Abstract

Penulisan hukum ini bertujuan untuk mengetahui perbandingan pengaturan Tindak Pidana Penodaan Agama berdasarkan KUHP Indonesia dan Israel Penal Law 5737-1977. Perbandingan tersebut meliputi perbedaan, persamaan, dan kelebihan serta kekurangan dari masing-masing peraturan perundang-undangan. Penulisan hukum ini termasuk pada golongan penulisan hukum normatif dengan sifat preskriptif dan terapan melalui pendekatan perbandingan. Sumber bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer dan sekunder. Teknik pengumpulan data dilakukan melalui studi kepustakaan serta analisis data yang digunakan yakni dengan metode silogisme melalui pendekatan secara deduktif. Berdasarkan perbandingan pengaturan tindak pidana penodaan agama berdasarkan KUHP Indonesia dan Israel Penal Law 5737-1977 terdapat beberapa persamaan dan perbedaan. Melalui adanya persamaan dan perbedaan tersebut dapat diketahui aspek kelebihan dan kekurangan dari masing-masing pengaturan baik dari sisi KUHP Indonesia maupun dari Israel Penal Law 5737-1977. Sehingga dari perbandingan tersebut dapat ditemukan beberapa kelebihan dari Peraturan Israel Penal Law 5737-1977 tentang Tindak Pidana Penodaan Agama di Israel yang dapat menjadi masukan untuk pembaharuan peraturan KUHP Indonesia tentang tindak pidana penodaan agama di Indonesia, sehingga aspek regulasi terkait Tindak Pidana Penodaan Agama di Indonesia menjadi lebih baik. Abstract

This research was conducted in order to understand and be able to describe the form of authority of the Audit Board of Indonesia under Law No. 15, 2006 concerning the Audit Board of Indonesia regarding the audit of village funds sourced from the state budget in village administration reviewed from the state administration system in Indonesia. The discussion in this writing is about what is the standing of the Audit Board of Indonesia in auditing the village fund in the village administration and the authority of the board in auditing the fund at the village administration. This research used normative approach through scientific study and aimed to ensure the concrete and conformity of the board authority normatively. The research was conducted through library research by studying and analyzing written legal materials and supported with the statements of informant and correspondent involved. The findings concluded that the Audit Board of Indonesia as the state organ of Indonesia with vital task to audit the state budget that can be considered as the Supreme Audit Institute either in the level of central government or the regional level. The authority of the board in the level of village administration to audit the village fund that comes from the state budget is a political movement of the government and is considered as the state will in realizing the good governance as the state program. However, in the implementation, the Audit Board of Indonesia has established its representatives in each province of Indonesia in which, unfortunately, the regional representative seemed meaningless since the board representatives have to answer to the Head and Deputy Head of the board regarding the examination and audit of the village fund of the state budget. The author suggests to promulgate additional concrete and clear provisions on the duty of the representatives of the board in every province. Abstract

Law No. 11, 2020 concerning Job Creation was enacted with the objectives to increase the business climate and to open as many as possible job opportunity. In the regulation, it is recognized a new form of company that is individual company of micro and small business. This business can be founded by an individual who owns the company’s shares. It certainly raised questions considering that limited company and the small business are two different things. This writing will discuss about the potential conflict of interest and violation of the principle of accountability in managing an individual company. The method used in this research was juridical normative with statute and conceptual approaches. The research specification was descriptive analytical. The research found that the Job Creation Act stipulation on the establishment of individual small business as an individual company is incorrect. When a particular company can be established by an individual who owns all the shares, it can create a huge conflict of interest. It surely can make the company so untransparent that the decisions made by the organ of the company to be subjective. In addition, it can make the organ of the company difficult in carrying out its duties in accordance with its duties and responsibilities. Keywords: Omnibus Law, Individual Company

Abstract

The Job Creation Act is believed to be able to end the obesity of statutory regulations in Indonesia which often creates disharmony between laws and regulations which results in sectoral ego and bureaucracy in providing government services to the people, both in the form of permit and non-permit. The spirit of the Job Creation Act in the context of regulatory simplification is expected to accelerate national economic recovery in the midst of a pandemic and to cut bureaucracy in services for investment and MSMEs. However, along the way, the Constitutional Court Decision No. 91/PUU-XVIII/2020 has stated that Law No. 11 of 2020 concerning Job Creation does not have conditionally binding legal force as long as it is not interpreted as "no amendment are made within 2 (two) years, even if it cannot be resolved, it becomes permanently unconstitutional and the amended and revoked law is declared to be reinstated. This research is a normative legal research or literature research (doctrinal research), which uses primary and secondary legal materials. These two materials are used in order to obtain a comprehensive analysis and perspective on the legal issues discussed. This research was conducted in order to analyze the job creation law after the Constitutional Court's decision. The Job Creation Act is still in effect but cannot be implemented, therefore the government as the initiator must immediately assign the Minister of Law and Human Rights to revise the Job Creation Law as soon as possible so that the process of procedure and its formation with Law No. 12 of 2011, or amendment to Law No. 12 In 2011 by adding the omnibus method and the procedure for its formation. Abstract

Legal policy governing goods subject to excise in the perspective of welfare state is a regulation enacted by the state in order to control the circulation and the use of certain goods affected the community health and the environment which in the end is leading to welfare. The regulation has caused problems since there were different and conflicting cross-sectoral interests. The findings of the research showed that the regulation on the goods subject to excise in the perspective of welfare state is applied through extensification of the excisable goods and the application and renewal of the excise tariff. General regulation applies by arranging provisions on controlling and handling impact of the goods subject to excise. The regulation gives power to the regional government to manage the profit sharing for the health service and welfare improvement for the community. Abstract

Dugaan praktik monopoli oleh PT.O dan Bandara I Gusti Ngurah Rai yang hanya menyediakan satu sistem pembayaran jasa berbasis online menimbulkan kerugian diantaranya banyak masyarakat yang kesulitan melakukan pembayaran karena sedikitnya pilihan sistem pembayaran, ditambah dengan sulit masukannya para pelaku usaha lain dalam melaksanakan usahanya. Hal ini menimbulkan permasalahan, permasalahan yang timbul antara lain; Bagaimana implementasi sistem online pada transaksi pembayaran jasa, serta bagaimana penerapan asas keseimbangan dalam transaksi pembayaran jasa berdasarkan sistem online. Penelitian yang dilakukan bersifat deskriptif analitis yang menggambarkan peraturan perundang-undangan yang berlaku, dikaitkan dengan teori-teori hukum dalam praktik pelaksanaan yang menyangkut permasalahan yang diteliti, metode pendekatan yang digunakan adalah pendekatan normatif kualitatif, yaitu penelitian yang dilakukan dengan betolak pada segi yuridis normatif yang lebih lanjut akan ditelaah secara kualitatif dengan berpedoman pada teori-teori dan asas-asas yang relevan. Hasil yang diperoleh dari penelitian diketahui bahwa 1) PT.O melakukan kerjasama dengan Lippo Group untuk menjadi sistem pembayaran tunggal yang mengakibatkan pemusatan ekonomi dengan dikuasainya jasa pembayaran di mal-mal tersebut hingga menghambat para pelaku usaha lainnya untuk masuk dan melakukan kegiatan usahanya. Sedangkan G, melakukan kerjasama dengan Bandara tertentu untuk menjadi satu-satunya platform penyediaan angkutan umum berbasis aplikasi dan hanya menyediakan satu sistem pembayaran yang telah ditentukan oleh pihak G yang mengakibatkan terhambatnya para pelaku usaha lain untuk masuk ke pasar telah memenuhi unsur-unsur dalam pasal 17 dan terbukti melanggar Undang-Undang Nomor 5 Tahun 1999 Tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat; dan 2) penerapan asas keseimbangan dalam pasal-pasal Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat, dapat di lihat asas keseimbangan tidak diterapkan oleh pelaku usaha dalam transaksi pembayaran jasa berbasis online pada kasus Lippo Group (PT.O) dan Bandara I Gusti Ngurah Rai, Hal ini terbukti dengan hanya ditunjuknya satu pelaku usaha untuk melakukan kegiatan membuktikan tidak diberikannya kesempatan usaha pada pelaku usaha lain di pasar tersebut.
