Abstract

Abstract: This article discusses the term of khuruj as a requirement of applying marriage for Jamaah Tabligh of Pakapuran Amuntai, South Kalimantan. This requirement is due to their belief that khuruj is a powerful tool to increase faith, while faith itself is the most important provision for the life of the world and in the hereafter, including marriage. In addition, the reservation stems from their fear about the inability of their young people in doing khuruj in a long time due to a variety of busy after marriage, as well as a manifestation of the Prophet Muhammad’s suggestion to fill youth with obedience to God. Khurūj, as a condition of marriage in the case of the Jamaah Tabligh’s members, is basically not regulated in Islamic law. Islamic law only requires the prospective groom to pays dowry to bride or do covenant of marriage. Within the perspective of the marriage covenant, it appears that the elements contained in such cases are in line with what is required in the legal basis and the terms of the marriage covenant. Therefore khurūj is not prohibited in Islamic law.Abstrak: Artikel ini membahas tentang Khurūj sebagai Syarat Pernikahan Jamā’ah Tablīgh Pakapuran Amuntai Kalimantan Selatan. Disyaratkannya khurūj dalam pernikahan Jamā’ah Tablīgh Pakapuran Amuntai Kalimantan Selatan dikarenakan keyakinan mereka bahwa khurūj merupakan salah satu sarana yang ampuh untuk meningkatkan iman, sedangkan iman itu sendiri adalah bekal yang paling utama untuk kehidupan di dunia maupun di akhirat, termasuk pernikahan. Selain itu pensyaratan tersebut berpangkal dari kekhawatiran mereka akan ketidaksanggupan para pemudanya untuk melakukan khurūj dalam waktu yang lama akibat berbagai kesibukannya pasca pernikahan, sekaligus sebagai manifestasi dari anjuran Nabi Muhammad untuk mengisi masa muda dengan ketaatan kepada Allah. Khurūj sebagai syarat nikah dalam kasus pernikahan anggota Jamā’ah Tablīgh ini pada dasarnya tidak diatur dalam hukum Islam. Hukum Islam hanya mewajibkan calon mempelai laki-laki membayarkan mahar kepada calon mempelai wanita atau mengadakan perjanjian pernikahan. Namun ketika ditilik dari perspektif perjanjian pernikahan, terlihat bahwa unsur-unsur yang terdapat dalam kasus tersebut selaras dengan apa yang dikehendaki dalam dasar hukum serta syarat perjanjian pernikahan. Oleh karena itu pensyaratan khurūj tersebut tidak dilarang secara hukum.Kata Kunci: Khurūj, syarat pernikahan, Jamā’ah Tablīgh.

Abstract

Riset ini dilakukan dengan tujuan untuk menganalisa praktik transaksi jual-beli rumah dengan tanah bersertifikat Hak Guna Bangunan (HGB) di PT. Suci Griya Perdana melalui perspektif hukum kontrak syariah. Penelitian ini merupakan jenis kualitatif yang menggunakan pendekatan Yuridis Sosiologis. Data diolah dengan menggunakan teknik triangulasi berdasarkan wawancara kepada pihak perusahaan dan pembeli, observasi langsung ke kantor perusahaan dan tanah yang menjadi objek jual-beli, serta dokumen berupa akta jual beli tanah tersebut. Data yang telah diolah kemudian dianalisa menggunakan perspektif hukum kontrak syariah, khususnya melalui teori jual-beli dan teori kepemilikan dalam hukum Islam sebagai dasar qiyas terhadap praktek penjualan rumah dengan tanah berstatus HGB ini. Hasil analisis menunjukkan bahwa transaksi seperti ini tidak diperkenankan jika mekanismenya dilakukan sepenuhnya dengan akad jual beli. Terkecuali developer menjualnya secara terpisah, yaitu rumah dengan akad jual beli dan tanah dengan akad sewa, maka transaksi tersebut dapat dibenarkan.

Abstract

Each financing has risks faced by banks and customers, including on musyarakah contracts. This can result in losses if not resolved, the bank must cover it first from the existing reserve fund in each bank in case of such problematic financing happen. On the other hand, the DSN has not specifically regulated the guidelines on handling non-performing financing on musyarakah contracts. While the questions about it continue to emerge.Therefore, it is needed to be clarified about how the practice undertaken by the bank in case of problematic financing, because it is very influential on the health of a bank.This research is field type and uses qualitative descriptive approach. The primary data in this study is about the Bank Kalsel Syariah, either through the official website, observation, or interviews with the bank. For the secondary data, the authors collect from various literature, especially from legislation such as the Compilation of Islamic Economic Law and MUI Fatwa.In this research, it is found that the Bank Kalsel Syariah has managed the problem financing settlement in this musyarakah contract through several phases, those phases are the cash payment, revitalization of financing through contract restructuring, settlement through guarantee, and lastly through legal court.

Abstract

This research aims to find out the law of fluctuations in the price of plane tickets through the qiyas method. This is a qualitative research with a normative legal approach. The legal material to be the basis of the analysis is the Prophet's hadith on market mechanisms, as well as the Fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) No. 40 and 80 in which there are provisions concerning market mechanisms. Fluctuations in the price of plane tickets are then analyzed using the qiyas method of the market mechanism system in Islam. The results showed that the law of fluctuations in airplane ticket prices is permissible, because it has the same characteristics (illat) with the market mechanism system that also fluctuates based on demand and supply.Riset ini bertujuan untuk menemukan hukum flutuasi harga tiket pesawat melalui metode qiyas. Penelitian ini merupakan riset kualitatif dengan pendekatan hukum normatif. Bahan hukum yang tim peneliti kumpulkan antara lain yaitu hadis Nabi tentang mekanisme pasar, serta Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia (DSN-MUI) Nomor 40 dan 80 yang di dalamnya terdapat ketentuan mengenai mekanisme pasar. Fluktuasi harga tiket pesawat tersebut kemudian dianalisa menggunakan metode qiyas terhadap sistem mekanisme pasar dalam Islam. Hasil riset menunjukkan bahwa hukum fluktuasi harga tiket pesawat adalah mubah, karena memiliki persamaan karakteristik (illat) dengan sistem mekanisme pasar yang juga berfluktuasi berdasarkan permintaan dan penawaran.

Terkecuali developer menjualnya secara terpisah, yaitu rumah dengan akad jual beli dan tanah dengan akad sewa, maka transaksi tersebut dapat dibenarkan.

Abstract

The purpose of this study is to analyze how the implementation of efforts to increase financial literacy through student savings at elementary school level students in the city of Banjarmasin, as well as to formulate an ideal student savings concept to maximize the results of efforts to increase financial literacy. This research is qualitative field research accompanied by a quantitative survey to 412 respondens from 18 different schools of students' saving behavior, which then will be analyzed descriptively. The results showed that only 38.1% of respondents independently allocated a portion of their allowance for savings. 11 of the 18 schools that become research sites manage their student savings independently with manual recording via a passbook or Microsoft Excel. Seven other schools have collaborated with banking institutions, but banks are only able to visit one to two times per week. Thus, parents of students need to have a good understanding of how to teach their children to save. The recording of student savings should also be supported by a web-based system that can be monitored by the teacher, students, and student guardians. Schools should also continue to receive student savings deposits every day with independent registration, to then be deposited at the same time when the bank visits the school.

Abstract

The purpose of this research is to examine methods of entrepreneurship education at Elementary School of Alam Muhammadiyah Banjarbaru, and to analyze the supporting and inhibiting factors. This is a qualitative field research using the interpretive approach to achieve the first goal, and the SWOT analysis (Strength, Weakness, Opportunity, and Thread) to achieve the second goal. The data in this research collected by the research team through interviews with the teachers, observations on entrepreneurial education activities that schools do, and questionnaire for the analysis of supporting and inhibiting factors. The results showed that Elementary School of Alam Muhammadiyah Banjarbaru held a "Market Day" to foster students' entrepreneurial spirit. The teachers asked students to bring any item that they wanted to sell themselves at school, which other friends or teachers who are interested in buying the merchandise will then buy. The results of the SWOT analysis show that the objects tested are in the SO region, because the Y and X values are more than 0. This means that Elementary School of Alam Muhammadiyah Banjarbaru in implementing this entrepreneurial education program must be aggressive by taking advantage of the opportunities and strengths that the school had.Tujuan riset ini adalah untuk meneliti metode pendidikan kewirausahaan di Sekolah Dasar (SD) Alam Muhammadiyah Banjarbaru serta menganalisa faktor pendukung dan penghambatnya. Riset ini merupakan penelitian kualitatif lapangan dengan menggunakan pendekatan interpretatif untuk mencapai tujuan pertama, dan analisis SWOT (Strenght, Weakness, Opportunity, Thread) untuk mencapai tujuan kedua. Data dalam riset ini tim peneliti kumpulkan melalui wawancara kepada pihak guru, observasi pada kegiatan pendidikan kewirausahaan yang sekolah lakukan, dan kuisioner untuk keperluan analisa faktor pendukung dan penghambat. Hasil riset menunjukkan bahwa SD Alam Muhammadiyah Banjarbaru mengadakan kegiatan “Market Day” atau hari pasar untuk menumbuhkan jiwa wirausaha siswa. Siswa diminta untuk membawa item apapun untuk mereka jual sendiri di sekolah, yang kemudian akan dibeli oleh teman lainnya ataupun guru-gurunya yang tertarik membeli dagangan tersebut. Adapun hasil analisis SWOT menunjukkan bahwa objek yang diuji berada di wilayah SO, karena nilai Y dan X lebih dari 0. Artinya, SD Alam Muhammadiyah Banjarbaru dalam melaksanakan program pendidikan kewirausahaan ini harus bersikap agresif dengan memanfaatkan peluang dan kekuatan yang ada.
