Ijtimaiyya journal is a journal which is managed by the Programme Pascasarajana (PPs) Universitas Islam negeri Raden Intan Lampung. First published in 2008 and regularly published two (2) times a year, in May and in November. Since 2014 this journal began in the online. The script that is loaded is the original manuscript, not yet published in any publication. Scripts can be articles, research results, scientific ideas as well as book reviews. Editors receive from the author of the Madrasah, universities, research institutions and other agencies concerned with the Islamic Community Development.

Abstract

Abstrak Baznas (the National Alms Agency) will design as the coordinator and supervisor of zakat collection and distribution activities in Indonesia, the world’s largest Muslim country. This role, he said, would help the government integrate the zakat management system in Indonesia which had been organized independently by countless registered and unregistered zakat collection organizations scattered around the country, and ensure that the zakat funds would also be used to empower the poor. According to the new alms law, the public is still allowed to establish zakat collection agencies under Baznas supervision as long as they meet all administrative requirements, including the possession of a recommendation from Baznas and technical ability to run their alms collection and distribution programs.

Abstract

Abstrak Traditionally, the first day of each month is the day (beginning at sunset) of the first sighting of the hilal (crescent moon) shortly after sunset. Beside that, the astronomical new moon times and dates are already computed exactly for thousands of years backward and forward. Some nations have used the lunar phase cycle as the basis for their calendars. In a majority of Nadlatul Ulama (NU), oppose the use of calculations, on the grounds that the latter would not conform with Muhammads recommendation to observe the new moon of Ramadan and Shawwal in order to determine the beginning of these months. This Indonesia’s largest Muslim organization, prefers to utilize the method called imkanur rukyat, which requires a clear, visible sighting of the moon. In the other side, Muhammadiyah organization sets the first Ramdhan based on mathematical and astronomical calculations known as hisab wujudul hilal. This article focuses to discuss further about how Muhammadiyah sets the first day of Hijrah calendar.

Abstract

AbstakMaqâshid Syari’ah refers to an act of achieving and protecting the benefits and good (masalih) for the sake of human beings. In fulfilling the maqâshid al Syari’ah, man inadvertently fulfills not only his social and ethical needs but also his commercial needs as well. There lies the wisdom of Muslims having to “fulfill all obligations” as in doing so mankind is fulfilling one another’s needs and obligations, hence a win-win for all. The current practice of Islamic banks needs to incorporate maqâshid al-Syari’ah into their management strategy to ensure its sustainability to serve mankind in the future, in confirmation to the requirement of Syari’ah. Though profitability is essential and must be achieved, but it is not the main objective. In Islam, the ultimate objectives of any activities including business activities are ultimately with the aim of achieving objectives of Syari’ah or maqâshid al-Syari’ah.

Abstract

 Abstrak The question of insurance is a major concern of contemporary Islamic jurisprudence. Insurance is an important part of the modern business environment. Many scholars criticize the system of conventional insurance as exploitative and unjust. They point out that paying money for something, with no guarantee of benefit, involves high ambiguity and risk. One pays into the program, but may or may not need to receive compensation from the program, which could be considered a form of gambling. The insured always seems to lose while the insurance companies get richer and charge higher premiums. On the other hand, there are scholars who argue that the insurance contract contains a great deal of gharar that makes the contract invalid. These argue that this gharar shall be forsaken if we change the structure of the insurance contract in question, making it a cooperative that receives premiums as donations. Based on this argument, Islamic insurance companies are founded. The purpose of this article is to discuss further about this issue.

Abstract

Abstak The legal system of Saudi Arabia is based on Sharia, derived from the Quran, the Sunnah and also include Islamic scholarly consensus. Its interpretation by judges is influenced by the medieval texts of the literalist Hanbali school of Islamic jurisprudence. Laws relating to marriage, divorce, children and inheritance are not codified and fall within the general jurisdiction of the Sharia courts. Polygamy is permitted for men but is limited to four wives at any one time. There is no minimum age for marriage in Saudi Arabia and with regard to the law of inheritance, the Quran specifies that fixed portions of the deceaseds estate must be left to the so-called Quranic heirs.

Abstract

Abstrak The main steps in the process to be followed in court if the parties in court-ordered mediation do not reach an agreement, they can proceed with their case in court. They proceed to trial on the court case and let the judge resolve the matter. When the judge completed his case based on the judges decision and determination. Judges decision is binding on the disputing parties, both parties to carry out the decision. Regarding the division of marital property that had been decided upon in the Religious Court is the case in the decision comdemnator. This decision contains the execution, If one party or the other doesnt fulfil the judge’s decision, based on the of other side, court decisions apply to the Chief court to enforce the execution.

Abstract

Abstrak Professional zakat is kind of zakat that be paid from professionals’ fees after certain nisab. In term of professional zakat, a profession is classified into two catagories which are: first, personal private profession; and second, the profession that depend on other people or institution. It formulation is referred logically to a common conduct of agricultural zakat; which is type of zakat that farmers paid after their harvest without any waiting times’ requirement. From this common practice, some peoples do an analogical effort to convert it to be a new form of zakat. A new terminology of zakat which is ‘professional zakat’ that really close to agricultural zakat in term of it laws’, purposes and requirement. Beginning here the controversies came up. These mentioned issues will be discussed further on the writing.

Abstract

Abstrak Female circumcision is a present muslim societies’ tradition since ancient to modern times. Some moslem scholars say women do not need to be circumcised, but many other scholars argue for female circumcision law is mandatory. They argue with hadith narrated by Abu Dawood from Umu Athiyah and narrated by Ahmad from Osama. Scientifically studied these hadits is dha’if can not be used as a basis in determining the proposition or obligation circumcision for girls. If at the time of the Prophet Muhammad ever set of female circumcision, it should be understood only as his ijtihad itself, not as a permanent Sunnah, and just because people not be continue it. This is the wisdom of the Prophet who want to make changes to the tradition but performed by gradual and without causing chaos.
