Abstract

Salah satu sumber kehidupan dan sangat dibutuhkan oleh makhluk hidup untuk menjaga kelangsungan hidupnya adalah pangan. Dengan perkembangan zaman, berbagai macam jenis dan bentuk olahan pangan dapat dengan mudah kita temui di supermarket. Misalnya adalah produk pangan kalengan cepat saji, yang mana konsumen tidak perlu banyak menghabiskan waktu untuk memasak. Sebagai pelaku usaha, salah satu cara yang dapat dilakukan untuk bersaing di pasar adalah dengan mengandalkan daya simpan produk pangan itu sendiri. Apabila suatu produk bahan pangan telah melebih batas waktu penyimpanannya, maka produk tersebut dikatakan telah kadaluarsa. Oleh karena itu, perlu dilakukan kajian terhadap bentuk perlindungan hukum konsumen terhadap produk pangan yang kadaluarsa di supermarket. Tulisan ini menggunakan metode penelitian yuridis normatif yang mengidentifikasi berbagai peraturan perundang-undangan terkait dengan perlindungan konsumen. Berdasarkan hasil penelitian dapat disimpulkan bahwa Indonesia sendiri sebenarnya sudah memiliki regulasi mengenai melindungi konsumen, yaitu Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Namun, dengan adanya beberapa regulasi tersebut tidak menjamin pelaku usaha dapat memenuhi kewajibannya dengan benar. Sebagai badan pengawas sirkulasi pangan, Badan Pengawas Obat dan Makanan juga berupaya melakukan penindakan terhadap peredaran bahan pangan kadaluarsa yang beredar di pasaran. Untuk mengatasi peredaran bahan pangan yang kadaluwarsa di supermarket, maka dapat dilakukan dengan upaya preventif dan represif. Upaya preventif yang dapat dilakukan adalah dengan menghadirkan regulasi yang melindungi konsumen terhadap bahan pangan yang kadaluwarsa di supermarket. Sementara itu, upaya represif dilakukan dengan cara melakukan penindakan terhadap pelaku usaha supermarket yang melakukan pelanggaran hukum.

Abstract

In Batam International University, there has a program which is known as SEPORA (Society Empowerment Program). In this program each team of Student has to create an innovation about Community services in a certain area which has been determined by lecturer. Our mission is to provide the fastest way for citizens of Buliang to create their important documents such as ID Card, Family Card ,Business domicile and other important documents. We started this project by creating a website with the database that connected to each others so the citizens of Buliang can sign up for online queue, so they didn’t have to go to Buliang district office to handle it, they can sign up by fill up the form in the website that we provided and the information will be recorded into Buliang’s database system. We also taught several citizens of Buliang how to access the website and sign up the queue form from their own phone. We hope that our little project here can help to boost Buliang's government performance and can help the citizen of Buliang so they didn’t have to wait to submit their form.

Abstract

The article entitled TS Dessert Castle Mark Registration Procedure and Process as an Effort to Protect Intellectual Property Law is motivated by the presence of increasingly creative and mushrooming businesses in Indonesia. These businesses are growing rapidly, one of which is the cafe business. A cafe is a place that is usually used to enjoy food and drinks, but each comes with its own uniqueness. This uniqueness can be an identity that distinguishes one cafe from another. This identity is also expressed in a brand. Trademarks should have legal protection. Therefore, the author would like to reveal the procedures and process of trademark registration for cafe business actors in Batam City, which in this case is together with one of the business actors named TS Dessert Castle. Where Batam City is a potential area so that currently there are many cafe businesses that stand in the city. This study aims to produce an understanding or education about the importance of registering a trademark for Batam City cafe business actors. Based on the results of the study, it can be concluded that Indonesia itself actually already has regulations regarding trademark protection, namely the Trademark Law No. 20 of 2016. Further studies are needed on trademark registration research in the form of case studies so that it can be used as a reference for other business actors, regarding the importance of registering brand.
