Abstract

AbstractRapid response to market demands can determine victory and defeat in the competition. Therefore, these days companies are concerned with things that accelerate this process for the sake of efficiency and effectiveness of the company. One way is to handover part of the work to other parties through chartering services or providers of laborers or known as outsourcing. Legal protection of workers/laborers in the employment agreement with the outsourcing system has been regulated in articles 64 to 66 of Law No.13 of 2003 concerning labor. And for outsourcing companies it has been regulated by the Decree of the Minister of Manpower and Transmigration Kep.101/Men/VI/2004 concerning Procedures for Licensing of workers of Labour Services Providers. The establishment of the Constitutional Court of the Republic of Indonesia on August 13, 2003 gave new hope to the people of Indonesia to obtaun their constitutional rights. Th position and the relations between the state with the people in the constitutional perspective mare expected to become clearer.  AbstrakRespon yang cepat terhadap tuntutan pasar dapat menentukan kemenangan dan kekalahan dalam persaingan usaha. Oleh karena itu, belakangan ini perusahaan mementingkan hal-hal yang mempercepat proses ini demi efisiensi dan efektifitas perusahaan. Salah satu caranya adalah dengan menyerahkan sebagian pekerjaan kepada pihak lain melalui jasa pemborongan atau penyedia jasa pekerja/buruh atau dikenal dengan istilah outsourcing. Perlindungan hukum terhadap pekerja/buruh dalam perjanjian kerja dengan sistem outsourcing telah diatur dalam pasal 64 sampai dengan pasal 66 Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, dan untuk perusahaan outsourcing juga telah diatur dengan Keputusan Menteri Tenaga Kerja dan Transmigrasi Nomor Kep.101/Men/VI/2004 Tahun 2004 tentang Tata Cara Perizinan Perusahaan Penyedia Jasa Pekerja/Buruh. Dibentuknya Mahkamah Konstitusi Republik Indonesia pada 13 Agustus 2003 memberi suatu harapan baru bagi rakyat Indonesia untuk mendapatkan hak-hak konstitusionalnya. Kedudukan dan hubungan antara Negara dengan rakyat dalam perspektif konstitusi diharapkan semakin jelas.

Abstract

The specific crime of narcotics is still something to be feared in Indonesia, the victims resulting from this problem are children. Even though the next generation of the nation are children who are in the growth stage, namely as survival assets for humans, the nation and the state. External and internal impacts are the cause of children who are victims of this evil object. Children have rights in their hands, with this right, children need to have legal protection, which has the goal of guaranteeing a child will get a decent life. Narcotics itself has been regulated in general, this is explained by the presence of Law no. 35 of 2009 concerning Narcotics. Rehabilitation efforts as well as special rules that clearly regulate juvenile justice are explained in law number 11 of 2012. On this occasion the author would like to discuss the Rehabilitation and Legal Protection of Underage Narcotics Crimes. The method used in this writing is normative legal research with a statutory and literature study approach which is then analyzed using qualitative method techniques using primary legal sources in the form of laws and regulations, secondary legal sources, namely from journals related to research and also legal sources. or or other legal sources. tertiary. Abstract

Kota Kupang masuk dalam salah satu daftar Kota yang penuh toleransi, itu dapat dilihat dari pembangunan enam rumah ibadah secara berdampingan yakni untuk agama khatolik, Kristen Protestan, Islam, Hindu, Budha, beserta Konghucu. Pembangaunan enam rumah ibadah tersebut merupakan perekat untuk menjalin keharmonisan serta toleransi antar umat beragama. Daerah tersebut kemudian diberi nama kampung toleransi, bertujuan untuk mempererat nilai-nilai persaudaraan dan kerukunan antar umat beragama karena mereka beraktivitas dan beribadah dalam kompleks yang sama. Kampung toleransi juga menjadi benteng pertahanan iman dari pengaruh-pengaruh ideologi tertentu yang akan memecah belah persatuan antar umat. Kampung toleransi juga merupakan suatu simbol ataupun bukti nyata bahwa Kupang merupakan Kota yang memiliki jiwa bertoleransi yang sangat tinggi, juga kita bisa melihat di beberapa daerah yang memeliki bangunan gereja dan masjid yang berdampingan namun tetap hidup rukun, aman dan harmonis. Sikap toleransi merupakan salah satu kearifan lokal yang dimiliki oleh masyarakat Kupang. Metodologi penelitian yang kita gunakan adalah metode studi kepustakaan dengan teknik pembacaan dan pencatatan. Penelitian kepustakaan merupakan studi yang digunakan dalam pengumpulan data dan informasi dengan bantuan berbagai macam bahan yang ada di perpustakaan seperti; dokumen, jurnal, buku, artikel, kisah-kisah sejarah, dan sebagainya.

Abstract

The purpose of this research is to find out how legal protection for workers has harmed employers so that workers have been laid off. The type of research used in this study is normative research using the nature of the law approach as well as the theoretical point of view from scientific books and journals that function to provide solutions to existing legal problems. The results show that even though Article 164 paragraph (3) of Law Number 13 of 2003 must provide severance pay, award money, and services during the employee's working period and provide compensation. When workers are proven to be unproductive at work or have problems with the detriment of the employer, the employer can take action to terminate the employment relationship with the worker. From there, the Law does not prohibit companies from taking efficiency measures, but these efficiency actions are no longer valid if there are procedures or reasons that are not in accordance with the applicable regulatory requirements. With the existence of Law No. 13 of 2003 concerning Manpower, I hope that it can implement various national instruments that have been ratified, for example labor rights. This ambiguity makes the Indonesian people have to have strong policies and regulations on labor rights regulations, so that they can restore the wheels of Indonesia's slumping economy. Keywords: Labor; Legal Protection; Termination of Employment.   Abstrak Tujuan penelitian yakni untuk mengetahui bagaimana perlindungan hukum bagi para pekerja yang telah merugikan pengusaha sehingga sampai para pekerja di PHK. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian normatif dengan memakai sifat pendekatan Undang-Undang serta sudut pandang teoritis dari buku dan jurnal ilmiah yang berfungsi untuk memberikan solusi terhadap permasalahan hukum yang ada. Hasil penelitian menunjukan bahwa Saat pekerja terbukti tidak produktif dalam bekerja atau memiliki masalah sampai merugikan pengusaha disitu pengusaha bisa mengambil tindakan untuk memutuskan hubungan kerja dengan pekerja. Dari situ Undang-Undang tidak melarang perusahaan untuk melakukan tindakan efisiensi namun tindakan efiensi tersebut menjadi tidak berlaku lagi jika ada prosedur atau alasan yang tidak sesuai dengan syarat peraturan yang berlaku. Adanya Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan saya harap bisa melaksanakan berbagai instrument nasional yang telah diratifikasi contohnya hak hak tenaga kerja. Ketidakjelasan tersebut membuat bangsa Indonesia harus memiliki kebijakan dan peraturan yang kuat atas peraturan hak para tenaga kerja, sehingga bisa mengembalikan roda perekonomian Indonesia yang terpuruk ini. Abstract

Pancasila education is the basis of education for Indonesian citizens in understanding the ideology of Pancasila. Without understanding the origins of the formation of Pancasila, an understanding of the ideology of Pancasila cannot be known in its entirety. Pancasila has life values ​​taken from Indonesian history and culture, so it can be seen that in understanding the Pancasila ideology, it is also necessary to study Indonesian history and culture which reflects the life of the Indonesian people. In a survey conducted on this issue, it was found that 69.2% of the respondents did not understand the origins of the Pancasila ideology in terms of Indonesian culture and history. Often there are separatist movements that occur because the perpetrators do not embrace the values ​​of Pancasila, it could be because they do not understand the history and culture of Indonesia which is embedded in the Pancasila ideology itself. By integrating Pancasila education with Indonesian history and culture education, it is hoped that students will be able to understand the philosophical and ethical aspects of Pancasila. Act in accordance with the character of the nation so that there will be no problem of differences of opinion that can cause divisions in the Indonesian nation.

Abstract

The existence of material law is very important in a social life. With the existence of material law all objects can be regulated so as to create a life that respects each other regarding material possessions and power over their owners. Of course material rights are based on statutory provisions so that they are binding. So that its existence provides things that need to be obeyed by the community in order to achieve a welfare state or a welfare state in accordance with the ideals of the state. With this basis, the principle of individuality can certainly be realized in society through material law because it is based on existing laws. The effectiveness of the principle of individuality can be realized on the basis of the existence of applicable laws and regulations, as stated in Law Number 12 of 2011. With the existence of applicable material law, it certainly has a full effect on people's lives, where people must obey and submit and comply with all rules. law especially in the implementation of statutory regulations that have been stipulated. So that the enforcement of the law of objects based on the principle of individuality can run in accordance with existing provisions. This principle makes it easier for the community to claim their ownership rights to an object because according to this principle the rights to objects can be determined individually. The right to own an object means the right to enjoy an object freely and regarding this property right is very necessary for the community so that problems do not occur in the future. The research contribution is expected that these guarantees will later become two parts, namely material (material) guarantees in the form of absolute rights to an object and can be maintained and transferred and immaterial (individual) guarantees which only cause direct relationships to certain individuals. This research method uses normative juridical, using a journal literacy approach using materials in the form of legal principles, related basic laws as primary or principal legal materials in completing this research. The systematic application of object law based on the principle of individuality can be carried out because it has been determined and ratified by the legislature with the approval of the president, of course.

Abstract

Village administration is the spearhead of national economic development and resilience. In its history, the Village has received recognition by passing Law Number 6 of 2014 concerning Villages. Before the existence of the Village Law, the basis for recognition by the Village Government was only found in Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia. This article tries to find out the forms of community participation in changing laws and regulations regarding Villages. In addition, it also examines the polemic over demands for an additional term of office for the Village Head, which has become the public spotlight from the perspective of Indonesian constitutional law. The type of research used in the preparation of this article is normative juridical with a statute approach and library research, by searching data and sources, which after that did a review and analysis until finally it was put in the form of writing of this article. Considering that Indonesia is a democratic country and not a communist country, where the communist government system seems authoritarian, and the term of office is long, the Village Law contains regulations regarding village authority and the term of office of the Village Head.

Abstract

Pseudo-legislation (pseudovetgeving) in the Dutch Legal Dictionary is defined as “regelstelling door een bettokken bestuursorgaan zonder dat dit op grond van een uitdrukkelijke wettelijke bepaling die bevoegdheid bezit”. Which can be understood as a regulation made by the competent Administrative Body but the policy does not have the power based on explicit statutory provisions. In writing this article, there are three main ideas related to the background of the problems raised, namely the use of the legal system by the Indonesian state which is more inclined to the common law system or civil law system, the ordering of laws and regulations in Indonesia, and the position of pseudo legislation (pseudowetgeving) or policy regulations (beleidsregels) against existing laws and regulations in Indonesia. To provide comprehensive results, in writing articles used research methods that are normative juridical. The conclusions obtained in this study are that Indonesia is a state of law with a civil law system character that makes so many legal products issued by the executive body, including pseudo legislation. However, this is not explicitly regulated in Law Number 12 of 2011 Jo. Law Number 15 of 2019 concerning the Establishment of Legislation, but it is implied in the regulation of the National Archives of the Republic of Indonesia Number 5 of 2021 concerning General Guidelines for the Administration of Service Manuscripts, specifically in the section "regulation official documents and determination official documents". The conclusions obtained in this study are that Indonesia is a state of law with a civil law system character that makes so many legal products issued by the executive body, including pseudo legislation. Abstract

Sexual deviant behavior is one of the many types of crimes that exist in Indonesia. This sexual deviant behavior activity is intended to achieve sexual satisfaction in an abnormal way, one of which is sadomasochistic behavior. Sadomasochistic behavior is synonymous with sexual activity that involves violence in it, both in the form of physical violence and mental violence from their partners. In practice, sadomasochistic actors seek sexual satisfaction with certain objects that arouse their sexual desires, thereby hurting their partners. This of course refers to criminal acts of sexual violence, apart from violating criminal law provisions, sadomasochistic acts are also prohibited in Human Rights. This article was compiled to find out about sadomasochistic behavior in the perspective of Human Rights and Criminal Law based on Law Number 12 of 2022 concerning Crimes of Sexual Violence. The method used in this writing is a normative research method using the statutory approach. Then analyzed and described to solve the topics discussed in this paper. Abstract

The purpose of this research is to determine the implementation of the General Principles of Good Government in the government of the Special Capital Region of Jakarta Province and to examine the inhibiting factors in implementing the General Principles of Good Government in the government of the Special Capital Region of Jakarta Province. This research is normative juridical in nature, the approach taken includes a statutory approach. The collected data was analyzed descriptively qualitatively. The results of the research conclude that, first, the administration of the Special Capital Region of Jakarta Province has implemented the General Principles of Good Government as guidelines in preparing licensing policies in the Province of the Special Capital Region of Jakarta, as outlined in Regional Regulation Number 5 of 2014 concerning Transportation and Governor Regulation 52 2022 concerning amendments to DKI Jakarta Governor Regulation Number 20 of 2019 concerning Assignments to Jakarta Transportation Limited Liability Companies for the Development, Revitalization, Operation and Maintenance of Bus Stops and Other Supporting Facilities in the Context of Public Transportation Integration. Second, the inhibiting factor in the implementation of the Provincial Government of the Special Capital Region of Jakarta is the quality of human resources in the State Civil Apparatus, more specifically, namely the lack of understanding of technology.
