Abstract

Upaya pemberdayaan konsumen melalui pembentukan undang-undang yang dapat melindungi kepentingan konsumen dan dapat diterapkan secara efektif di masyarakat sangat dibutuhkan, di samping adanya kemudahan dalam proses penyelesaian sengketa konsumen. Setelah berlakunya Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK) yang semula diharapkan oleh semua pihak mampu memberikan solusi bagi penyelesaian perkara-perkara yang timbul, ternyata dalam penegakan hukumnya terjadi ketimpangan dan menimbulkan kebingungan bagi pihak yang terlibat dalam proses implementasinya, terutama yang berkaitan dengan prosedur acaranya. Pasal 52 huruf a UUPK menyebutkan bahwa salah satu tugas dan wewenang dari BPSK adalah melaksanakan penanganan dan penyelesaian sengketa konsumen dengan cara mediasi, konsiliasi, dan arbitrase. Pasal 45 Ayat (4) UUPK menyatakan bahwa apabila telah dipilih upaya penyelesaian sengketa konsumen di luar pengadilan, gugatan melalui pengadilan hanya dapat ditempuh apabila upaya tersebut dinyatakan tidak berhasil oleh salah satu pihak atau oleh para pihak yang bersengketa. Pasal 54 Ayat (3) UUPK menyebutkan bahwa putusan majelis (BPSK) bersifat final dan mengikat. Pasal 56 Ayat (2) UUPK menyatakan bahwa para pihak dapat mengajukan keberatan kepada Pengadilan Negeri setelah menerima pemberitahuan putusan BPSK. Kendala lain juga terdapat dalam ketentuan permohonan eksekusi putusan BPSK. Hal ini jelas menimbulkan ketidakpastian dalam hukum. Untuk menyelesaikan permasalahan tersebut, Mahkamah Agung telah mengeluarkan Peraturan Mahkamah Agung Nomor 1 Tahun 2006 tentang Tata Cara Pengajuan Keberatan Terhadap Putusan Badan Penyelesaian Sengketa Konsumen. Peraturan Mahkamah Agung ini merupakan solusi sementara untuk memberikan keseragaman pemahaman dalam penerapan hukum acara terhadap UUPK.Kata kunci: upaya keberatan, putusan, penyelesaian sengketa konsumen.

Abstract

Polygamy is allowed only for those who their law and religion allowing a husband to have more than a wife. Such provision has been stated in general elucidation of Marriage Law at point 4c states that “This Law encourages monogamy. Only if requested by concerned parties, under their law and religion of the concerned parties, which allowing a husband to have more than a wife.” The word “law” in general elucidation of Marriage Law at point 4c refers to the marriage law of the husband. The Judge of Religious Court may have competency to consider any reasons and requirements of request for polygamy. The Judge of Religious Court shall try the case and render its judgment in accordance to the prevailing laws, Al Qur’an, Al Hadits, and the opinion of Islamic scholars. The judgment must have clear and suffi  cient consideration, in which the judge may base its verdict. Article 62(1) of Law No. 7 of 1989 concerning Religious Court provides that all ex parte decisions and judgments rendered by the court shall contain sufficient consideration and refer to certain rules of the prevailing laws both written or unwritten regulation.

Abstract

Land is a very important entity for human life. There are no activities carried out that are not in contact with land. In its development, land is not only a form of one’s existence, but as an economic value that guarantee one’s life. It is important that land tenure is not only in physical form but also legal control based on rights. In order to realize the community’s desire for land control, an activity known as land registration is carried out. In regulation, land registration is regulated in Government Regulation No. 24 of 1997 concerning Land Registration. In this provision, there is a principle that guarantees legal certainty for certificate holder, namely the rechtsverwerking institution. The existence of this institution was aimed to provide legal certainty to proprietary right holders of land. However, in reality, this principle does not work as desired, because the judiciary continues to base decisions on the facts found in court.

Abstract

Abstract

Abstract

Abstract:The emergence rights and obligations as a result of legal relationship between doctors and patients could potentially trigger a dispute between doctors and patients or medical disputes. In an effort to avoid or reduce medical disputes, it is necessary to understand the construction of the legal relationship between doctor and patient. From this legal relationship which will result legal actions and gave rise to legal consequences. In a legal effect, it can’t be separated is about who is responsible, as far as what responsibility can be given. It describes that relationship and the patient's physician if constructed, it can be divided based on two factors; transaction of therapeutic and act. In relation patient - physician based therapeutic, known as therapeutic relationship or transaction therapeutic, there is a binding between patients and physicians in the treatment of the disease or treatment. Engagements happens is inspanningsverbintennis and not resultaatsverbintennis, and must comply with the provisions of Article 1320 of the Civil Code. The relationship between doctor and patient is based on the Act - legislation occurred under Article 1354 of the Civil Code, which formulates zaakwaarneming. Legal relationship that occurs by two things above give rise to legal liability for doctors, the responsibility in the field of disciplinary law, criminal law, civil law and administrative law.Keywords: Doctor, Patient and Legal Relationship.Abstrak:Munculnya hak dan kewajiban sebagai akibat hubungan hukum antara dokter dan pasien berpotensi memicu terjadinya sengketa antara dokter dengan pasien atau sengketa medik. Dalam upaya menghindari atau mengurangi sengketa medik yang terjadi, maka perlu dipahami mengenai konstruksi hubungan hukum antara dokter dengan pasien. Dari hubungan hukum inilah yang akan melahirkan perbuatan hukum dan menimbulkan adanya akibat hukum. Dalam suatu akibat hukum, hal yang tidak dapat dipisahkan adalah mengenai siapa yang bertanggung jawab, sejauh apa tanggung jawab dapat diberikan. Dalam tulisan ini diuraikan bahwa hubungan dokter dan pasien ini jika dikonstruksikan maka dapat dibagi berdasarkan dua hal, yaitu transaksi terapeutik dan undang-undang. Pada hubungan pasien- dokter berdasarkan terapeutik, dikenal hubungan terapeutik atau transaksi terapeutik, yaitu terjadi suatu ikatan antara pasien dan dokter dalam hal pengobatan atau perawatan penyakitnya. Perikatan yang terjadi ialah inspanningsverbintennis dan bukan resultaatsverbintennis, dan harus memenuhi ketentuan Pasal 1320 KUHPerdata. Hubungan dokter dan pasien berdasarkan undang–undang terjadi berdasarkan Pasal 1354 KUHPerdata yang merumuskan tentang zaakwaarneming. Hubungan hukum yang terjadi oleh dua hal diatas menimbulkan tanggung jawab hukum bagi dokter, yaitu tanggung jawab dalam bidang hukum, hukum pidana, hukum perdata dan hukum administrasi.Kata Kunci: Dokter, Pasien dan Hubungan Hukum.

Abstract

Corruption or commonly referred to as "white collar crime" is a crime that can affect a country's economy. The perpetrators of corruption crimes are usually people who have power. With his authority,the perpetrators of corruption act arbitrarily, causing losses to the Indonesian state. Marwan Effendy stated that "Corruption by various groups is now seen as an extraordinary crime (extrardinary crime), therefore the response can no longer be pursued only by conventional means, but requires extraordinary handling. Corruption starts from the investigation process, prosecution until the court requires high costs, often these costs are not proportional to the value of losses incurred due to corruption. Corruption is an organized crime, this is not possible by a single perpetrator of corruption.

Abstract

House buying and selling is very vulnerable and problems often occur to cause disputes, This research was conducted in an empirical juridical way, the nature of descriptive analysis was by qualitative data analysis, The absence of consumer understanding of the buying and selling process in a contract carried out with the developer and there are still those who do not understand the contents of a contract and there are still developers with consumers making agreements under the hand that are not in accordance with the Laws and Regulations, Housing developers must be responsible for losses suffered by consumers, The legal effort that can be made by consumers is by taking a solution in a way outside the court of non-litigation and litigation through the general court, Consumer dispute resolution is first resolved by means of consensus agreement or peacefully if there is no further settlement, it can be done through a way of settlement outside the court (non litigation) or through a public court (litigation) either civil or criminal.

Abstract

One of the government's efforts to resolve consumer disputes through non-litigation is through the Consumer Dispute Resolution Agency (BPSK). In addition, the Financial Services Authority (OJK) also mandates the establishment of institutions to resolve financial service sector consumer disputes, namely the Alternative Consumer Dispute Resolution Institute (LAPS). The study was conducted normatively. The study emphasizes the authority to resolve consumer disputes at financial institutions between BPSK and LAPS. The results show that BPSK has the authority to settle final consumer disputes, the authority exercised by BPSK is regulated in the Decree of the Minister of Industry and Trade of the Republic of Indonesia Number: 350 / MPP / Kep / 12/2001 concerning the Implementation of the Duties and Authorities of the Consumer Dispute Resolution Board and the Republic of Indonesia's Minister of Trade Regulation Indonesia Number 06 / M-DAG / PER / 2/2017 concerning the Consumer Dispute Resolution Board. It's just that the decisions issued by BPSK related to the case of financial institutions, especially those containing elements of the credit agreement are often canceled by the Supreme Court because BPSK considered not authorized to settle disputes that contained the agreement element. The authority of LAPS is regulated in POJK Number 1 / POJK.07 / 2014 concerning Alternative Institutions for Settlement of Financial Services Sector Disputes. LAPS divides financial services sector dispute resolution institutions into 6 institutions, the establishment of which is carried out by the OJK in collaboration with Financial Services Institutions. LAPS which has the authority to settle consumer financing company disputes is BMPPVI (Indonesian Ventura Medication, Financing, And Capital Mediation Agency).
