Abstract

Perlindungan paten yang ketat khususnya paten farmasi, memberikan dampak negatif terhadap harga obat yang tinggi yang dapat membatasi akses obat-obatan. Hal ini melatarbelakangi lahirnya The TRIPs Safeguards yang diharapkan dapat menanggulangi dampak negatif dari paten farmasi. Artikel ini kemudian akan membahas The TRIPs Safeguards dilihat dari dua kepentingan yang berbeda, yaitu dari sisi hak eksklusif pemegang paten, dari sisi kepentingan umum, serta kendala dalam implementasi The TRIPs Safeguards. Ketentuan The TRIPs Safeguards ini sesungguhnya merupakan cara untuk memenuhi kepentingan umum, akan tetapi perlu dilakukan standarisasi untuk menghindari penyalahgunaan.

Abstract

Bajo is a tribe that has a uniqueness, they settled in coastal or shallow water areas. The uniqueness of the settlements and the natural conditions of the Bajo people can be a tourism potential to improve the economic conditions of the Bajo people. Tourism requires preserved environmental conditions. The Bajo has a 'living law' related to the preservation of coastal and marine areas, such as the prohibition of throwing garbage and household waste into the sea, the prohibition of killing turtles, the prohibition of destroying corals, and the prohibition of going to sea during the spawning period of fish. Bajo's 'living law' is in the form of unwritten law, so it has several weaknesses. First, because the unwritten form is feared to shift and could be lost, second, the implementation could not be enforced by the official because it is not official law. A good official law is one that is in accordance with the 'living law', so it would be better to adopt the 'living law' of Bajo in the official law, for the sake of preserving the environment, and support economic improvement through tourism.

Abstract

This study aims to find out and analyze how the role of the police in dealing with cases of selling sharp weapons without a permit through social media, as well as to find out the obstacles in the process of handling these cases. This type of research is empirical research with a descriptive approach. Data obtained directly through observations and interviews from the Gorontalo Provincial Police, and data obtained directly through social media. The results of the study show that there has been no action against the perpetrators of selling sharp weapons on social media which is actually a criminal act as regulated by law. This is one proof that law enforcement in Indonesia, especially in the matter of criminal acts committed in social media or cyberspace, is not implemented properly. The lack of supervision and seriousness of law enforcers in implementing the law is the cause of many cases that are not handled.As for the obstacles in law enforcement against the case in question due to the lack of experts in the cyber field, weak government supervision in the virtual field, people who do not understand and care, as well as the limitations of laws that discuss and regulate criminal acts of selling sharp weapons, especially through social media.

Abstract

Tulisan ini membahas tentang Apa saja dampak dari pencemaran lingkungan akibat sampah elektronik dalam prespektif hukum lingkungan dan membahas tentang pengaturan hukum pidana lingkungan terhadap pencemaran dan pengelolaan sampah elektronik (E-Waste) Di Indonesia. Dalam Undang-Undang Nomor 32 Tahun 2009 tentang perlindungan dan pengelolaan lingkungan hidup dan peraturan pemerintah nomor 101 tahun 2014 tentang pengelolaan limbah Bahan Berbaha Dan Beracun mengatur tentang bagaimana melakukan pengelolaan limbah elektronik. Namun sampai dengan saat ini setiap tahun Indonesia mengalami peningkatan terkait dengan sampah elektronik hal ini di sebabkan oleh perkembangan industri teknologi elektronik yang sangat cepat mengeluarkan dan menawarkan alat elektronik yang terbaru dan lebih canggih, hal tersebut menjadi salah satu pendorong meningkatnya jumlah sampah elektronik tiap tahunnya. Penelitian ini menggunakan penelitian Normatif yang menggunakan metode pengumupulan data dengan cara studi literatur mengenai judul penelitian tersebut. Hasil dari penelitian ini yaitu bahwa pengelolaan sampah elektronik Di Indonesia masih jauh dari kata sempurna selain itu juga untuk pengaturan sampah elelktronik sendiri belum diatur secara spesifik dalam satu peraturan.

Abstract

Law/regulation on mining play a significant role, because mining sector is a potential sector for developing the economy of Indonesian. Law on Mining underwent several amendments, namely the era of Law Number 11 of 1967, Law Number 4 of 2009 and Law Number 3 of 2020. This article will analyze shiftss in mining sector regulations from each of these eras. This article uses normative juridical methods, with statutory, contextual, historical, and comparative approaches, and is analyzed qualitatively. The results of the study show that between Law No. 11 of 1967 to Law No. 4 of 2009 and Law no. 3 of 2020 underwent a change, namely from a centralized arrangement, where the mining sector holding power became a matter for the central government to decentralization, handed over to local governments. Another change is in the field of relations between the government and capital or investors, the contract of work model becomes licensing. The impact on the contract of work model is that the state is positioned as a 'party' to the contract, while in terms of licensing the government has a position that tends to be stronger. This Amendment Contract is adapted to Indonesian conditions and the protection of Article 33 of the Indonesian constitution.

Abstract

Tujuan penulisan artikel ini merupakan luaran kegiatan pengabdian masyarakat yang dilakukan oleh dosen dan mahasiswa, di Desa Ilomata Kecamatan Bilato Kabupaten Gorontalo, sebagai salah satu wilayah pesisir yang berada di Kawasan Teluk Tomini.  Membangun desa diawali dengan membangun manusianya. Dari desalah seharusnya kita membangun kemajuan Indonesia. Membangun masyarakat desa harus dimulai dengan menyadarkan setiap individu akan hakikat hidupnya. upaya memberdayakan masyarakat, salah satunya adalah menciptakan suasana atau iklim yang memungkinkan potensi masyarakat berkembang (enabling). Permasalahan utama yang dialami oleh Kelompok Perempuan Keluarga Nelayan di pesisir ini, adalah minimnya partisipasi terhadap kesejahteraan keluarga, yang pada umumnya bergantung kepada penghasilan suami atau kepala keluarga yang sebagian besar bermata pencaharian sebagai petani dan nelayan.  Solusi yang dilakukan adalah dengan  melakukan pendekatan pemberdayaan masyarakat melalui kegiatan pengabdian masyarakat, berupa sosialisasi dan pelatihan ketrampilan. Perempuan sebagai anggota keluarga, merupakan sumber daya manusia yang perlu diberdayakan dalam menopang ketahanan ekonomi keluarga, melalui kemampuan mengolah hasil pertanian kelapa menjadi minyak goreng dan memanfaatkan kulit ikan sebagai kripik, yang bernilai ekonomi. Objek pemberdayaan dalam kegiatan pengabdian masyarakat ini adalah kelompok perempuan keluarga nelayan berjumlah 15 orang. Evaluasi terhadap kegiatan ini ada 2 peserta yang sudah mencoba mengembangkan hasil pelatihan dengan mengembangkan usaha pengolahan kelapa menjadi minyak goreng kampung, yang dipasarkan melalui warung terdekat maupun secara perseorangan. The purpose of writing this article is an output of community service activities carried out by lecturers and students, in Ilomata Village, Bilato District, Gorontalo Regency, as one of the coastal areas in the Tomini Bay Area.  Building a village begins with building its people. It is from the village that we should build the progress of Indonesia. Building a village community must begin with making each individual aware of the nature of his life. efforts to empower the community, one of which is to create an atmosphere or climate that allows the potential of the community to develop (enabling). The main problem experienced by the Women's Group of Fishing Families on this coast, is the lack of participation in family welfare, which generally depends on the income of the husband or head of the family, most of whom make a living as farmers and fishermen. The solution is to approach community empowerment through community service activities, in the form of socialization and skills training. Women as family members, are human resources that need to be empowered in supporting the family's economic resilience, through the ability to process coconut agricultural products into cooking oil and use fish skins as chips, which are of economic value. The object of empowerment in this community service activity is a group of women's fishing families totaling 15 people. Evaluation of this activity there are 2 participants who have tried to develop the results of the training by developing a coconut processing business into village cooking oil, which is marketed through the nearest stalls and individually.

Abstract

This study aims to analyze the management of BUMDes in strengthening economic enterprises in Teratai Village, Tabongo District, Gorontalo Regency, and to find out the constraints of BUMDes in strengthening economic enterprises in Teratai Village, Tabongo District, Gorontalo Regency. this type of research is a type of empirical juridical research. The approaches used by researchers in compiling this research are, among others: the Legislative Approach (Statue Approach) and the case approach (case approach). In this case, the data collection that will be used in this study includes several steps, namely through observation, interviews, and documentation. The results of the study indicate that the management of BUMDes in strengthening economic business in the Teratai village has been running effectively, as seen from the several business units that have been run which have been able to increase the economy and village income. There are several obstacles faced in the management of BUMDes, namely human resources and inadequate facilities and infrastructure.

Abstract

The development of weapons technology is currently very advanced and competitive, one of which is the Anti-Satellite weapon (ASAT) technology. ASAT has become a real threat to the sustainability of the space environment, this is because ASAT has the potential to damage international peace and security, trigger an arms race, and increase the amount of space debris orbiting the earth. The absence of regulations that specifically regulate ASAT makes countries feel free to conduct anti-satellite missile test launches. For example, in 2021 Russia conducted an ASAT test targeting the Cosmos-1408 satellite. Using normative juridical research and research approaches with statute approach, case approach, and analytical approach, the author wants to study and analyze international legal arrangements regarding the launch of Anti-Satellite Weapon (ASAT) missiles and the legal consequences against Russia as the country that launches Anti-Satellite Weapon (ASAT) missiles. Based on the results of the study, the researchers found that there were no regulations specifically limiting ASAT, but the regulation in question should have been contained in the Outer Space Treaty 1967 as the basis for regulating all activities related to space, then further legal consequences against Russia for launching anti-missile missiles. -satellite, namely Russia is obliged to be responsible in terms of responsibility and liability in terms of liability and is strengthened by the principle of liability based on fault as stated in the Liability Convention 1972.

Abstract

This study aims to determine the legal consequences of betel marriage settlement during the Covid-19 pandemic.  The type of research used is sociological juridical and this study uses a descriptive research approach and qualitative data analysis techniques. The results of this study show that the legal consequences of an unrecorded marriage can cause the marriage to be invalid in the eyes of positive Indonesian law, but according to religion and public belief that the marriage is valid as long as it meets the conditions and legal pillars of a marriage itself. As for the settlement, there are two things, namely the application for a marriage and remarriage hearing. However, the bad factor is that if the marriage partner has obtained a child, then in civil law the child does not have a nasab with the father but only has a nasab with a mother and her family.

Abstract

Indonesia and Singapore were the founding members of an economic and geopolitical organization of countries in the Southeast Asian region called the Association of Southeast Asian Nations (ASEAN). ASEAN mandates each member country to create regulations and policies related to e-commerce transactions through the 1999 ASEAN Summit. This paper is a normative study and aims to analyse the development of e-commerce regulations in Indonesia and Singapore by utilizing comparative and statute approaches. The result of the study finds out that Singapore has designed its e-commerce master plan since 1998, meanwhile, Indonesia started to develop the master plan related to e-commerce a decade late than Singapore through the Acceleration and Expansion of Indonesian Economic Development program (MP3EI), which launched in 2011. Indonesia has regulated a few components related to e-commerce, but some are still partial and spread in a few regulations. This paper recommends governments unify all e-commerce components regulations into one act that can cover legal protection and become the basis of procedure regulation related to e-commerce in Indonesia. The usage of the Trustmark stamp and online registration procedure for the e-commerce activities required by Singapore can be enforced in Indonesia as a solution to problems that occur in e-commerce activity in Indonesia.
