Abstract

This study tries to 1) identify the elements that lead murderers to plan their crimes, and 2) understand those elements. The judge's factors to consider when determining murder cases with intent to kill, 3). Comparing the Criminal Code with Islamic law's definition of premeditated murder. To gather data for this study, a library research technique known as a normative juridical approach to literature evaluation was used. The Criminal Code, followed by the Koran, Hadith, and translations into Indonesian, as well as relevant scholarly works, books, and articles, served as the source for legal information. The study's findings led to the conclusion that Indonesian law's Criminal Code Articles 338–350 govern the crime of murder. In the Criminal Code, premeditated murder is defined as a purposeful killing, whereas in Islamic criminal law, the victim's life is the first thing that is intended to be taken. According to Article 340 of the Criminal Code, the perpetrator of a premeditated murder may be sentenced to life in prison by a jury of judges. Whereas in Islamic criminal law, as mentioned in QS. Al-Maidah verse 45 and Hadith, the perpetrator's acts might result in a death sentence (Qishash) for committing purposeful murder.

Abstract

Prophetic education is education that imitates the life of the prophet. departs from the prophetic sentence (prophecy or relating to the prophet), which then makes the notion of education to form productive human beings and can build a pious civilization, or it can also be interpreted as education which prioritizes and interprets all the behaviour of the prophet, namely the Prophet Muhammad SAW. The Saheeh, Sunan, Musnad and others reveal these beautiful qualities and great morals. Likewise comes in a separate explanation, one of the well-known books is the book Syamail Muhammadiyah which was written by Imam Tirmidhi, the author of the book al-jami' who died in 279H. Being a big and important reference in the theme, and has helped many hadith scholars know the personality and morals of the Prophet. The research that utilizes the scientific work (book) of one of the scholars who lived and preached in the 2nd century of Islam uses the library research method, by making the theological approach the main goal, namely to make his people more familiar with and follow what has been taught. in their daily interactions. As for some conclusions that can be drawn from this research is to humanize humans according to perfunctory levels guided, directed, and exemplified by the Prophet. In other words, prophetic education aims to realize humans as servants of Allah who can worship Him with good thoughts, deeds and even feelings. Likewise, humans as actors who are ready to act, not as products that are ready to be used in institutions, factories, offices or other things, because human beings are essentially not working machines. Hopefully with this research, humans from now until the end of time can interpret, practice and place their position as perfect humans (kaffah).

Abstract

Al-Qur'an in the view of Muslims, is a way of life. Verse after verse has a very deep meaning and content beyond the famous poets though. Thus, Muslims need to understand the contents of the Qur'an so that they can be contemplated and practised. One Day One Verse (ODOV) has an important role in increasing the understanding of students at Dea Malela Modern International Islamic Boarding School. One Day One Verse is one of PMI Dea Malela's flagship programs because it is quite different from other programs such as the tahfidz program and the like. The purpose is that students (male and female) can memorize, understand, recite, and apply One Day One Verse. The research method presented is a case study method combined with various related references. Thus, this research includes descriptive research, which focuses on a systematic explanation of the facts obtained when it was conducted. The research subjects were students by conducting interviews and direct observation of activities. The results showed that PMI Dea Malela’s students strongly supported this activity because they felt it had a positive impact on their understanding of the al-Qur’an. Applicatively, some of the verses that have been memorized have been practised in everyday life.

Abstract

This study aims to 1) understand the meaning of corruption from a moral and ethical perspective, 2) find out the causes of people committing corruption, and 3) identify the impacts of corruption in the 5.0 era. Data collection methods using literature research techniques known as normative juridical approaches to literature evaluation are used. Following the moral and ethical basis derived from the Qur'an, Hadith, scientific papers, books, and articles, serve as a source of legal information. The findings of this study lead to the conclusion that corruption according to the moral and ethical perspective that has been discussed in the Qur'an Surah Al-Baqarah Verse 188 is taking the property of others in a vanity and deviant way of moral and ethical rules, and this act is a sin in the view of religions. Corruption has been regulated in the universal laws of all countries in the world, even the rules on combating corruption decide the harshest punishment is death, life imprisonment, or imprisonment according to the size of the property confiscated. Whereas in Islamic law perpetrators of corruption can be punished with chopping off hands or life imprisonment or ta'zir punishment (after the amount of property corrupted).
