Abstract

Alternative, complementary medicine is non-conventional medicine aimed at improving public health status, including promotive, curative, preventive, and rehabilitative efforts obtained through structured education with high quality, safety, and effectiveness based on biomedical science, which has not been accepted in conventional medicine. In several hospitals in Indonesia, this complementary medicine has begun to be applied as supportive therapy or replacement therapy for patients who refuse traditional treatment methods. This complementary therapy can also be carried out at the patient's request or with the referral of other doctors. The approach method used in this study, namely normative juridical, is a method of legal research conducted on library materials or secondary data using deductive thinking methods based on truth criteria. Coherent. There is also a complementary therapy called holistic medicine, which is because the form of therapy can affect individuals. The limitations of conventional medicine are one of the reasons why complementary and alternative therapies are an option in treating/healthy Indonesian people. The development of complementary and alternative therapies must be the responsibility of health workers, especially nurses. Legality for complementary and integrated health services must have a Traditional Health Worker Registration Certificate (STRTKT) and a Traditional Health Worker Practice License (SIPTKT).

Abstract

The handling of the dead bodies caused by the epidemic is one of the methods used to control disease outbreaks. The handling of the dead bodies itself has always been regulated in Article 16 of Government Regulation Number 40 of 1991 about Disease Outbreak Management, way before the COVID-19 pandemic happened. The purpose of this paper is to contribute to the advancement of legal science by expanding knowledge and providing references, particularly in the case of the rejection of COVID-19 victims' bodies, which is the subject of Ungaran District Court Ruling number 76/Pid.Sus/2020/PN Unr. This research is focused on these two problems: the legal review of the funeral law and the rejection of a deceased COVID-19 victim's funeral; and the judges’ consideration in deciding the case of the rejection of a deceased COVID-19 victim's funeral. Objectively, this research aims to describe the legal review of funerals and the rejection of a deceased COVID-19 victim's funeral, as well as the judges' considerations in deciding the case of the rejection of a deceased COVID-19 victim's funeral. The research was conducted using a normative juridical method with a statutory and conceptual approach. Primary and secondary legal materials are discussed and researched using an interpretation method with the aim of providing clarity on the existing legal materials related to the problems encountered. As such, the research results were as follows: Firstly, there are adequate laws and regulations for funeral management, including protocols for the burial of bodies due to infectious disease outbreaks. Refusing to bury a deceased COVID-19 victim is a penal act, both according to Law No. 4 of 1984 concerning Outbreaks of Infectious Diseases and the Criminal Code, and is an unlawful act according to Article 1365 of the Civil Code. Second, it was found that the judges decided the case by considering the law, the action, the mental attitude or guilt, and the penality. It is expected that there will be effective public education about the human rights inherent in a person even after death, as well as education about the dangers of stigmatizing COVID-19 patients and victims in efforts to combat the pandemic.

Abstract

Correctional Institution as a place to house terrorist inmates have not managed to solve the problem ofderadicalization to complete for terrorist inmates, so it is necessary to cooperate with other relevant stateinstitutions. But the deradicalization process has obstacles such as inmates being unwilling to cooperate and theabsence of synergy with other applicable state institutions. The parameters of the success of correctional institutionsin conducting deradicalization are necessary to strengthen the process of returning terrorism convicts to thecommunity, so that this research is important to do. This study uses the research method that is juridical normativeby collecting primary data and secondary data. The results of this study describe the correctional institution to bethe vanguard in the process of deradicalization of terrorism convicts to be ready to return to the community so thatthe implementation of effective deradicalization required cooperation from correctional institutions, relevant stateinstitutions, and inmates. Correctional institutions are an important vector in the fight against radicalism. The roleof correctional institutions in the deradicalization of terrorism prisoners is to synergize with other institutions tofoster terrorist prisoners to become good human beings when they leave correctional institutions.

Abstract

AbstrakSetiap anak dan balita memiliki hak yang sama dengan orang dewasa, antara lain hak atas kesehatan, rasa aman, tumbuh kembang yang sehat, dan lingkungan yang baik. Selama situasi pandemi Covid-19, fasilitas pelayanan kesehatan membatasi pelayanannya karena mengutamakan penanganan pasien covid-19, sedangkan untuk pelayanan balita yaitu posyandu di masyarakat untuk sementara ditiadakan. Hal ini dikarenakan posyandu perlu melakukan berbagai upaya untuk melakukan pencegahan penularan covid-19. Selain itu juga posyandu memiliki peranan yang sangat penting di masyarakat dalam mewujudkan kemandirian masyarakat dalam menjaga kesehatan melalui pemberdayaan dan peran aktif masyarakat dalam mengubah perilaku dan lingkungan khususnya untuk pelayanan kesehatan bagi balita. Penelitian ini menggunakan metode pendekatan yang digunakan yaitu pendekatan yuridis sosiologis. Penelitian yang dilakukan adalah penelitian eksplanatif. Penelitian ini bertujuan untuk memperoleh hubungan antara variabel satu dengan variabel lainnya tentang kajian yuridis peran Posyandu di masa pandemi Covid-19 dalam pemenuhan hak kesehatan pada balita. Hasil penelitian ini bahwa Posyandu memiliki peran yang baik di masa pandemi Covid-19 dalam pemenuhan hak kesehatan pada balita dan sudah berjalan. Kendala yang terjadi di posyandu pada masa pandemi Covid-19 dalam pemenuhan hak atas kesehatan pada balita disebabkan oleh faktor-faktor seperti jumlah kader, partisipasi masyarakat untuk menjadi kader, kondisi ekonomi kader yang menurun sehingga mereka harus bekerja untuk membantu ekonomi keluarga dan fasilitas yang dimiliki di posyandu.Kata Kunci: Posyandu, Hak kesehatan, Balita, Covid-19 AbstractEvery child and toddler has the same rights as adults, including the right to health, a sense of security, healthy growth and development, and a good environment. During the Covid-19 pandemic situation, health service facilities limited their services because they prioritized handling covid-19 patients, while for toddler services, namely posyandu in the community, it was temporarily suspended. This is because posyandu needs to make various efforts to prevent the transmission of covid-19. In addition, posyandu also has a very important role in the community in realizing community independence in maintaining health through empowerment and the active role of the community in changing behavior and the environment, especially for health services for toddlers. This research uses the approach method used, namely the sociological juridical approach. The research carried out is explanatory research. This study aims to obtain a relationship between one variable and another about the juridical study of the role of Posyandu during the Covid-19 pandemic in fulfilling health rights in toddlers. The results of this study are that Posyandu has a good role during the Covid-19 pandemic in fulfilling health rights for toddlers and is already running. The obstacles that occurred at the posyandu during the Covid-19 pandemic in fulfilling the right to health in toddlers were caused by factors such as the number of cadres, community participation to become cadres, the declining economic condition of cadres so that they had to work to help the family economy and facilities owned at the posyandu.Keywords: Posyandu, Right to health, Toddler, Covid-19

Abstract

AbstrakCiri paling mendasar dari sebuah demokrasi adalah adanya hak pilih yang transparan dan demokratis secara universal. Seiring waktu, pelaksanaan pemilihan umum harus dipantau. Penting untuk membahas masalah penggunaan teknologi informasi dalam melakukan pemilihan umum, karena hampir setiap negara modern telah memakai teknologi informasi dalam pelaksanaan pemilu untuk mencapai pemilihan yang berkualitas. Oleh karena itu, teknologi informasi harus digunakan untuk mendukung fungsi pengawasan dalam penyelenggaraan pemilu umum. Penelitian ini menggunakan metode yuridis normatif dengan menggunakan teknik pengumpulan data sekunder melalui penelusuran pustaka, menelaah bahan-bahan yang diambil dari literatur yaitu undang-undang, jurnal, buku dan berita online. Tujuan dari penelitian ini adalah untuk mendorong optimalisasi pemantauan pemilu umum dengan menggunakan teknologi informasi. Penggunaan teknologi informasi dalam pemilu umum menjadi isu penting, terutama terkait pengawasan. Penyelenggaraan pemilu legislatif di era kemajuan teknologi informasi yang berkembang saat ini diperlukan sumber daya manusia yang profesional dalam hal untuk mempermudah kinerja penyelenggara pemilu umum dan meminimalisir kesalahan data baik di tingkat daerah maupun pusat. Proses pengawasan pemilu saat ini sudah berjalan baik, namun karena keterbatasan sumber daya manusia, jangkauan yang luas dari lembaga pemantau pemilu, berbagai upaya kecurangan, dan kurangnya sosialisasi yang optimal dalam penggunaan dan pemantauan teknologi informasi hal tersebut menjadi merupakan kelemahan dalam pengawasan.Kata Kunci: Pemilihan Umum, Pengawasan, Teknologi Informasi AbstractThe most fundamental feature of a democracy is the existence of universally transparent and democratic suffrage. Over time, the conduct of elections should be monitored. It is necessary to discuss the issue of using information technology in conducting elections, because almost every modern country has used information technology in the conduct of elections to achieve quality elections. Therefore, information technology must be used to support supervisory functions in the holding of general elections. This research uses normative juridical methods by using secondary data collection techniques through literature searches, examining materials taken from literature, namely laws, journals, books and online news. The purpose of this study is to encourage the optimization of general election monitoring using information technology. The use of information technology in general elections is an important issue, especially related to supervision. The implementation of legislative elections in the era of advances in information technology that is developing today requires professional human resources in terms of facilitating the performance of general election organizers and minimizing data errors both at the regional and central levels. The election supervision process is currently running well, but due to limited human resources, the wide reach of election monitoring agencies, various fraud efforts, and the lack of optimal socialization in the use and monitoring of information technology, these are weaknesses in supervision.Keywords: Elections, Surveillance, Information Technology

Abstract

Surgery is an effort to treat or help to treat a patient's disease. The increasing demand for health care is to increase, whether it is expected that a nurse improves her knowledge and skills, such as a surgical nurse specialist. This research uses normative juridical research methods, using secondary data sources including legislation, books, journals, court decisions, and other literature. The result of the study is that the surgical nurse while performing his duties both in the surgical room, before surgery, during surgery and after surgery must be based on SOPs and mandates from doctors made in writing. That way a surgical nurse if working is in accordance with the procedures and directions of the doctor, the surgical nurse cannot be sanctioned in the event of a medical dispute because his responsibility rests with the surgeon.

Abstract

Doctors and paramedics as health resources are the main component of health care providers to the public to achieve health development goals by national goals. Doctors and paramedics are the vanguard of treating Covid-19 patients with a very high risk of transmission of the virus. Legal protections for Doctors and paramedics are often overlooked as if society is apathetic and opinionated that it is already a duty and responsibility as medical personnel. Legal protections for the safety of Doctors and paramedics are less noticed, even though medical personnel are the vanguard in the handling of the Covid-19 pandemic. Speaking of legal protections certainly cannot be released from rights and obligations. Unprotected health workers, in this case, the profession of health workers. Violation of the rights of Doctors and paramedics related to covid-19 patient services that often occur is that the patient does not provide honest information on his condition as a Person in supervision or Patient In Supervision, so the more prone to the transmission of the Covid-19 virus that certainly has a domino effect on both doctors, Doctors and paramedics, other patients and also their families. Legal protection of Doctors and paramedics should be a serious concern of governments and hospitals. The patient must need and trained to be honest with what he feels and does. Legal protections that will surely make Doctors and paramedics feel protected in carrying out their humanitarian duties. All good measures of the assessment until evaluation will be carried out properly. Synergy together is the way to be done for all to realize quality health care.

Abstract

Waste resulting from an activity or production is highly undesirable in human life because waste negatively impacts life, especially for human health. Hospitals are one of the institutions that produce considerable waste and can have a devastating impact on the environment. Because medical waste has the potential to cause problems for the environment as well as to human health. The most dangerous hospital waste is infectious medical waste. Experts and skilled should appropriately handle infectious waste in its management. This research is empirical legal research using a statutory, conceptual, and sociological approach. As well as conducting interviews and observations with the analysis used is qualitative descriptive analysis. It is expected that the management and management of the hospital can carry out the medical waste treatment by the regulations that have been published by the government, and the government must carry out strict supervision so that medical waste does not cause pollution to the environment.

Abstract

Ibu post sectio caesarea di rumah sakit, sesuai dengan peraturan yang ada harus memberikan ASI eksklusif. Data yang diperoleh dari survey demografi kesehatan Indonesia tahun 2017 adanya peningkatan pemberian ASI eksklusif dari tahun 2012 yaitu 42% menjadi 52% pada tahun 2017. Tetapi jika dikaji ternyata pemberian ASI eksklusif menurun seiring dengan bertambahnya usia anak dari 67% pada usia 0-1 bulan menjadi 55% pada usia 2-3 bulan dan 38 persen pada usia 4-5 bulan. Penelitian ini bertujuan untuk mengetahui faktor-faktor penyebab pada ibu post sectio caesarea tidak memberikan ASI eksklusif pada bayinya dan mengetahui implementasi pemberian ASI eksklusif pada bayi dengan ibu post sectio caesarea di Rumah Sakit Kawasan Danau Tahun 2020. Metode penelitian ini adalah penelitian yuridis empiris, spesifikasi penelitian dalam penelitian ini adalah deskriptif analitis. Hasil penelitian menunjukkan dari 60 responden ibu post sectio caesarea dan 22 tenaga kesehatan didapatkan bahwa bayi belum mendapat inisiasi menyusui dini dan ASI ekskusif dan pada umumnya mengunakan susu formula. Kesimpulan bahwa ibu post sectio caesarea masih belum sepenuhnya dilakukan diseluruh lokasi penelitian, dibutuhkan kebijakan nasional untuk mendukung ASI ekslusif bagi ibu dan bayi post sectio caesarea.

Abstract

Perkembangan penularan virus COVID-19 saat ini relatif signifikan lantaran penyebarannya telah mendunia & semua negara merasakan dampaknya termasuk Indonesia. Berbagai upaya dilakukan pemerintah buat memutus penyebaran COVID-19, salah satunya merupakan dengan penerapan physical distancing/social distancing dan menjaga kesehatan. Kerjasama yang baik juga harus dilakukan antara dokter dengan pasien di masa pandemi COVID-19 pada saat pasien memberikan keterangan atau informasi tentang dirinya harus dilakukan secara jujur. Tujuan dari penelitian ini adalah untuk mengetahui dampak dari ketidakjujuran pasien kepada dokter. Metode Penelitian ini menggunakan metode yuridis normatif dengan mengkaji berbagai literatur yang relevan dengan tema yang dikaji. Pengumpulan data dilakukan melalui studi pustaka untuk menemukan bahan hukum sekunder yang relevan dengan Pendekatan deskriptif preskriptif. Hasil Penelitian menunjukkan bahwa belum ada sanksi tegas kepada pasien yang tidak jujur ketika ketidakjujuran pasien tersebut dapat berdampak merugikan tenaga medis dan tenaga kesehatan lainnya. Sehingga diperlukan dibuat sebuah peraturan dan kebijakan terkait dari ketidakjujuran pasien, sebab dampak dari ketidakjujuran pasien di masa pandemi COVID-19 dapat menularkan bagi Tenaga medis dan tenaga kesehatan lainnya yang bisa menyebabkan kematian.
