Abstract

Southeast Asia is a region that is vulnerable to terrorism. Of the total terrorism cases that occurred in the world, 50 percents occurred in this region. Mindanao is one of the regions in Southeast Asia that since a long time ago has been the basis of world-class terrorism. This situation is getting worse due to the presence of terrorist groups with a strong tradition of maritime piracy. The nexus between terrorism and piracy makes the issue of maritime terrorism in Southeast Asia a regional security concern. Abu Sayyaf Group is a terrorist group in the Southern Philippines that is very well-known but difficult to map. This makes the Abu Sayyaf a source of prolonged tension in the Southern Philippines in particular and in the Southeast Asia region in general. This study is a field observation that uses descriptive analysis to reveal the details of the Abu Sayyaf and the issue of terrorism in Mindanao.

Abstract

The shamanic phenomenon realized or not, still present in all activities of the community in Central Aceh Regency. The social practice is carried out in a patterned and repetitive manner, continuing to live since the Gayo community is still traditionally patterned until the transition to modernity. Through sociological perspective with a qualitative descriptive approach, this article aims to describe the existence of shamans in Gayo land's people at Central Aceh District. The results of this research show that shamans have a very large role in the lives of the Gayo people. Shaman services are used by some people for various purposes, ranging from political, economic, socio-cultural affairs, security, sports, and especially health/medicine. The habit of going to shamans has become an intersubjective world that is continually maintained by the community. Although the Gayo community is Muslim, the community resistance never manifested in collective action in rejecting the existence of a shaman. Because it's has been objectified in society's social life. Keywords: Existence, Shamans, Gayo, Objectivation Fenomena perdukunan selalu hadir dalam segenap aktivitas masyarakat di Kabupaten Aceh Tengah yang dilakukan secara berpola, berulang, dan terus hidup sejak masyarakat Gayo masih bercorak tradisional hingga transisi menuju modern.

Abstract

The determination of various types of Covid-19 vaccine products that have been determined by the Indonesian government as well as promises to provide Covid-19 vaccine products cannot be guaranteed to be halal, thayib and safe to use, especially for Indonesian people who are Muslim. On this basis, there was a debate in Indonesia regarding the halalness of thecovid 19 vaccine. Therefore, in order to organize and be able to successfully distribute the vaccine, as well as the consumption of the vaccines that have been purchased. So the Indonesian government cooperates with the Indonesian Ulema Council (MUI) by referring to the Fatwa of the Indonesian Ulema Council (MUI) NO. 02 of 2021 which issues a fatwa regarding the law that the Covid-19 vaccine produced by Sinovac Life Sciences Co. Ltd. China and PT. Bio Farma (Persero) is legal, holy and halal. This study aims to find out in detail the legal basis for the MUI to issue a fatwa that the Sinovac vaccine is halal and to know and be able to analyze the views of Islamic law on the MUI Fatwa No. 02 of 2021 regarding the halalness of the Sinovac vaccine. This research is legal-normative research, namely research that uses law to justify a legal event. This type of research is descriptive-analytic research using library research. Based on the results of the study, it is known that there are 7 basics used by the MUI in determining the halalness of the Sinovac vaccine, namely: First, the opinion of the Ulama; Second, MUI Fatwa No. 04/2016 on Immunization; Third, MUI Fatwa Number 01 of 2010 concerning the Use of Microbes and Microbial Products in Food Products; Fourth, MUI Fatwa Number 45 of 2018 concerning the Use of Blood Plasma for Medicinal Ingredients; Fifth, the report and explanation of the audit results of the LPPOM MUI Auditor Team together with the MUI Fatwa Commission to Sinovac and PT Bio Farma; Sixth, the opinion of the participants of the Fatwa Commission meeting on January 8, 2021; Seventh, BPOM's decision to give approval for emergency use and guarantee of safety, quality, and efficacy for the Sinovac vaccine, which is one indicator that the vaccine meets thayyib qualifications. In addition, it can be believed that the Covid-19 vaccine produced by Sinovac is holy and halal. Those are the notes on the results of the MUI Fatwa regarding the halal certification of vaccines that were described in the Plenary Session of the MUI Fatwa Commission on January 8, 2020 and the MUI Fatwa No. 2 of 2021 has been issued/decided.

Abstract

Abstract

Aceh is the only region in Indonesia granted special rights to implement Islamic law within its territory, as stipulated in Law No. 44 of 1999 regarding the administration of special autonomy in the Aceh Special Region. This uniqueness can be seen as a political solution to the long-standing conflict in Aceh. Several institutions serving as enforcers of Islamic law were established to support the implementation of local regulations on Islamic law, including the Sharia Court, the Sharia Office, and the Wilayatul Hisbah (WH). Additionally, the Aceh regional government collaborates with the police and the prosecutor's office, where they act as investigators, interrogators, and public prosecutors in the implementation of Islamic law. This research examines the implementation of the Qanun Jinayat in Aceh. The research findings indicate that the implementation of Islamic law in Aceh faces several challenges. Firstly, the Wilayatul Hizbah (WH) faces issues related to their authority, as according to Sharia rules, their role is limited to supervision, while investigation falls under the jurisdiction of the police. In practice, the police often disregard Islamic law in Aceh, mainly due to several provisions conflicting with national laws. Consequently, many cases of Sharia violations end with reconciliation processes within the police and do not proceed to court prosecutions. Secondly, the execution process is often lengthy, and in many cases, execution is neglected. The principles of equality before the law and legal certainty have not yet become primary principles in the application of Islamic law in Aceh.
