society. Clearly, Islamic economics strongly supports research programs that help maximize falah. Furthermore, Khan elaborates several issues related to the methodology that often appears in the forum of Islamic economists. There are some problems that Khan proposes, they are the interaction with modern economics, the role of revelation, assuming ideal Islamic society, and the general theory of Islamic economics. Keywords:  Islamic Economics, Methodology, Muhammad Akram Khan
