Abstract

In resolving land acquisition disputes for the public interest, it is fitting for the state to pay attention to values outside of the rule of law itself, including the value of social justice and the value of benefits to guarantee the basic rights of affected communities. This study aims to find out what factors cause the settlement of land acquisition disputes in terms of juridical aspects not reflecting the value of justice and benefit for the parties and formulating land acquisition dispute resolution models in a legal socio perspective that can realize the value of social justice and benefits for party. an appropriate method is needed that can accommodate the value of social justice and the benefits in resolving the dispute, among others, promoting the Consensus Meeting and the Need for Alternative Dispute Resolution (ADR) as an alternative solution. In addition, the need to calculate non-physical losses in the assessment of compensation for people who have lost their livelihoods due to land acquisition projects Keywords: Land Acquisition, Land Dispute Settlement, Public Interest AbstrakDalam penyelesaian sengketa pengadaan tanah untuk kepentingan umum sudah sepatutnya negara memperhatikan nilai-nilai diluar daripada aturan hukum itu sendiri, diantaranya nilai keadilan sosial dan nilai kemanfaatan untuk menjamin hak-hak dasar masyarakat terdampak. Penelitian ini bertujuan untuk  untuk mengetahui faktor apa saja yang menyebabkan penyelesaian sengketa pengadaan tanah tersebut ditinjau dari aspek yuridis belum mencerminkan nilai keadilan dan kemanfaatan bagi para pihak sertaa merumuskan model penyelesaian sengketa pengadaan tanah dalam perspektif socio legal yang dapat mewujudkan nilai keadilan sosial dan kemanfaatan bagi para pihak. dibutuhkan suatu metode yang tepat yang dapat mengakomodasi nilai keadilan sosial dan kemanfaatan dalam penyelesaian sengketa tersebut diantaranya mengedepankan Musyawarah Mufakat dan Perlunya Alternative Dispute Resolution (ADR) sebagai solusi alternatif.. Abstract

The notary public as the general official has the authority to make authentic deed in accordance with the norms, the values and the provisions of the applicable legislation so that the law can work in the community. Every deed made by a notary must stored in a notary protocol, and the protocol shall be transferred in the event of a notary passing away. But the problem is when a notary has passed away and his protocol is transferred to another notary, then a dispute arises related to the deed. Notary recipient of the protocol will still be called for questioning if there is a problem related to the protocol that is in his control, because it is one of the responsibility of the recipient of notary protocol. This is where the role of MKN appears to provide protection in the form of inspection or investigation permits by the authorities. And the role of MPD and INI in preventing the occurrence of violations in the deed by the notary in the form of guidance to all members of the notary. Keywords : Notary Protocol, Original Of The Deed, Legal Protection AbstrakPada hakekatnya notaris sebagai pejabat umum memiliki kewenangan untuk membuat akta otentik sesuai dengan norma-norma, nilai-nilai dan ketentuan peraturan perundang-undangan yang berlaku sehingga hukum dapat bekerja dalam masyarakat.. Setiap akta yang dibuat oleh notaris wajib disimpan dalam protokol notaris, dan protokol wajib dialihkan dalam hal notaris meninggal dunia. Namun yang menjadi persoalan adalah ketika seorang notaris telah meninggal dunia dan protokolnya dialihkan kepada notaris lain, kemudian muncul sengketa yang berkaitan dengan akta tersebut. Notaris penerima protokol tetap akan dipanggil untuk diminta keterangan apabila terdapat permasalahan terkait protokol yang ada dalam penguasaannya, karena merupakan salahsatu tanggungjawab penerima protokol notaris. Disinilah muncul peranan MKN untuk memberikan perlindungan berupa ijin pemeriksaan ataupun penyidikan oleh pihak yang berwenang. Serta adanya peranan MPD dan INI dalam mencegah terjadinya pelanggaran dalam pembuatan akta oleh notaris berupa pengayoman kepada seluruh anggota notaris. Abstract

Kabupaten Boyolali merupakan daerah yang kaya akan bahan tambang, terutama bahan tambang Galian Golongan C. Bahan-bahan tambang tersebut sangat potensial untuk diusahakan. Namun demikian, pengusahaan bahan-bahan tambang tersebut berpotensi dan terbukti menimbulkan dampak yang banyak dengan beberapa penyebabnya. Metode penelitian yang digunakan penulis dalam penelitian ini ialah menggunakan pendekatan kualitatif yang bersifat yuridis empiris, sehingga penelitian ini disebut penelitian hukum sosiologis. Hasil penelitian ini merupakan tinjauan yuridis sosiologis. Proses pengelolaan galian golongan C oleh pemerintah Kabupaten Boyolali tidak melalui tahapan perencanaan karena usaha tersebut merupakan usaha turun temurun dan dikelola oleh perorangan.Penegakan hukum yang dilakukan yaitu dengan penerapan instrumen administratif, instrumen perdata dan juga instrumen pidana tetapi dalam mengatasi sengketa lingkungan hidup dan juga pertambangan lebih banyak dilakukan penyelesaian diluar pengadilan yaitu melalui negosiasi dan mediasi. Ada beberapa faktor pendorong yang menjadi penyebab suburnya kegiatan tambang illegal, mulai dari faktor ekonomi hingga masalah menghindar dari kewajiban bagi pengusaha pertambangan maupun pihak pemerintah dan penegak hukum. Sehingga pada akhirnya menghasilkan dampak yang buruk pada lingkungan alam & sosial.

Abstract

Fakta menunjukkan bahwa pemenuhan hak atas air (the rights to water) untuk sebagian penduduk dunia, termasuk Indonesia, belum tercapai. Fakta ini mendorong upaya pemenuhan ha katas air dimasukkan sebagai salah satu tujuan Pembangunan Milenium atau Milenium Development Goals (MDGS) sebagai tarhet ke-10. Target tersebut ditetapkan untuk mengurangi setengah dari jumlah penduduk dunia yang tidak mempunyai akses air bersih dan sanitasi pada tahun 2015.

Abstract

Indonesia's natural resources (SDA) are clearly regulated through the 1945 Constitution of the Republic of Indonesia and various related laws and regulations. The management of natural resources must be based on Indonesia's basic constitution and also the values of Pancasila. But the fact is, many cases show that the management of natural resources has not been fulfilled as mandated by the 1945 Constitution of the Republic of Indonesia.

Abstract

The facts show that the fulfillment of the rights to water for some of the world's population, including Indonesia, has not yet been achieved. This fact encourages efforts to meet water levels to be included as one of the Millennium Development Goals (MDGS) goals as the 10th tarhet. The target is set to reduce by half of the world's population who do not have access to clean water and sanitation by 2015.

Abstract

The formation of public policies, including the Warehouse Receipt System in Indonesia, is based on interests, whether sourced from the internalstate or originating from external or other countries environmental factors. Adaptation to external factors cannot be denied because the Indonesian Government has to follow the mechanism that is enforced internationally, mainly in the commercial and financial fields, including banking. This paper aims at analyzing the direction of the warehouse receipt system policy in Indonesia, identifying and describing the policy of the warehouse receipt system and describing it based on the reading of the critical paradigm, and exploring the potential for the development of legal knowledge of the warehouse receipt system policy. The results of the conceptual review of this paper showed that the policy of the Warehouse Receipt System in Indonesia is directed atproviding opportunities to farmers to access credit with savings commodities as collateral.

Abstract

Teknologi deepfake sebagai produk dari kecerasan artifisial sedang marak diperbincangkan masyarakat karena kecanggihannya dalam menggantikan wajah subjek asli dengan wajah subjek lain dalam bentuk video atau foto yang hasilnya hiper-realistis. Hal ini kemudian disalahgunakan oleh masyarakat untuk membuat konten pornografi non-konsensual yang memakan banyak korban. Konten-konten tersebut kemudian disebarluaskan di platform-platform media sosial beserta dengan identitas korban. Berkaitan dengan hal tersebut, korban berhak untuk mendapatkan hak untuk dilupakan atau right to be forgotten (RtBF) dengan menempuh jalur litigasi sebagaimana termaktub dalam Pasal 70 ayat (2) huruf l UU TPKS. Namun, pemenuhan RtBF bagi para korban deepfake pornography mengalami banyak hambatan di lapangan, baik karena peraturan pelaksana daripada UU TPKS yang belum ada, aparat penegak hukum yang tidak memiliki perspektif gender dan keberpihakan terhadap korban, budaya hukum yang buruk, dan lain-lain. Penelitian ini menggunakan metode pendekatan socio-legal, guna mengkonseptualisasikan fenomena sosial yang ditinjau dari aspek hukum terhadap kejahatan pemalsuan yang didukung oleh teknologi.

Abstract

When attaining effective governance and justice, as described in the Sustainable Development Goals (SDGs), corruption is a serious hurdle in sustainable development. The issue of corruption continues to be widespread in Indonesia, necessitating responses that are both comprehensive and international in scope. Essential to the fight against corruption is the empowerment of community engagement at the local level; in developing, implementing, and monitoring Anti-Corruption Action programs. On the other hand, there is considerable space for improvement regarding community participation in anti-corruption activities. This study aims to analyze the significance of community involvement in anti-corruption measures within Indonesia by employing a socio-legal methodology: a combination of legal research with sociological analysis. Data collection entails using primary sources, such as interviews and observations made in the field; in addition to secondary sources, including legal literature and decisions made by the courts. Descriptive-analytical approaches are used to examine the elements influencing community participation in preventing and eliminating corruption. After completing the research, the researchers concluded that anti-corruption learning programs, law enforcement, and community awareness are necessities to effectively combat corruption. Additionally notable is the increasing importance of the independent media's role in discovering corruption and increasing public awareness. Among the recommendations are the enhancement of community engagement, the promotion of anti-corruption education, the expansion of media cooperation, and the improvement of government openness. To combat corruption and promote good governance, it is possible to develop an effective and sustainable collaboration between the government and society by implementing these measures.KEYWORDS: Corruption, Community Engagement, Anti-Corruption Action Programs, Local Governance

Abstract

This study aims to analyze the state of society that began without a system, or what is called the condition of disorder, which is unstable (social melee) so that the state of law, when it comes to people's lives, must also follow the unstable pattern (legal melee). The method used is normative philosophical, which leads to the basis of discourse (Conceptual). This study also explains some of the gaps in previous similar studies by presenting some novelty of analysis, such as (1) an explanation of how legal wisdom is an important concept for progressive law enforcement, (2) the national legal system (conventional) with legalistic positivistic substance remains an open formulation towards legal progressiveness in Indonesia. The exposure of the construction of a legal system continuously undergoing development is an issue that must always get a balance for new legal discoveries so that the developing law always follows the development of society. The results of this study revealed that the existing legal products also naturally show how the law plays a role. Then, with the existence of legal products, one area that gets regulation against it must be more organized than areas that legal arrangements have not been regulated by law. It can be concluded that today's Indonesian legislation is a portrait that shows the problem of existing regulations. It has become natural to revive and develop with a more structured of legal enforcement.
