VARIA HUKUM: Jurnal Forum Studi Hukum dan Kemasyarakatan is a periodical scientific journal published by the Law Studies Program, Faculty of Sharia and Law, State University of Sunan Gunung Djati, Bandung. The birth of the VARIA HUKUM journal is inseparable from the transformation of IAIN into UIN. This transformation has encouraged the delivery of faculties/general study programs and strengthened the existing faculties/religious studies programs. One of the general study programs is the law study program. The characteristics developed by the Legal Studies study program at UIN Sunan Gunung Djati Bandung are a legal, educational institution that can integrate the existence of sharia-based legal scholarship. This is a distinct colour in the world of higher legal education. The Journal of Varia Hukum is published every six months, in January and July. The review process in this journal employs a double-blind peer-review, which means that both the reviewer and author identities are concealed from the reviewers, and vice versa.

Abstract

ABSTRACTElection criminal provisions regulated in Law Number 7 of 2017 concerning General Elections only cover 80 articles of election crimes and do not comprehensively regulate election criminal acts in the electronic field for all applications to be used in the 2024 Election. This can create a legal vacuum or the obscurity of election crimes in the field of electronics in the use of electronic election systems. Although Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions generally regulates electronic crimes, the 11 articles of electronic crimes do not regulate electronic crimes at the time of the election stage. The electronic election crime above will guarantee protection for all applications that will be implemented by the KPU in carrying out the 2024 election stages. In the context of this crime, the "electronic election system" includes all electronic systems used by the KPU in accordance with the Decree of the General Election Commission of the Republic of Indonesia Number 13/TIK.03/14/2022 concerning Plans for Electronic-Based Government Systems. This regulation will provide legal clarity for the prosecution of electronic election crimes in Indonesia  ABSTRAKKetentuan pidana pemilu yang diatur dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum hanya mencakup 80 pasal tindak pidana pemilu dan tidak secara menyeluruh mengatur tindak pidana pemilu di bidang elektronik untuk semua aplikasi yang akan digunakan dalam Pemilu 2024. Ini dapat menimbulkan kekosongan hukum atau ketidakjelasan pidana pemilu di bidang elektronik dalam penggunaan sistem elektronik pemilu. Meskipun Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, secara umum mengatur tindak pidana elektronik, namun 11 pasal tindak pidana elektronik tersebut tidak mengatur pidana elektronik pada saat terjadinya tahapan pemilu. Kejahatan pemilu elektronik di atas akan menjamin perlindungan terhadap seluruh aplikasi yang akan diterapkan oleh KPU dalam melaksanakan tahapan pemilu 2024. Dalam konteks tindak pidana tersebut, "sistem elektronik pemilu" mencakup semua sistem elektronik yang digunakan oleh KPU sesuai dengan Keputusan Komisi Pemilihan Umum Republik Indonesia Nomor 13/TIK.03/14/2022 tentang Rencana Sistem Pemerintahan Berbasis Elektronik. Abstract

This study aims to understand the role of Islamic law in empowering youth and its impact on protecting children's rights in a social context by analyzing the challenges and opportunities that exist in defending children's rights within the framework of Islamic law. The literature study method is used by collecting information from relevant sources such as books, journals, and related documents. The results show that Islamic law provides a robust framework for each child to contribute to society through values such as Justice, balance, and social responsibility. Implementing children's rights in Islamic law creates holistic growth and positive social change. Educational institutions, families, communities, and the state are essential in upholding the child's rights. Despite challenges such as diverse interpretations, gender imbalances, and social problems, opportunities lie in the flexibility of Islamic law and the involvement of activists and civic organizations. By optimally utilizing the role of Islamic law, involving all parties, and overcoming existing challenges, there can be sustainable social transformation and fulfillment of children's rights within the framework of Islamic law.

Abstract

AbstractThe purpose of this research is to measure the possibility of delaying the implementation of the 2024 elections from the perspective of constitutional law in Indonesia. In this study, a normative juridical method was used with a statutory approach to study the legal basis, legal principles, and regulatory processes related to postponing elections in Indonesia. journals or surveys conducted by credible research institutions. The results of the discussion stated that the results of a survey conducted by Indonesia Political Opinion on the postponement of the general election in 2024, the result was that the approval rate was only 23% while the rejection rate was 77%. The details are 31% strongly disagree, 46% disagree. Besides that, through the General Election Commission Decree Number 21 of 2022 the implementation of the elections was set for February 14, 2024. The Central Jakarta District Court decision number 757/Pdt.G/2022/PN Jkt Pst which required the KPU to postpone the elections has also been annulled by the Jakarta High Court . Furthermore, related to efforts to postpone constitutional and comprehensive elections is by changing the provisions of the articles contained in the 1945 Constitution of the Republic of Indonesia, another way is by issuing a Presidential Decree. The conclusion of this article states that the chance of postponing the election is very small and even if it has to be postponed the correct procedures and procedures are only through amendments to the 1945 Constitution of the Republic of Indonesia. AbstrakTujuan penelitian ini adalah untuk menakar peluang terjadinya penundaan pelaksanaan Pemilu 2024 dalam perspektif Hukum ketatanegaraan di Indonesia. Dalam penelitian ini, digunakan metode yuridis normatif dengan pendekatan perundang-undangan untuk mempelajari dasar hukum, prinsip-prinsip hukum, dan proses pengaturan terkait penundaan pemilu di Indonesia, selain itu digunakan juga sejumlah dokumen hasil riset terdahulu dalam rangka memperkuat argumentasi penelitian, baik dalam bentuk jurnal ataupun survei yang dilakukan oleh lembaga peneliti kredibel. Hasil pembahasan menyatakan bahwa hasil survei yang dilaksanakan oleh Indonesia Political Opinion terhadap penundaan pemilihan umum di tahun 2024, hasilnya tingkat persetujuan hanya berada pada angka 23% sementara tingkat penolakan sebanyak 77%. Rinciannya 31% sangat tidak setuju, 46% tidak setuju. Disamping itu, melalui Keputusan Komisi Pemilihan Umum Nomor 21 Tahun 2022 pelaksanaan pemilu ditetapkan pada tanggal 14 februari 2024. Putusan PN Jakarta Pusat nomor 757/Pdt.G/2022/PN Jkt Pst yang mengharuskan KPU untuk menunda pemilu juga telah dibatalkan oleh Pengadilan Tinggi Jakarta. Selanjutnya, terkait upaya penundaan pemilu secara konstitisional dan komprehensif ialah dengan mengubah ketentuan pasal-pasal yang terdapat dalam UUD NRI 1945, cara lainnya dengan mengeluarkan dekrit Presiden. Simpulan artikel ini menyatakan bahwa peluang terjadinya penundaan pemilu ialah sangat kecil dan sekalipun harus ditunda prosedur dan tata cara yang benar hanya melalui amandemen UUD NRI 1945.

Abstract

Penulisan ini bertujuan guna mengetahui pola Desentralisasi Asimetris proses pengisian jabatan Kepala Daerah dalam pelaksanaan demokrasi di Indonesia. Penulisan ini menggunakan metode yuridis normatif, dengan spesifikasi penelitian deskriptif analitis. Dalam pembahasan diuraikan bahwa dalam Konstitusi Indonesia Desentralisasi asimetris ditegaskan dan diakui hingga saat ini. Terdapat 4 (empat) daerah yang mempunyai ciri khusus dalam pengisian jabatan kepala daerahnya. Keempat daerah tersebut adalah DKI Jakarta, Daerah Istimewa Yogyakarta, Papua, dan Aceh. Realita pada pemerintahan daerah, landasan yuridis konstitusional berlakunya desentralisasi asimetris tersebut dapat ditinjau pada Pasal 18A ayat (1), dan Pasal 18B ayat (1) UUD 1945. Satuan-satuan pemerintahan daerah khususnya keberagaman pengisian jabatan kepala daerah diakui dalam pelaksanaannya.

Abstract

AbstractThe Shafi'i school plays a significant role in the thinking and establishment of Islamic law in Indonesia. This article aims to analyze the existence of the Shafi'i School as a paradigm in the thinking and establishment of Islamic law in Indonesia. This research was conducted using a descriptive-analytical approach and referring to various literature sources and related empirical studies. The concepts and principles of the Shafi'i School are presented, including its history and development as well as the contributions of the Shafi'i scholars to Islamic legal thought. Apart from that, the differences between the Shafi'i School and other schools of thought are also studied, especially in the methodology of ijtihad and the approach to sources of Islamic law. This research also highlights the advantages and relevance of the Shafi'i School in the Indonesian context, including its influence in the establishment of Islamic law in this country. However, criticism and challenges to the Syafi’i Mazhab are also considered, such as the limitations of adaptation and the plurality of schools in Indonesia. In order to strengthen the role of the Shafi'i School, this article recommends efforts to understand and further research on the thinking and application of Islamic law based on the paradigm of the Shafi'i School in Indonesia. AbstrakMazhab Syafi'i memainkan peran penting dalam pemikiran dan pembentukan hukum Islam di Indonesia. Artikel ini bertujuan untuk menganalisis keberadaan Mazhab Syafi'i sebagai paradigma dalam pemikiran dan pendirian hukum Islam di Indonesia. Penelitian ini dilakukan dengan menggunakan pendekatan deskriptif-analitik dan mengacu pada berbagai sumber literatur dan studi empiris terkait. Dipaparkan konsep dan prinsip Mazhab Syafi'i, termasuk sejarah dan perkembangannya serta kontribusi para ulama Syafi'i terhadap pemikiran hukum Islam. Selain itu juga dipelajari perbedaan mazhab Syafi'i dengan mazhab lain, terutama dalam metodologi ijtihad dan pendekatan sumber hukum Islam. Penelitian ini juga menyoroti keunggulan dan relevansi Mazhab Syafi'i dalam konteks Indonesia, termasuk pengaruhnya dalam penegakan hukum Islam di negeri ini. Namun kritik dan tantangan terhadap Mazhab Syafi’i juga diperhatikan, seperti keterbatasan adaptasi dan pluralitas mazhab di Indonesia. Untuk memperkuat peran mazhab Syafi'i, artikel ini merekomendasikan upaya untuk memahami dan meneliti lebih lanjut pemikiran dan penerapan hukum Islam berdasarkan paradigma mazhab Syafi'i di Indonesia.

Abstract

AbstractAccording to Article 23 Paragraph (1), Letter d of the Citizenship Law, Indonesian citizens lose their citizenship status for several reasons, namely it is wrong to become a foreign soldier without prior permission from the President. This is reinforced by the regulation in PP No. 2 of 2007, the revocation was carried out by the president must go through a legal process. The legal process referred to is not the litigation process, but the HAN process, namely the Menkumham examines, after being reviewed it is feasible to revoke the status of the former ISIS member's Indonesian citizen, then the Menkumham submits it to the President, and continues with the issuance of a Presidential Decree. However, there is a problem, if the Government complies with the positive law regarding the revocation of the status of Indonesian citizens. Ex-members of ISIS seem undemocratic, because it is only based on a Presidential Decree issued based on the recommendations of the Ministry of Law and Human Rights. For this reason, the author is interested in writing about the revocation of the status of Indonesian citizens who are former members of ISIS which is in accordance with the concept of a democratic rule of law, but also prioritizes effectiveness and time efficiency. The author considers that the revocation of the status of Indonesian citizens who are ex-ISIS members by the government is something that is logical for now, but the government before revoking the status of Indonesian citizens who are ex-ISIS members must ask for consideration from the Constitutional Court as a bodyguard, and interpreters of Pancasila and the Constitution through the revision of the Constitutional Court Law and the Citizenship Law. AbstrakMenurut Pasal 23 Ayat (1), Huruf d UU Kewarganegaraan, WNI kehilangan status kewarganegaraannya dengan beberapa alasan, yaitu salah menjadi tentara asing tanpa izin terlebih dahulu dari Presiden. Hal ini diperkuat oleh pengaturan dalam PP No.2 Tahun 2007, pencabutan itu dilakukan oleh presiden harus melalui proses hukum. Proses Hukum yang dimaksud bukan Proses Litigasi, akan tetapi Proses HAN, yakni Menkumham memeriksa, setelah dikaji layak untuk dicabut status WNI Mantan Anggota ISIS ini, selanjutnya Menkumham menyerahkan ke Presiden, dan dilanjutkan dengan dikeluarkan Keppres. Akan tetapi ada problematik, jika Pemerintah tunduk pada hukum positif tentang pencabutan status WNI Mantan Anggota ISIS terkesan tidak demokratis, karena hanya berdasarkan Kepres yang dikeluarkan berdasarkan Rekomendasi Kemenekumham. Untuk itulah Penulis tertarik untuk menulis tentang pencabutan status WNI Mantan Anggota ISIS yang sesuai dengan konsep Negara hukum yang demokratis, tetapi juga mengedepankan efektivitas, dan efisiensi waktu. Penulis menilai pencabutan status WNI Mantan Anggota ISIS oleh Pemerintah adalah sesuatu yang logis untuk saat ini, akan tetapi Pemerintah sebelum mencabut status WNI Mantan Anggota ISIS harus meminta pertimbangan dari MK sebagai pengawal, dan penafsir Pancasila dan Konstitusi melalui Revisi UU MK dan UU Kewarganegaraan.
