Abstract

Rahn (pawning) is one of the sharia economic transactions that is currently increasing in development in Indonesia. The need for funds to meet the shortcomings in everyday life makes rahn (pawn) an alternative to getting fast money loans to sharia pawnshops by pledging valuable goods as a condition of the contract (contract). In this study, using normative research with a conceptual approach and analysis approach. Primary sources of law used in this study refer to journals, proceedings, scientific papers relevant to Islamic economic law (Fiqh Muamalah). Meanwhile, secondary sources of law refer to books related to fiqh muamalah. The urgency of customer protection according to fiqh muamalah, in rahn transactions, of course, it depends on the contents of the agreement clause which is mutually agreed upon by prioritizing the principle of goodwill and the principle of justice so that both debtors and creditors have equality and equality to fulfill their rights and obligations according to the agreed agreement to avoid things that can break the contract.

Abstract

This study provides an overview of strengthening the merger of state-owned sharia banks, namely BNI Syariah, BSM, BRI Syariah which merged into Bank Syariah Indonesia (BSI). The purpose of the study was to determine the legal arrangements for strengthening the merger of Islamic banks to become BSI and its impact on the stability of state finances during the COVID-19 pandemic. The research method used in this study uses normative research with a statutory approach and a conceptual approach. Primary sources of law use legal regulations related to mergers of banking institutions and secondary sources of law from several kinds of literature such as journals and books relating to the issues being discussed. Meanwhile, legal material analysis techniques are used descriptively. The result of the research is the strengthening of the merger of BUMN Islamic banks starting with the existence of an agreement that is outlined in the written form of an Islamic commercial bank merger agreement as regulated in several applicable legal regulations. The merger of Islamic commercial banks during a pandemic is the right step to maintain the country’s economic stability, as stated in Perpu No.1 / 2020 and POJK No.18 / POJK.03 / 2020. The impact of the merger of Islamic commercial banks, of course, has a positive impact, Indonesian Islamic banks can compete globally by prioritizing more complete services, wider coverage, and better capitalization. For the state, it is certainly a good thing that can be done by the Ministry of BUMN, by initiating the merger of 3 sharia-based state-owned subsidiaries (BNI Syariah, BSM, BRI Syariah) merging into PT. Abstract

Sistem transaksi jual beli konvensional dianggap sudah tidak mengakomodir keinginan konsumen untuk berbelanja dengan tidak harus keluar rumah atau gedung kantor, menggunakan sarana komputer atau handphone dan terhubung jaringan internet dengan membuka situs-situs belanja online yang kian menjamur memenuhi pangsa pasar, memudahkan transaksi jual beli secara e-commerce menjadi solusi bagi masyarakat. E-Commerce lahir berdasarkan kontrak jual beli yang terjadi secara elektronik antara penjual dan pembeli. Meskipun transaksi elektronik telah mengalami amandemen dalam perundang – undangannya yaitu Undang – Undang Nomor 11 Tahun 2008 tentang perubahan atas Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik, namun belum mengakomodir tentang syarat-syarat sahnya suatu kontrak elektronik secara khusus, E-commerce diatur dalam Undang – Undang Perdagangan, dan Peraturan Pemerintah serta Keputusan Menteri Perdagangan. Namun, prinsip dasar keberlakuan suatu kontrak di Indonesia mengacu pada Pasal 1320 KUHPerdata, sehingga dapat pula diterapkan pada kontrak elektronik. Transaksi jual beli E-commerce secara umum diatur dalam Undang-Undang Nomor 11 Tahun 2008 tentang perubahan atas Undang – Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik atau yang disingkat dengan ITE. Pasal 18 ayat 1 UU ITE menyebutkan bahwa kontrak elektronik harus memiliki kekuatan hukum yang sama dengan kontrak konvensional.Kata Kunci : Transaksi Jual Beli, E-commerce, Undang-undang

Abstract

Pasca diberlakukannya UU No. 5 Tahun 2009 tentang Perubahan Atas UU No. 3 Tahun 2006 tentang Peradilan Agama, peradilan agama memperoleh perluasan kewenangan dalam menyelesaikan sengketa ekonomi syariah. Perluasan kewenangan ini kemudian mendapat legitimasi dalam ketentuan ekonomi syariah yang memperoleh payung hukum undang-undang seperti dalam UU No. 21 Tahun 2008 tentang Perbankan Syariah. Terbitnya Peraturan Mahkamah Agung tentang Kompilasi Hukum Ekonomi Syariah direspon positif oleh masyarakat, khususnya kalangan peminat dan pemerhati hukum ekonomi syariah di Indonesia. Keberadaan KHES memberikan kodifikasi dan unifikasi hukum ekonomi syariah di Indonesia. Kesulitan para hakim pengadilan agama memutus perkara ekonomi syariah hanya merujuk kepada kitab – kitab fiqih yang tersebar dalam berbagai mazhab, karena tidak memiliki pedoman hukum positif yang bersifat unifikasi, sehingga terjadi perbedaan dalam putusan antar suatu pengadilan dengan pengadilan yang lain, antar hakim yang satu dengan hakim yang lain. Salah satu faktor yang sangat mendukung perkembangan pelembagaan keuangan syariah di Indonesia adalah adanya dukungan peraturan perundang – undangan yang selalu pro-aktif memberikan payung hukum dan regulasi. Jika peran payung hukum dimainkan untuk mendasari tumbuhnya lembaga – lembaga keuangan syariah di berbagai bidang, maka peran regulasi dilaksanakan untuk memberikan kerangka (framework) dalam operasional kegiatannya. Abstract

The article has questions from the background of the research as follows: how to protect consumers fintech transactions from financial technology companies? What are the innovations and challenges of the financial services authority in overseeing and issuing regulations related to fintech? The research method used is normative with the statute approach and conceptual approach. The technique of collection primary legal is carried out by collecting OJK regulations regarding fintech companies, and consumer protection. Meanwhile, the technique of collection secondary legal is the concept or theories related to the main issue complete with bibliography. The Results that found are the fintech companies must be registered in the financial services authority by obeying and implementing OJK regulations. Innovation that OJK did enact Supervisory Technology (Suptech) to develop the financial technology (fintech) corporate ecosystem that is included in the realm of Digital Financial Innovation (IKD) on the OJK portal with the name Gerbang Elektronik Sistem Informasi Keuangan Digital. OJK also established the Innovation Center or Fintech Center in 2018. Challenges OJK must face: fintech lending is to create a balance between increasing financial inclusion and risk management, improving people’s understanding of fintech services, infrastructure, cybersecurity and data protection for consumers and fintech must collect more consumer data so that the lending and borrowing process becomes more efficient and effective.

Abstract

Intellectual Property (IP) objects from copyright such as songs and films have economic value that can improve the country’s economy and can even be used as collateral for credit, but the condition is that they must be registered with the ministry of law and human rights. Law No. 24/2019 has not yet regulated in detail the mechanism for granting credit to creative economy actors with intellectual property collateral objects. The research method used here is in the form of a doctrinal approach to laws and regulations. Primary sources are relevant legal regulations related to intellectual property and credit financing, and secondary sources are books and journals. The purpose of this research is to understand credit financing with collateral in the form of songs and films. PP No.24/2022 provides flexibility for creative economy actors to obtain credit financing not only at bank financial institutions but also at non-bank financial institutions. However, the special conditions that are regulated are that the intellectual property has been registered or registered with the ministry that organizes government affairs in the field of law, the intellectual property has been self-managed, and or the rights have been transferred to another party.

Abstract

This study explains the importance of regulating government legal protection in the form of legal regulations for crypto asset customers in commodity futures trading activities. The ease of digital transactions in the form of crypto investments that have high risk requires unusual legal arrangements so that the urgency of institutions such as CoFTRA have a hand in the commodity futures trading traffic. The results of the research provide an answer that specifically it is not regulated in the form of a separate law but is regulated explicitly by CoFTRA in the form of a CoFTRA, which regularly updates regulatory policies every year, trading activities for commodity futures crypto assets No.8/2021 and the legitimacy of crypto transactions strengthened by the stipulation of PMK No.68/2022 PPN and PPH. Through institutions that have the authority to regulate and limit crypto transactions, the government has provided legal and registered balanced protection not only to crypto asset traders but also to crypto asset customers. The Ministry of Trade of the Republic of Indonesia, through CoFTRA, seeks to regulate the transaction mechanism of crypto asset trading activities in such a way that all parties involved in the digital transaction can comply with and apply it, including crypto customers, seeks to provide education in the form of socialization movements to the public as potential crypto customers by first studying investment high risk to minimize losses that occur in the future.Keywords: Protection; Customer; Crypto Asset; Commodity Futures Trading Abstrak Penelitian ini menjelaskan penting mengatur proteksi hukum pemerintah dalam bentuk peraturan hukum kepada pelanggan aset kripto dalam kegiatan dagang berjangka komoditi. Kemudahan transaksi digital dalam bentuk investasi kripto yang memiliki risiko tinggi memerlukan pengaturan hukum yang tidak biasa sehingga urgensitas lembaga seperti Bappebti memiliki andil dalam lalu-lintas perdagangan berjangka komoditi tersebut. Hasil riset memberikan jawaban bahwa secara khusus tidak diatur dalam bentuk Undang-Undang secara tersendiri melainkan secara spesifik diatur oleh Bappebti dalam bentuk Perbappebti yang secara berkala kebijakan regulasi selalu diperbaharui setiap tahunnya kegiatan transaksi dagang berjangka komoditi aset kripto No.8/2021 dan legitimasi transaksi kripto diperkuat dengan ditetapkan PMK No.68/2022 PPN dan PPH. Pemerintah melalui lembaga yang memiliki kewenangan mengatur dan membatasi transaksi kegiatan kripto telah memberikan proteksi yang berimbang legal dan terdaftar tidak hanya kepada pedagang aset kripto saja namun juga kepada pelanggan aset kripto. Kemendag RI melalui Bappebti berupaya mengatur mekanisme transaksi kegiatan perdagangan aset kripto dengan sedemikian baik agar dapat dipatuhi dan diterapkan oleh semua pihak yang terlibat dalam transaksi digital tersebut termasuk pelanggan kripto, berupaya memberikan edukasi berupa gerakan sosialisasi kepada masyarakat sebagai calon pelanggan kripto dengan mempelajari terlebih dahulu investasi berisiko tinggi tersebut guna meminimalisir kerugian yang terjadi kemudian hari.Kata Kunci: Perlindungan; Pelanggan; Aset Kripto; Berjangka Komoditi
