Abstract

Worker rights and the right to work are interesting topics to be discussed, especially in the manpower development context in Indonesia. Respect and guarantee on the worker rights is a part of fairness principles in labor law and such guarantee is very important for the continuity of a business. The fulfillment of the rights became the responsibility of the companies. However, the workers also have the obligation and responsibility as well. As an integral part of the company, workers have an obligation and social concerns on the sustainability of the company. In this case, internalization of Islamic principles should be considered in carrying out the duties. This principle should also be guidelines for workers in maintaining order and regularity. Based on the analysis, it can be concluded that the general accepted norms, decency norms, the legal norms and moral norms obtain in all life aspects,. These norms cannot be separated, each has relevance, and the law actually is the essence of positive moral norms, especially the empirical moral norms in the society.

Abstract

The sexual violence against women in armed conflict has been admitted as the intentionally and systematic violence, and even tended to be part of the war strategy by combatants.  Afterwards, legal protection on such violence became very important to be given not only in peacetime but also in war time. Under some international legal instruments related to the humanitarian legal protection i.e. the Geneva Convention of 1949, additional Protocol of 1977, and other supplementary legal instrument including human rights legal instruments, sexual violence carried out in armed conflict was categorized as war crime and crime against humanity.

Abstract

Judicial Commission is an independent state institution created to carry out the judicial body reform. The Judicial Commission power of maintaining judge’s dignity and behavior  is no longer exist following  the Constitutional Court Verdict No.005/PUU-IV/2006. This article examines the existence of judicial commission in the realization of independent judicial power. Theories of constitution, power separation, power distribution and independent judicial power are used to study and analyze the study. The author concludes that the objective of the creation of the Judicial Commission is to monitor and maintain the efficiency and effectiveness of judicial power.   It is recommended that the Law No.22 of 2004 on  Judicial Commission be amended to enable the Judicial Commission to be able in exercising the task and power to realize  an independent judicial power following the above Constitutional Court Verdict.

Abstract

he development of Islamic economic institutions in Indonesia has created the conflict of interest between  stakeholder and  Religious Court, especially in settlement of syariah-economic disputes. The  application of fiqih muamalah in settlement of syariah-economic disputes in Islamic Religious Court,  has been the crucial issue in Indonesia positive law . This article will seek to find and determine  whether the application of  fiqih muamalah as a basis in such dispute settlement is consistent with  the Islamic Law Principles. It also examines the implementation of  fikih muamalah that has become an Indonesian postive law. This research applies juridical normative approach.  Data collection  is gathered from library research complemented by primary from field research. The specification of this research is descriptive analysis, and the data gathered  is analyzed in qualitative method.  The article will demonstrate that  the above fiqih muamalah rules are stipulated in Law No.3 of 2006  Jo. Law No 50 of 2009 on  Second Amendment of Act No.7 of 1989.  Meanwhile, the Islamic Law Principles have been adopted by Law No.21 of 2008,  the Supremre Court Decree No 2 of 2008 and other relevant laws and regulations. The author  recommends that the Indonesian Government adopt implementing regulation on syariah- economic.  It is also recommended that the government  should enhance socialization of the laws and regulations relating to fikih muamalah and syariah –economic  to the general public.   This can be a  guidance for the Indonesian Muslims to comprehensively practice  their religion teaching.

Abstract

The Indonesian Penal code and Penal Code of Singapore contain the criminal act provisions of decency offence. Decency offence under Indonesian penalcode is categorized according to criminal serious and minor offences. The decency offence sanction is regulated by Book II, Chapter XIV and Book III Chapter VI respectively. In the meantime, decency offence and its criminal sanction under Singaporean Penal code are set out in Chapter XIV entitled: Offences Affecting the Public Health, Safety, Convenience, Decency dan Morals; Chapter XVI on The Offences Affecting Human Body and Chapter XX concerning Offences Relating to Marriage. This article examine a comparative study of decency offence and its criminal sanction under Indonesian and Singaporean Penal Code. It finds that there is similarity between Indonesian and Singaporean Penal Code with regard to the types of criminal acts of decency, rape, adultery, incest,pornography among other thngs. Abstract

One of the power of District/City Government is to deal with investment affair, which is governed by Regional Regulation. In fact, such regulation governs from license process to the determination of retribution amount, which is classified as a regional tax. Although this regional revenue aims to improve public services in order to boost investment, it has created unfair competition among the  District/City Governments in an attempt to get investor by ignoring all legitimate interests of other District/City Governments. Based on the above background, this article seeks to examine the function and role of the West-Jawa Province Government in regulating the investment matter. The issues that will be discussed in this article as follows: (1) Whether the West-Java Province Government has the authority to govern the regional regulation relating to investment?; (2) What steps that can be taken by the Province Government to make Law Harmonization in investment arrangement at a regional level?; and (3) Can the District/City Government Regulation, which is considered to be hampering the investment business climate, be revoked by the West-Java Province Government ?

Abstract

Perhaps the most important development in patients’ rights has been that in Indonesia and the United States regarding the doctrine of informed consent. Embracing the Continental European legal system, the doctrine of informed consent in Indonesia is articulated in  Law No. 36 of 2009 on Health, Government Regulation No.32 of 1996 on Health Worker, Law No.29 of 2004 on Medical Practice, and Law No. 8 of 1999 on Consumer Protection. It is also specifically regulated by Health Ministerial Decree No. 29 of 2008 regarding Medical Action Approval.  This doctrine requires physicians to share certain information with patients before asking for their consent to treatment. The Court in  the United States of America used the term of informed consent to describe the physicians obligations to provide information. The legal consequences if informed consent is not given, it is considered  as an act of abuse (intentionally) to the patient. According to Rule of law in the United States  that physicians have to open all the information about all the necessary facts, so that patients can determine appropriate treatment options. Tort Law in Anglo-Saxon legal system, similar to "act against the law" in the Continental European legal system. This article examines a comparative study of informed consent in the Indonesian Health Laws and regulations and those of the United States.

Abstract

A merchandise is protected by the intellectual property rights regime over creative copy rights, known as merchandising rights. Basically, merchandise product and trade use the main components of an intellectual work in the field of copy rights, trade-mark rights, industrial design rights and other  intellectual property rights. Legal protection over merchandising rights in Indonesia is not regulated by the existing laws and regulations relating to intellectual property rights. In this context, Law No. 19 of 2002 on Copy Rights does not specifically regulate the provision of merchandising rights. The absence of such provision and the law enforcement weakness in this area is unexpected condition by industrial-creative business actors. This article will seek to demonstrate gaps in the current legal framework on intellectual property rights providing legal protection over merchandising rights.

Abstract

Mudharabah is a permissible commercial agreement in Islam and it contains great benefits for human beings. Mudharabah role in Shariah economic development is very important  in improving the welfare and empowering the economic of people. Mudharabah will correlate the people with  surplus of fouds to the people with lack of fouds for reaching the human welfare (al falah) through organizing the natural resources which is based on cooperation and participation. However, Mudharabah is not implemented optimally yet,  there are several obstacles in implementing it, Therefore, there is a need a comprehensive measurement to socialized the utility of mudharabah to the people through education and dissemination, and it has to be done by certain institutions such as, shariah financial institution, Association of Muslim Scholars (MUI), ademicians  and also from prominent figures in the society.

Abstract

The case of this thesis is how the regulation of judicial local act authority in Indonesia. And how the implementation of  185 articel of act number 32/2004 about the local government. And what the implication of 144 article of act number 32/2004 about the local government and what the law instrument is appropriate with province act strike down. From the conceptual approach and statute approach, we can make conclusion that the judicial of local act could be done from two authority, judicial review with supreme court and executive review with president c.q the internal minister, the stating of local act in 185 article of act 32/2004, can’t to implementing, until the mixtime a long 30 days to stating the local act is not impelemented. And the executive regulation as the instrument to strike down the local act is wrong. Because of that, recommended to make harmonization or synchronization between executive and Supreme Court sincronisation  authority. And revise 185 article of act 32/2004  and the law instrument to strike down a province act is president decition.
