Abstract

The results of the WTO panel's decision were recorded in the DS 592 lawsuit. The final panel report was issued on October 17, 2022, stating that the export policy and the obligation to process and refine nickel minerals in Indonesia proved to violate WTO Article XI provisions. GATT 1994 and cannot be justified by Article XI.2 (a) and XX (d) GATT 1994. The purpose of the provisions of WTO Article XI.1 GATT 1994 states that each WTO member country is prohibited from making restrictions other than tariffs, taxes and other duties , and not other restrictions including quotas and licensing of imports or sales in the framework of export. There are two consequences that will be faced by Indonesia, including having to pay losses to the European Union (EU) as the plaintiff arising from the nickel export ban. Second, facing retaliation from the European Union's ban on other Indonesian commodities or in fiscal prohibition instruments. Problems in the field of capital loading are related to demands and threats to the principle of equality of sovereignty against investors who are treated differently, amid demands to make as much profit as possible. The principle can be a way out for investors to withdraw from investing in arbitration or court courts, so that Indonesia will suffer losses. Thus, it is necessary to explain the concept to understand the principle of sovereign equality and its influence in Indonesian laws and regulations in the field of capital protection, so as to provide a clear picture of the treatment of investors.

Abstract

Solok Selatan Regency is one of the areas that once had the status of a 3T area in West Sumatra Province, where there are still many blindspot areas. To be able to level the telecommunication network, the Government of Solok Selatan Regency cooperates with various parties, including through Nagari-Owned Enterprises, PT Indonesia Comnet Plus or Icon+, as well as the Nagari Government and community groups in the Nagari. From several previous studies, it appears that collaboration makes a major contribution to the development of a region. Departing from these previous research studies, the researcher is interested in studying further related to multi-actor collaboration in alleviating blindspot areas in Solok Selatan Regency. This research is a type of qualitative research with descriptive analysis. The data source is the actors involved in alleviating blind spot areas in Solok Selatan Regency. Data collection through interviews and documentation as well as observation. The results showed that the actors involved in alleviating blankspot areas in Solok Selatan Regency were the Government of South Solok Regency (Diskominfo), PT Indonesia Comnet Plus (Icon+), Nagari Government and BUMNag. There are many benefits to be gained if this collaboration can run optimally in all villages which are included in blind spot areas. In addition, the distribution of telecommunication networks in South Solok Regency can also have a positive impact on increasing the quality of public services in South Solok Regency.

Abstract

Pasar Minggu is one of the oldest markets in DKI Jakarta which is one of the causes of overcrowding, resulting in limited selling space. The lack of selling land has pushed some people to turn into street vendors (PKL) since the expansion of the Jakarta City area. As a result, Pasar Minggu has become an unorganized area, in this case it is contrary to DKI Jakarta Regulation Number 10 of 2015 concerning Arrangement and Empowerment of Street Vendors. This research is aqualitative research that aims to find out how the implementation, supporting and inhibiting factors and the right strategy in the arrangement and control of street vendors carried out by the Civil Service Police Unit at Sunday Market, South Jakarta. This study explains that there are 4 (four) indicators of policy implementation, namely communication, resources, disposition and bureaucratic structure. The process of collecting data using observation techniques, interviews, and documentation. The results showed that the implementation of DKI Governor Regulation Number 10 of 2015 concerning Arrangement and Empowerment of Street Vendors by the Civil Service Police Unit at Pasar Minggu, South Jakarta has not run optimally due to several factors, such as the lack of awareness of street vendors about order, not yet optimal enforcement of regulations, and lack of socialization of regulations. The strategies that can be used to improve the implementation of these regulations are improving the quality of Satpol PP human resources through education and training, conducting outreach related to structuring street vendors and optimizing Satpol PP tasks so they can work optimally.

Abstract

This research is entitled Analysis of Performance management in supporting the Government Agency Performance Accountability System in the Yapen Islands Regency of Papua Province which raises the issue of the implementation of local government performance management which is considered to have not been running as expected. The Government Agency Performance Accountability System is an effort to realize a government that is accountable, professional, has integrity, is clean and free of KKN (Corruption, Collusion and Nepotism), and is able to provide excellent and equitable services to the community. The reality that occurs in the administration of government in the island district that Performance Management has not been implemented properly so that it has a negative impact on the value of the Government Agency Performance Accountability System based on the assessment of the Ministry of Administrative Reform and Bureaucratic Reform. The research method used is a qualitative research method to formulate the ideal conditions for implementing performance management in the regional government of the Yapen Islands Regency. Furthermore, to analyze Local Government Performance Management in supporting the Performance Accountability System in the Yapen Islands Regency, researchers used ASOCA analysis, which stands for (Ability, Strength, Opportunities, Culture and Agility). According to Suradinata (2014: 18) says that the ASOCA analysis adds elements of culture and agility as important elements in finding problem-solving strategies, decision making, and can be developed in following changes, times, and needs. Based on the data and analysis previously described, it can be concluded that Performance Management has been implemented in the Yapen Islands Regency, especially in measuring local government performance which can be seen from regional level planning documents or RPJMD and Regional Apparatus level documents, namely Renstra, but understanding of SAKIP is still not optimal so that it has implications for its implementation. HR management needs to be reconstructed so that it is in accordance with the targeted tasks and functions. The strategy that can be carried out by the Regional Government of the Yapen Islands Regency is to optimize the capacity of human resources related to understanding performance management and SAKIP by conducting massive and comprehensive technical guidance to each regional apparatus.

Abstract

In essence, public policies in a good governance system are actions or steps taken by the government to ensure openness, accountability and public participation in the decision-making process. That public policy in a good governance government system has several meanings, including: Public policy is implemented openly and transparently to the public. Information related to policies, decision-making processes and policy implementation must be easily accessible to the public. The government is responsible for the policies produced and implementing these policies appropriately. The government also ensures accountability to the community in the use of public resources. Public policy must be responsive to the needs and aspirations of society. The government must be able to respond to community problems or complaints with appropriate solutions and policies. The community is given the opportunity to participate in the decision-making process. The government must involve them actively in planning, designing and implementing public policy. Public policies must be fair and side with all groups of society without discrimination. The main goal is to improve the welfare of all people by reducing social and economic disparities. Thus, public policy in a good governance government system aims to support the creation of good government, convince the public that government decisions are based on the public interest, and encourage active public participation in the decision-making process. The problem studied in this research is, how is the implementation of the principles of good governance in the Mamberamo Raya Regency Government with a study focus on three specific indicators, namely Transparency, Law Enforcement and Accountability. Initial. The main instrument determined in this research is through interviews with a number of informants who are considered to have capacity in the problems that are the focus of the study in this research. Data processing and analysis techniques are carried out in stages: data reduction, data display and data verification or drawing conclusions. The research results show that the three indicators are as follows: 1). In terms of transparency indicators, so far the achievements have been relatively good, because the government always strives to provide the necessary information and data to the public or people who need it; 2) in terms of law enforcement indicators as a reflection of good governance, so far the achievements have been relatively good, although not yet optimal, especially in terms of increasing employee discipline, which has not yet experienced maximum improvement, specifically in terms of activity in the office; 3) The accountability indicator has so far gone quite well. What is of particular concern for this indicator is the timeliness in compiling and submitting accountability reports from employees to management, which sometimes still experiences delays.

Abstract

The authority given to several fields overlaps, for example authority has been given in accordance with Regent Regulation Number 33 of 2012 concerning the Delegation of Part of the Regent's Authority to District Heads in the Fakfak Regency Government Environment, but in practice this is not the case, the agencies at the Regency level are in charge of the field/sector In fact, they almost never coordinate with the District, so that the functions of the District according to Regent Regulation Number 33 of 2012 are not carried out properly. This research uses a qualitative method with a descriptive approach using theory from Iglesias (Kaho, 1997: 59) with primary and secondary data sources. Data collection techniques were carried out using interviews, observation and documentation, data analysis techniques used were data reduction and drawing conclusions. Based on the research results, it was concluded that the ideal revitalization of the role of regional apparatus through delegating the authority of the Regent of Fakfak to the Head of the Fakfak District must be followed by increasing financial capacity, apparatus capability, community participation and non-human resource capabilities. The implementation of the role of regional apparatus through the delegation of part of the authority of the Regent of Fakfak to the Head of the Fakfak District has not been optimal, where the delegation of authority for the fields of government, economic development, education and health and civil service has not been fully followed by giving full authority to the Head of the District, or it seems still half-hearted because The district head's space for movement is always monitored by the regent regarding the implementation of his authority. The process of delegating authority is still not able to run optimally because the district's resources are still limited so that service activities are not yet optimally felt by the community.
