Abstract

Putusan Mahkamah Konstitusi No. 46/PUU-XIV/2016 yang menolak perluasan makna zina yang ada dalam Kitab Undang-Undang Hukum Pidana menjadi topik yang ramai diperdebatkan. Sebagian masyarakat berpendapat bahwa seharusnya Mahkamah Konstitusi berani melakukan terobosan hukum dalam isu yang sangat penting tersebut. Namun, Hakim Mahkamah Konstitusi berpendapat perluasan makna zina tersebut bukan ranah kewenangan mereka. Penelitian ini bertujuan untuk mengkaji lebih jauh argumentasi hukum (ratio decidendi) putusan Mahkamah Konstitusi yang bersifat open legal policy dan bagaimana implikasinya terhadap pembentukan peraturan perundang-undangan di Indonesia. Penelitian ini merupakan penelitian kepustakaan dengan pendekatan undang-undang dan studi kasus terhadap beberapa putusan Mahkamah Konstitusi yang mengandung argumentasi open legal policy. Secara konseptual penelitian ini juga akan membahas bagaimana implikasi putusan Mahkamah Konstitusi yang mengandung open legal policy tersebut terhadap sistem legislasi nasional. Hasil penelitian menunjukkan bahwa pertama, konsepsi open legal policy dalam putusan Mahkamah Konstitusi belum memiliki batasan yang jelas sehingga pengertian positive legislator dan negative legislator sering dikacaukan dalam praktik pembentukan dan pengujian undang-undang. Kedua, putusan yang bersifat open legal policy tersebut juga menunjukkan bahwa di antara hakim Mahkamah Konstitusi telah terjadi tarik menarik penggunaan paradigma judicial activism dan judicial restraints sehingga menimbulkan ketidakpastian hukum di tengah masyarakat. Penelitian ini merekemomendasikan perlunya kajian yang lebih mendalam tentang disain open legal policy dalam putusan Mahkamah Konsitusi dan sistem legislasi nasional Indonesia.The Constitutional Court Decision No. 46/PUU/XIV/2016 which rejected the petition of petitioners to broaden the meaning of zina (fornication) in the Criminal Code of Indonesia has been becoming an interesting issue to be discussed. Some argue that the Constitutional Court must use its authority to conduct a break-through in responding the crucial legal issue. On the other hand, the Court asserted that widening the meaning of zina in the Criminal Code of Indonesia is not its authority. The research aims at discussing further the ratio decidendi of the Constitutional Court Decision which contains the element of open legal policy and its implication to national legislation system. The research is a normative legal research which uses statute approach and case law approach. The result of research shows that firstly, the concept of open legal policy in the Constitutional Court decisions does not have a clear limitation which implies uncertainty of its implementation in the Court decisions and the national legislation system. Secondly, the Decision of the Constitutional Court with open legal policy also shows that on one hand, there is a trend of using judicial activism among the constitutional judges. On the other hand, some constitutional judges also use judicial restraint approach as their reasons which results uncertainty of law in Court decision. The research recommends that there should be a further study on design model of open legal policy in the Constitutional Court decisions and its implication to national legislation system.

Abstract

The single candidate became a political phenomenon in Indonesia. However, the phenomenon rarely happens, consistently increasing the number of single candidates in the local election. This research aims to analyze whether this political phenomenon alerts democracy decadency or a typical circumstance in a democratic state. The method used in this research is doctrinal legal research. The result shows several reasons the single candidate consistently increases from event-to-event sort of an epidemic virus that could spread across the province. Some factors supporting the rise of the single-candidate phenomenon, for instance, the local parliamentary threshold of proposing the candidate, public distrust to the political parties, disfunction of a political party to giving a political education for its members and constituents, and the political parties tend to avoid the political risks of losing (incumbent). Finally, this single candidate phenomenon is a bad alert for democracy development, notably in the local area.

Abstract

Masalah pandemi Covid-19 telah memperburuk kemampuan keluarga untuk bertahan menyelamatkan keutuhan keluarga. Hal ini ditandai dengan terus meningkatnya angka perceraian. Di Sleman misalnya, tercatat ada 1.106 pasangan bercerai hingga Juli 2020 lalu. Setidaknya ada empat pilar ketahanan keluarga yang terdampak kelangsungan sebuah keluarga yang berujung meningkatnya angka perceraian di masa pandemi Covid-19 antara lain ketahanan fisik, ekonomi, sosial psikologi dan sosial budaya. Kegiatan ini bertujuan untuk mewujudkan empat pilar keluarga tangguh melalui pendampingan gerakan ECCOHEALTH (Economis, Communication, and Healthy). Kajian ini menggunakan metode studi kepustakaan dan penelitian lapangan dengan mengajukan daftar pertanyaan dalam bentuk kuesioner kepada warga di Umbulharjo dan Ambarketawang. Metode yang digunakan yaitu FGD (Focus Group Discussion), wawancara, penyuluhan, dan pelatihan. Evaluasi diberikan dengan memberikan sejumlah pertanyaan-pernyataan untuk masing-masing materi melalui teknik pre-test dan post-test yakni pengisian sebelum dan setelah pemberian materi. Dengan teknik ini diketahui adanya peningkatan pengetahuan yang diterima oleh warga di Umbulharjo dan Ambarketawang. Hasil kajian menunjukkan setelah kegiatan penyuluhan dan dilakukan pre-test dan post-test, diketahui bahwa pemahaman peserta terhadap empat indikator ketahanan keluarga mengalami peningkatan secara cukup signifikan.

Abstract

The location for the New Yogyakarta International Airport (NYIA) construction involved in land disputes during the land acquisition process. The land acquisition will always lead to disputes or conflicts with the affected people. It is even more complicated if, in the development process, the ruling elite intervenes, external forces outside the local community that are not directly related to the development. This article deals with the question of the government's public perceptions of the legal polemic of land dispute settlement based on Law No.2 of 2012, and concentrates to examine a new model of land dispute resolution from the perspective of affected communities against NYIA. This research is normative-empirical based on primary and secondary data, namely a literature study, field study, using purposive sampling with interviews, FGD, observation, and qualitative descriptive analysis. The result showed the failure of formal litigation and non-litigation approaches offered by Law No.2 of 2012 to resolve the disputes fairly. Village discussions based on local wisdom as a new model for equitable land dispute resolution needs a political review of Law No. 2 of 2012. The new paradigm of agrarian reform must be based on customary law and local wisdom values in the 1945 Constitution and the Agrarian Law. Given recent controversies concerning land disputes, a law on reform and structuring the national agrarian structure, Agrarian conflict resolution law, and law of natural resources management for the community are urgently needed.

Abstract

Fokus utama pengabdian ini adalah mencerdaskan pemilih pemula dengan memberikan pengayaan materi pendidikan politik di kalangan siswa-siswi Madarasah Aliyah Muallimin dan Muallimat Yogyakarta sebagai kelompok sasaran dalam mengikuti pemilihan Presiden/Wakil dan para wakil rakyat di tahun 2019. Indikator bagi pemilih cerdas diasumsikan paling tidak : 1. Memahami jejak rekam para kontestan secara baik. 2. memahami visi-misi calon Presiden/Wakil, dan wakil rakyat dengan baik. 3. Memahami komitmen keberpihakan kontestan terhadap isu-isu kepentingan rakyat, isu anti korupsi dan non diskriminasi terhadap semua orang. 4. Mampu mengatasi isu/berita kampanye negatif (negative campaign ) dan isu/berita hoax terhadap para kontestan. 5. Terinternalisasi sikap anti money politics, kesediaan untuk turut mengawasi terselanggaranya Pemilu yang jurdil dan luber. Metode pendekatan berbasis partisipatif aktif dan interaktif dengan model ceramah, pelatihan, dan participatory learning/role playing disertai diskusi interaktif dan bedah kasus seperti kasus-kasus Hoax, money politics, dan negative campaign. Pola ini lebih menempatkan mitra sebagai mitra/partsipan aktif, dalam suasana kegiatan yang non formal/atraktif sehingga mampu menghasilkan serapan pengetahuan pendidikan politik yang mencedaskan. Terpenuhinya pemahaman dan perilaku pemilih pemula yang cerdas akan mendorong terwujudnya hasil Pemilu 2019 yang berkualitas dalam menghasilkan pemimpin dan para wakil rakyat yang amanah dan berjiwa negarawan.

Abstract

The Constitutional Court Decision No. 88/PUU-XIV/2016 grants a possibility for a woman to be a candidate for Governor and Vice-Governor in the Special Region of Yogyakarta. As the only province in Indonesia where the executive leaders are only able from the royal family of the Ngayogyakarta Hadiningrat, the decision then triggers a polemic among people in the region. This is due to the current governor, Sri Sultan Hamengku Buwono X, does not have a son as his successor to the throne. Thus, this paper reveals institutional disputes’ settlement mechanism in the Ngayogyakarta Hadiningrat Sultanate if any disputes ever appear. The outcome finds that the Sultanate has yet clear mechanism of dispute settlement among the royal family and no official institution which possesses authority to settle royal disputes. Insofar, the Sultanate has had a customary law or paugeran adat in which a female figure might taking the throne to be the Sultanah and the governor of the province. Nevertheless, the authors recommend to establish an institution to settle royal disputes for the continuation of the Ngayogyakarta Hadiningrat Sultanate. Abstrak: Putusan Mahkamah Konstitusi No. 88/PUU-XIV/2016 meniscayakan adanya kemungkinan untuk seorang perempuan menjadi kandidat Gubernur dan Wakil Gubernur di provinsi Daerah Istimewa Yogyakarta. Sebagai satu-satunya pronvisi di Indonesia dimana pemegang kekuasaan eksekutif daerah hanya boleh berasal dari keturunan kerajaan Ngayogyakarta Hadiningrat, keputusan tersebut nyatanya memicu polemic diantara masyarakat di daerah. Hal ini disebabkan oleh tidak adanya keturunan laki-laki dari gubernur atau sultan yang sedang menjabat saat ini, yaitu Sri Sultan Hamengku Buwono X, untuk melanjutkan tahta kepemimpinan. Oleh sebab itu, artikel ini bertujuan untuk melihat mekanisme penyelesaian sengketa institusi di Keraton Ngayogyakarta Hadiningrat jika terjadi sengketa. Hasil yang ditemukan adalah tidak adanya mekanisme penyelesaian sengketa di dalam Keraton serta tidak adanya institusi resmi yang dapat memutus dan menyelesaikan sengketa tersebut. Hingga saat ini, Keraton hanya menerapkan hukum adat atau paugeran adat dimana mengizinkan untuk seorang perempuan mengambil alih tahta dan menjadi seorang Sultanah sekaligus gubernur. Namun demikian, penulis menyarankan untuk tetap dibentuknya sebuah lembaga yang memiliki otoritas untuk menyelesaikan sengketa antar anggota Keraton guna keberlanjutan Keraton Ngayogyakarta Hadiningrat kedepannya. Abstract

Pengabdian ini memfokuskan pada upaya pencegahan gerakan radikalisme melalui penanaman ideologi Pancasila dan budaya sadar konstitusi berbasis komunitas. Komunitas yang dipilih adalah Pimpinan Ranting Muhammadiyah Bangunjiwo Barat, Banguntapan IV dan Sidokarto. Persoalan komunitas masyarakat saat ini adalah adanya gerakan-gerakan radikalisme yang memiliki agenda terselubung yang menggerogoti nilai-nilai Pancasila - memecah belah bangsa Indonesia, melemahkan persatuan dan kesatuan – merusak kebhinekaan yang sejak Indonesia berdiri telah menjadi konsensus bersama. Kegiatan ini dilakukan dalam bentuk pengabdian berupa: (1) Pelatihan Pencegahan Radikalisme melalui Penanaman Ideologi Pancasila dan Budaya Sadar Konstitusi yang dilakukan di 3 tempat, yakni: di Pimpinan Ranting Muhammadiyah Bangunjiwo Barat, Banguntapan IV dan Sidokarto. Pelatihan ini memfokuskan pada penguatan pemahaman Pancasila dan budaya sadar konstitusi serta strategi pencegahan radikalisme di Indonesia; (2) ToT Pencegahan Radikalisme melalui Penanaman Ideologi Pancasila dan Budaya Sadar Konstitusi. Training of Trainer ini merupakan lanjutan dari pelatihan pada PRM yang dilakukan sebelumnya. Adapaun materi dalam ToT ini meliputi: Pemahaman Ideologi Bernegara Menurut Muhammadiyah dan Sikap Bernegara Muhammadiyah; Pencegahan Radikalisme melalui Kewajiban Bela Negara dalam kehidupan beragama; Advokasi Kebijakan dan Hukum terkait Gerakan Radikalisme. ToT ini dilakukan agar peserta memiliki kemampuan untuk menjadi pelatih yang memiliki pemahaman dan sikap bahwa radikalisme/ terorisme harus dicegah sedemikian rupa dengan berbagai kegiatan pencegahan. Kegiatan pencegahan tersebut merupakan bentuk bela negara warga negara yang baik demi menjaga kelangsungan hidup bangsa dan negara yang seutuhnya dengan melakukan pencegahan gerakan radikalisme di masing-masing komunitas.Kata kunci: Pancasila, budaya sadar konstitusi, radikalisme, terorisme, pencegahan.AbstractThe community service program aims to prevent radicalism movement through inculculating state ideology, Pancasila and building awareness on understanding more about Constitution among the community. In this program, Muhammadiyah branches at some villages in Yogyakarta are selected to be the pilot project. They are Muhammadiyah branch of Sidokarto, Banguntapan IV and Bangunjiwo Barat. These area are considered as some villages that are susceptible for penetrating radicalist movement ideology which threaten the state ideology, Pancasila as the result of national political consensus of Indonesia since 1945. The program is divided into two activities, 1) training for understanding Pancasila and preventing radicalism. The program focuses on how to improve the level of understading of Muhammadiyah actisvits on the phenomena of radicalist movement in the society. The participants are also guided by the understanding Pancasila as the state ideology. 2) Training of Trainers for understanding Pancasila and the 1945 Constitution. This program is more focused on developing the understanding of participants on Pancasila and the 1945 Constitution. The participants are also equipped with basic skill on how to advocate the rights of people in combating radicalism. It is expected that the program educates the Muhammadiyah activists to be the agent of combating radicalism as well as protecting the society.

Abstract

The paper attempts to assess the role of the Constitutional Court of Indonesia in the process of consolidating democracy in the country. Examinations are made on the court’s decisions regarding dispute concerning jurisdiction among state organs. This paper argues that the Constitutional Court has not made a significant impact on the promotion of democracy. It is believed that the failure of the Court to consolidate democracy through its decisions regarding dispute concerning jurisdiction among state organs could be attributed to two main reasons. The first is due to the unclear concept of subjectum litis of the petitioners to have legal standing in the Constitutional Court, and the second is the lack of understanding of the subject matter jurisdiction of the Court. Due to uncertainties only, small numbers cases registered and heard by the Constitutional Court. Furthermore, most of the cases registered in the Court either been rejected or not been accepted by the judges. Despite the misgivings, the Court is still relevant and have certain contributions towards democracy. It has to a certain extent that enhances the working of checks and balances mechanisms among state organs. It is believed that the court could be more reliable and enhance its function in promoting democracy in the country by defining clearly classification of the subjectum litis as well as the objectum litis of the dispute that it may hear.

Abstract

Abstract

The research aims to analyse the powers and limits of the State and whether Indonesia has properly adopted the concept of powers and limits during the state of emergency concerning the COVID-19 pandemic. The article adopted the normative legal research method, using the statute and case approaches for data analysis. The results show that a State may apply some types of power during an emergency. However, in using its powers, the government must consider the limits during a state of emergency. Indonesia has not properly adopted a balance of powers and limits during the state of emergency concerning the COVID-19 pandemic. While the government may take actions to respond to the pandemic, it cannot exceed the limitations on powers in accordance with the state of emergency principles. The State has tended to exceed the limits during the pandemic. In doing so, the State violated some state of emergency principles during the COVID-19 pandemic, such as temporariness, the rule of law, necessity, proportionally, intangibility, constitutionalism, harmony and supervision. The research recommends that in the future, the government and the House of Representatives (DPR) should obey the state of emergency principles, particularly in terms of State power limits to respect constitutional principles and the rule of law. In addition, individuals, groups of people or organisations may request judicial review of laws or regulations during a pandemic that violate the state of emergency principles to protect the fundamental rights of citizens.
