Journal of Economics, Law, and Humanities, published by Islamic Economics and Islamic Family Law Departments, Postgraduate of State Islamic Departments Institute (IAIN) Ponorogo since 2022. The subject covers various perspectives of Islamic economics, legal drafting and Islamic family law, Islam and humanitarian discourse, including conceptual thoughts, research reports, case reports, application of theory, critical studies and literature reviews. Authors who want to submit their manuscript to the editorial office of the Journal of Economics, Law, and Humanities should obey the writing guidelines. If the manuscript submitted is not appropriate with the guidelines or written in a different format, the editors will reject it before further review. Abstract

The potential for halal products in the global market is currently experiencing rapid development, marked by an increase in demand every year. However, as the largest Muslim country is still in the spotlight because of the low export of halal products and even far behind non-Muslim countries. It may be influenced by inflation and exchange rate fluctuations in Indonesia. This study uses time-series data for the period January 2016-December 2020 with the Auto-Regressive Distributed Lag Models (ARDL) analysis method. The results show that (1) Inflation has no significant effect on exports of halal products in the short and long term. (2) The exchange rate has a negative and significantly effect on exports of halal products in the short term, but has no significant effect in the long term. (3) Inflation and exchange rates simultaneously have a significant effect on the export of halal products with a contribution of 32.06%.

Abstract

In the discussion of inheritance, there are two critical aspects: assets and relatives. So, inheritance must be regulated to realize justice among the heirs. However, the heirs stipulated in the inheritance law guidelines do not always have perfect mental health or are persons with disabilities. Heirs of persons with disabilities cannot carry out legal actions, agreements, or obligations. Being an heir means managing the inheritance to benefit the bereaved family. Thus, the researcher wants to analyze further the implementation of inheritance in the Karangpatihan Village community with a sociological perspective of law, starting from the analysis of the concept of inheritance, the legal basis used, and how somebody can fulfill disability rights. This research is field research with an inductive and qualitative approach. Judging the proposed problem formulation shows that this research is fundamental and empirical. The data was obtained through observation, interviews, documentation, and triangulation. The stages of data processing include the locations of re-examination, data classification, data analysis, and conclusions. The study is reviewed with the theory and indicators of the sociology of law, and findings are obtained from connecting the results of data analysis with the formulation of the problem or anxiety of the researcher. The results showed that the implementation of inheritance in families with disabilities practiced their concept or with the idea of hereditary division, as long as they could maintain harmony, meet daily needs, and not cause conflict. And the protection of inheritance rights in families with disabilities independently does not have the ability, but using collectivity or the use of shared assets, using the concept of cooperation in maintaining inherited assets.

Abstract

This research was motivated by the anxiety of the people of Ngringinrejo Village, located on the banks of the Bengawan Solo river, because it often experiences crop failure during the rainy season. Natural disasters are one of the impacts of irresponsible economic activities, for example, illegal sand mining, logging in mixed forests, dumping industrial waste into rivers, etc. This study aims to describe and analyze the process of implementing the three pillars of the green economy, namely the economic, social, and ecosystem (environment) pillars in Ngringinrejo Starfruit Agrotourism. This research approach uses qualitative research (field research). Data collection techniques using observation, interviews, and documentation. The results of this study indicate that the agro-tourism of the Ngringinrejo star fruit garden has an impact on improving the economy, society, and ecosystem. Based on the economic pillar, there is an increase in the income of the people who are members of this primary tourism group. The growth occurs because every day there will be visitors who come and always buy star fruit for souvenirs. From a social point of view, this agro-tourism has involved many stakeholders who influence the number of workers needed. Even residents who do not own land can rent it to sell star fruit or other products. Meanwhile, in terms of ecosystems, star fruit trees have a lot of water absorption, have an average age of about 20 years, and bear fruit throughout the year.

Abstract

The Covid-19 pandemic has had an impact on the social sector. One of the smallest institutions in the social system that is affected is the family, namely the occurrence of underage marriages. Based on data released by the Religious Courts Agency, the phenomenon of child marriage has tripled. In 2019 there were 23,126 cases, and in 2020 it increased to 64,211 cases. This increase in underage marriage also occurred in Ponorogo Regency. Based on data from the Ponorogo Regency PA, in 2019 there were 97 cases, and in 2020 it increased to 235 cases. From exposure to these facts, this study aims to analyze the impact of social changes due to the Covid-19 pandemic on the increase in underage marriage in Ponorogo Regency, analyze the form of social processes due to the Covid-19 pandemic on the increase in underage marriage in Ponorogo Regency, and analyze the role of agents of social change in the increase in underage marriage due to the Covid-19 pandemic in Ponorogo Regency. This research includes field research, with qualitative methods and a sociological approach. The results of this study can be concluded that first, there are social changes due to the Covid-19 pandemic which have an impact on increasing underage marriage in Ponorogo Regency, which includes three aspects, namely structure, family function, and environment. Second, the form of the social process of change above is social development. Third, there is a change in the role of the community as agents of social change due to the Covid-19 pandemic which has an impact on increasing underage marriages.

Abstract

This thesis is the result of a literature study entitled “Imām al-Shāfi’i Thoughts on Talak Tafwi̅ḍ and Its Relevance to the Theory of Gender Equality in The Practice of Developing Islamic Family Law in Indonesia”. Academic problems are felt by the author so do this research, because there are still many people who consider that the absolute right of divorce belongs to a husband. This study aims to answer the question of what is the opinion and legal basis of Imām al-Shāfi’i thinking about the ability of the practice of divorce tafwi̅ḍ?. And how is the relevance of talak tafwi̅ḍ with the theory of gender equality in the practice of developing Islamic Family Law in Indonesia?. The results of the study concluded, Imām al-Shāfi’i argued that divorce tafwi̅ḍ the law is permissible, because of the surrender of the authority of divorce to his wife was once done by Rasullah saw. which is based on naṣ al-Qur'an surah al-Aḥzāb verses 28-29, and hadith ṣahih narration muttafaq ‘alaih from Aishah r.a. The relevance of tafwi̅ḍ divorce with the theory of gender equality, that with the practice of divorce tafwi̅ḍ this can help to lift the status/gender of women, especially in relation to divorce. When a husband submits his right to divorce authority to his wife, then surely a husband has raised his wife degree in the concept of gender equality.

Abstract

The purpose of this study is to find out how fair the application of irrigation of rice fields is in determining the consideration for irrigation services of rice fields according to John Rawls' idea of ​​justice. The research methodology in this study is qualitatively descriptive by processing primary and secondary data obtained through observation, interviews, and documentation in Bibrik village, Jiwan province, Madiun province. The result of the study is that the perception of fairness in the application of rice field irrigation is carried out from the irrigation stage, determination of fees for irrigation services of rice fields, and the water distribution mechanism is not always accurate, although it is. Designed so that there is no fairness, the fairness of the service will reflect the fairness of the water workers group. Standardization of payment for services is not the same in villages, whether it is the location of rice fields next to irrigation canals or vice versa so the fairness of services is expected to have a significant impact on farmers' education and bring about social upheavals. . The means of payment for this service is of two types: quality money and grain, so it is not fair between farmers and workers that grain is sold for more money than direct cash payments, which causes unrest in the company.

Abstract

The research, which aims to determine the potential, regulations, and problems of the Free Halal Certification (Sehati) initiated by the Ministry of Religion through the Halal Product Guarantee Agency (BPJPH), is descriptive qualitative research that uses a phenomenological approach and a legal approach. The results show that the free halal certification program's potential success is supported by many micro and small business actors and the majority of the Indonesian Muslim population as a market. Free Halal Certification Regulations for Micro and Small Businesses are carried out using the halal self-declare with assistance from the Halal Product Process Facilitator (PPH) based on Law no. 33 of 2014, PP No. 39 of 2021, PMA No. 20 of 2021, Kepkaban No. 77 of 2021 and Kepkaban No. 33 of 2022. Problems that arise in the implementation of Sehati include: lack of socialization and information about the existence of the program, the role of stakeholders is not optimal, PPH assistants who are less thorough in verifying so that many files are returned, not yet business actors who are not responsive to Sehati regulations and digital services, the lack of maximum assistance in the process of halal products.

Abstract

Facility and service are essential parts that must exist in hotels, especially sharia hotels, which must pay close attention to facilities and services to support the hotel's success. This study aims to determine how facilities and services hotel constraints in carrying out compliance with sharia principles at Hotel Asia Jaya Syariah Sarangan. The results of this study are in terms of facilities at the Asia Jaya Syariah Hotel as a whole in accordance with Islamic law in the hospitality business, starting from the entertainment, consumption, ethical, and layout principles. Service, as a whole, has been good in implementing the six sharia principles. It's just that there are shortcomings in applying the consumption principle in restaurants because there is no supervision on how to slaughter the meat purchased. Constraints in sharia compliance from Hotel Asia Jaya Syariah Sarangan have not been able to comply with rules Numbers 3, 6, and 7 in the Fatwa of the National Sharia Council of the Indonesian Ulema Council No. 108/DSN-MUI/X/2016 concerning Guidelines for the Implementation of Sharia Tourism because they do not have a valid halal certificate. Issued by the Ministry of Religion, it does not yet have a hotel service procedure guide and has not used Islamic financial institutions' services.

Abstract

Financial Technology (Fintech) is defined as financial services integration and solutions based on technology. Unbanked is a group of people who do not have savings in the bank. There is a substantial potential increase in financial services for the unbanked by utilizing Fintech in Indonesia. It is seen from the young population and the high growth of internet access. However, compared to other countries, the development of Fintech access in Indonesia is still far behind. The theory used in this research is the Unified Theory of Acceptance and Use of Technology 2 (UTAUT 2). The data were analyzed using the path analysis method using the bright partial least square (Smart-PLS) software. Respondents in this study amounted to 304 people from all over Indonesia. The variable constructs used in this study are usefulness, ease of access, preference, behavioral intention to use, and actual system use. The results of this study explain that usefulness has a significant positive effect on ease of access; help has a positive impact on behavioral intention to use, but the value is not substantial; ease of access has a positive effect on preference and has a considerable discount; priority harms behavioral intention to use, but the value is not significant; pick has a positive impact on actual system use, but the value is not the substantial and behavioral intention to use has a positive effect on actual system use, but the value is not significant.

Abstract

Independence can be interpreted as the potential to be able to produce to meet their own needs and help others who do not depend on others in carrying out or carrying out a business process. Likewise, in the management of an institution. Economic independence in Islamic educational institutions means that these institutions can choose and carry out activities to survive in a better way. This qualitative descriptive study aims to identify and analyze the economic activities and innovations carried out by PT Ngabar Mandiri Sejahtera and their impact on finansial independence at the Wali Songo Islamic Boarding School, Ngabar. Primary data were obtained from interviews and in-depth observations of and documentation of business unit managers and administrators of the Waqf Maintenance and Development Foundation of the Wali Songo Islamic Boarding School, Ngabar. Secondary data was obtained from the documentation and financial records of PT Ngabar Mandiri Sejahtera. The results show that PT Ngabar Mandiri Sejahtera has various kinds of business units to support the independence of the Wali Songo Islamic Boarding School through its business units, including NBC Supermarkets, Ngabar Food Courts, Ngabar Hostel and Meeting Hall, Ngabar Mart, Ngabar Bistro, Cafeteria Al Azhar, Ngabar Perfume, and Ngabar Laundry. The innovations carried out included developing the type of business, using smart card payment methods cashless, and establishing relationships with third parties to supply the needs of Islamic boarding schools. The impact of economic activities through PT Ngabar Mandiri Sejahtera for the internal boarding school is well-organized sales management, asset improvement, and operating profit. The external is to open up job opportunities for the community around the Wali Songo Islamic Boarding School, Ngabar.
