Abstract

One of the important substance of Amendment of the Constitution of the Republic of Indonesia Year 1945 is the existence of the   Constitutional Court as a state institution that functions to handle certain cases in the field of state administration,  in  order  to  maintain  the  constitution  to be implemented in a responsible  manner in accordance with the will of  the people and democratic ideals. Constitutional Court’s constitutional authority to implement the principle of checks and balances which places all state agencies in the equivalent position so that there is a balance in  the administration of state The existence of the Constitutional Court is a real step to correct each other’s performance among state institutions. The Constitutional Court in carrying out justice to examine, hear and decide a case still refers to the organizing principle of judicial power which, among others, is carried out simply and quickly.

Abstract

Statue no. 22/ 2001 on Oil and Gas. (Oil and Gas Law). Have reaped the problem, since the establishment, terms with the impact of globalization, as well as the world economic crisis. Therefore as new laws that regulate oil and gas, there has been a reform in the oil and gas law,  as well as a variety of model settings. As is usually the administrative laws, tend to use the criminal provisions, in order to maintain, this thing is set, it can be done ideally, and improve the welfare of the people in business   with the capital requirement migas.yang besar.Investasi multinational companies have long engaged in oil and gas, even since the  colonial period, until today. Hence privatization of State-Owned Enterprises in  the field of oil and gas business, must be strictly regulated, so that the model of economic democracy as provided for in the Constitution Article 33 of the Constitution of 1945, can be implemented with a high spirit of nationalism.

Abstract

This paper provides a constitutional review of the extension of the Sunset Policy program. It tries to analyze whether or not the extension of the Sunset Policy program abuses the existing law. The paper argues that even though the extension of the program does not break the Indonesian constitutional law, the government should be more prudent to establish  the next public policies based on the government regulation of the law substitute. This paper recommends to constituting a clear regulation in regard to the strict conditionals of the establishment of a government regulation of the law  substitute.

Abstract

Nowadays, in Indonesia, there are so many laws appear after KUHP which regulate about criminal laws, beside providing the rules of material criminal law againts to KUHP, also providing the formal rules which againts to KUHAP (formal criminal laws). In criminal laws that related to financial government, has common law which is regulated by laws itself. And corruption criminal laws which has the regime of law itself, but it is still unclear where could be qualificated as crimnal laws in financial government and which could be qualificated as corruption criminal laws. It is still in the “grey area”

Abstract

What it means by “under state control” on article 33 point (2) and (3)  of UUD 1945, should not be interpreted that the state will control totally the entire economic activities that serve the public basic; the state  is not a company refers to democratic economy of Indonesia which hinder monopoly on business by any state or etatism (state monopoly). The precise understanding of “under state control“ is state responsibility to manage and drive the economy regulation correctly.

Abstract

Freedom of association is not the right belongs to certain group but it is belong to every person as a social beings who naturally can not live alone and stand alone, but living in a group of specific communities.In the context of freedom of association for workers / laborers juridically guaranteed by the Constitution through Article 28 . Through its organic regulations, Law number. 21 year 2001 about Trade Union / Labor Union, according to the opinion of the writer this law is too consentrating on the substance of freedom of association in the shaping of workers / laborers organization, so there is a tendency out of the spirit and the purpose of the formation of trade unions / labor unions that promote the creation of the protection of the interests of the workers / laborers, and boils down to the welfare of the workers / laborers.At the level of industrial relations that emphasizes the aspect of Pancasila and Constitution 1945, the concrete is driven to the creation of industrial relations that runs in the balance between the worker / laborer with the company. The spirit and implementation of industrial relations should be clearly reflected in the harmonious relationship between the worker / laborer with the company, in the form of partnerships that are complementary and beneficial, that is created and protected the interests of the workers / laborers and the resulting product and / or service quality and high competitive, as the offerings from the workers to the company in order to create work productivity optimization.

Abstract

Status keistimewaan Provinsi DIY dalam kurun waktu sekian lama lebih sering diinterpretasikan sebagai istimewa dalam hal wilayah yang dulunya berbentuk kerajaan, istimewa dalam pemimpin yaitu dipimpin dwi tunggal dari lingkungan Kasultanan dan Pakualaman, dan istimewa dalam sistem pemerintahannya yang hierarkis patrimonial. Apabila dikelompokkan, pemaknaan keistimewaan Provinsi DIY setidaknya terbelah menjadi 2 (dua) yakni pihak yang pro-pemilihan  dan  pro-penetapan.  Penetapan Sri Sultan Hamengku Buwono sebagai Gubernur dan Sri Paku Alam sebagai Wakil Gubernur Provinsi DIY tidak bertentangan dengan prinsip-prinsip demokrasi menurut UUD 1945 karena dalam Pembukaan UUD 1945, para penyusun UUD 1945 sepakat untuk mengadaptasikan bentuk dan model demokrasi yang sesuai dengan budaya dan corak masyarakat Indonesia yakni demokrasi permusyawaratan berdasar kekeluargaan. Artinya, masyarakat DIY berhak bermufakat secara kekeluargaan mengenai mekanisme yang ingin dipraktikkan, sepanjang mekanisme tersebut dipandang demokratis, dalam arti tidak bertentangan dengan gagasan demokrasi permusyawaratan serta tidak mengabaikan hakikat keistimewaan DIY, termasuk melalui mekanisme penetapan. Dalam hal menentukan kepala daerah DIY, para pengubah UUD 1945  tidak memaknai demokrasi hanya melalui mekanisme pemilihan secara langsung oleh rakyat atau oleh DPRD, melainkan membuka mekanisme lain di luar itu sepanjang mekanisme tersebut dianggap demokratis dan mendapatkan payung hukum dari undang- undang.

Distribution agreement that contains the agency agreement if the terms of law no.5, the year 1999 concering Prohibition of Monopolistic Practices and Unfair Business Competition can be categorized as a distribution agreement if the basic agreement between the parties is a purchase agreement so that he acts on his own name so that can have     the freedom to set prices of goods or services that have been bought.In practice in Indonesia,distribution agreement have a variety of different shapes and substances in accordance with the will of the parties,so that in determining whether the agreement included an agreement that made the distribution or agency agreement should be seen from the substance of the  agreement
